1 Endless Summer Nites Rental Agreement 412 Wells Street Lake Geneva, Wisconsin Reservations are on a first-come basis; simply receiving this agreement does NOT confirm your reservation. Numerous agreements are sent out to guests, so we recommend making your reservation as soon as possible to guarantee your requested dates. Renter will receive an confirmation confirming their reservation once the reservation request form and the initial deposit is paid. Endless Summer Nites of Lake Geneva, LLC does not accept 3rd party reservations. The person reserving the home must be the same person whose credit/debit card is submitted. In addition, the renter/person reserving the home must be present at the home for the duration of the stay. It should also be noted that since guests are allowed to book dates on a first-come basis, we occasionally will have open dates left unreserved. In that event, we make every attempt to get the open dates filled by offering reduced rates or specials. Should you receive one of these special offerings your confirmed reservation rate will NOT be eligible for a rate reduction. RESERVATIONS All reservations require a 50% deposit to hold the unit. The balance is due 30 days before arrival. Endless Summer Nites, LLC permits the payment of rent and/or security deposit by the following forms of payment: American Express, Visa, Master Card, and Discover. You must be 21 years of age to make a reservation. Renter will be an occupant of the home during the entire reserved period. Other guests will be family members, friends or other responsible adults. Renter is responsible for communicating and informing all guests, family members, friends and other responsible adults of the contents contained in the rental agreement. If all payments are not received at least 30 days prior to the Check-In Date, Endless Summer Nites, LLC, without notice to Guest, treat the failure to pay as a cancellation by Guest of the reservation, may rent the property to another person, and may deal with the Reservation Deposit as provided below under Guest Cancellation Policy. CANCELLATIONS You are reserving a rental home, which means when we experience a cancellation the potential loss for us is 100%. We are not a hotel with hundreds or even dozens of rooms to offset this kind of loss. Once we accept your reservation and block off the time, we will no longer accept new requests for that time period. We field hundreds of reservation requests, so it is highly likely that any time period reserved (and then ultimately cancelled), would have been reserved by another party. If you must cancel your reservation, we will make every attempt to re-rent the home. Written notification is required by the signing tenant in order to release the existing rental agreement back to us in an effort to rent home again. At that time we will make the home available for rent in an effort to rent the property. Should the home be re-rented for the full amount the following will apply: You will be charged a $ cancellation fee, all credit card transactions ran will be subject to a 5% fee or $50 whichever is greater. Should the home need to be discounted to get re-rented, you will be required to inform us via mail or accepting the discounted rate and the above mentioned cancellation and credit card fees will apply. You will receive a refund for the balance which will be sent to you once the new rental is secured and payment has been received in full. Should the home not be re-rented no refunds or partial refunds will be given, you are responsible for payment in full. If the possibility of a cancellation concerns you, please look into trip cancellation insurance. There are several sites online that explain the policies, and offer this service such as InsureMyTrip.com or TravelSafe.com. SECURITY DEPOSITS In lieu of a security deposit we will keep your credit card on file as a security deposit. Use of a Debit Card authorizes Endless Summer Nites of Lake Geneva, LLC to obtain a $ security deposit prior to arrival on the debit card provided. The purpose of the security deposit is to protect the home and it s contents from malicious or negligent damage and/or the home being left in abnormally dirty conditions resulting in excessive cleaning costs (i.e. carpet/furniture stains, furniture damage, incomplete check-out procedures, broken or stolen items, pet damages, eviction charges, etc.). It is unlawful to remove any items from the home. Such actions are grounds for prosecution. It is the tenant s responsibility to report, upon arrival, any damages found and/or

