2 APPEALS DISCLAIMER No appeal may be taken as to the amount of an assessment unless a written objection signed by the affected property owner is filed with the municipal clerk prior to the assessment hearing or presented to the presiding officer at the hearing. The council may upon such notice consider any objection to the amount of a proposed individual assessment at an adjourned meeting upon such further notice to the affected property owners as it deems advisable. An owner may appeal an assessment to district court pursuant to Minn. Stat by serving notice of the appeal upon the mayor or clerk of the city within 30 days after the adoption of the assessment and filing such notice with the district court within ten days after service upon the mayor or clerk.

6 PROJECT SCOPE

7 INITIAL PROJECT SCOPE Presented at 12/2/2014 HEARING RED = RECONSTRUCTION YELLOW = OVERLAY $7.2 Million

8 OVERLAY Mill and overlay of asphalt streets is a preventative surface treatment in the City's Street Improvement Project. Two to three inches of the asphalt street are milled off and an overlay of new asphalt is applied. Gravel roads will be engineered for proper drainage and receive new bituminous surface. Curb & gutter repair will be done on a case by case basis IF curb & gutter existed before. Preliminary Assessment rate for overlay is $20.00 a lineal foot

9 RECONSTRUCTION Reconstruction includes utility replacement in the City's Street Improvement Project. Utility Replacement means water, sewer, and/or storm sewer replacement may be installed. Curb, gutter, and driveway approach replacement will be done IF it existed before. Sidewalks are only being replaced in the Downtown District, only on one side of the street, as per City Policy Preliminary Assessment rate for reconstruction is $50.00 a lineal foot

14 FUNDING SOUGHT BY CITY IRRRB has committed $250,00 to the project St. Louis County CDBG funds are not eligible for this project Legislative Money but has been sought but has yet to be confirmed General Obligation Tax Exempt Financing will be Used

15 WHY DOES THE CITY USE SPECIAL ASSESSMENTS FOR STREET PROJECTS? MN STATUTES OBLIGATIONS for an improvement or improvement program, which obligation is payable wholly or partly from the proceeds of special assessments levied upon property specially benefited by the improvement or by an improvement within the improvement program, or from tax increments, as defined in section , subdivision 25, including obligations which are the general obligations of the municipality, if the municipality is entitled to reimbursement in whole or in part from the proceeds of such special assessments not less than 20 percent of the cost of the improvement or the improvement program is to be assessed against benefited property MN STATUTES APPORTIONMENT OF COST. The cost of any improvement, or any part thereof, may be assessed upon property benefited by the improvement

17 PROPOSED SPECIAL ASSESSMENT PAYBACK OPTION 1 If paid in full by November 30, 2015, no interest charged. OPTION 2 If not paid by November 30, 2015, the assessment will be included on your property tax statement in twenty equal installments plus up to 5% accrued interest. *Please note that the first year installment will include interest for the period May 5, 2015 through December 31, 2015.
