1 CROSSROCK CABIN RENTALS SUNSET VISTA CABIN [CROSSROCK (SUNSET VISTA ISTA), LLC] 405 Carter Avenue SE Atlanta, GA Tel: (877) or (404) Fax: (404) info@cabinsinblueridgega.com Rental Agreement & Policies Short Term (14 days or less) This agreement constitutes a contract between the Guest(s), hereafter referred to as Guests, and the Owners and/or Caretaker of CROSSROCK CABIN RENTALS SUNSET VISTA CABIN, hereafter referred to as SVC. RENTAL PAYMENT Rental fees are charged following booking and after receipt of a signed and dated RENTAL AGREEMENT & POLICIES contract (faxed, or scanned and ed) to Crossrock Cabin Rentals ( CCR ). The remaining balance is due before check-in. For reservations beyond 30 days, one night s lodging will be charged based on the total size of your party, with the remaining amount charged 30 days prior to check-in. For reservations made less than thirty (30) days of the arrival time, 100% of the rental payment will be charged. Your credit card information is required and appreciated in order to confirm reservation of the cabin along with a signed and dated contract. You do not have a secured reservation until we receive your signed contract and have charged your credit card. The person reserving the cabin must be the person or spouse of the person whose name appears on the credit card provided. OCCUPANCY We have a strict policy regarding occupancy of the Cabin. Each child counts as one guest. Occupancy is limited to registered guests only. To protect you and our property, absolutely no visitors are allowed. In the event this occurs, additional amounts will be charged to your credit card and you will be asked to vacate the premises. RATES SVC rents for $160 per night ($195 per night on holidays) for 1 to 4 guests with a 2-night minimum; 3-night minimum on other noted holidays (e.g., Valentine s Day) and October weekends; a 4-night minimum on July 4 th, Thanksgiving and Christmas. One night rentals are not offered. For more than 4 guests, add $10 per night per guest with a maximum capacity of 8 guests total. A $90 cleaning fee per week covers cabin cleaning, laundry and hot tub cleaning. County and state taxes totaling 10% will be added to the final lodging amount. Sunset Vista Cabin must be cleaned on a weekly basis and arrangements will be made for this service. [Example: If you rent SVC for two weeks (14 days), you are required to pay a 2-week cleaning fee, ($180 total).] CHECK-IN TIME 3:00 P.M. - Information regarding entry access will be provided upon receipt and clearance of all monies due and payable to the Owners. CCR will use all reasonable efforts to have SVC ready for guest at check-in time, but cannot guarantee the exact time of occupancy. Please call in advance to verify that the cabin will be ready for your arrival. Please note: NO ARRIVALS ARE ALLOWED ON THANKSGIVING DAY, CHRISTMAS DAY OR NEW YEARS DAY. CHECK-OUT TIME 11:00 A.M. - Unless authorized in advance by the Owners. Please respect the departure time to allow our housecleaning staff sufficient time to clean and prepare the cabin for our next guests. Checkout procedures are provided as an attachment to this agreement and must be followed to avoid additional charges. They are also posted in the cabin. CANCELLATION All cancellations must be in writing via , fax or certified mail. 30 or more days prior to your arrival date (cancellation notice is required prior to arrival date) ALL RENTAL MONEY is refunded, less a $25 cancellation fee. Less than 30 days but at least 14 days prior to your arrival date (cancellation notice is required prior to arrival date) ALL RENTAL MONEY, less one-half of a night s rent ($80.00 for $160/night rate) will be refunded. Less than 14 days but at least 7 days prior to your arrival date (cancellation notice is required prior to arrival date) ALL RENTAL MONEY, less $160, will be refunded. Less than 7 days cancellation notice in writing prior to arrival date ALL RENTAL MONEY (including any security deposit made) will be forfeited. NO SHOW POLICY The total amount of the reservation will be forfeited. RETURNED CHECKS A $35 service charge will be incurred for any returned checks. CENTRAL AIR CONDITIONING/HEAT For energy efficiency, the Central Air/Heat Unit operates year round using controlled cooling and heating. In warmer months, the thermostat is programmed to cool at temperatures no lower Page 1 of 6

