1 SHORT TERM RENTAL AGREEMENT This Short Term Rental Agreement (the Agreement ) is made by and between Mark S. Bounds ( Owner ) and ( Guest ) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows: 1. Property. The property is located at: 9300 EMERALD COAST PARKWAY, SUITE, MIRAMAR BEACH, FL The property is furnished and includes BEDSPREADS, LINENS, BLANKETS, PILLOWS, TOWELS, TWO (2) QUEEN BEDS WITH TEMPURPEDIC MATTRESSES, ONE (1) DRESSER, TWO (2) BEDSIDE-TABLES, 50 FLAT-SCREEN HDTV, MEDIA CABINET WITH DVD PLAYER, ihome BLUETOOTH WIRELESS DUAL ALARM CLOCK, 2-PERSON DINING SET, PATIO SET, SOFA, MINI-FRIDGE, COFFEE MAKER, HAIR DRYER, IRON & IRONING BOARD. Paper products (toilet paper, paper towels, etc.) are supplied, however, will not be replaced if consumed prior to check-out date. A limited supply of dishes, drinking glasses, eating utensils, etc., are stocked by Owner. Guest(s) should bring personal items such as bath soap, shampoo, sunscreen, and toiletries. Extra towels are recommended as towels and linens are not permitted to be taken from the property. 2. Rental Party: Guest is an adult, age 21 or older, and will be an occupant of the property during the entire reserved period. Other occupants will be family members, friends, responsible adults, or children under direct adult supervision. The rental party shall consist of Guest and the following persons: Primary Guest: Guest #2: Guest #3: Guest #4: Total number of guests: 3. Maximum Occupancy: The maximum occupancy for the rental property is the number the rental property sleeps, including children, as displayed on the rental property s advertisement. The number of guests must be pre-approved by Owner. For each approved additional guest (over 3 years of age), an additional charge of $10.00 per person per night will be assessed. Additional guests without prior approval and payment, if applicable, may result in request for Guest and occupants to vacate the rental property, immediate termination of rental agreement, and forfeiture of all rent, fees, and deposits paid. This rental property sleeps four (4). The total number of guests booked with this reservation is. 4. Term of the Lease. The lease begins at 4:00 p.m. on (the Check-in Date ) and ends at 10:00 a.m. on (the Check-out Date ). Key codes for check-in will not be issued with a balance owing or without a signed rental agreement. 5. Minimum Stay: This property requires a two (2) night minimum stay. Longer minimum stays may be required during holiday periods. 6. Rental Rules: Guest and all occupants of the rental property will comply with all local laws, ordinances, and community rules regarding the use of the property. Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the Rental Rules at all times while at the property. If Guest(s) violates any of the conditions of this agreement, including exhibits hereto, Owner may terminate this agreement and enter premises. Upon notice of termination of this Guest s Initials: 1

2 agreement, Guest(s) shall vacate the rental property immediately and forfeit all rents, fees, and deposits. 7. Access: Guest shall allow Owner access to the property for purposes of repair and inspection. Owner shall exercise this right of access in a reasonable manner. 8. Cleaning: A one-time cleaning fee is due upon reservation of property in the amount of $ Property will be inspected, sanitized, and cleaned after each Guest s departure. There is no daily housekeeping service; however, Guest may notify Owner should additional scheduled housekeeping, at Guest s expense, be required during an extended stay. Fresh linens and towels are provided. An on-site Laundromat is available for your convenience on the fifth floor of the building. Any undue or unreasonable cleaning necessary as a result of Guest s stay will result in a cleaning charge assessment of $55.00 per hour, with a one (1) hour service minimum, and will be deducted from Guest s Damage Deposit. This includes, but is not limited to, excess trash removal, arranging furniture back to original position, or service calls beyond that which is considered normal and customary as a result of occupancy. 