The undersigned are renting Mariner House At 2071 Broadway Ave, Clearwater FL for vacation or recreation purposes, 2. Are responsible for full payment for the entire rental period: * minimally a $300 Reservation Deposit (converts to a refundable security deposit once on site) being due with the return of this Agreement, and the Balance of the rent and fees being due 45 to 90 days prior to occupancy (if not all paid in advance). Payments must be made by Accepted Credit Card or check. We require checks to clear before securing your date on the calendar (thus, checks must be received 45 days prior to arrival). NOTE: * if booking 6 months or more prior to arrival date, you must also pay 50% of rents/ taxes in addition to the reservation deposit. Remainder will be due 90 days prior to arrival in those cases.

5 3. Reservation will not be confirmed until the Rental Agreement has been returned and the Reservation Deposit cleared. receipt will be sent to address on file within 24 hours of charges. We recommend following up by phone call if not received as it might have gone to junk or spam filters in your account. 4. Failure to make / secure payments within 24 hours when due will result in default of this Agreement & forfeiture of any deposits or fees paid to date. 5. Cancellation Policy Non negotiable: Full refund, less $300 reservation deposit), upon 45 days or more notice for most nightly rental periods(that are NOT booked more than 6 months or more in advance of arrival date). 90 day or more cancellation notice is required for those booking 6 months or more in advance of your arrival date. ***If cancellation occurs within the 45 or 90-day cancellation period, whichever applies, the entire funds & deposits paid to date of cancellation request are fully earned and non-refundable. For those booking 6 months or more from date of arrival, if cancellation is requested within the 90 day period prior to arrival, the entire $300 Reservation Deposit AND 50% up-front payments of rent/ taxes already made is NON REFUNDABLE. (check box stating you ve read, understand and agree to the cancellation policy) Mariner House, LLC HIGHLY recommends trip insurance from several reputable trip cancellation / interruption insurers to assist with alleviating this type of unforeseen risk. I / we have reviewed the vacation rental website link for details on trip cancellation/ interruption insurance options ( Trip Insurance link). You can of course choose your own insurance program that you might find elsewhere outside of our site page referral. Be sure you understand what the policy will and won t cover as they tend to only insure what is referred to as Acts of God claims. Our cancellation policy is standard for vacation homes being that once we have your reservation booked, we removed it from the market for others to rent, as such, it is historically impossible to get it re rented with short notice and not to mention all the potential unknown renters we ve passed over since it was off the market. We realize uncertainties in life occur, thus the reason we recommend you invest in trip insurance coverage if you feel at risk. We cannot be responsible once within the period of cancellation. It is your responsibility to secure the coverage on your own and your cost. 6. If you booked online via HomeAway/ VRBO, you are still required to submit this entire rental agreement completed in full prior to confirmation of your booking. After 24 hours of accepted booking online, if contract is not returned, we reserve the right to cancel your booking. HomeAway Payments will then refund monies paid via their payment system. By booking online with HomeAway/ VRBO, you are aware of their extra service fee charge that you will pay to them direct and this has nothing to do with our fee structure or service provided by that fee paid. If you did not book online with HomeAway/ VRBO, you may disregard this paragraph. 7. Weather / Acts of God: Additionally, Mariner House LLC will not refund monies paid in advance due to cancellation or interruption of trip for inclement weather, hurricane conditions, or other circumstances beyond our control, in Florida or at your home origination point. 8. If I (We) do not personally inspect the premises prior to signing this Agreement, I (We) agree to accept the rental property upon arrival, provided it meets the basic description as listed on our Rental Website ( In Addition, I (we) agree that we will not be entitled to a refund of rent money, nor relocation to another property, and will have no claim or recourse against the Owner, Property Management, etc. Our properties are professionally cleaned and maintained. (check box stating you ve read this page and agree)

6 9. Entry to this property is keyless and as such requires the use of a special 4 digit code at front door that will be given to you via notification about 24 hours prior to arrival. Mariner House LLC will not disclose this code any earlier, for security reasons. This code will only be active from 3pm check-in and will deactivate after 11am on checkout date per the contract on file. All times are Eastern Time Zone in this contract. 10. I (We), our guests and visitors, agree to NEVER smoke in the House. If we elect to smoke outside, we will dispose of butts in an appropriate receptacle, not the yard! Any violation of the smoking policy will incur a separate $ charge, and if additional cleaning is necessary to remove smoke odors, burns, etc. from the house and/or linens, any additional costs will be subtracted from our security deposit or charged accordingly. 