Resolution RECOMMENDATION Staff recommends that City Council move to approve the Resolution to adopt a list of projects for Fiscal Year 2018/19 funded by SB 1: The Road Repair and Accountability Act of INTRODUCTION In April 2017, Governor Brown signed Senate Bill (SB 1), which is known as the Road Repair and Accountability Act of To address basic road maintenance, rehabilitation and critical safety needs, SB 1 increases the gallon fuel excise taxes, increases diesel fuel sales taxes and vehicle registration fees and provides for inflationary adjustments to tax rates in future years. Since November 2017, the State Controller has been depositing portions of these funds into the newly created Road Maintenance and Rehabilitation Account (RMRA). The funds are apportioned by formula to eligible cities and counties for basic road maintenance, rehabilitation and critical safety needs on the local streets and roads system. The California Transportation Commission (CTC) is the agency responsible for administering this program in accordance with the Streets and Highway Code provisions as outlined in SB 1. 2 Meeting Date: July 17, 2018 DISCUSSION The SB I program guidelines require that eligible cities and counties must submit a Resolution each year that includes a project list, even if the project list is the same from previous years. The City of Beverly Hills is estimated to receive $183,521 (projection based on actuals to date) in SB 1 funding during Fiscal Year 2017/18. City Council previously approved Resolution 17-R at its October 3, 2017, meeting with the following Fiscal Year 2017/18 project locations: N. Linden Drive between Whittier Dr. and Santa Monica Blvd. Burton Way (North side) between North Rexford Dr. and Oakhurst Dr. Burton Way (South side) between North Rexford Dr. and North Robertson Blvd. Rexford Dr. between Olympic Blvd. and Pico Blvd. Crescent Dr. between Sunset Blvd. and Lexington Rd. Copley Place near Copley Dr. and Sunset Blvd. Linden Dr. between S. Santa Monica Blvd. and Charleville Blvd. Rexford Dr. between Olympic Blvd. and Wilshire Blvd. Almont Dr. between Charleville Blvd. and Olympic Blvd. The locations are in accordance with the City s Pavement Management Plan which identifies locations in need of street rehabilitation work. Since the Fiscal Year 2017/18 SB 1 funding allocation is insufficient to cover project costs for all locations listed above, staff is recommending that the same project list be submitted for Fiscal Year 2018/19 so additional SB I funds can be set aside to cover project costs, which is allowable according to the program s guidelines. The City is projected to receive $579,697 in SB 1 funding for Fiscal Year 2018/19. The City needs to submit its Fiscal Year 2018/19 project list via an approved Resolution to CTC no later than August 1, 2018, to be eligible for funding. The project list does not limit the flexibility of an eligible city or county to fund projects in accordance with local needs and priorities, so long as the projects are consistent with RMRA priorities. Eligible RMRA projects can include, but are not limited to, the following: Road maintenance and rehabilitation; Safety projects; Railroad grade separations; Complete street components, including active transportation purposes, pedestrian and bicycle safety projects, transit facilities and drainage and stormwater capture projects in conjunction with any other allowable project; and Traffic control devices. It is noted that City Council adopted Resolution 18-R at its May 8, 2018, meeting in support of the proposed ballot initiative to repeal SB 1. To ensure that the City does not lose its funding allocation in the event that the repeal effort is not successful, City Council could adopt the Fiscal Year 2018/19 Resolution and also direct staff to not spend any of the funding until after the repeal initiative decision is made in November. 3 Meeting Date: July 17, 2018 RMRA funding recipients will be required to submit annual progress reports detailing the project status and expenditures. Additionally, funding recipients are required to sustain a Maintenance of Effort (MOE) by spending at least the annual average of its general fund expenditures during the 2009/10, 2010/11 and 2011/12 Fiscal Years for street, road and highway purposes from the City or County s general fund. FISCAL IMPACT This RMRA funding is an additional revenue source for the maintenance of local streets and infrastructure; local infrastructure capital improvement program monies may be used to cover remaining project costs. The RMRA funding will be placed in a separate City fund that is designated for special revenues. Any expenditure of these funds will require City Council appropriation during the fiscal year or through the budget process. 5 RESOLUTION NO. 18-R RESOLUTION OF THE COUNCIL OF THE CITY OF BEVERLY HILLS ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR FUNDED BY SB 1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 WHEREAS, Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and Signed into law by the Governor in April 2017 in order to address the significant multi-modal transportation funding shortfalls statewide; and WHEREAS, SB 1 includes accountability and transparency provisions that will ensure the residents of the City of Beverly Hills ( City ) are aware of the projects proposed for funding in our community and which projects have been completed each fiscal year; and WHEREAS, the City must adopt a list of all projects proposed to receive funding from the Road Maintenance and Rehabilitation Account (RMRA), created by SB 1 by resolution, which must include a description and the location of each proposed project, a proposed schedule for the project s completion, and the estimated useful life of the improvement; and WHEREAS, the City will receive an estimated $579,697 in RMRA funding in fiscal Year2Ol8-19 from SB 1;and WHEREAS, this is the second year in which the City is receiving SB 1 funding and will enable the City to continue essential road maintenance and rehabilitation projects, safety improvements, repairing and replacing aging bridges, and increasing access and mobility options for the traveling public that would not have otherwise been possible without SB 1; and WHEREAS, the City used a Pavement Management System to develop the SB 1 project list to ensure revenues are being used on the most high-priority and cost-effective projects that also meet the communities priorities for transportation investment; and WHEREAS, the funding from SB 1 will help the City maintain and rehabilitate streets and roads throughout the City this year and similar projects into the future; and WHEREAS, the 2016 California Statewide Local Streets and Roads Needs Assessment found that the City s streets and roads are estimated to be in good condition and this revenue will help us maintain the overall quality of our road system; and B \ vLdoc -1-

6 WHEREAS, the SB 1 project list and overall investment in our local streets and roads infrastructure with a focus on basic maintenance and safety, investing in complete streets infrastructure, and using cutting-edge technology, materials and practices, will have significant positive co-benefits statewide. NOW, THEREFORE, THE COUNCIL OF THE CITY OF BEVERLY HILLS, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The foregoing recitals are true and correct. Section 2.
