2 TERMS AND CONDITIONS Please read these terms and conditions carefully as they incorporate the basis upon which reservations are accepted by Bundaberg Legacy Inc. Making a reservation automatically accepts all the terms and conditions outlined hereunder. Bundaberg Legacy reserves the right to change and/or modify any of these terms and conditions at any time without notice and such changes will become effective immediately. Please check these terms and conditions periodically for changes. The effective date of these terms and conditions is December APARTMENT DAMAGE The guest who registers at check-in/arrival will be held accountable for any damage to the apartment and contents during the stay dates. The registered guest will be liable for damages caused (including those by third parties visiting the apartment) which will result in forfeiting any deposits, pre-payment, cash security deposit and also may be subject to additional charges. ARRIVAL / DEPARTURE Check-in/arrival time is between 1100hr (11am) and 1430hr (2.30pm) weekdays. Check-out/departure time is prior to 10:00 (10:00am) - late check-out after this time may incur an extra night s charge. If the unit is fully committed on the departure date, late departures or extensions not already confirmed will not be permitted. BEDDING The unit is equipped with two single beds. CANCELLATIONS Our standard cancellation policy requires reservation cancellations or changes to be advised to us by 12-noon, one (1) day prior to arrival. If the guest does not arrive, the reservation will be released and any payment will be forfeited. Over high demand and special event periods alternative cancellation polices may apply. The cancellation policy will be communicated during the reservation process and can be supplied in a confirmation when requested. CAR PARKING There is only street parking available and you agree that parking is at your own risk. Bundaberg Legacy does not accept any responsibility for damages or loss to your property or property belonging to someone else.

3 PAYMENT POLICY Full pre-payment of the entire accommodation charge along with a cash security deposit will be required. We reserve the right to reject reservations and subsequently cancel them if the guest cannot provide enough cash to cover this. All cash paying guests must agree to allow Bundaberg Legacy to make a photocopy of at least one form of government issued photo identification at time of check-in/arrival. The minimum cash security deposit required (in additional to the full accommodation charge) is $100. The cash security deposit will be refunded after an inspection of the unit by a Bundaberg Legacy representative has been conducted and the apartment is deemed in the same condition at the time of check-in/arrival. We accept cash in $AU (Australian dollars) and cheque. Once booking has been made, an invoice will be provided. Payment may be made via internet banking to bank account as detailed on the invoice, cash or cheque. Payment is per night at AU $30 or AU $200 per 7-day week. AMENITIES AND PERSONAL COMFORTS The following amenities are included (variations may apply and brands are subject to change): bedding linen, blankets and pillows kitchen tea towels, dishwashing liquid and washing machine The unit is rented fully furnished and equipped with all major electrical appliances: refrigerator, oven, microwave, toaster, electrical kettle, colour TV with remote control, and Washing Machine. The price includes quality linen & towels, toilet paper, basic cleaning products. For health and allergy reasons, we do not provide detergent for washing machine. EVICTION OF A GUEST Bundaberg Legacy may evict a guest or visitors without warning. Guests who are evicted from a hotel will be blacklisted from all Bundaberg Legacy locations and we may choose to notify the police. A guest is subject to such eviction should the following (but not limited to) occur; Intoxication and unsavoury behaviour Overcrowding - when the number of persons in the apartment exceeds the capacity of two persons. Physical or verbal assault towards Bundaberg Legacy representatives, residents or other guests

4 Wilful damage to Bundaberg Legacy property Any incident for which the police need to be called onto the premises Any behaviour posing a safety threat to others Ignoring advice to reduce excessive noise (music or other noise) Throwing of objects Smoking within the unit (a cleaning and deodorizing fine will also apply) GUEST COURTESY For the comfort of all our guests, we ask that noise is kept to a minimum so everyone can enjoy a peaceful and comfortable stay. We request that any non-registered visitors leave all apartments by 11pm (23:00) each evening. Please also extend this courtesy to our neighbours when entering and exiting the unit. HOUSEKEEPING The guest is responsible to ensure all linen used is laundered and dry prior to departure and all kitchen appliances and utensils are clean and replaced in the same location as on arrival. (However, if there is no opportunity for this to occur then a fee of $20 for laundry will be charged and deducted from the security deposit) HOW TO RESERVE Reservations can be made by contacting Bundaberg Legacy Inc. on (07) or by secretary@bundaberglegacy.com.au Bookings cannot be accepted from persons under 18 years of age at the time of booking. We reserve the right to refuse a booking without giving any reason. LIMIT OF LIABILITY We do our best to ensure your reservation arrangements are satisfactory, however Bundaberg Legacy does not accept any liability whatsoever for any injury damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by any events which are beyond our control including, but not limited to, war, civil disturbance, terrorism, fire, floods, acts of God, acts of Government or of any other authorities, accident to or failure of machinery or equipment, maintenance requirements or industrial action. MAXIMUM CAPACITY PER APARTMENT NUMBER OF PEOPLE USING THE TEMPORARY ACCOMMODATION Only those persons named on the booking form and total numbers of guests agreed upon in the rental forms may use the property without prior agreement. The number of people staying at the property must not exceed the number of sleeping places