2 any repairs or maintenance needed. You are responsible for any and all damages that occur to the property or its contents by you or any other member of your group while you are the registered occupant of the property. If we discover that there has been damage to the property or its contents while you are the occupant we will capture an amount from your credit card to cover the estimated cost of repairs. The amount we capture will be an estimate and will probably be more than the actual cost of repairs. We will provide a statement of the damages and the cost of the repairs after they have been completed. If there is a refund due it will be returned to the credit/debit card after all repairs have been made. If the cleaning company detects any evidence of smoking in the home you will be billed an additional $200 to deodorize the home. Should it be necessary for Endless Summer Nites of Lake Geneva, LLC to pursue legal action against the tenant, the tenant will be responsible for any and all attorney and court costs. WEATHER/STORM POLICY/ROAD CONDITIONS No refunds or partial refunds will be given for storms, weather delays or canceled flights. No refunds or partial refunds will be given due to road or traffic conditions. No refunds or partial refunds will be given due to inclement weather during your reserved time. No refunds or partial refunds will be given due to a guest s decision to depart the property early due to weather conditions, storms, road conditions or flight changes. CHECK-IN/CHECK-OUT TIMES In order to supply our guests a clean home and avoid delays we ask that all guests abide by our check-in time of 4:00 p.m. and check-out time of 10:00 a.m. Check-in time after 11:00PM is prohibited. $25.00 per hour charge for early/late check in/out, if available. KEYS There is no need for us to mail you keys because you will gain access to the home with a combination which will be sent to you prior to check-in. Early check-in is strictly prohibited without prior consent from Endless Summer Nites of Lake Geneva, LLC. PARKING You will be supplied with 5 off-street parking spaces. Street parking overnight is not permitted and you will be ticketed. No parking is allowed in the lot behind the house. Additional off-street parking spaces may be available next door from the house for a rate of $10.00 per day/per car, please inquire if needed we will attempt to make the arrangements. MAXIMUM OCCUPANCY The number of guests the property is limited to is 12 guests with the exception of 1 infant requiring a crib. Fire Department and Insurance Provisions require a list of the names and ages of all guests that will be occupying the property and property grounds. You will be required to supply a Guest List prior to arrival. In the event of an emergency lockout should we be contacted during your stay; only registered guests will be given an access code for entry to the home. Renter agrees that more than the number of people stated on the Registered Guest List shall not occupy the home or property grounds at any time. Renter agrees that all people stated on the Registered Guest List will be informed of the limitations. If the home or property grounds are occupied by more than the number of people stated, it will result in immediate eviction and forfeiture of total rent. Renter certifies that they have read carefully the limitations placed on the number of persons permitted and agree to abide by such limitations: if not, Renter and all guests will be asked to vacate the property which will result in forfeiture of total rent. No mobile homes, campers or tents of any sort are allowed on the property grounds. OUTDOOR QUIET TIME The City of Lake Geneva has a very strict outdoor noise ordinance; therefore the outdoors quiet time rule is from 10:00PM to 7:00AM and is enforced. We respect the rights of our neighbors. Renter and Guests shall peacefully and quietly occupy the premises at all times and shall not interfere with the rights of our neighbors. No loud music playing, boisterous conversations or yelling outside of the home is allowed at any time outdoors. Loud or unruly behavior is restricted by local ordinance and may result in citation or arrest by local law enforcement. If law enforcement officers are called,

3 come to the home and complete a substantiated "Disturbance Report or similar complaint, eviction will be immediate and all of your rental funds will be forfeited. Calls pertaining to complaints from neighbors that need to be addressed for excessive outdoor noise will result in a $ charge to the credit/debit card supplied and possible eviction. RESIDENTIAL PURPOSES Renter and Guests shall permit no activities on the premises, which are contrary to any law, ordinance and/or applicable health and/or fire department or insurance policy provisions. Using the premises for any illegal activity including, but not limited to, the possession, serving or consumption of alcoholic beverages by or to persons less than 21 years of age is strictly prohibited. OUTSIDE ACTIVITES The City of Lake Geneva strictly prohibits bonfires or contained fires with the exception of the BBQ Grill provided. The home is located within the city limits; therefore, this rule is strictly enforced. Fireworks are strictly prohibited in the State of Wisconsin; immediate eviction will be made if fireworks are being used at the property. No pools are allowed on the property grounds - the City of Lake Geneva restricts the use of pools on the property grounds which includes kiddie pools. All guests are to insure the outside grounds are at all times cleaned up and garbage is placed in the toters to respect the property, neighbors and city. BBQ GRILL Guests are supplied with a BBQ Grill. Briquettes and fluid are not supplied. The BBQ is not to be used on any of the decked areas, sidewalks or driveway and is to remain at all times