THE STRUCTURE OF THE DEPARTMENT The Member in Executive Cuncil (MEC) is the plitical head f the Department and the administrative wing f the Department (HOD) is headed by the Head f Department, wh is als the Department's Accunting Officer. HOW TO GAIN ACCESS TO RECORDS NOT AUTOMATICALLY DISCLOSED 5.1. The request prcedure T gain access t the recrds held by Department f Rads and transprt a request must be made t the Infrmatin Officer r specific Deputy Infrmatin Officer listed in Sectin 3 f this manual 12

15 STAATSKOERANT, 27 OCTOBER N A requester must be given access t a recrd f the Department if the requester cmplies with the fllwing: The requester cmplies with all the prcedural requirements in the Act relating t the request fr access t that recrd; and Access t that recrd is nt refused n any grund f refusal mentined in the Act. Nature f the request: A requester must use the frm that has been printed in the Gvernment Gazette (Gvt. Ntice R February 2002) (Frm A). The requester must als indicate if the request is fr a cpy f the recrd r if the requester wants t cme in and lk at the recrd at the Offices f the Department. Alternatively if the recrd is nt a dcument it can be viewed in the requested frm, where pssible. S 29(2). If a persn asks fr access in a particular frm then the requester shuld get access in the manner that has been asked fr. This is unless ding s wuld interfere unreasnably with the running f the public bdy cncerned, r damage the recrd, r infringe a cpyright nt wned by the state. If fr practical reasns access cannt be given in the required frm but in an alternate manner, then the fee must be calculated accrding t the way that the requester first asked fr it. S29 (3) and (4). If, in additin t a written reply t their request fr the recrd, the requester wants t be tld abut the decisin in any way, e.g. telephne, this must be indicated. S18 (2)(e). If a requester is asking fr the infrmatin n behalf f smebdy else, the capacity in which the request is being made shuld be indicated. S18 (2) (f). If a requester is unable t read r write, r has a disability, then they can make the request fr the recrd rally. The infrmatin fficer must then fill in the frm n behalf f such a requester and give him/her a cpy. S18 (3). There are tw types f fees required t be paid in terms f the Act, being the request fee and the access fee (S22): 13

Every ther requester, wh is nt a persnal requester, must pay the required request fee: The infrmatin fficer must ntify the requester (ther than a persnal requester) by ntice, requiring the requester t pay the prescribed fee (if any) befre further prcessing the request. The request payable t public bdies is R The requester may ldge an internal appeal, where apprpriate, r an applicatin t the curt against the tender r payment f the request fee. After the infrmatin fficer has made a decisin n the request the requester must be ntified f such a decisin in the way in which the requester wanted t be ntified in. If the requester is granted then a further access fee must be paid fr the search, preparatin, and reprductin and fr any time that has exceeded the prescribed hurs t search and prepare the recrd fr disclsure. 6. The requester shuld indicate his/her preferential language and specify his/her cntact details. If a request is made n behalf f anther persn, the requester must submit prf f the capacity in which the requester is making the request. If the requester is unable t cmplete the prescribed frm because f illiteracy r disability, such a persn may make the request rally. A third party may ldge an internal appeal against a decisin f the infrmatin fficer r deputy infrmatin fficer t grant a request fr access Manner f internal appeal 17

20 20 N GOVERNMENT GAZETTE, 27 OCTOBER An internal appeal musta) be ldged in the prescribed, Frm B (attached heret) within 60 days if ntice t a third party as required by sectin 49(1)(b) and within 30 days after decisin was taken r ntice has been given t the appellant f the decisin appealed against, b) be delivered r sent t the infrmatin fficer r deputy infrmatin fficer at his r her address, fax number r electrnic mail address; c) identify the subject f the internal appeal and state the reasns theref and may include any ther relevant infrmatin knwn t the appellant; d) state the manner and prvide the particulars which the appellant desires t be infrmed f n the decisin f the internal appeal in additin t a written reply; and e) specify a pstal address r fax number. If an internal appeal is ldged after the expiry f the perid referred t, the MEC must, upn gd cause shwn, allw the late ldging f the appeal. If the MEC disallws the late ldging f the appeal, he/she must give ntice f that decisin t the persn wh ldged the appeal. A requester ldging the appeal against the refusal f his/her request fr access must pay the prescribed fee (if any). If the prescribed appeal fee is payable in respect f an appeal, the decisin f the appeal may be deferred until the fee is paid. As sn as reasnably pssible, but in any event within 10 wrking days after receipt f an appeal the infrmatin fficer r Deputy Infrmatin fficer must submit t the MEC: 7.2 APPLICATIONS TO COURT Applicatins regarding decisins f the MEC r the persn designated in writing by the MEC A requester r third party may nly, after exhausting the internal appeal prcedure against a decisin f an infrmatin fficer r deputy infrmatin fficer, apply t a curt fr apprpriate relief. A requester whse internal appeal has been unsuccessful r aggrieved by a decisin f the MEC r the persn designated in writing by the MEC t disallw the late ldging f an internal appeal in terms f sectin 75 18
