Technical and pre-qualification bid details specification (envelope No.1) will be opened first and subject to evaluation based on the qualification criteria contained in the individual bid document. Price bids (Envelope No.2) of bidders who are assessed and declared as substantially technically responsive on evaluation of the technical bid will be opened for further commercial evaluation. The Earnest Money Deposit and tender fee will be accepted by Demand Draft on any Nationalized Bank only situated at GONDAL, drawn in favor of GUJARAT ENERGY TRANSMISSION CORPORATION LTD. Tender without EMD and tender fee shall be rejected. Two separate demand drafts for Tender fee and EMD should be submitted with technical bid. The Corporation reserves the rights to reject any or all tenders or accept any tender without assigning any reason thereof. 9 Qualification requirement (A) Technical The bidder should satisfy following minimum technical requirements. 1. The bidder should provide standard make closed body long chaises jeep (Bolero, Tavera, Toofan or Equivalent) not registered before more than 02 years on the date of tender opening and taxi passing of minimum (08+1) persons. OR 1. The bidder should provide standard make new closed body long chaises jeep (Bolero, Tavera, Toofan or Equivalent). 2. Experience certificate of similar work carried out and as per corporate office s directives issued from time to time, for experience of work. 3. Copy of RC book of taxi passing vehicle 4. Copy of road (Contract carriage) permit of vehicle. 5. Copy of PUC certificate (regularly renewed every six month) 6. Copy of driving license of LMV cab & Badge or TRANS. 7. Copy of taxi passing certificate of minimum (08+1) persons 8. Copy of vehicle fitness certificate. (B) Financial Qualification requirement: 1. Copy of PF registration/p.f. under taking on stamp paper of Rs (Form attached). 2. Copy of PAN no. 3. Copy of service tax reg. no/s.t. under taking on firm s letter pad(form attached). 4. Copy of power of attorney as the case may be. 5. Copy of partnership deed if any. 6. Copy of insurance certificate. 7. Copy of Road Tax 8. Any other documents required for particular & specific work. 9. D.D. for payment of EMD& tender fee. 10. Vehicle provider shall have to pay Rs /- additional EMD amount over and above regular EMD amount byway of DD on any nationalized bank only situated at GONDAL and drawn in favour of GETCO. In case bidder fails to provide vehicle papers at the time of offering rate for vehicle with condition to be purchase vehicle after confirmation of GETCO. Without paying additional EMD for such case, tender shall be out rightly rejected. Note: Above technical criteria is for technical scrutiny after opening the technical bid. However the GETCO reserves the right to award the work to one or more bidders, considering their technical and financial capacity OR to reject any or all tenders or accept any tender without assigning any reason thereof. 10 Terms and Conditions: 1) The vehicle is to be hired for the maximum of 3000 km. 2) Any excess travel of vehicle beyond 3000 km by the officer in-charge of the vehicle shall be under the written/verbal approval of circle head and the same shall be regularized by an office note giving clear reasons for travelling beyond stipulated km. 3) The vehicle to be offered for hiring shall be in up-to-date condition including the tubes, tyres, engine as well as condition of outside body. The vehicle to be offered shall not have been registered before more than 02 years as on the date of tender opening. However, in case of a very poor response or to break off the likely cartel, a relaxation can be granted for one year with the permission of circle head. However, the officers placing an order should ensure that condition of such vehicle is tiptop. 4) The vehicle should have good upholstery covered with clean covers, comfortable seating arrangement and shall be washed/service at regular intervals of a week. Vehicle shall always be kept neat and clean. 5) Driver shall be preferably below the age of 40 years and never above 55 years. The lodging and boarding of driver shall be borne by owner. 6) The driver should provide with enough money to cover the cost of diesel, repairs and incidental expenditure while in journey. Driver should provide mobile phone facility for communication. Driver should always keep all documents relating to vehicle such as R.C.Books, insurance, valid license and PUC certificate or any other important documents in original copy with vehicle. 7) When day to day, vehicle for its duty on specific time given by GETCO, at that time driver must be fully equipped i.e. including required Money to keep the Car running in full condition. He should not demand money from the officer traveling for repairing the vehicle on road etc. 8) The contractor shall also make his own arrangements for refueling, repairs and maintenance of his vehicle and provide other vehicle during maintenance or repair period with all above-mentioned conditions. 