2 Savannah Country Club Levels Golf (30yrs- 71yrs) Monthly dues are $ Full Golf includes the use of ALL facilities of The Savannah Country Club. Senior (72yrs- 79yrs) Monthly dues are $ Senior Full Golf includes the use of ALL facilities of The Savannah Country Club. Intermediate Golf (21yrs- 29yrs) Monthly dues are $ Intermediate Golf includes the use of ALL facilities of The Savannah Country Club. At age 30, members will upgrade to Golf without having to pay any additional initiation fees. Monthly dues will be the current rate at the time of the upgrade. Out of Town Golf Out of Town Golf includes the use of ALL facilities of The Savannah Country Club. To qualify for this membership, an applicant must live outside a radius of 50 miles. Monthly Dues are $ Full Golf includes the use of all facilities of The Savannah Country Club. Senior 80 (80yrs & up) Tennis (21yrs- 71yrs) Senior Tennis (72yrs & up) Social Monthly dues are $ Senior 80 includes the use of ALL facilities of The Savannah Country Club. Tennis includes the use of all facilities of The Savannah County Club except golf. Monthly dues are $ Senior Tennis includes the use of all facilities of The Savannah Country Club except golf. Monthly dues are $ Social includes the use of all facilities of The Savannah Country Club except golf and tennis. Monthly dues are $145.00

3 I do hereby submit my application for membership to The Savannah Country Club. (the Club ). I have initialed the category of membership for which I am applying. I further initialed the method of payment I wish to use in paying my monthly charges and have signed the past due charge authorization section. I have provided a valid MasterCard or Visa Card through the Bank of my choice or a valid Discover Card or American Express. The undersigned, hereinafter referred to as Applicant, hereby applies for membership to The Savannah Country Club, hereinafter referred to as Owner, for the right to use the club facilities as applied for and as defined below, subject to the terms hereof and to the terms of those rules and regulations formulated from time to time by the Officers and Directors of the Owner. Applicant hereby agrees that acceptance of this application by the Owner, the Applicant s rights with respect to the Club shall be in accordance with and subject to the following: 1. CLUB. The Club is hereby defined to consist of and include the golf course, swimming pool, tennis courts, clubhouse and pro shops located on the property on Wilmington Island in Chatham County, Georgia, known as The Savannah Country Club. 2. LICENSE. Applicant shall have the privilege to use portions of the Club to which the application applies, subject to the terms of this agreement and further subject to the rules from time to time promulgated by the Club, until this agreement is terminated. 3. FEES. Applicant has heretofore paid, or shall pay upon delivery of this application to Owner, an initiation fee of $ and will pay the entire amount with this application or in the appropriate payments as described in the application, for the right to use the Club. Such initiation fee shall be non-refundable unless Applicant s rights hereunder are terminated without cause by the Club as provided in Paragraph 5 hereof. In addition to the initiation fee, applicant acknowledges that to maintain the right to use the Club, Applicant shall pay the monthly dues and any assessments from time to time set by the Board of Directors of the Club, and shall pay for goods and services purchased at the Club. 4. RULES. Applicant acknowledges receipt of a copy of the Club Rules. Club through its Officers and Directors may, at any time and from time to time and at its sole discretion, modify, expand, or eliminate any of the Rules, provided that such charges are in writing and are available at the Club for inspection by Applicant. The Rules as they exist on the date this agreement is signed and any subsequent amendments thereto are incorporated into and made a part of this agreement. Applicant shall at all times abide by and comply with the Rules. Any breach of the Rules by Applicant shall give Club the right to terminate the Applicant s right to use any portion of the Club or Applicant s membership. 5. TERMINATION. Club may also at any time after notice terminate this agreement with Applicant, for cause, upon breach of any term or condition hereof by Applicant, including but not limited to non-payment of dues, fees, charges or assessments, or breach of the Rules. Upon such termination, for cause, there shall be no refund of the Initiation Fee or any dues paid prior to the time of termination. Club may also at its sole discretion terminate this agreement at any time, without cause and without prior notice to Applicant. Such termination will take effect upon date of mailing of notice of such termination without cause. If membership of Applicant is terminated without cause, Club will owe to Applicant the Refundable Amount of Applicant s Initiation Fee (without interest), and any prepaid dues. The Refundable Amount is computed by reducing the original Initiation Fee by 20% for each full twelve (12) successive month period during which the Applicant has been a member of the Club. Payment of any refund by Club may be deferred at Club s discretion for a period of up to forty-five (45) days from the date that notice of termination was sent to Applicant. Upon termination of this agreement for any reason, Applicant shall have no further rights hereunder (except the right to payment of the refund for termination without cause). However, Applicant shall remain liable to Club for any unpaid fees, assessments and dues that have accrued prior to termination and for any unpaid charges by Applicant for goods and services from the Club. 6. LIABILITY. Applicant, for him/herself, any member of his/her family, or any other party using the Club as a guest of Applicant, agrees that Club shall not be liable to Applicant or any member of Applicant s family or any other party using the Club as a guest of Applicant for any loss, injury, death or damage resulting from the sole negligence of Owner. 7. FAMILY. The Initiation Fee paid hereunder by Applicant shall, unless Club is given written notice to the contrary, entitle Applicant s spouse and unmarried child or children under the age of twenty-one (21) residing

4 with the Applicant to use the portions of the Club covered hereby, subject to the provisions hereof and the Rules. Applicant shall be responsible for the action of such family members as well as any bills or charges incurred by them at the Club and any damage done by them to Club facilities, and any violation by any such family member of the Club Rules shall constitute a violation by Applicant. 8. ASSIGNMENT AND TRANSFER. Applicant shall not have the right to transfer or assign any rights or obligations hereunder. 9. APPLICABLE LAW. This agreement shall be governed by and construed and enforced in accordance with the laws of the State of Georgia. 10. ENTIRE AGREEMENT. This agreement contains the sole and entire understanding between Owner and Applicant with respect to the Club, and all promises, inducements, offers, solicitations, agreements, representations, and warranties heretofore made are merged into this Agreement. This Agreement shall not be modified or amended in any respect except by written agreement executed by or on behalf of the parties to this Agreement in the same manner as this Agreement is executed. 11. SEVERABILITY. If any term or provision of this agreement is held illegal, invalid, or unenforceable, such illegality, invalidity, or unenforceability shall not affect the legality, validity, or enforceability of the remainder of this agreement.
