3 INTRODUCTION WE WANT YOUR VIEWS The Gvernment f Canada is beginning cnsultatins n the Infrmatin Requirements and Time Management Regulatins (prpsed regulatins) that will be develped pursuant t the prpsed Impact Assessment Act. These regulatins wuld prescribe: the infrmatin that the prpnent is required t prvide t the new Impact Assessment Agency f Canada (the Agency) at the early planning phase f the ptential impact assessment; the dcuments the Agency is required t prvide t prpnents if it is determined that an impact assessment is required; and the circumstances in which the Minister culd stp the clck fr the legislated timelines during the impact assessment prcess. Fr cases where life-cycle regulatrs, such as the Canadian Nuclear Safety Cmmissin r the prpsed Canadian Energy Regulatr, r the Offshre Bards may be invlved, there may be additinal regulatry requirements t be addressed thrugh thse existing prcesses. These prpsed regulatins wuld replace the existing Prescribed Infrmatin fr the Descriptin f a Designated Prject Regulatins under the Canadian Envirnmental Assessment Act, 2012 (CEAA 2012) upn the cming int frce f the prpsed legislatin. The purpse f this paper is t seek views n the prpsed apprach t the regulatins prir t the frmal regulatry prcess. This paper prvides an verview f pssible elements f the prpsed regulatins. It represents the start f a cnsultative prcess in which the Gvernment will discuss, with Indigenus grups, prvinces, stakehlders and the public, hw best t meet the requirements f the legislatin. The Gvernment is cmmitted t revising the regulatins thrugh engagement and early discussins with Canadians n the path frward. CONTEXT In January 2016, the Gvernment f Canada annunced an interim apprach that included principles and plans t guide its decisin-making n majr natural resurce prjects while it undertk a review f envirnmental assessment prcesses. The bjective f the review is t rebuild public trust, prtect the envirnment, advance recnciliatin with Indigenus peples, and ensure gd prjects get built and create jbs and ecnmic pprtunities fr Canadians. In June 2016, the Gvernment f Canada launched a review f envirnmental assessment prcesses under CEAA One year later, fllwing the reprt f the Expert Panel and extensive cnsultatin, the Gvernment released a Discussin Paper in June 2017 utlining the changes it was cnsidering fr Canada s envirnmental assessment and regulatry prcesses and undertk further cnsultatins. Thrugh the prpsed Impact Assessment Act, the Gvernment is prpsing new rules that prtect the envirnment, recgnize and respect Indigenus rights, and strengthen ur ecnmy. These new rules will invlve a shift frm envirnmental assessment t impact assessment. While federal envirnmental assessment under CEAA 2012 fcuses strictly n effects n the envirnment r ther types f effects resulting frm changes t the envirnment, the new impact assessment prcess will serve as a planning tl that takes int cnsideratin the whle range f envirnmental, health, scial and ecnmic effects f prjects. This new regime will shift away frm decisins based slely n the significance f effects and fcus instead n whether the adverse effects in areas f federal jurisdictin are in the public interest. The public interest determinatin will be guided by a prject s cntributin t sustainability, the extent t which these effects are adverse, measures t mitigate adverse effects, impacts n indigenus grups and their rights and impacts n Canada s ability t meet its envirnmental bligatins and climate changes cmmitments. The Gvernment will be launching a strategic assessment f climate change in the cming mnths which will lay ut hw climate change cnsideratins wuld be integrated in the impact assessment prcess and in determining whether a prject is in the public interest. 1
4 In additin t the brader review f prject effects under the prpsed Impact Assessment Act there will be an emphasis n early planning and engagement with Indigenus peples, the public and stakehlders t identify and discuss ptential effects and benefits early, leading t better prject design. We are making prcesses mre predictable and timely Impact assessments fr designated prjects under this new regime will be led by the Impact Assessment Agency f Canada. Where prjects links t life-cycle regulatrs such as the Canadian Energy Regulatr, the Canadian Nuclear Safety Cmmissin and Offshre Bards, the Impact Assessment Agency f Canada will wrk cllabratively with the lifecycle regulatr t draw upn their expert capacity and ensure that safety and ther key regulatry factrs are cnsidered as part f a single, integrated review. Making a single agency respnsible fr leading all impact assessments under the Impact Assessment Act will build trust and prvide mre clarity and cnsistency fr all stakehlders. It will als give Indigenus grups a clear pint f cntact fr engagement with the Crwn. OVERVIEW OF THE PROPOSED IMPACT ASSESSMENT PROCESS The prpsed impact assessment prcess differs frm that under Canadian Envirnmental Assessment Act, 2012 (CEAA 2012). The fllwing diagram prvides a brad verview f the phases f the prpsed legislated impact assessment prcess. It indicates where the prpnent wuld be required by the prpsed regulatins t submit infrmatin t the Agency (highlighted in green) as well