Councilors Present: Also Present: Councilor Varon, Councilor Putter, Councilor Erxleben, Councilor Dulcich, Deputy Mayor Lee, and Mayor Garber. John Starbard, City Manager; Jeff Johnson, Assistant City Manager; Lisa Marshall, City Attorney; Rob Wyman, Director of Community Development; Maiya Andrews, Director of Public Works; Eric Christensen, Budget Manager; and Bob Baker, City Clerk. Councilor Varon MOVED; Deputy Mayor Lee SECONDED; TO EXCUSE THE ABSENCE OF COUNCILOR DAN HUBBELL. THE MOTION TO EXCUSE THE ABSENCE OF COUNCILOR DAN HUBBELL CARRIED 6-0. FLAG SALUTE Councilor Erxleben led the Flag Salute. PRESENTATIONS - NONE. PUBLIC COMMENT Adrienne Anderson Smith, Newcastle, spoke of variety of societies throughout the centuries and how freedom was an uplifting, fulfilling rejuvenation for religious people escaping brutal condemnation. Ms. Anderson Smith also spoke of an increasing amount of litter collecting on Newcastle City streets. To aid in the problem, the speaker suggests Boy Scouts have helped in the past. Sadly, the litter returns. In light of that, she encouraged City staff to provide a polite reminder to those who may be causing the problems. It is Ms. Anderson Smith's belief that landscapers visiting Newcastle may be at the root of the problem. Lisa Jensen, President, Newcastle Chamber of Commerce, announced the Chamber will host a candidate's forum on October 21, 2006, at the Newcastle Golf Club. An advertisement will appear in the Newcastle News and more information may be obtained from the Chamber's website and an ensuing Press Release. Moreover, questions are being gathered from community members, reviewed by Councilmembers and presented to the moderator.

2 Page 2 of 7 COUNCIL COMMENTS Councilor Putter shared results of new cost projections for the Alaskan Way Viaduct and SR 520 Bridge replacement costs as well as implications for some of the projects in the Newcastle vicinity. Changes in proposed figures come from changes in assumptions from inflation compounded by the time it takes to complete the projects. MAYOR-COMMISSION-CITY MANAGER'S REPORT a. Mayor -Appointments to Parks Commission Reporting the presence of Suzi O'Byrne at this meeting, Mayor Garber informed those present of the candidate's knowledge of the City's parks and trails. Ms. O'Byrne is enthusiastic and is looking forward to serving and called the opportunity, "fun and interesting." Not present at this meeting, Peggy Price is an active member of the Newcastle Trails Group, is familiar with the City's trails and roads and is also enthusiastic about serving. Mayor Garber explained the process used to fill Commissioner appointments. The Newcastle Municipal Code gives the Mayor the authority to make the final decision on appointments. Next, Mayor Garber stated sincere appreciation for the service of outgoing Commissioner, Garry Kampen. The decision to not reappoint Dr. Kampen was difficult, yet the Mayor stands behind her decision for the appointments of Ms. O'Byrne and Ms. Price. Finally, Mayor Garber spoke in favor of re-appointing Curtis Gray to the Parks Commission. Deputy Mayor Lee MOVED; Councilor Putter SECONDED; APPROVAL TO RE-APPOINT CURTIS GRAY, AND TO APPOINT SUZl O'BYRNE AND PEGGY PRICE TO THE PARKS COMMISSION, ALL WiTH TERMS TO EXPIRE Discussion ensued regarding the decision to not reappoint Garry Kampen to the Parks Commission. Based on discussions with the outgoing Commissioner, Mayor Garber stated her belief the City would not lose Dr. Kampen as an enthusiastic volunteer. THE MOTION APPROVALTO RE-APPOINT CURTIS GRAY, AND TO APPOINT SUZI O'BYRNE AND PEGGY PRICE TO THE PARKS COMMISSION, ALL WITH TERMS TO EXPIRE CARRIED 6-0. b. Planning Commission Russ Segner, Planning Commission Chair, noted that beginning in September, the Commission will meet twice per month (for an unspecified length of time) to tackle the many issues on their 2006 Work Plan. In addition to other items at future meetings, the Commission will consider public comments on the review process currently under way regarding the CBC Plan. Additionally, the Planning Commission Chair provided highlights of a previously-distributed report to the Council. c. City Manager John Starbard, City Manager, reported the Newcastle Trails Group was the host organization for the Volks March in Newcastle on September 23, Councilor Erxleben asked about T-Mobile's cell tower and related landscape maintenance agreement. Damage has occurred to the parking right-of-way and must be repaired. Maiya Andrews, Public Works Director, reported the right-of-way permit is still open and that she would contact T-Mobile.