9) Contractor should appoint a driver with valid license according to vehicle. Driver must not be addicted of any habits. Changing of driver shall be intimated by contractor to concern user of vehicle in prior. 10) Vehicle hired should be displayed board in paint with words ON GETCO DUTY. 11) If the vehicle sent by the contractor is not as per the specification, charges will not be paid though the vehicle is used because of emergency. 12) RTO rules, insurance rules & safety rules are to be complied by contractor and Driver. Also labour and P.F. laws are to be strictly compiled. 13) Drivers which are provided by contractor must be fully conversant with the routes of Gujarat State and he must be having valid driving license and other vehicle documents with him. 14) The vehicle shall be utilized for EHV lines and/or sub-stations under GETCO anywhere in Gujarat. However the contractor should provide the vehicle for continuous 12 hours. The general use of vehicle is for line maintenance work to transport man & material, used on Kaccha/ Pakka road/bullock cart way where vehicle approach is possible. 15) The vehicle shall be utilized for any other official purpose of GETCO as per EIC. 16) Vehicle should be available 12hours at office of GETCO. 11 17) Before starting journey, vehicle driver must be in the position to have the log book of journey of the registered vehicle and it must be filled up the vehicle user officers by mentioning opening and closing km of the journey. 18) The starting and closing kilometers will be admissible from the point of starting and closing of journey. This will be considered from Morbi office & back. No additional Kilometers will be allowed for to and for journey from the head quarter i.e. Morbi. 19) Log book of the vehicle is also to be filled up day to by the user/officers mentioning the place visited by him along with the duration of journey, traveled and duly signed. 20) The contractor shall employ qualified and well behaving drivers having valid permanent for driving vehicle as per RTO and insurance rules. This shall be subjected to scrutiny and checks by the officer in charge handling the execution of the contract from time to time. If any legal liability occurs on account of any lapse in this regards, the same will be at contractor s account. The driver should behave courteously and respectfully with travelling officers. He should be free from habits of smoking/drinking intoxicant liquors. The driver sent with the vehicle shall have valid license for driving and Taxi badge. No any allowance shall be paid by GETCO to the driver. Any misbehavior of the driver will be reported to vehicle owner and if vehicle owner fails to provide new driver within 24 hrs. GETCO reserves the right to terminate the contract or hire vehicle from open market at risk and cost of the contractor. Driver should wear a uniform supplied by contractor, welldressed driver having good manners with necessary tools and tackles and Contact facility (Mobile-Phone) to meet the normal breakdown while on road. The lodging and boarding of driver shall born by contractor. 21) The contractor shall provide standby vehicle(s) to ensure prompt substitute arrangements should any hired vehicle go off road. 22) The vehicle once inspected and approved by the Engineer for hire shall not be changed or substituted by the contractor except on orders from the Engineer or on becoming defective/off road due to accident, breakdown, etc. In such an event, the contractor shall give immediate intimation to the Engineer. Where a change of vehicle is likely to last for more than one week prior approval of this Engineer shall have to be taken. 23) The vehicle to be deployed shall be inspected by authorized representative of GETCO at any time during period of contract & if any defect is noticed, it should be rectified by the contractor. GETCO shall have right to reject vehicle if condition of vehicle is not satisfactory. 24) In case of breakdown of vehicle or in case of a vehicle not acceptable to GETCO the contractor will immediately replace the same by good one within shortest time (say within 1 hour only). Failure to replace the vehicle will entitle GETCO to impose penalty equivalent to the average daily hiring charges for that period or actual expenditure done whichever is higher for the period, for which vehicle is under breakdown and not been accepted by GETCO. 25) Accident liability : The contractor shall at all-time indemnifies GETCO and its officers, servants and agent against all third party claims, what so ever (Including but not limited to) property losses/ damages, personal accident, injury or death of persons of any subcontractor, and/or agents of the contractor and/or of GETCO, damage to the property of GETCO, arising out by the Hired vehicle, the contractor shall bare at his own cost and initiative at all times till the successful completion of the contract period. Contractor shall have to maintain comprehensive insurance policy in respect of all insurable liabilities, under Motor vehicle Act, workman s compensation act, Personal injuries act, Emergency risk insurance act, Approved by Secretary/GETCO. 