(2) In this Act, good-quality, in relation to local infrastructure, local public services, and performance of regulatory functions, means infrastructure, services, and performance that are (a) efficient; and (b) effective; and (c) appropriate to present and anticipated future circumstances. 4 4 To: Temporary Road Closures Sub Committee Date: 16 April 2015 Significant Decision: No Ram Paddock Road Motorsport Speed Event 2015 Recommendation THAT THE COUNCIL AGREES TO APPROVE THIS APPLICATION. Executive Summary The Council has received an application from Autosport for the temporary closure to the following sections and roads listed below. This is for the running of the Ram Paddock Road Motorsport Speed Event Roads Proposed to be closed to Ordinary Vehicular Traffic: Ram Paddock Rd, from 1036 Ram Paddock Rd to 522 McDonald Downs Rd, Broomfield. Date and Time: Sunday 26 April 2015, 9.00am to 5.00pm. This community event is held annually and has proven to be safely run and a successful event. This proposal meets the requirements of Local Government Act 1974, section 11(e). Background An application has once again been received from Autosport for a temporary closure of: Ram Paddock Rd, from 1036 Ram Paddock Rd to 522 McDonald Downs Rd, Broomfield. The Council has authority under paragraph 11 (e) of the tenth schedule of the Local Government Act 1974 to approve or decline this application. No objections have been received to date. The objection period was still open at the time of the agenda preparation. Any objections received will be tabled at the meeting. Discussion This event has always been safe and successful in previous years and given the following proposed conditions we expect this would be the same this year. Proposed conditions: Organisers must notify all property owners on the route of the event. Provide access in the event of an emergency.
5 5 Provide radio communication between the start and finish of each stage. Place marshals at intersections and at the start and finish of the stage to alert people that the road is temporarily closed. Allow property owners access whenever it is practicably possible That within the same day of the event, organisers shall clear the route of debris and litter including that left by spectators. Organisers to pay all costs of newspaper advertising. Supplied with Application: Current Traffic Management Plan Proof of current public liability insurance cover of $1,000,000. A cash bond in the sum of $2, has been deposited with the Hurunui District Council against damage to roads or signs or road reserves during the event. The sum to be refunded less the costs of any repairs required. Desired Outcome a. A safely run event. b. Minimal interruption for road users. Financial Considerations Legal Considerations There are no financial considerations for Council as all costs are charged to the applicant. Council has authority under paragraph 11 (e) of the tenth schedule of the Local Government Act 1974 to approve or decline this application. Policy and Plan Implications Risks Considerations for Tangata Whenua Options None. Identified risks have been mitigated by the proposed conditions as stated under the discussion section of this report. None. Option 1: Do Nothing. This is not an option as under paragraph 11(e) of the tenth schedule of the Local Government Act 1974, the Council is required to either approve or decline this application. Option 2: Approve the application. The application meets the criteria necessary for approval. Option 3: Decline the application. There have been no reasons identified to decline this application.

7 Significance Consideration (Guidelines from Hurunui District Council s Significance and Engagement Policy) The Council, in considering each matter, must be: a. Satisfied that it has sufficient information about the practicable options and their benefits, costs and impacts, bearing in mind the significance of the decisions. b. Satisfied that it knows enough about and will give adequate consideration to the views and preferences of affected and interested parties bearing in mind the significance of the decisions to be made. Questions a. Does the Council have sufficient information about the issue, proposal, decisions or other matter? b. Does the issue, proposal, decisions or other matter: Affect all or a large portion of the community in a far-reaching way? Have a potential impact or consequence on the affected persons (being a number of persons) that is substantial? Have financial implications on the Council s resources that would be substantial? Generate (or would be expected to generate) a high degree of controversy? Have any impact on Council s capacity to undertake its statutory responsibilities? Fail to flow logically or consequentially from a decision in the Council s Long Term Plan? Evaluation Council officers preparing these reports will have regard to Council s policy on significance. Councillors will make the final assessment on whether the subject under consideration is to be regarded as being significant or not. Unless the Council explicitly determines that the subject under consideration is to be deemed significant then the subject will be deemed as not being significant.