as where in the prcess the Agency wuld be required t prvide prpnents with dcuments fr the impact assessment prcess. It als lays ut the assciated legislated timelines fr each stage f assessment, and which f thse timelines culd be suspended based n the criteria set ut in the prpsed regulatins (highlighted in blue). Thrughut the impact assessment prcess, ther federal gvernment departments wuld be invlved and prviding expert advice in engagement with Indigenus grups, prvinces, and stakehlders, the determinatin that an impact assessment is required, the develpment f the summary f issues, the impact assessment by the Agency and the Review Panel. The Gvernment is cmmitted t timely, evidence-based decisins reflecting the best available science and Indigenus knwledge. The engagement f Indigenus grups, prvinces, stakehlders, and the public in the early planning phase alng with the right level f infrmatin prvided by the prpnent will supprt a mre timely impact assessment prcess. In supprt f this cmmitment the prpsed legislatin wuld prvide Ministerial authrity t develp Infrmatin Requirements and Time Management Regulatins that wuld utline: key infrmatin requirements t supprt the new early planning phase and impact assessment; the dcuments the Agency is required t prvide t prpnents if it is determined that an impact assessment is required; and the criteria fr stpping the clck fr legislated timelines. 2
5 INFORMATION REQUIREMENTS The Gvernment is cnsidering prescribing in regulatins the infrmatin which the prpnent must prvide t the Agency befre and during the early planning phase. The infrmatin that the prpnent wuld be required t prvide wuld be in the tw key dcuments the prpnent is required t prvide t the Agency: an initial prject descriptin t cmmence the early planning phase, and subsequently fllwing Agency engagement with Indigenus grups, prvinces, stakehlders, and the public, a dcument that includes the prpnent s respnse t issues raised during the early planning phase and a detailed prject descriptin. The Gvernment is als cnsidering prescribing in regulatins the dcuments that the Agency must prvide t the prpnent if it is determined that an impact assessment is required. Early engagement in the assessment prcess is critical fr an effective and efficient review INITIAL PROJECT DESCRIPTION The first dcument the prpnent wuld be required t prepare, the initial prject descriptin, is a high-level descriptin f the prpsed prject which, nce accepted by the Agency, wuld be psted n the Agency website. The purpse f this initial prject descriptin is three-fld. It wuld: 1. Allw the Agency t determine if the prject is a designated prject under the prpsed legislatin; 2. Infrm the public abut the prpsed prject; and 3. Include sufficient detail t supprt cperatin discussins with Indigenus jurisdictins and prvinces and cmmence engagement with Indigenus 3
6 grups, prvinces, stakehlders, and the public n the prject. The initial prject descriptin wuld frm the basis fr early engagement n the prpsed prject. It wuld allw the ptentially affected Indigenus grups, prvinces, stakehlders, and public the pprtunity t understand what the prpsed prject invlves and if it is lcated in an area that culd impact them. It wuld als be used by the Agency as it undertakes engagement with Indigenus grups, prvinces, stakehlders, and the public during the planning phase. The initial prject descriptin wuld als prvide prpnents the pprtunity t cnsider changes t the prject design befre the design is t far advanced. While sme prpnents undertake early engagement with ptentially affected parties as a best practice, there is currently n legislated requirement t d s. The Gvernment is cnsidering the key infrmatin that shuld be required in the initial prject descriptin (Annex I) that wuld include general infrmatin abut the type, cmpnents, and lcatin f the prject as well as infrmatin n cnsultatin that the prpnent has cnducted t date. The infrmatin requested in Annex I is similar t that required in the first three sectins f the current Prescribed Infrmatin fr the Descriptin f a Designated Prject Regulatins under the Canadian Envirnmental Assessment Act, 2012 (Fr reference see in Annex III). Prpnents may be required t submit infrmatin and data in an accessible and usable frmat prescribed by the Agency. Questin 1: What are yur views n the prpsed cmpnents in the initial prject descriptin (Annex I)? THE PROPONENT S RESPONSE TO ISSUES AND DETAILED PROJECT DESCRIPTION The secnd dcument the prpnent wuld be required t prepare wuld include tw cmpnents: 1. The prpnent s respnse t the issues prvided by the Agency fllwing engagement and cperatin discussins. This culd include issues that were raised during cnsultatin in the early planning phase as well as issues with respect t the prpsed prject that the Agency cnsiders relevant. 2. A detailed descriptin f the designated prject. This dcument wuld be used t help the Agency determine whether r nt an impact assessment is required. As per the prpsed legislatin, the Agency wuld need t cnsider the fllwing when deciding if the designated prject is required t underg an impact assessment: the infrmatin included in the initial and the detailed prject descriptins; the pssible adverse effects within federal jurisdictin r the adverse direct r incidental effects caused by carrying ut the designated prject; any adverse impact the designated prject may have n the rights f Indigenus peples f Canada; any cmments received by the public; any relevant reginal r strategic study; any study that is cnducted r plan that is prepared by a jurisdictin (in respect f a regin in which the designated prject is lcated) and that has been prvided t the Agency; and any ther factr that the Agency cnsiders relevant. The prpnent s respnse t issues and the detailed prject descriptin wuld supprt mre timely impact assessments. It wuld allw the Agency t prvide the prpnent with mre clarity n the infrmatin and the level f cnsultatin that wuld be required t cmplete the impact assessment. 4