3 Page 3 of 7 Councilor Erxleben inquired about the status of the Parks Manager position. John Starbard, City Manager, reported the position has not been re-posted since previous unsuccessful recruitment attempts. Pressing the City Manager on when the position would be advertised, Councilor Erxleben asked if the position could be filled by the end of Mr. Starbard is unable to make such a guarantee. APPROVAL OF FlNAL AGENDA Councilor Varon MOVED; Deputy Mayor Lee SECONDED; TO APPROVETHE FlNAL AGENDA AS PRESENTED. THE MOTION TO APPROVE THE FINAL AGENDA AS PRESENTED CARRIED 6-0. CONSENT AGENDA a. Proposed resolution authorizing execution of an Interlocal Agreement with the Watershed Basins within Water Resource Inventory Area 8 b. Motion to rescind Resolution Councilor Varon MOVED; Deputy Mayor Lee SECONDED; TO APPROVE THE CONSENT AGENDA AS PRESENTED. THE MOTION TO APPROVE THE CONSENT AGENDA AS PRESENTED CARRIED 6-0. APPROVED RESOLUTION #0365 (item A) and #0366 (item B) PUBLIC HEARINGS - NONE. GENERAL BUSINESS ' a. City Hall Architectural Programming Update - LMN Architects Walt Neihoff, LMN Architects, provided an overview of the project from its inception to date. Although no site has been selected, work has begun to create a vision statement and overall goals and policies for CIP project F-001. That project is described as a "budgetary provision to pursue potential land acquisition opportunities and to perform conceptual urban designlarchitectural work" for a new City Hall." Those goals and policies will provide future guidance as to the way the project should be approached when the time comes to develop detailed architectural plans. Showing a series of photographs, Mr. Neihoff showed various types of civic architecture (taken around Puget Sound) which could work well for Newcastle. For planning purposes, the speaker suggested tours of nearby cities. Jim Brown, LMN Architects, described the behind-the-scenes process to date. After meeting with City staff to discuss how the current space is being used and what newly-proposed spaces would work best for current and future staffing needs, Mr. Brown created proposed space layouts for cubicals, offices, shared meeting room spaces, lobby, public spaces and City Council Chambers. It was emphasized that future needs are being taken into account throughout the planning process. It was learned that storage space at the current City Hall is approximately 7,000 square feet. After planning, drawing and considering a newly proposed space, LMN Architects anticipate a new "total building area" roughly 17,000 square feet. Councilors questioned Mr. Neihoff and Mr. Brown and learned the following: 1. "hot offices" are cubical spaces for temporary uses, such as when the Washington State Auditor is on

4 Page 4 of 7 site; 2. future expansion needs were considered and the designs being presented could easily serve the City's needs for 20 to 30 years; 3. "grand plans" and ideas were discussed when creating the program and cost restraints will be considered during the next step of the process; and 4. LMN staff has completed approximately 50% of their scope of work on this contract. Mayor Garber recessed the meeting at 8:22 PM and reconvened it at 8:33 PM. Councilor Erxleben asked if LMN Archicects staff should speak with the King County Library System to determine whether or not our plans would work in conjunction with the new library to be built in Newcastle. John Starbard, City Manager, reminded the Council of a motion and vote from April, 2006 wherein Council voted not to do this very thing. Councilor Erxleben MOVED; Councilor Dulcich SECONDED; TO DIRECT THE ClTY MANAGER TO HAVE LMN ARCHITECTS CONTACT KlNG COUNW LIBRARY SYSTEM ARCHITECTS TO CONDUCT PRELIMINARY DISCUSSIONS ON THE FEASIBILITY OF CO-LOCATING ClTY HALL ON THE TOP FLOOR OF THE KCLS BUILDING LOCATED ON THE DONNER SITE. Rob