2 than 74, and in colder months, it is programmed to heat at temperatures no higher than 74. DO NOT operate heating or air conditioning while any windows or doors are open. This can result in an additional charge. SATELLITE TELEVISION SVC is equipped with Dish TV satellite service; however, we do not guarantee any specific channels, programs or events. We are not responsible for any technical failure or difficulties that may arise from this service including and especially during bad weather. PAY-PER-VIEW channels are blocked. Do not attempt to block additional channels or activate parental controls as these have a pre-entered owners code. No refunds will be given for this service not working. WIRELESS DSL LINE SVC is equipped with a Wireless DSL/Wi-Fi line; we are not responsible for any technical failure or difficulties that may arise from this service. DSL service is available via Ethernet cable (not supplied) and by Wi-Fi throughout the cabin. PHONE CALLS SVC is equipped with telephones on each level for local service (does not include directory assistance or information). Long distance service is blocked. Outgoing local calls may be made and incoming calls received. Outgoing long distance calls will require a calling card. Due to the mountainous terrain, cell phones may or may not work in the cabin. No refunds will be given for telephone service being down. FIREPLACE The indoor fireplace on the main floor is vented and burns wood. Be sure the fireplace flue is OPEN before starting a fire and ensure it is CLOSED when the fire is completely out and when you are exiting upon checkout. The lower level fireplace is vent-less and burns propane gas. Both are operational from October through April only. Do not leave any fireplace on when not necessary. NEVER leave a Fireplace burning unattended or when you are not in the cabin. The outdoor fireplace is wood burning. Exercise caution and safety when using at all times. Check the Weather Channel or for local wind and fire watch advisories. Review Checkout Procedures. SMOKING Smoking is not permitted at any time inside of SVC. Outside smoking is permitted using smoking receptacles on deck. Do not pitch or toss cigarettes or cigar tips or butts on the premises or in the woods. Do not use throws or blankets outside especially if smoking. Failure to obey this rule will result in additional charges or the loss of any security deposit. FIREARMS Firearms or guns of any kind (BB guns included) are not permitted to be discharged on our property at any time. LITTER & TRASH Secure all loose trash in plastic bags and store in outdoor trash receptacles. Do not place loose trash in outdoor cans our sanitation company will not pick up loose trash. Do not throw aluminum cans, glass bottles or trash of any kind on the property, including down the mountainside or in the woods. Failure to obey this rule will result in additional charges or the loss of any security deposit. NO PETS SVC has a NO PET POLICY. Guest(s) will not bring any pet to SVC. Any violation of this policy will result in an automatic eviction and additional charges. Any cleaning or repairs resulting from evidence of pet hair or damage will be billed to you. We charge a minimum $100 fee if evidence exists that a pet stayed in the cabin. HOME FURNISHINGS, ACCESSORIES, EQUIPMENT, ETC. If you require special appliances or equipment, please bring them with you. We do not permit ANY moving of furniture or décor. Furniture, bedding, linens, towels, robes, utensils and other property belonging to SVC may not be removed from the premises for ANY reason. These items are inventoried following your departure. Loss of these items, as well as damage to any property or furnishings in excess of normal wear will be charged to you, the guest(s). A $75 fee will be charged (per robe) for any missing robes. Certain areas in SVC are locked for Owners personal storage and are not included for your use in this rental. LINENS A basic supply of linens are provided. Please be considerate of wear and tear on linens, blankets and furnishings. Bed linens, towels and supplies are not changed or replenished during your stay, unless you have rented SVC for more than 7 days. A washer and dryer are provided for your use. (See the RATES section pertaining to weekly cleaning.) CLEANING REQUIREMENTS You as the guest(s) are required to leave the property in the same