1 Village of Belledune Regular Meeting Time: 7:15 P.M. Place: Belledune Municipal Chambers Present: Mayor, Nick Duivenvoorden CAO - Clerk/Treasurer, Brenda Cormier Deputy Mayor, Ron Bourque Councillor, James Carrier Councillor, Michael Firlotte Councillor, Austin Tardif Councillor, Emmie Flanagan Mayor, Nick Duivenvoorden called the meeting to order. Councillor, Emmie Flanagan delivered the Serenity Prayer. Austin Tardif moved that the agenda with additions be adopted as presented, seconded by Emmie Flanagan. Motion carried. Statement of Conflict of Interest: Nil Minutes & Business Arising from Minutes Austin Tardif moved that the minutes of regular meetings for July 10 and August 8, 2006, be adopted as presented, seconded by Emmie Flanagan. Motion carried. Business Arising: Mayor, Duivenvoorden made inquiry to Councillor, Tardif on the status of the development of canopies for municipal building entrances. Presentations / Petitions / Delegations: Danny Smearer Ditching job Lawlor Rd. o Questions & comments directed to Mayor, Duivenvoorden Why did the Mayor have a second contractor (Tommy Landry) go in a redo the job on Lawlor Road in front of his property which has already been completed by him (Mr. Smearer) as directed by municipal Maintenance Supervisor? Is this job going to be paid for twice by the village? The scope of work that he was advised to do did not include removal and reinstallation of culvert. The work performed was as per directed, to create a ditch to have water drain. The ditch had an 18 inch slope and would have drained well. Yet the second contractor did replacement of culvert, the ditch now, although deeper, has hardly any slop and drainage will be an issue. As for removal and replacement of culvert he would have did that scope of work as well if he have been instructed to do so. While he understands that the time frame for doing the work was lengthy, it was not indicated to him that timing was an issue. As well, even thought he may have had equipment problems the job was still his to complete and he had made arrangement with Dwayne Woodcox to complete. 1

2 He feels that the Mayor made this decision by himself to call Tommy Landry to redo a job that was already done as requested by municipal Maintenance Supervisor, even thought in conversation with the Mayor by telephone he was advised that the job would be completed. Council comments o Mayor, Duivenvoorden explained that when he seen the job was not completed and heard that Mr. Smearer equipment was broke, he proceeded to call Mr. Landry to do the work. Mr. Smearer s equipment was at least on site for a month. However, it is unfortunate that Mr. Smearer feels slighted by this. This is in no way a refection on his work. o Councillor, Bourque commented that he cannot see why the Mayor would put the Council in a situation where they now have to make a decision to pay a second invoice, after the fact. There is a system in place whereby Council could have been consulted first before this decision was made by the Mayor. o Mayor, Duivenvoorden noted that Council can decide whether to pay the invoice or not. But there should be a standard for the contractors to do the job in a timely manner. Statements by Members of Council: Mayor, Duivenvoorden Ladies Auxiliary request to use bus Thursday for a bus trip to Presque Isle, Maine. o Consensus of Council -yes Councillor, Carrier Rental Lease Agreement Hometown Communications Councillor, Flanagan Extend Roherty Point Employees Extension of two (2) weeks Late Charles O Neil Related expense for hotel lodging and bus fuel Reports: Financial Report: James Carrier moved that the Financial Report be accepted as read and the Accounts Payable be paid, seconded by Austin Tardif. Motion carried. Administrative Report: Memo to Council July 21, 2006 (James Daigle Complaint) o Have municipal Maintenance Supervisor go with contractors and get quotation on removal of cattails, ditching and backfill if needed. Land Purchase Offer Mrs. S. Firlotte (PID ) accepted o Property owner legal fees to be paid by them Website News Articles & Photo Gallery o Get cost proposal from Flo`s Camera for photos and news events for website Robert Hickey Towing Cost (Stuck in broken culvert 3649 Main St.) o Village reimburse cost 2

3 Culvert Chaleur Drive o Have engineering look at street and make evaluation and recommendations for culverts and crossover pipe at entrance. Shoulder of Road Intersection Route 134 & Hillivew Street o Solutions to be looked at Shoulder of Road Top of Jacquet River hill to Fenderson Rd. o Solutions to be looked into by Council Job Approvals: o Gazebo Completion, Seating Area Concrete Pads, Rec. Centre Door Repairs Council approved for payments Village properties Firlotte Road Taxation Issue 2007 o Solutions are to be looked into. Check with assessment office to see if any further details. Have surveyor look at possibilities for subdivision of property. Prepare for future discussion with building owners to address and resolve the issue. By-laws and Policies: Austin Tardif moved that By-law Amendment # A By-Law # Respecting the Remuneration of the Mayor & Council be read a third and final time and adopted, seconded by Michel Firlotte. Motion carried. Austin Tardif moved that Amendment EC , an amendment to Expense Claim Policy - EC be adopted as presented, seconded by Michel Firlotte. Motion carried. Motions & Resolutions: James Carrier moved that the Village enter into a legal lease agreement with Hometown Communications Ltd. for rental of space upstairs at Station # 1 Fire Hall for a three (3) year term for the amount of $400 per month and as recommended by the municipal insurance company, that they hold liability insurance for a minimum of $1 million, naming the Village of Belledune as additional insured, and provide annually to the municipal office proof of such insurance, seconded by Emmie Flanagan Comments by Council: Councillor, Tardif issued statement that he does not want to see 25 jobs leave the Village. However, the Village should not be competing with the private sector. Councillor, Bourque stated that 25 jobs are important to the community. What transpired is that Council was not notified at an earlier time and was unable to look at what it would cost them to relocate to another building. He is not against financially assisting them to relocate. A cost of relocation was never presented to Council. Council was being pushed to make a reactive decision. Councillor, Flanagan questioned the three year term. Councillor, Firlotte said he understands the concerns by the private sector. Hometown Communications was looking for a place to settle in. Council decided to try at the fire hall. 3

4 They got caught in to a cross fire. If it had been known they could have been accommodated in the private sector. As a business now that they are set up it is hard to move. Councillor, Carrier said he is basing his decision on people who elected him. He understands that the private sector is struggling. The 25 jobs are the issue and once the agreement is signed they can work on finding other locations. Austin Tardif moved that the motion be amended to change the words three (3) year term to one (1) year term and add after the words proof of such insurance the words and the Council assist them within that term to find a alternate suitable space in the private sector, seconded by Ron Bourque. Motion carried. Motion carried. Emmie Flanagan moves to extend the temporary employment at Roherty Point for two (2) more weeks, seconded by Michael Firlotte. Motion carried. Emmie Flanagan moved that the Village reimburse for lodging expense incurred on August 8 & 9, 2006 during the search for Mr. Charles O Neil in the amount of $334 and approve the cost of fuel for the bus, seconded by Austin Tardif. Motion carried. Michael Firlotte moved that the Village proceed by invitational tender for the painting of arena ceiling with contractors identified by the Arena Committee members, seconded by Ron Bourque. Motion carried. General Correspondence: Correspondence In: DOT-Brian McEwing - Property PID Clarification (2) Tourism Chaleur Official Travel Guide (Contribution) Austin Tardif moved that the additional amount of $350 be approved for the 2007 Official Travel Guide, as requested by Tourism Chaleur, seconded by Emmie Flanagan. Motion carried.