12 26) The speedometers recording the kilometers by the vehicle should always be maintained in working conditions. If at any time, the speedometer goes out of order, the kilometer travelled will be admissible according to route kilometers till the speedometer is brought back in to working condition. No average shall be admissible based on the earlier journeys to the same places. 27) The vehicle shall have to be properly insured so as to cover the risk of the lives of the officers and staff of the GETCO traveling by the same, with their property. 28) GETCO have right to cancel the contract if service of driver or vehicle are not satisfactory without any reason and justification issue to contractor. 13 COMMERCIAL TERMS ANDCONDITIONS: 1 Rate: The rates may please be submitted as per Schedule-B. The rates shall be given both in figures and words. There should not be any over writing and crossing. If any changes are to be done crossing the original writing the same should be countersigned by the tenderer. In case of difference between rates in figures and words the rates most favorable to the GETCO shall be considered which have been quoted. 2 AGREEMENT: The successful tenderers will have to execute Agreement on stamp paper of value Rs.100/- at our Transmission Circle Office, Gondal before commencement of works as per GETCO s prescribed Performa. 3 INCOME TAX: Income tax as per rules will be deducted from the bills. 4 Earnest Money Deposit : a. Bidders are requested to pay an earnest money deposit (1% of estimated cost) by demand draft only on any Nationalized Bank at Gondal for the amount as specified in the tender notice. Payment of EMD in form of Cheque or any other form shall not be accepted. b. The EMD shall be submitted along with submission of Technical bid only. c. Tenders no accompanied by EMD shall be rejected. d. If during the tender validity period, i.e. 180 days, the tenderer withdraws his tender, the EMD shall be forfeited and the tenderer may be disqualified from tendering for future works of GETCO. e. The EMD will be returned promptly to the unsuccessful tenderer. The EMD will be returned to the successful tenderer after he furnishes the Security Deposit for performance and duly enters into the contract. If he fails to furnish the SD or to execute the contract for the work offered to him, his EMD shall be forfeited and the tenderer may be disqualified from tendering for further works for GETCO. 5 Arithmetical error will be rectified on the following basis : A. If there is a discrepancy between the unit price and the total price that is obtained by multiplying the unit price and quantity, the unit price shall prevail and the total price shall be corrected. If there is a discrepancy between the total bid amount and the sum of total costs, the latter shall prevail and the total bid amount will be corrected accordingly. If there is a discrepancy between work and figures, the amount advantageous to the Owner will prevail. If the bidder does not accept the correction of the errors as above, his bid will be rejected and the amount of EMD will be forfeited. The bidder should ensure that the prices furnished in various price schedules are consistent with each other. B. In the case of any inconsistency in the prices furnished in the specified prices schedules to be identified in Bid Form, the Owner shall be entitled to consider the highest price for the purpose of evaluation and for the purpose of award of Contract use the lowest of the prices in these schedules. C. Prior to the detailed evaluation, the Owner will determine the substantial responsiveness of each bid to the Bidding Document. For purpose of these Clauses, a substantially responsive bid is one which conforms to all the terms and conditions of the Bidding Document without material deviations. A material deviation is one which affects in any way the prices, quality, quantity or delivery period of the equipment, completion of works or which limits in any way Seal & Sign of Contractor Page 13/19

14 the responsibilities or liabilities of the Bidder of any right of the Owner as required in these specifications and documents. The Owner s determination of a bid s responsiveness shall be based on the contents of the bid itself without resource to extrinsic evidence. D. A bid determined as not substantially responsive will be rejected by the Owner and may not subsequently be made responsive by the Bidder by correction of non-conformity. 