5 indicated in the booking confirmation (number also including infants under two years). If the maximum number is exceeded without prior agreement, Bundaberg Legacy reserves the right to refuse or revoke the contract at its sole discretion. Bundaberg Legacy adheres to the maximum capacity at all times which in all cases is two persons. MINIMUM LENGTH OF STAY A minimum length of stay may apply during high demand or special event periods, as determined by Bundaberg Legacy. If you reserve an apartment over such dates (as per the reservation terms and conditions) you agree to stay for the required minimum nights. Any changes or cancellations (within the cancellation period) are subject to a penalty and may result forfeiting of any pre-payments and/or deposits. PET POLICY Bundaberg Legacy does not permit pets at any time. If you have an animal it is considered a breach of your accommodation conditions and you will be asked to leave or remove the animal. Guide dogs are permitted and must have a medallion on their collar with the registration number and the owner must also carry a laminated pass (with the owner and dog s name). Guide Dogs are required to be harnessed in public areas. Please advise ahead of time if you will be travelling with a Guide Dog. PHOTOGRAPHS AND DESCRIPTIONS Whilst care is taken to ensure that the photos and description of our facilities and services is accurate, these are continually being changed, upgraded, and on occasion removed from service. If any feature or facility is essential to you we highly recommend speaking to our staff, who will assist your decision-making process and if that feature or facility will be available during your stay. Descriptions are based on information available at the time of publishing and may vary or change at any time. Maps and location photographs are shown for general information only and highlight places in surrounding areas. Actual units occupied may vary in decor and inclusions from those shown in photographs. PHOTO IDENTIFICATION Valid photo identification (ID) matching the name of the main guest within the reservation must be presented at time of check-in/arrival. This is required to verify your identity for security purposes. A valid Australian driver's license, Australian issued proof of age card or a passport are all acceptable forms of photo identification.

6 This ID may be copied and securely stored as record that we have verified who you are. As per our privacy policy, any personal information contained on the collected identification will not be on-sold; will be securely stored and carefully disposed of at the end of its usefulness. RATES All rates are quoted in AU$ (Australian dollars) and are per unit per night and includes 10% goods and services tax (GST). Rates within reservations that have a valid confirmation by Bundaberg Legacy will be honoured. Rates that have been quoted are not confirmed until a valid confirmation has been received from Bundaberg Legacy and therefore subject to change. Bundaberg Legacy reserves the right to amend rates that have been confirmed at incorrect rates due to human or distribution errors. RIGHT OF ENTRY If the Bundaberg Legacy has a legitimate cause for concern or if the guest has not been seen nor been able to be contacted over a period, the unit may be entered by a Bundaberg Legacy representative to ensure the safety and comfort of all guests is in order. RIGHT TO REFUSE ENTRY Bundaberg Legacy reserves the right to refuse a guest entry to the accommodation for any reason whatsoever including where the guest has engaged in conduct on a previous occasion adverse to the Bundaberg Legacy. RUBBISH REMOVAL A rubbish bin is provided for rubbish (trash). All guests are responsible for the removal of their own rubbish (trash) daily. Bags are provided in each apartment for this purpose and additional bags are available upon request to housekeeping. SECURITY AND LOSS PREVENTION Bundaberg Legacy will do everything possible to ensure security levels are maintained, and we ask that our guests do also. However, Bundaberg Legacy takes no responsibility for any personal possessions that are lost, stolen or misplaced whilst on the premises.

7 INSURANCE The property itself and its furniture and equipment are covered by insurance, in case of fire, water leak and burglary or window glass breakages. Your belongings are not covered by the property insurance. We strongly recommend you insure yourself, every member of your party, your luggage and your party's luggage, cash, jewels, valuables, etc. by a comprehensive travel insurance including also personal responsibility. Please contact your insurance agent or your travel agent before leaving your permanent home. SMOKING POLICY Bundaberg Legacy Units are non-smoking and smoking is not permitted. Fines will apply to guests who do not adhere to this policy. Only in outdoor areas is smoking is permitted. MINORS Bundaberg Legacy cannot accept any responsibility for injury caused by an unsupervised minor staying in our apartments, nor can we provide the service of supervising and caring for a minor during their stay.