Wyman, Director of Community Development, reported KCLS has not yet selected an architect. Mr. Neihoff noted it is inappropriate for them to contact KCLS architects. He asked that if the motion is successful, Mr. Starbard contact the architects to determine if they are willing to speak with LMN staff. THE MOTIONTO DIRECT THE CITY MANAGER TO HAVE LMN ARCHITECTS CONTACT KlNG COUNTY LIBRARY SYSTEM ARCHITECTS TO CONDUCT PRELIMINARY DISCUSSIONS ON THE FEASIBILITY OF CO-LOCATING ClTY HALL ON THE TOP FLOOR OF THE KCLS BUILDING LOCATED ON THE DONNER SlTE FAILED 3-3 WITH COUNCILOR PUTTER, DEPUTY MAYOR LEE, AND MAYOR GARBER DISSENTING. Councilor Dulcich MOVED; Councilor Erxleben SECONDED; TO DIRECT THE ClTY MANAGER TO RETURN WITH A ROUGH ORDER MAGNITUDE OF COST RANGES FOR ClTY HALL, ITS POTENTIAL SlTE LOCATIONS AND POTENTIAL FUNDING SOURCES WITHIN 30 DAYS AFTER RECEIPT OF A FINAL REPORT FROM LMN ARCHITECTS. City Manager Starbard noted the request may be carried out easiest and most efficient when LMN has completed work on their current contract. Cost estimates were not included as part of the scope of work. Mayor Garber favors the review of funding sources and potential mechanisms for locating a mixed-use development arrangement. Councilor Ducich spoke in favor of the motion so as to have a clue as to potential cost impacts. To make things easier, Councilor Varon suggested the information could be presented within 30 days after the final report is received from LMN Architects. THE MOTION TO DIRECT THE ClTY MANAGER TO RETURN WITH A ROUGH ORDER MAGNITUDE OF COST RANGES FOR ClTY HALL, ITS POTENTIAL SITE LOCATIONS AND POTENTIAL FUNDING SOURCES WITHIN 30 DAYS AFTER RECEIPT OF A FINAL REPORT FROM LMN ARCHITECTS CARRIED 6-0. THE MOTION TO DIRECT LMN ARCHITECTS TO COMPLETE THE ADOPTED SCOPE OF WORK FOR THE CITY HALL ARCHITECTURAL PROGRAMMING PROJECT CARRIED 5-1 WITH COUNCILOR ERXLEBEN DISSENTING. b. Legislative Update & Proposed Resolution adopting the 2007 State Legislative Agenda of the City of Newcastle -Mike Doubleday, Doubleday Government Relations Mike Doubleday, Doubleday Government Relations, reviewed the proposed 2007 Newcastle State Legislative Agenda. Highlighting that which was in the Council agenda packet, Mr. Doubleday noted top priorities include: infrastructure financing (supporting better local infrastructure financing options from Washington State; Streamlined Sales Tax (supporting passage of the agreement may mean receipt of $250,000 in revenues); and transportation funding (by closely monitoring a review of the Transportation Partnership Act. Support issues include Regional Transportation Governance, Municipal Courts contracting, Cable franchising, and Public Works Trust Fund Award of Construction Loans. Other issues include Multi-family Housing Tax Exemptions; alternative Public Works financing; government liabiiity; jail capacity in King County; and prisoner medical costs. In addition to praising his efforts, Councilors questioned Mr. Doubleday and learned I) he primarily lobbies at the State level, yet works for the City of Newcastle at the Federal level on some issues; 2) the potential for receipt of any additional funding for the Coal Creek Parkway is unknown at this time; and, 3) the upcoming legislative session goes to the end of April, Councilor Putter MOVED; Deputy Mayor Lee SECONDED; APPROVALOF THE PROPOSED RESOLUTION, ADOPTING THE 2007 STATE LEGISLATIVE AGENDA OF THE CITY. Mayor Garber relinquished the gavel in order to make a motion. Mayor Garber MOVED; Deputy Mayor Lee SECONDED; TO MONITOWTRACK RESULTS OF THE TASK FORCE RECOMMENDATIONS ON AFFORDABLE HOUSING MANDATES TO CITIES. Citing the potential for great impacts and implications to the City of Newcastle, Mayor Garber spoke favorable of her motion. She also spoke favorably of developing strategies for use to increase affordable housing within all