Establish Fund 6, "Road Maintenance and Rehabilitation Account" (RMRA), to account for funds to be received by the City under Senate Bill 1, the Road Repair and Accountability Act of 2017, and direct staff to record in that Fund all applicable transactions; and 2. Adopt a resolution amending the Capital Improvement Program Budget to add CIP Project (Capistrano Villas I, II, and Ill Pavement Rehabilitation Project) as a project to be partially funded through the Road Repair and Accountability Act of 2017 in Fiscal Year ; and 3. Transfer to CIP Project (Capistrano Villas I, II, and Ill Pavement Rehabilitation Project) funding from the street projects identified in Attachment 2. DISCUSSION/ ANALYSIS: On April 28, 2017, the Governor signed Senate Bill 1 (SB 1 ), known as the Road Repair and Accountability Act of In order to address basic road maintenance, rehabilitation, and critical safety needs on both State and local streets, SB 1 increases per-gallon fuel excise taxes, diesel fuel sales taxes, and vehicle registration fees, and provides for inflationary adjustments to tax rates in future years. Beginning November 1, 2017, the State Controller will deposit various portions of these funds into the newly created Road Maintenance and Rehabilitation Account (RMRA). A percentage of the RMRA funds will be apportioned by formula to eligible cities and
2 City Council Agenda Report October 3, 2017 Page 2 of 3 counties for basic road maintenance, rehabilitation, and critical safety projects on local street and road systems. The City of San Juan Capistrano is projected to receive approximately $208,000 of RMRA funds in Fiscal Year Prior to receiving an apportionment of RMRA funds from the State Controller in a fiscal year, the City must submit to the California Transportation Commission a list of proposed projects to be funded with RMRA funds. All projects proposed to receive RMRA funding must be included in the City's Operating Budget or Capital Improvement Program. The listed projects must be defined with some specificity as to location and expected useful life. The City already has an eligible project funded through the Fiscal Year Capital Improvement Program, which is the Capistrano Villas I, II, and Ill Pavement Rehabilitation Project. The current Project budget also includes the anticipated RMRA revenues. What is needed at this time to be eligible to use the RMRA funds for this Project is a more detailed description of the Project and a statement of the expected useful life of the Project. The attached resolution (Attachment 1 ), with its attached Exhibit "A," provides the necessary information for the City to receive the RMRA funding. It is recommended that the City Council adopt this resolution. Staff will then submit the approved resolution to the State by the deadline date of October 16, FISCAL IMPACT: The recommended action will have no impact on the total amount appropriated by the City for street projects in Fiscal Year The action only provides a more detailed description of the City's project that has already been designated for SB 1 funding as required under policies adopted by the California Transportation Commission in accordance with the Road Repair and Accountability Act of 2017, and consolidates funding for CIP as set forth in Attachment 2. Bids for construction of the Capistrano Villas I, II, and Ill Pavement Rehabilitation Project are due November 2, 2017, and it is anticipated that the bids, plus contingencies and construction management costs, will exceed the current year's budget for the Project. Staff will submit recommendations for award of a contract and funding options to the City Council later this year. ENVIRONMENTAL IMPACT: The present action of identifying a funding source for a previously adopted Capital Improvement Project is not subject to CEQA pursuant to Section 15060(c)(3) of CEQA Guidelines, because the action is not a project as defined in Section of the CEQA Guidelines, and the action has no potential for resulting in physical change to the environment, directly or indirectly.

4 RESOLUTION NO XX A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING THE FISCSAL YEAR BUDGET TO INCORPORATE A LIST OF PROJECTS FUNDED BY SB 1, THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 WHEREAS, Senate Bill 1 (SB 1 ), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and signed into law by the Governor in April 2017 in order to address the significant multi-modal transportation funding shortfalls statewide; and WHEREAS, SB 1 includes accountability and transparency provisions that will ensure the residents of San Juan Capistrano are aware of the projects proposed for funding in our community, and which projects have been completed each fiscal year; and WHEREAS, the City must include a list of projects proposed to receive funding from the Road Maintenance and Rehabilitation Account (RMRA), created by SB 1, in the City's budget, which must include a description and the location of each proposed project, a proposed schedule for the projects' completion, and the estimated useful life of the improvement; and WHEREAS, the City of San Juan Capistrano will receive and estimated $208,092 in RMRA funding in Fiscal Year from SB 1; and WHEREAS, the City of San Juan Capistrano used a Pavement Management System to develop the SB 1 project list to ensure revenues are being used on the most high-priority and cost-effective projects that also meet the community's priorities for transportation investment. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby order and find as follows: 1. The foregoing recitals are true and correct. 2. The Capital Improvement Program Budget for fiscal year is amended to add the following project planned to be partially funded with Road Maintenance and Rehabilitation Account revenues: a.