9. Damage Deposit: A refundable damage deposit is due upon reservation of property in the amount of $ The deposit covers any damages to the rental property and its furnishings caused by Guest(s), excluding normal wear and tear. Guest should check the property upon arrival and immediately report any damages found, obvious missing items, or if maintenance or cleaning is needed. Failure to report any of these items prior to check-out could result in full or partial loss of the refundable damage deposit. Owner may use all or part of the damage deposit to repair any damage caused by Guest(s). Should the damage amount exceed the amount of the deposit, the primary Guest remains liable for the balance. The property is carefully inspected after each rental by our cleaning staff. The refundable damage deposit will be processed and the proper amount returned to Guest within 30 days of check-out. 10. Rental Rate and Fees Payment in full of the following fees shall be due and payable upon return of this executed agreement: $ per night x nights = $ Cleaning fee $ Refundable Damage Deposit $ Processing Fee $ Sales Tax (12%) $ TOTAL Due $ 11. Cancellation Policy: No refunds for cancellations except as provided for herein. IF GUEST CANCELS OR OTHERWISE TERMINATES THIS AGREEMENT PRIOR TO ARRIVAL, GUEST WILL FORFEIT ALL SUMS PAID LESS THE CLEANING FEE AND DAMAGE DEPOSIT. Shortened stays or cancellations after Guest s arrival will result in the refund of the damage deposit only, provided damages have not been incurred. If Guest contemplates that s/he may have to cancel this Agreement due to health, employment, cancellation by other guests, etc., Owner encourages Guest to purchase the appropriate traveler/cancellation insurance coverage. Please see Paragraph 17 regarding refunds in the case of severe weather. Guest agrees that this agreement may not be assigned or sublet. 12. Insurance: Owner encourages all renters to purchase traveler/cancellation insurance. Accidental damage insurance may also be purchased for Guest s convenience. Guest s Initials: 2

3 13. Payment: A. The property will not be held for Guest until payment in full, this Agreement signed by Guest, and a copy of Guest s driver s license have each been received by Owner. Once paid and accepted, the total reservation payment (less damage deposit and/or cleaning fee as provided for in Paragraph 11) is NONREFUNDABLE. If you think you may need to cancel this reservation due to a covered reason in a standard travel insurance policy, you are strongly encouraged to purchase such a policy from the insurance agency of your choice. If you think you may need to cancel this reservation for a non-covered reason, you are strongly encouraged to purchase an appropriate traveler insurance policy accordingly. B. Reservations and payment are currently set up to be accepted securely through VRBO.com and HomeAway.com online. Acceptable payment methods are Master Card, Visa, Discover and echecks. Contact Owner to discuss alternate acceptable forms of payment. (In no instance will personal checks be accepted within 30 days of arrival.) Once an online payment has been processed, both Guest and Owner will receive a payment receipt via confirming payment. C. The following must be completed. Payment of deposit or online reservation payment does not exclude this requirement. Guest is providing the following credit card number as a guarantee of payment to Owner and agrees to pay all rent charges related to rental property. Guest accepts all terms of this rental agreement and accepts all liability for rent and charges related to property rental, as well as any damage beyond normal wear and tear as described herein. In the absence of another payment arrangement, Guest authorizes Owner to charge the following credit card for payment of these items. I certify that I am an authorized user of this credit card and that I will not dispute the payment with my credit card company; so long as the transaction corresponds to the terms indicated in this form. 14. Key/Code Procedure: Owner utilizes Oracode Keyless Entry to secure the rental property at all times. In lieu of keys or key-cards being sent to Guest, and to mitigate issues with lost or stolen keys or key-cards, Owner will generate a temporary access code for Guest s use during the rental period. Guest may personalize their code to a unique 6-digit code of their choice. (Instructions will be provided in Guest s Booking Confirmation and Welcome Packet.) Temporary guest codes activate at permitted time of check-in and expire at time of check-out. GUEST S TEMPORARY ACCESS CODE WILL NOT GRANT ENTRY PRIOR TO THE CHECK-IN TIME OF 4:00 P.M. OR ALLOW RE- ENTRY AFTER THE CHECK-OUT TIME OF 10:00 A.M. GUEST WILL NOT BE GRANTED EARLY CHECK-IN OR LATE CHECK-OUT WITHOUT PRIOR NOTICE TO OWNER. If the temporary access code is lost or forgotten, Guest must contact Owner at (601) in order for a new temporary access code to be generated for immediate use. 15. Maintenance: Owner will diligently attempt to address maintenance issues as they occur. Guest agrees to immediately notify Owner of any maintenance problem so that the problem may be remedied as quickly as possible. If a maintenance issue occurs that cannot be fixed in a reasonable Guest s Initials: 3

