1 09/19/17 Page 1 Item #20 CITY OF DANA POINT AGENDA REPORT Reviewed By: DH X CM X CA DATE: SEPTEMBER 19, 2017 TO: FROM: HONORABLE MAYOR AND CITY COUNCIL MARK DENNY, CITY MANAGER SUBJECT: PROPOSED MEMORANDUM OF UNDERSTANDING FOR EVALUATION OF ORANGE COUNTY SHERIFF S DEPARTMENT CONTRACT LAW ENFORCEMENT SERVICES RECOMMENDED ACTION: That the City Council: 1) Approve the proposed Memorandum of Understanding (MOU) authorizing the City s participation and commitment to a multi-city effort to commission a contract law enforcement cost and efficiency study; and 2) Authorize the City Manager to execute the proposed MOU; and, 3) Appropriate funds in the amount of $15,700 for the City s estimated share of the cost of the study; authorize the City Manager to amend the MOU up to his purchasing authority should the actual cost of the study be higher than currently estimated. DISCUSSION: Costs for law enforcement services provided by the Orange County Sheriff s Department (OCSD) have increased by approximately 33% over the past ten years across all of its contract cities. On average, over the ten years spanning from FY08 to FY18, the OCSD costs for Dana Point have increased by 45%, or on average 4.5% per year. The law enforcement services contract currently accounts for $12,072,713, or approximately 35% of the City s General Fund operating budget. While services provided by OCSD are excellent, cost increases have consistently outpaced inflation, and growth in City revenue. In an effort to identify potential cost savings and operational efficiencies, the cities that contract with the Sheriff s Department are seeking an independent, third party review and analysis of OCSD contracts, including contract model cost assumptions, methodologies, allocations and law enforcement strategies. The thirteen cities that are proposing the study include: Mission Viejo, Aliso Viejo, Dana Point, Laguna Hills, Laguna Niguel,

2 09/19/17 Page 2 Item #20 Laguna Woods, Lake Forest, Rancho Santa Margarita, San Clemente, San Juan Capistrano, Stanton, Villa Park and Yorba Linda. The city managers of the contract cities have discussed, developed and agreed upon a scope of work. The cities have also prepared a Memorandum of Understanding (MOU) to establish a collective working relationship, with the City of Mission Viejo assuming the role as the lead agency in soliciting the Request for Proposals (RFPs) and administering the related consultant contract. Additionally, the contract cities anticipate collectively hiring a contract project manager to oversee the contract work. The draft Scope of Work for the project can be found in Exhibit A to the Attached MOU. All thirteen cities are expected to have the MOU approved and executed by September 26, It is estimated that the project will be completed in the latter part of NOTIFICATION AND FOLLOW-UP: None required. FISCAL IMPACT: The initial estimate for this project is $300,000, with costs allocated proportionally based on population of the contract cities (Exhibit B of the MOU), with Dana Point s share estimated at $15,685, or 5.23% of total project cost. This amount will be due and payable to Mission Viejo by September 22, 2017, and Council is requested to appropriate funds in the Police Services budget ( ) in the amount of $15,700. Because the RFP for consulting services has not yet been circulated, the actual cost may be higher. Any proposed cost increases, per the MOU, will be considered collectively by the contract cities staff. As such, staff is recommending authority be provided to the City Manager to amend the MOU for a not to exceed total MOU amount of $35,000; should a budget adjustment be necessary to cover any increase, a request will be placed on a future Council agenda.