generally clean condition it was in when you arrived. All dishes, pots, pans, etc. will be placed in the dishwasher with detergent provided and turned on for cleaning prior to your departure. All bedding, towels, etc. if used, will be removed from the beds and sleepers (if used) and placed downstairs in laundry basket provided. Do not place wet items on dry items, as colors may bleed onto each other. The refrigerator is to be left clean and free of any food that will spoil. All trash and garbage must be bagged and placed in outside trash receptacles (no loose trash). Due to abundant wildlife including black bears, ensure all lids are secure on all trash receptacles. If additional cleaning of the cabin is required beyond the norm, appropriate charges will be charged to your credit card. Page 2 of 6

3 Guest(s) are responsible for any damage, abuse, excessive cleanup or loss caused by any member of the guest(s) party to the property or its contents during the guest(s) occupancy. The SVC caretaker will conduct a walk-through after your departure to check the property and ensure it is left in good order and that no policy violations or theft have occurred. Additional cleaning services of the cabin and/or hot tub can be arranged during your stay at an additional charge to you. REPAIRS/SERVICE CALLS, ETC. The Owners cannot guarantee against mechanical failure of heating, air conditioning, hot tub, TV s, satellite receivers, DVD s, VCR s, propane tanks running out, or any other problem with appliances or equipment. Please report any inoperative equipment to us. We will make every reasonable effort to have repairs done quickly and efficiently. A Maintenance Request Form is provided for non-emergency problems. Should a repair person make a call to the cabin and find that the equipment is in working order and the problem is determined to be due to the Guest(s) oversight or neglect, the charge for the service will be the responsibility of the Guest(s). No refunds or rent reductions will be made due to failure of appliances or equipment. All maintenance requests must be reported to the owners or caretaker before 9 P.M. No refunds will be given for mechanical breakdown or inoperative equipment. ACTS OF GOD The Owners shall not be liable for events beyond their control which may interfere with guest(s) occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, inclement weather, noise, etc. No rebate or refund will be offered under these circumstances. HOUSE and OTHER LARGE PARTIES ARE NOT ALLOWED NO EXCEPTIONS. Occupancy in use of premises shall not be such as to disturb or offend neighbors or other guests at surrounding cabins. The use of fireworks and firearms is strictly prohibited. Illegal drugs and activities, under-age drinking of alcohol, dirt bikes and ATV s are NOT permitted on our property. Additionally, dirt bike and ATV riding is banned on surrounding roads. By signing this contract, guest(s) certify that they have carefully read the limitations placed on the number of persons permitted to occupy the premises, and agree to abide by such limitations. If not, guest(s) will be asked to vacate the property which will result in loss of total rental and any security deposit with no refund. CHECK-OUT PROCEDURES Please help us avoid increasing costs by following these steps for proper check-out: 1. Place all soiled linens in the laundry basket provided and carry to laundry room. Do not lay wet items on dry items as they may bleed onto each other. Do not leave wet items on the floor. 2. ALL trash taken to outside receptacles must be bagged. Our trash company will not pick up loose garbage from outside receptacles. Secure lids to each trashcan. 3. Load all dishes, pots, pans, etc., and run the dishwasher before final exit. 4. Close and lock all doors and windows. DEADBOLT all outside doors. We regularly have high winds in the mountains and outside doors have and will blow open if not dead bolted. 5. Turn off all inside and outside lights. Close all reachable blinds (this will aid in energy savings). 6. Leave all ceiling fans on at High setting. 7. If used, turn off the red-colored gas valve behind grill on the deck floor (valve should be in 90 OFF position). Place grill cover back on. 8. Ensure that all wood and embers in fireplace have been extinguished and CLOSE FIREPLACE FLUE (flue is closed when lever is in Left position). Leaving the flue open results in a strong upward draft and loss of inside heat. Never leave the flue open unless a fire or embers are burning in the fireplace. 