4 amount of time, and significantly affects Guest s stay, Owner reserves the right to refund at his discretion or relocate Guest(s) to another unit, if available. 16. Hold Harmless: Guest(s) agree to indemnify and hold harmless the Owner for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest(s) use and occupancy of the rental property including but not limited to any claim or liability for personal injury or damage or theft of property which is made, incurred, or sustained by Guest(s). Owner is not responsible for any inconveniences that may occur for which he has no control. This may include, but is not limited to: power outages, adverse weather conditions, mandatory evacuation, construction, mechanical failure such as pool, hot tubs, televisions, etc. No refunds will be given for occurrences beyond the Owner s control with the exception of the conditions outlined in Paragraph Storms: If there is a storm or hurricane, no refunds will be given unless one or both of the following occur: The state or local authorities order mandatory evacuations in a Tropical Storm/Hurricane Warning area A mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning area of residence of a vacationing guest. The day that the authorities order a mandatory evacuation order in a Tropical Storm/Hurricane Warning area, Owner will refund: Any unused portion of rent from a Guest currently registered; Any unused portion of rent from a Guest that is scheduled to arrive and wishes to shorten their stay in order to arrive after the Tropical Storm/Hurricane Warning is lifted; Any advance rents collected or deposited for a reservation that is scheduled to arrive during the Tropical Storm/Hurricane Warning period. 6 Exhibit A RENTAL RULES 1. Smoking is NOT allowed. Should the cleaning staff detect evidence of smoking inside the property, Guest is responsible for the entire cost of cleaning and deodorizing. Non-smoking rules are strictly enforced. 2. People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest. 3. NO PARTIES. Any complaints from neighbors regarding excessive noise or other nuisances may be cause for immediate termination of the rental agreement and forfeiture of the guest s damage deposit and rents. 4. All of the units are privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. 5. Keep the property and all furnishings in good order. 6. Only use appliances for their intended uses. 7. Pets are NOT allowed. A pet of any kind in the rental property is absolutely prohibited, a material breach of this rental agreement, grounds for expedited eviction, will cause forfeiture of all fees and rents paid, and Guest will be responsible for the cost of full carpet/mattress/upholstery cleaning and flea treatment. 8. Parking: Vehicles are to be parked in designated parking areas only. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. 9. Housekeeping: There is no daily housekeeping service. Please notify the owner should you require scheduled housekeeping during an extended stay. While fresh linens and bath towels are included in the unit, we suggest you bring beach towels as we do not permit towels or linens to be taken from the units. An on-site Laundromat is available for your convenience on the fifth floor of the building. 10. Hot Tub: Guest hereby acknowledges that if the property they have reserved includes a hot tub, the undersigned is fully aware that the hot tub and surrounding patio/deck can be dangerous; that the deck/patio can be slippery when wet and that injury is likely to occur to anyone who is not careful. Guests should observe and adhere to all rules and policies as posted at the property. With full knowledge of the above facts and warnings, the Guest accepts and assumes all risks involved in or related to the use of the hot tub and deck/patio areas. 11. DO NOT FLUSH anything other than toilet paper. No feminine products or items other than toilet paper should be flushed at anytime. If it is found that non-toilet paper items have been flushed and subsequently clog the system, Owner may hold Guest responsible for the expense of repair. 12. Telephone: There is no charge for local calls. The phone number is. Guest must pay all charges incurred during the term of this agreement whether for special services or international calls. Use of a calling card or personal cell phones for long distance calls is encouraged and preferred by Owner. Guest s Initials: 6