in the grass area where it is located. It is the guest s responsibility to clean and maintain the barbeque before departure. There will be a minimum cleaning charge of $50 if the BBQ needs cleaning to enable use by the next guest. NO SMOKING IS ALLOWED IN PROPERTY Any extra cleaning charges, including but not limited to carpet, furniture, draperies or bedding, because of smoking will be charged to the credit/debit card supplied. Smoking is allowed outside or on the 3 season porch, however, all cigar/cigarette butts, wrappers, and/or other material must be properly discarded. Materials found discarded about the grounds will necessitate additional cleaning, with a one (1) hour service minimum. Candles are not to be burned inside or outside the premises. CHILDREN The home is NOT child proofed. We do not have child proof locks on any cabinets or doors and there are not gates to keep children from entering specific rooms. The yard is fenced although no entrance gate exists on the driveway side of the yard. Upon arrival, you may want to put items you think your child may get into away or up on higher shelves. Any child proof items you may need for your children must be brought with the renter. We do not supply Cribs, Pac n Plays, Highchairs or Strollers; these items are necessary to bring with for your stay. PETS No pets are allowed on the property without prior written consent and pet fees. Renter certifies that they agree to abide by such limitations: if not, Renter and all guests will be asked to vacate the property which will result in forfeiture of total rent. There are no exceptions to this policy. PHONE CALLS The home has no land line phone. We suggest you bring along a cell phone for use during your stay. WIRELESS INTERNET When high speed wireless Internet is provided it is not integral to the rental agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to Internet service. Use of WIFI and the Internet is at your own risk. Renter and guests agree to use it responsibly - no illegal music or other downloads, or visiting illegal websites, etc. is permitted. Should the cable company refer any action to us for illegal activities we will forward on the renter information to them. Please make sure your guests understand to use the WIFI safely and legally. SATELLITE/CABLE TELEVISION The property has cable television installed. Endless Summer Nites, LLC does not guarantee any programs or special events will be accessible and no refunds will be given for outages of service.

4 LINENS AND HOUSEWARES All bed linens, blankets and 12 sets of bath towels, hand towels and washcloths are provided. We suggest you bring your own beach towels and beach chairs, and other kitchen and bathroom convenience items. An initial supply of hand soap, toilet paper and trash bags are provided complimentary; once these items are used, it is the Renters responsibility to replenish them. Bed Linens and Towels are to remain inside the home and are not to be used for any other use then their intended indoor use. USE OF WASHER/DRYER The use of our washer and dryer is available. Laundry soap is not supplied. SKIS/BOARDS/WATER TOYS Please refrain from bringing water skis, snow skis/boards into the interior of the home. REPAIRS Appliances, toilets, heating /air conditioning systems and all mechanicals are continually checked and kept maintained. However, we cannot guarantee a mechanical may not malfunction during your stay. We make every effort to have repairs made as quickly as possible. No refunds will be made for failure or damage. HOUSEKEEPING The home will be ready for you upon check-in and will be cleaned after you depart. If you require additional housekeeping during your stay please contact us. BEFORE DEPARTING GUESTS ARE REQUIRED TO Leave all bedspreads and bed linens on the beds Place all towels, washcloths and dishtowels in the bathroom tubs Replace all furniture and décor/games/accessories in original location and condition. Clean dishes and cookware and place in cabinets. Empty refrigerator of all foods and take out trash. Clean the BBQ grill thoroughly. Lock all windows and doors. Turn air to 75 degrees in summer and heat to 60 degrees in winter. LOST/FORGOTTEN ITEMS Endless Summer Nites of Lake Geneva, LLC shall not be responsible for any personal property left at the property by renters. Renter and Guests are responsible to check all drawers, closets and under beds prior to check out for your personal belongings. Any item(s) left behind and found by the cleaning service or management will be held for 30 days and then will be donated to a non-profit charity. If we are contacted about a left item(s) and the item(s) are found we will be happy to package and return to you with applicable shipping charges and a $15.00 handling fee. INDEMNIFICATION The renter agrees to indemnify and save individual homeowner and Endless Summer Nites of Lake Geneva, LLC free and harmless for any liabilities or any loss or damages whatsoever arising from, related to, or in connection with rental of the premises. This includes, but is not limited to any claim or liability for personal injury or damage or loss of property, which is made, incurred or sustained, by guest or guests of guest, or