9. Securely cover the HOT TUB using the cover lift. To open: Fold half of cover over the bar and glide back and down side of hot tub. To close: push cover/bar up and over top half of hot tub. Open remaining half of cover back over hot tub. All 4 corners of cover should be snug over rim. Hot tub temperature should be set to 80. In winter time and during cold weather, disconnect all outside hoses you may have used to prevent freezing and rupturing of hoses and water lines. 10. Please call and/or complete a Request for Maintenance form and leave on the kitchen counter, reporting any problems with the cabin such as leaks, appliances not working, light bulb replacement, etc. 11. Upon final cabin exit, set thermostat at 55 in winter/cooler months and 80 in summer/warmer months. RIGHT OF ENTRY Guest(s) agree that the owners and/or caretaker reserve the right to enter the rental property at any time to investigate disturbances, check occupancy, check for damages, to make such repairs, alterations or improvements thereto as owners/caretaker may deem appropriate. EXPEDITED EVICTION A material breach of this agreement by guest(s) which is the sole determination of the owners and/or caretakers and results in damage to the property, personal injury to guest(s) or others and is considered to be a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of guest(s) tenancy. Violation of any of the rules contained herein will result in IMMEDIATE EVICTION and forfeiture of rent and any security deposit. If the tenancy created hereunder is for 30 days or less, the expedited eviction procedures set forth in the cabins act will apply. Guest(s) may be evicted under such procedures if guest(s): (i) hold over in possession after guest(s) tenancy has expired; (ii) commit a material breach of any provision Page 3 of 6

4 of this agreement that according to its terms would result in the termination of guest(s) tenancy; (iii) fail to pay rent as required by this agreement, or (iv) have obtained possession of the premises by fraud or misrepresentation. Any reservation made under false pretense will result in forfeiture of advance payments and the party will not be permitted to check-in. INDEMNIFICATION AND HOLD HARMLESS GUEST(S) AGREE TO INDEMNIFY AND SAVE HARMLESS THE OWNERS AND CARETAKER FOR ALL OR ANY LIABILITIES, THEFT, DAMAGES, COST OR EXPENSE WHATSOEVER ARISING FROM OR RELATED TO ANY CLAIM OR LITIGATION WHICH MAY ARISE OUT OF OR IN CONNECTION WITH GUEST(S) USE AND OCCUPANCY OF THE RENTAL PROPERTY INCLUDING BUT NOT LIMITED TO ANY CLAIM OR LIABILITY FOR PERSONAL INJURY OR DAMAGE OR THEFT OF PROPERTY WHICH IS MADE, INCURRED OR SUSTAINED BY GUEST(S). THE TERMS OWNERS OR CARETAKERS AS USED IN THIS AGREEMENT SHALL INCLUDE THEIR HEIRS, SUCCESSORS IN INTEREST, ASSIGNS, EMPLOYEES, AGENTS, AND REPRESENTATIVES WHERE THE CONTEXT REQUIRES OR PERMITS. THE TERMS GUEST(S), YOU, AND YOUR AS USED IN THIS AGREEMENT SHALL INCLUDE GUEST(S) HEIRS, SUCCESSORS, ASSIGNS, GUESTS, INVITEES, REPRESENTATIVES AND OTHER PERSONS ON THE RENTAL PROPERTY DURING GUEST(S) OCCUPANCY (WITHOUT REGARD TO WHETHER SUCH PERSONS HAVE AUTHORITY UNDER THIS AGREEMENT TO BE UPON THE RENTAL PROPERTY), WHERE THE CONTEXT REQUIRES OR PERMITS. DISPUTES This agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia and shall be treated as though it was executed in the County of Fannin, State of Georgia. Any action relating to this Agreement shall be instituted and prosecuted only in the Fannin County Superior Court, Georgia. Guest(s) specifically consent to such jurisdiction and to extra-territorial service of process. CROSSROCK CABIN RENTALS and its OWNERS RESERVES THE RIGHT TO REFUSE SERVICE TO ANYONE Our rental property is leased without regard to race, color, religion, sex, national origin, handicap or sexual orientation. Due to liability issues, we cannot provide prospective renters a key or access to preview the property. VIOLATING AGREEMENT If Guest(s) violates any of the conditions of this agreement, owners and/or caretaker may terminate this agreement and enter the premises. Upon notice of termination of this agreement, guest(s) shall vacate the premises immediately and forfeit all rental monies and any security deposit. Page 4 of 6