cities. THE MOTION TO MONITOR/TRACK RESULTS OF THE TASK FORCE RECOMMENDATIONS ON AFFORDABLE HOUSING MANDATES TO CITIES CARRIED 6-0. THE MOTION APPROVALOF THE PROPOSED RESOLUTION, ADOPTING THE 2007 STATE LEGISLATIVE AGENDA OF THE ClTY CARRIED 6-0. c. Initial Presentation of 2007 Operating Budget John Starbard, City Manager, introduced the proposed 2007 Operating Budget to Council. Covering information provided within the agenda bit1 for this item, Mr. Starbard reported: -operated revenues are projected to increase by approximately 4.6-percent in 2007; -no new revenue sources have been identified and no rate inreases are proposed; -the City's budget is increasing at less than the rate of inflation; and -the total salary and benefits budget for 2007 is less than $1,000 greater than that of 2006.

6 Page 6 of 7 -the proposed Cost of Living Adjustment (COLA) is 4.41-percent. The largest expenses in the City's budget are attributable to the King County Sheriff's Office and Bellevue Fire Department. As the City appears to be underspending the operating budget in 2006, staff is proposing the purchase of a new financial management software package and an upgrade to the City's document management software, LaserFiche. Department Directors shared notes regarding increases or decreases within the proposed 2007 Operating Budget. John Starbard, City Manager, reported his office budget will experience a I -percent increase. Lisa Marshall, City Attorney, reported her office will realize a 3-percent decrease. Jeff Johnson, Administrative Services Director and Assistant City Manager, explained the re-organization of staff within his department and noted it will experence a 19-percent increase. John Starbard and Melinda Irvine, Chief of Police, noted the Police Department will incur a -/-percent increase; while the Bellevue Fire contract will see a 5-percent inrease. Rob Wyman, Director of Community Development, stated an intended decrease of 6-percent. Maiya Andrews, Director of Public Works, noted her department will experience a 3-percent increase. Deputy Mayor Lee MOVED; Councilor Putter SECONDED; APPROVAL TO SUSPEND THE RULES AND PROCEED UNTIL 10:15 PM. THE MOTION APPROVAL TO SUSPEND THE RULES AND PROCEED UNTIL 10:15 PM CARRIED 6-0. Eric Christensen, Budget Manager, reported the purpose of this item is to introduce Council to key emerging issues for the proposed 2007 Operating Budget and to inform them of the proposed schedule for the coming months. After delivery of the Proposed Operating Budget on November 2, Council will conduct two public hearings (November 7 and 21) and may adopt the document on December 5,2006. Introducing a suggested improvement for accounting purposes, Mr. Christensen spoke of an intended addition of new user account codes which will provide greater clarity and detail expenditures. No changes in services or revenue sources are anticipated for 2007 and it would appear a provision for seasonal maintenance workers for infrastructure maintenance will be realized. Mr. Christensen noted City staff is discussing whether or not the City should increase the Special Events Producer position from.5 FTE to 1.0 FTE. Mr. Starbard noted research and analysis must be performed prior to any decisions being made. More information will follow. Finally, Mr. Starbard noted it appears that operating expenditures will be significantly less than budgeted for 2006 and revenues may be greater than forecast. With that, he suggested a small percentage of the monies be used to purchase the financial management software package, LaserFiche upgrade (previously mentioned) and new maintenance equipment for Public Works; and the remainder of the funds to be placed into the General Fund balance. After discussion, Council would like more information before making a decision on the idea. Informational only, no action was taken on this issue.