any occupants of the premises. Renter(s), their family and guests bear the risk of any injury. TERMINATION OF RENTAL Endless Summer Nites of Lake Geneva, LLC reserves the right to refuse or discontinue tenancy if in its opinion the renter/guest(s) are detrimental to the property. Endless Summer Nites of Lake Geneva, LLC reserves the right to enter the property should we believe any of the above policies are being violated. Any violation of the above mentioned policies which will immediate eviction and forfeiture of total rent. HOLDING OVER Renter, their family and guests agrees that occupancy of the premises beyond the ending date and time shall be considered a trespass unless this Agreement is extended in writing. Renter, their family and guests acknowledges their status as a Guest within the meaning of the innkeeper statute, subject to removal at the end of the term agreed upon herein. Nothing herein contained shall be construed to create a tenancy within the meaning of RSA Chapter 540.

5 FORCE MAJEURE There may be circumstances beyond our control and contemplation, in which the property might not be available for your reservation. Examples of these, but are not limited to, destruction of property, sale of property, water, gas or sewer leaks, fire or any other damage to the property making it inhabitable or potentially inhabitable. In the event of Force Majeure, Endless Summer Nites of Lake Geneva, LLC will do their best to make alternative arrangements for the renter/guests whenever possible. If we are unable to do so or if the alternative arrangements are not acceptable to you Endless Summer Nites of Lake Geneva, LLC will prorate and/or refund any monies paid for the days the property was not available. If the renter accepts the alternative accommodation, they agree to re-locate back to the original property when it is deemed available by Endless Summer Nites of Lake Geneva, LLC. This will be the full extent of our liability to you and we will not be responsible for any other costs connected with any such cancellation, howsoever arising. LIABILITY WAIVER- Please read carefully - this limits our liability Whereas, the renter desires to rent from Endless Summer Nites of Lake Geneva, LLC Therefore, the renter hereby agrees that he/she shall not file any claim, action or lawsuit against Endless Summer Nites of Lake Geneva, LLC its owners, booking agent, managers, representatives or employees for costs or damages arising from renter and renter s registered guests use of the property. Renter agrees to be held liable for actions of his/her guests, whether they be registered or unregistered guests, at all times, and by doing so to save Endless Summer Nites of Lake Geneva, LLC its owners, booking agent, managers, representatives or employees from any and all claims arising from their guest's use of the property. The renter hereby acknowledges that he/she is using the property for the purpose of short-term rental in "as is" condition, at his/hers own risk. The renter hereby agrees to check in and out at the contracted times specified on their short-term vacation rental lease. The renter hereby acknowledges that they must close and lock all windows and doors when they are away from the property for any amount of time. Renter hereby acknowledges that Endless Summer Nites of Lake Geneva, LLC its owners, booking agent, managers, representatives or employees are not responsible in any way for theft that may occur on or to your personal property during your stay at Endless Summer Nites of Lake Geneva, LLC The renter hereby acknowledges that he/she has been advised of the dangers of swimming, boating, and related water sports and activities. Renter agrees to indemnify and save harmless Endless Summer Nites of Lake Geneva, LLC its owners, booking agent, managers, representatives or employees from any and all liability, negligence on the part of either party, loss, damage, injury or death resulting from the use of the property, its fixtures and contents. The renter hereby acknowledges that they have been informed that Endless Summer Nites of Lake Geneva, LLC is NOT a child-proofed property or dwelling. It is the renter s responsibility to monitor the activities of all children. Renter hereby acknowledges that they have been provided with copies of the following documents: Rental Agreement /Rental Regulations, & Cancellation Policy, General Release of Liability, Pet Agreement if applicable Endless Summer Nites of Lake Geneva, LLC CREDIT/DEBIT CARD AUTHORIZATION I understand and consent to the use of the credit/debit card provided without an original signature on the charge slip and that this Credit/Debit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include: unauthorized cable TV charges; damages beyond normal wear and tear; eviction charges; cancellation charges. I authorize Endless Summer Nites of Lake Geneva, LLC to charge amounts to my credit/debit card. Charges will appear from Endless Summer Nites of Lake Geneva, LLC on your credit card statement. *Use of a Debit Card authorizes Endless Summer Nites of Lake Geneva, LLC to obtain a $ upfront security deposit prior to arrival on the card provided which will be refunded within 7 days of departure.