11. That there will be no parties or other loud noises in the home or on the premise, especially after 8pm at night. That all tenants listed previously will maintain the premises in good order and appearance and conduct themselves in a manner inoffensive to any neighbors. Note that Clearwater City Ordinances for noise is from 7am-9pm. 12. That any drug use on the property, or any disturbance, annoyance, endangerment, or inconvenience of the neighbors; or use of the premises for any immoral or unlawful purposes, or violation of any law or ordinance or nuisance on or about the premises will constitute a breech, and Mariner House LLC may immediately terminate our occupancy and this rental agreement. 13. Owner or Owner s Agent may enter the premises immediately in the event of an emergency, in order to perform necessary repairs and/or maintenance; and with 24 hours notice for normal maintenance, utilizing cellular phone and/or contact on this agreement. 14. Occupancy (including small children, infants and ANY visitors) is NEVER to exceed 5 persons- NO EXCEPTIONS. If more than the maximum number is found to be occupying the leased property, I (we) agree that a charge of $ per additional person above the maximum number allowed will be made to my (our) credit card on file. Additionally, at the discretion of the Owner, this Agreement may be immediately terminated and without refund. This is due to undue stress on the home if over occupied and violation of our commercial liability policy. This is strictly enforced. Ask in writing before attempting to violate this section of the contract. Only those listed on page #2 are allowed on property under terms of this contract. 15. Parking is to be limited to designated areas. Parking is recommended kept to driveway or front curb of house directly in front of house, not in front of neighbor s homes. 16. Pets are NEVER allowed on the property or premises and as such, if it is determined that pets have been staying on / in the property, a separate $250 cleaning fee will be assessed accordingly and taken from the security deposit or in addition to as required. 17. I (we) shall be responsible for all damage, breakage and /or loss to the premises, except normal wear and tear and unavoidable casualties (deemed solely by Managers of Property), which may result from Occupancy. I (we) agree that all household contents, etc., & other equipment and fixtures will be in the same condition as at the beginning of our stay, forgoing reasonable wear and tear and damage by unavoidable fire and casualty, the only exception. 18. The property will be left in the same good and habitable condition. Any damages or notable conditions found upon arrival will be reported to the Property Managers / Owners or their Agents within a reasonable amount of time; generally accepting this to be within one (1) or two (2) hours of Occupancy or early next morning if arriving late at night. I understand the property will be inspected prior to my (our) inhabitance and when I/ We departs. Otherwise, I (we) agree, acknowledge & authorize that any repair or replacement costs for loss or damages incurred during our stay (other than normal wear and tear) may be debited from my (our) credit card on file. (check box stating you ve read this page and agree)

I (we) agree to indemnify and save Owner, Agents and Property Managers harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by me (we) guests or invitees. Also from any carelessness, neglect, or improper conduct of any above persons entering, occupying or visiting the property or premises. 20. The Owner shall provide utilities, charcoal grill (no briquettes), furniture and fixtures, certain count of bed linens (1 set in place on beds), bath towels (6), hand towels (4) and wash cloths (4) & kitchen appliances and general utensils, pans, etc. Any and all other and additional provisions, etc are the tenant s responsibility. We do have washer and dryer in the house for self-service, just like you were at home. Toilet paper, dishwasher detergent, paper towels, etc are the responsibility of the tenant, although we try to stock several days of these items as a courtesy. 21. Prior to vacating the House, Tenant is responsible to remove all trash to waste cans in front, ensure all dishes and cookware is clean, and return any furniture that was moved to its original position (please don t move the furniture). Beds should NOT be stripped ; towels can be placed in the bathtub. Trash day is Tuesday mornings no later than 7am please have on curb. Please make special note of our protocol placard on Dining Room table upon check in/out and please be sure all items are completed before your final departure. If a late departure and/or an exceptionally filthy house (ie; lots of trash left in house, dirty dishes, etc) impede our cleaning crew s ability to properly turn over the property in a timely manner for tenants arriving the same day, we reserve the right to assess an additional $90 cleaning fee. 22. Owner shall not be liable to Tenant, Tenant s guests, licensees or invitees or any other person for any injury, loss or damage to any person or property on or about the premises. Tenant shall defend, indemnify and hold Owner, Manager and their Agents harmless from and against all loss, injury or damage occasioned by the use or misuse or abuse of any part of the premises, parking areas, and from or against any omission, neglect, or default of Tenant, his guest, licensees or invitees. 23. Note that the Pinellas Trail backs to our property and we maintain a private gate that has a combination lock. We provide the code for this lock on site. Please always insure if you unlock the pad lock that you replace the lock EVERY NIGHT before retiring for the night. 24. This Agreement may not be assigned or the property sublet, and is for the Tenant s use only. No changes to, or changing of locks of the property / premises are permitted. 