6. SECURITY DEPOSIT: The contractor will have to pay the Security Deposit at 5% of the order value on placing the order out of which 2.5% will have to by demand draft in favor of GUJARAT ENERGY TRANSMISSION CORPORATION LTD or FDR in name of GUJARAT ENERGY TRANSMISSION CORPORATION LTD/A/c name of Bidder within 7 days from the date of the issue of LOI, and the remaining 2.5% will be recovered from the first two R.A. Bills and higher percentage of security deposit may be fixed at the direction of the Superintending Engineer. The security deposit will be refunded only after the completion execution period of contract successfully. 7. SETTLEMENT OF DISPUTE:In case of any dispute, the decision of the SE (TR), Circle Office, GETCO, Gondal will be final and binding to the tenderer. Any dispute or difference arising under and in connection with the contract shall be subject to exclusive jurisdiction of Gondal. 8. Tender must be sent only in sealed cover addressed to The Superintending. Engineer (Trans), Circle Office, Station Plot, Old Power Compound, GETCO, Gondal. 8A Payment : Payment will be made every month on actual work executed for which contractor has to submit the bill to EE(TR),GETCO,Morbi or to the officer instructed by SE (TR) Gondal along with copy of log-book. The payment will be made by A/C payee Cheque only. 9. The Tender No. and Tender for (here state the title) should be prescribed on the cover. 10. The 100% bills for traveling of the vehicle shall be paid on monthly basis. 11. If you fail to execute the order successful, the order will be got completed through other agency and if required to pay higher rates, in that case, difference of rates will be recovered from you. 12. If the contractor fails to provide a vehicle, the deduction from his RA bill should be made on prorate considering the monthly rate payable within 26 days per month. 13. The Head Quarter of Vehicle at Morbi however it may be changed if required for administrative point of view. And the successful tenderer shall have make arrangement accordingly 14. Rs per km is fixed for every km above first 3000 km. 15. Rs per hour is fixed for every hour beyond 12 hour a day. 16. Formula for considering price variation: For every ten paise increase in prices of fuel, per km payable price shall go up by one paise. This will be applicable to the actual km travelled during the month. No price variation will be payable on cost of oil, tyres, tube etc. Only changes in price of diesel will be adjustable. Contractor must quote prices on the basis of prevailing 15 days before the due date of tender. This basic rate shall be indicated in the offer. 17. All road tolls/bridge tolls shall be reimbursed on production of proof of payment along with monthly bills. The parking charges at the railway station, Air port any public / private places for the vehicle when utilized by GETCO would be admissible subject to Seal & Sign of Contractor Page 14/19

15 the production of such parking slips. These slips may be submitted along with the monthly bills for reimbursement of these parking charges will be paid on production of documents along with monthly bill. 18. The period of the contract shall be for Two years. The period of further one year can be extended for mutual agreed terms as per same rates, terms and conditions. However in case of poor services provided by the contractor, superintending engineer, Gondal shall be empowered to terminate the contract after one year. 19. The contractor shall immunize company s personal against any claim arising out of accidents or misbehavior of the drivers. The vehicle shall be kept properly insured all the time to cover the 3 rd party risk and simultaneously immunized company on account of likely claims from public, police dept. etc. 20. The bill for travelling of the vehicle shall be paid on monthly basis. 21. If contractor fail to provide the vehicle requisitioned by GETCO authorities reserves the right to hire same type of vehicle as may be required / available for the time being from open market at the risk and cost of contractor and the amount will be deducted from the monthly bill payable to the contractor. If the driver fails to report on time given by controlling officer, penalty of Rs. 50/- per hour will be imposed. 22. If due to any reason whatsoever, the GETCO has to make any payment, for vehicle or driver etc. the amount so paid by GETCO payable by the contractor to GETCO and all such payment shall be recovered by GETCO from the dues payable to the contractor and/or from the security deposit of the contractor. Balance amount if any is still payable by contractor; it has to be paid immediately to GETCO. 23. No night halt charges will be paid. 24. In case of poor services provided by the contractor, superintending engineer, Gondal shall be empowered to terminate the contract any time during contract period and security deposit will be forfeited. Payment of tall tax will be done by submitting original tall tax receipt with RA bill. 5. Bidder has to submit Xerox copy of insurance of vehicle which includes insurance of passengers and luggage. 6. Charges in price of diesel will be adjustable. Bidder must quote prices on the basis of prevailing 15 days before due date of tender. The basic rate shall be indicated in item no.