6 PETS The following is an addendum to the Rental Agreement to which it is attached as a rider. Unless otherwise indicated, these items are in addition to the terms of the Agreement. If there is conflict in understanding between the Addendum and the Agreement, the Addendum will supersede. (1) PETS ALLOWED. Contrary to the terms of the Agreement, Endless Summer Nites of Lake Geneva, LLC does hereby agree that Renter or Guest may bring one or more pets to the home and will allow the Pet limited access to the home as follows: (2) PET ACCESS. The Renter or Guest agrees to limit the pet s access to the homes outside grounds and the interior of the home. Pets are not to be left unattended or leashed unattended allowing them to roam the property grounds outdoors at any time. Pets are not allowed on any of the home s interior furniture or on any of the homes beds. (3) PET RULES. Renter or Guest agrees to retrieve all waste matter, store it in plastic zip lock bags and deposit into the garage cans. Renter or Guest agrees to clean the interior of the home and exterior grounds at the end of tenancy and to thoroughly clean any soiling or other mess caused by the Pet and to return the home and grounds to the condition it was in when they arrived. (4) PET FEES. For allowing Pets access to the home Renter agrees to pay a fee of One Hundred Dollars per pet ($ per pet) which Endless Summer Nites of Lake Geneva, LLC may add to Renters charges. (5) PET DEPOSIT. In lieu of a security deposit we will keep your credit card on file as a security deposit for possible damages or overages caused by Renter or Guests Pet(s), Renter agrees to any outstanding charges be billed to the credit card on file. (6) DAMAGES In the event that Endless Summer Nites of Lake Geneva, LLC finds any evidence of pet soiling, pet odor, pet deposits in the grassy areas or other problem, Renter agrees to pay for additional cleaning and repairs necessary to return the home s interior and exterior grounds to its original condition as if the Pet had not been allowed. In the event, that the time required to complete additional cleaning or repairs caused by Renter or Guest s Pets delays move-in for following Guests or causes them to cancel their tenancy, Renter agrees to pay for any lost Income the home suffers. In the event that Endless Summer Nites of Lake Geneva, LLC determines the Pet(s) have been allowed onto areas of the home s interior or exterior grounds not specifically authorized above, Renter also agrees to pay an additional fee of $500 as damages. (7) EVICTION. In the event that Endless Summer Nites of Lake Geneva, LLC feels the Pet is causing damage to the home s interior or exterior grounds, receives complaints from neighbors, authorities or other parties concerning Renter or Guest s pet(s), then Endless Summer Nites of Lake Geneva, LLC may, as sees fit, terminate the provisions of this addendum and require to immediately remove Pet(s) from the home and grounds, or immediately terminate the Agreement and require the Renter and Guests and all other occupants to immediately vacate the without refund of fees or other charges. (8) NEIGHBORS/GUESTS. We respect the rights of our neighbors and guests that may be occupying the property. Endless Summer Nites of Lake Geneva, LLC prohibits renter or guests bringing dog(s) to the home to be allowed to bark outdoors excessively during occupancy. (9) RENTER or GUEST AGREES TO FAX A NOTE FROM PETS VET, PRIOR TO ARRIVAL, STATING PET S SHOTS ARE ALL CURRENT.