7 The Gvernment is cnsidering a list f requirements (Annex II) fr the detailed prject descriptin. This list wuld include updated infrmatin frm the initial prject descriptin that prpnents have already prvided as well as infrmatin abut the pssible envirnmental, scial, health and ecnmic effects f the prject. This infrmatin wuld enable the Agency t prduce the dcuments which wuld guide the impact assessment, prviding mre certainty and predictability at the utset f the prcess. Agency guidance wuld be develped t supprt prpnents in prviding the apprpriate infrmatin and level f detail. As is currently the apprach the Agency wuld be available t engage with prpnents in develping their submissin. Prpnents may be required t submit infrmatin and data in an accessible and usable frmat prescribed by the Agency. Questin 2: What are yur views n the prpsed cmpnents in the detailed prject descriptin (Annex II)? DOCUMENTS THE AGENCY IS REQUIRED TO PROVIDE TO PROPONENTS If an impact assessment is required, the Agency wuld prvide the prpnent with a ntice f cmmencement f the impact assessment and pst this ntice n the website. This wuld signal the end f the early Planning phase. Infrmatin in the detailed prject descriptin and the prpnent s respnse t issues wuld be used by the Agency t supprt assessment planning and crdinatin with implicated jurisdictins and departments. It wuld help infrm the develpment f dcuments that wuld be used t guide the impact assessment prcess, which wuld be psted n the Agency website at the same time as the ntice f cmmencement. The Gvernment is prpsing t prescribe in the regulatins these dcuments that the Agency wuld be required t prvide t the prpnent if it is determined that an impact assessment is required. These dcuments wuld be made available n the Agency website fr public cmment: Impact Assessment Cperatin Plan This wuld establish a plan between the Agency and prvinces and Indigenus jurisdictins, where applicable, n the impact assessment prcess. It wuld als establish harmnized timelines, when pssible, with ther jurisdictins. Public Engagement Plan This plan wuld be develped t utline the public engagement apprach and tls t be used in the assessment. Indigenus Engagement Plan This wuld be develped jintly with Indigenus jurisdictins and prvinces where relevant. It wuld be a plan fr engagement with Indigenus grups during the impact assessment prcess. Tailred Impact Statement Guidelines This wuld be a dcument the Agency develps in cnsultatin with thers t utline the infrmatin required frm the prpnent in the impact statement. These guidelines wuld be psted n the Agency website fr public cmment. Permitting Plan This permitting plan wuld be develped by the Agency in crdinatin with federal regulatrs. It wuld prvide the prpnent with an utline f the anticipated permits, licences, and authrizatins required fr the prject. It wuld be psted n the Agency website. 5
8 Prescribing in regulatins the dcuments that the Agency wuld prduce t guide the impact assessment prcess wuld prvide Indigenus grups, prvinces, stakehlders and the public with clarity and predictability at the utset f the prcess in knwing what the Agency is cmmitted t prvide as a result f the planning phase. Decisin Making Decisin by Minister up t 30 days Decisin by Gvernr in Cuncil up t 90 days These timelines are expressed as calendar days in the prpsed legislatin. The Minister, the Agency, the Panel, and the Gvernr in Cuncil wuld be subject t these timelines. Questin 3: What are yur views n the dcuments the Agency is required t prvide t prpnents if it is determined that an impact assessment is required? TIMELINE MANAGEMENT T ensure predictability fr Indigenus grups, prvinces, stakehlders, and the public, legislated timelines wuld be established fr each phase f federal assessments. The fllwing stages f the impact assessment prcess wuld be subject t legislated timelines: Early Planning Early Planning and engagement ttal time f up t 180 days Minister s respnse t a request fr Ministerial Designatin up t 90 days Impact Assessment Minister s referral f the prject t a Review Panel up t 45 days Assessment by Agency up t 300 days Assessment by Review Panel up t 600 days Clarity n hw timelines will be managed will ensure greater predictability Sme examples f the maximum lengths f time n the part f the federal gvernment fr impact assessments under the prpsed legislatin are as fllws: Impact assessment by Agency fr a prject n the designated prject 510 days (180 days Early Planning plus 300 days fr Impact Assessment plus 30 days fr