25. Finally, we agree that this contract shall be governed by Missouri Law, notwithstanding conflict of laws provisions, and venue for any disputes shall be the circuit courts of Greene County, MO. By signing this document, I (we), the Responsible Party indicated on page 1 of the application, agree to the terms and conditions stated above. I (we) understand the Cancellation policy and that the Additional Items to Note below are also considered part of this agreement. In addition, I (we) understand it is solely my (our) responsibility to acquire Trip Cancellation insurance, should I (we) deem it necessary. I/ We also attest that the primary Responsible Party is at least 25 years of age or older. Please be sure to return ALL 7 pages when faxing or ing to us. 8 Emergency Contact number 911; Other non-emergent issues Please note that our main offices are in Springfield MO. We do utilize a local agent and cleaning service to assist us with urgent local requests. Our check in / check out protocol is simple. We give you a unique 4 digit entry code and you enter any time after the noted time of arrival per your contract. The front door does automatically re-lock after 30 seconds, this way we don t worry about our tenants not locking the door after departing or entering. Do not give this code to anyone other than that is staying with your party and listed on our contract. Please make special note our welcome placard on the dining room table upon entering. Here there are detailed instructions about the home and its operations, rules, etc. We appreciate making special efforts to follow the outlined requirements regarding door locks, window operations, etc upon departure. We trust our clients will care for it as it was their own home If linen counts or other items are not correct per the rental agreement, we will have one of our associates or cleaners come out and remedy ASAP. Please keep in mind that we are a private vacation home property and not a major hotel chain with 24 hour staff on call. We make every effort to stock some basic items required for a few days stay, but it is ultimately your responsibility to provide your own food stocks and supplies for your stay, as every tenancy requires different needs. This is in keeping with the concept of a Vacation Home and not a hotel. 1) Please respect our neighbors, their privacy and noise levels when outside especially in back yard of an evening. If we have provided gate access to the Pinellas Trail gate, please ensure it is re locked with lock. 2) Parking is best if kept in the driveway. Pay special attention if backing out of driveway for traffic from three directions. 3) Please NO Pets! We never allow pets as many of our clients have pet allergies. 4) Please NO smoking IN THE HOUSE AND no butts left outside anywhere! We have a zero tolerance policy if our home is left smelling like burnt cigarettes, etc 5) Note we use GAS for stove/ oven: mind children playing with knobs as it will cause gas smell if not lit. 6) Laundry / towels etc can be left in the bath tub but if you do your own laundry, please wash ALL WHITES TOGETHER NOT WITH COLORED ITEMS! We will have to charge to replace any property towels or linens that become adversely colored when doing your own laundry. Just a friendly reminder Also keep in mind we direct our cleaning crew to stock linens as such for this property: a. Bedding Sheet sets (1 per bed) including 2 pillows. b. Bath towels (6), Hand towels (4), Washcloths (4). c. If you require more, please do a load of laundry. Again, in keeping with we are NOT a hotel with unlimited linens. 7) When leaving premises, lock all doors to prevent theft of your personal items AND our furniture and electronics. Please remember that this is our second home and personal property as well. It s an extremely safe neighborhood, but nonetheless, we expect all doors to be locked when you leave the home, even for a few minutes to run to the store. Also Pinellas Trail gate in back yard must be always pad locked when not using. 8) BBQ Grill use: We do provide a conventional charcoal BBQ. Briquettes / matches are your responsibility (some could be left behind from a previous tenancy). Please extinguish hot coals when done and do not dump ashes directly on the property/ ground. There is an ash bucket. Fire Extinguisher in kitchen under cabinet near stove for emergencies only. When using tiki torches on back patio, please be sure to extinguish before turning in for the night. Tiki oil is not provided unless already in the torches or some oil is left from a previous client. 9) No conventional hard wired phone service on site. Excellent cellular reception on property for all major cellular networks. You ll want to bring a cellular or smart phone. 10) Television service is DIRECT TV (satellite), basic level programming. We provide FREE secured WIFI (information on how to connect and password is in the cabinet in living room). We also do provide Roku TV, a device that allows for viewing and downloading a multitude of movies, etc for free. Netflix, Pandora, Hulu, etc are all included in our Roku system. Please do not change our account settings on the Roku device. If you have a favorite game on and we don t carry it, there are many great sports bars in the area. 11) Trash service is via the City of Clearwater and they pick up before 8am every Tuesday morning. We provide a trash can and one large bin for recycling only. Please only recycle what is noted on the lid and place other

9 trash in other trash can. All cans and bins must be pulled to curb side by driveway or trash will not get picked up. Also please return empty cans to near garage.
