Competitive open tenders in separate sealed covers superscribed with the name and number of tender are invited in two bid system (in two identical copies) for the supply of Medical Gases for Regional cancer Centre, Trivandrum Due date and time for receipt of tenders : 20/04/ PM Due date and time of opening of bids : 21/04/ PM Cost of tender form ( non refundable) : Rs. 3780/- (Rs % Tax) 2. Tender Application for tender form should be accompanied by DD/Cash/money order remittance of Rs 3780/- which is the price fixed for the original form/set of forms and is not refundable under any circumstances. Tender form is not transferable. 3. In addition to the above, the tender notices are available in the RCC website for downloading from the computer by the prospective tenderers. The cost of tender document i.e Rs 3780/- can be paid in the form of Demand Draft drawn in favour of Director, RCC, Trivandrum while submitting their tender document. The DD should be kept along with the Technical Bid only. 4. The tender documents should contain two parts namely Technical Bid and Financial Bid. Technical Bid - Cover No 1 :- (a) Tender document duly signed and sealed by the tenderer in each page (b) Detailed technical specification of the product quoted (c) Agreement in Kerala Stamp Paper worth Rs.100 (d) DD for Rs 3780/- towards cost of tender form if downloaded from Computer. (e) Earnest money deposit of Rs Rs /- (f) Document for EMD exemption if applicable (g) Payment conditions 1/4

2 Finance (Price bid) Cover No 2 :- (a) (b) (c) Price of the product quoted. If VAT is extra, % of VAT should be clearly mentioned. Any other charges like freight, insurance etc. 5. The tenders duly filled and signed by the tenderers alongwith necessary documents shall be submitted to the Director, Regional cancer Centre on or before 4 PM on 20/04/2015. The tender terms and conditions be clearly typed or legibly written giving the full name and address of the tenderers. The tenderers should quote the rates and amount in figures as well as words tendered by them. The tenderers should take care that the rates and amounts are written/typed in such a way that interpolation is not possible and no blank space should be left. Alterations, if any should be attested by the tenderer with their full signature and seal. The Earnest Money Deposit (EMD) of Rs 24000/- shall be submitted by way of Demand Draft, Deposit Receipt or Bank Guarantee in favour of Director, regional Cancer Centre, Trivandrum. If you are submitting Bank Guarantee, it validity should be up to one year. 6. Earnest Money Deposit (EMD) is exempted in the following cases. If the tenderer comes in any of the following category, they should upload the scan copy of the relevant certificate counter signed by the tenderer in technical bid for EMD exemption. (a) Firms who are registered with the Stores Purchase Department or the Directorate General of Supplies and Disposals, New Delhi are exempted from furnishing EMD for tenders in respect of stores by which they have registered as suppliers of stores. (b) Micro and small enterprises and Industrial Co-operatives within the Kerala State which are certified as such by the Director of Industries and Commerce or by the General Manager, District Industries Centre are exempted in respect of certified items from furnishing EMD in support of tenders. (c) The Khadi and Village Industries Co-operative Societies and the Institutions registered under the Travancore Cochin Literary, Scientific and Charitable Societies Registration Act, 1955 within Kerala State which are certified as such by the Secretary, Kerala Khadi and Village Industries Board are exempted from furnishing EMD in support of tenders. (d) Micro, Small & Medium enterprises registered with the National Small Industries Corporation Limited, New Delhi and in respect of which competency certificates are issued by the Corporation will be exempted from payment of EMD. (e) Government Institutions/Kerala State Public Sector Undertakings which manufacture and supply stores are exempted from furnishing EMD. (f) Kerala State Small Industries Development Corporation Ltd when it participates in tender on behalf of Small Scale Units will be exempted from furnishing EMD. 2/4

The technical bids will be opened at 2 PM on 21/04/2015 at RCC Main Conference Hall near to Director s Office in the presence of such tenderers or their authorized representatives who may be present at that time. The financial bid of technically qualified firms will be opened at a later stage and the date will be intimated. 8. The details of Medical Gases/services required by RCC is as under :- (a) Medical Oxygen - A type (b) Medical Oxygen - B Type (c ) Medical oxygen - Bulk ( D Type) (d) Medical N 2 O - A type (e ) Medical N 2 O - Bulk (D type) (f) Carbon Dioxide (g) Nitrogen (h) Cylinder Testing (i) Cylinder Painting (j) New Valve/Bulk Valves (k) New cap (Valve Guard) (l) New Spindle (m) Hydraulic Testing 9. The contract is for one year from the approval of tender and order placing. 10. Terms and conditions :- (a) (b) (c) (d) The offered rates should be firm and free delivery at Regional Cancer Centre Trivandrum for a period of one year from the date of approval of the tender and order placing. No price escalation clouse will be accepted in the above period. The unloading of filled cylinders and loading of empty cylinders will be arranged by Regional Cancer Centre. The supply should be done as per the requirements and instructions by Engineering Department of Regional cancer Centre. Visual examination, stamping etc should be properly maintained and certificate to that effect should be issued. 3/4

4 (e) (f) (g) (h) (i) (j) Any action on the part of tenderer to influence anybody of the institute will make his tender liable to rejection. The supplier should have the conformity with CGMP regulations for the manufacturing/supply of all medical gas cylinders which are to be supplied at Regional Cancer Centre, Trivandrum. Suppliers shall supply properly colour coded, hydrostatic tested and clearly labeled (date of filling & testing etc) cylinders to Regional Cancer Centre, Thiruvananthapuram. Suppliers shall replace the fully filled cylinders with no additional cost, if any valve assembly leaks are detected and out dated labels found on supplied cylinders. The successful tenderer has to submit an agreement in Kerala Stamp paper worth Rs 100 and a Security Deposit of 5% of the total value of the order with in 15 days from the date of receipt of Purchase Order. This deposit amount will be refunded only after the successful expiry of the contract period. Director, Regional Cancer Centre, Trivandrum reserves the right to accept or reject and cancel all or any tender at his sole discretion without assigning any reasons. 5 AGREEMENT Articles of agreement executed on this the...day of... between the Director, Regional Cancer Centre (hereinafter referred to as the Director ) of the one part and Shri... (H.E name and address of the tenderer) (hereinafter referred to as the bounden ) of the other part. WHEREAS in response to the Notification No 29/RCC/14:15/P4 dated 20/03/2015 the bounden has submitted to the Centre a tender for the supply of Medical Gases subject to the terms and conditions contained in the said tender. WHEREAS the bounden has also deposited with the Regional Cancer Centre a sum of Rs 24000/- as earnest money for execution of an agreement undertaking the due fulfillment of the contract in case his tender is accepted by the Centre. NOW THESE PRESENTS WITNESS and it is hereby mutually agreed as follows ; 1. In case the tender submitted by the bounden is accepted by the Centre and the contract for supply of Medical Gases is awarded to the bounden, the bounden shall within 15 days of acceptance of his tender execute a agreement with the Director incorporating all the terms and conditions under which the Centre accepts his tender. 2. In case the bounden fails to execute the agreement as aforesaid incorporating the terms and conditions governing the contract, the Centre shall have power and authority to recover from the bounden any loss or damage caused to the Centre by such breach as may be determined by the Centre by appropriating the earnest money deposited by the bounden and id the earnest money is found to be inadequate the deficit amount may be recovered from the bounden and his properties movable and immovable in the manner hereinafter contained. 3. All sums found due to the Centre under or by virtue of this agreement shall be recoverable from the bounden and his properties movable and immovable under the provisions of the Revenue Recovery Act for the time being in force as though such sums are arrears of land revenue and in such other manner as the Centre may deem fit.