Ministerial decisin) Review Panel 870 days (180 days Early Planning plus 600 days fr Review Panel plus 90 days fr Gvernr in Cuncil decisin) Timelines can be extended nce by the Minister fr a perid f up t 90 days. Any additinal timeline extensin must be made by the Gvernr in Cuncil. Timeline extensins can nly be prvided fr the planning phase, the impact assessment by the Agency, the Review Panel, r the decisin making phase. Thrughut all phases f the prcess prpnents will remain in cntrl f the timing fr the submissin f infrmatin that they are required t prvide. In rder t ensure that infrmatin fr analysis and decisin-making is current, prpnents will be required t submit their Impact Statement t the Agency within 3 years f receiving the Impact Statement Guidelines frm the Agency. The Agency wuld have the ability t prvide an extensin t the 3 year limit if a reasnable request is received frm the prpnent fr additinal time. 6
9 STOPPING THE CLOCK FOR LEGISLATED TIMELINES There may be circumstances in which the clck may need t be stpped fr the legislated timelines, with the exceptin f decisin making. The criteria t determine when the clck fr the legislated timelines culd be stpped wuld be prescribed thrugh regulatins. The intent f these prpsed regulatins is t build in a mechanism where the clck can be stpped fr legislated timelines t accunt fr circumstances which might ccur n the part f the prpnent, the Agency, the Minister, r the Review Panel thrughut the planning phase and impact assessment prcess. T prvide greater predictability and cnsistency t Indigenus grups, prvinces, stakehlders, and the public in the management f these legislated timelines, the Gvernment is cnsidering setting in regulatins a limited number f clear criteria fr the Minister t stp the clck fr legislated timelines. The Minister can delegate the authrity t stp the clck fr legislated timelines t the Agency. Requests frm an expert federal department fr additinal infrmatin that was nt previusly identified during the early planning prcess, and which wuld result in the Agency stpping the clck, wuld first need t be validated by the Chief Science Officer (r equivalent senir-level psitin) within that expert federal department prir t being actined by the Agency. In each case where the clck is stpped fr a legislated timeline, the Minister wuld be required t pst a ntice n the Agency website and identify the reasns fr the stppage. Setting ut these criteria in regulatins and psting a ntice n the Agency website each time the clck is stpped wuld increase transparency under the prpsed new impact assessment prcess. The prpsed criteria under which the clck fr the legislated timelines culd be stpped in the future wuld include: the prpnent requesting that the timeline be suspended; if there is a design change by the prpnent that culd change the ptential impacts f the prject; if critical infrmatin is missing (e.g. frm the prescribed infrmatin requirements prvided by the Agency during the early planning phase) that is needed t cmplete the assessment; r in the event f nn-payment by the prpnent f cst recverable activities, until such time as the payment has been received. The prpsed regulatin wuld specify that whle days are t be cunted. This means that any actin taken n ne calendar day wuld then lead t stpping the clck fr legislated timelines r restarting the clck fr the legislated timelines n the fllwing calendar day. REVIEW MECHANISM The Agency wuld establish a review mechanism thrugh which prpnents, Indigenus grups, stakehlders, and the public culd submit cncerns abut the management f timelines. Recmmendatins n hw t address these cncerns wuld be submitted t the head f the Agency. The recmmendatins as well as the Agency respnse t thse recmmendatins wuld be made publicly available n the Agency website. Questin 4: What are yur views n the prpsed criteria under which the clck fr timelines in the prpsed legislatin culd be suspended? 7
10 NEXT STEPS SEEKING YOUR VIEWS We are interested in yur views n the prpsed cntent f these ptential regulatins and wuld welcme cmments n r befre June 1 st, They can be prvided t: The Gvernment will cnsider all cmments received as it further refines its apprach and cntinues engagement n the prpsed Infrmatin Requirements and Time Management regulatins. The prpsed regulatins prvide the right infrmatin in the new planning phase t guide the impact assessment and clarify the cnditins under which the clck can be stpped fr legislated timelines s that timelines are effectively managed. The verall bjective f the prpsed regulatins is t supprt the Gvernment s cmmitment t timely, evidence-based decisin making. In the next few mnths, the Gvernment will cnduct a review f the feedback received n the prpsed Infrmatin Requirements and Time Management regulatins as part f this cnsultatin pprtunity. Fllwing this first rund f cnsultatin, there will be tw ther phases f cnsultatin. In the fall f 2018 the prpsed regulatins will be shared fr a subsequent rund f cnsultatin with Indigenus grups, prvinces, stakehlders, and the public. Fllwing this input the prpsed regulatins will be revised in advance f cmmencing the frmal regulatry prcess in 2019, ultimately leading t the fficial cming int frce f the regulatin thrugh publicatin in the Canada Gazette. 8
