Sealed tenders are invited in two separate envelopes (one for techno-commercial bid and second for price bid) by Supdt. Engineer, Gujarat State Electricity Corporation Ltd, Kadana Hydro Electric Project, Diwada colony , Dist: Panchmahal on payment of tender fee in cash or by demand draft payable to Gujarat State Electricity Corporation Ltd., drawn on BOB Diwada Colony. In case, tenderer desires to purchase tender by Post, tenderer shall have to pay additional Rs.50/- alongwith tender fee, towards postage charges well in advance to issue tender in time. In case of late receipt of tender by tenderer, sent through post, GSECL shall not be responsible for the same. 1.2 The tender will be received only by Regd. Post A.D. / Speed Post addressed to Supdt. Engineer, Gujarat State Electricity Corporation Ltd, Kadana HEP, Diwada colony , Dist: Panchmahal. 1.3 Firms registered as a Small Scale Industries (SSI) with NSIC are exempted from payment of EMD, if they furnish a notarized true copy of their latest valid Registration alongwith the bids. 1.4 Tenders submitted without Earnest Money Deposit by those bidders who are not eligible for getting exemption from its payment will be rejected and no correspondence in this regard shall be entertained. 1.5 Techno-commercial Bids and Price Bids will be opened on the date and time specified above in the office of the Supdt. 3 1.6 Issue of tender documents to any party will not automatically qualify the party as to its capability etc. to execute the work / supply and GSECL shall assess the capability of the party at the time of evaluation of bids. 1.7 All required documents should invariably be submitted along with technocommercial bid, otherwise offer will be ignored. 1.8 For Technical scrutiny documents, copies of the papers regarding similar type of work executed in GSECL/other Electricity Board s/govt. & Semi Govt. Ref: This Office advertisement No. KHEP/TECH/10/3/07 Dear Sir, Tender documents are for the work of Repairing, Renovation & fixing of components for Sumesh make 5000 LPH Transformer oil filter machine at KHEP as specified in attached schedule-b material specification and as per specifications of material, quantity and conditions mentioned. Any clause, condition or term of your offer and/or your acknowledgment letter which is repugnant to or in consistent with the terms and conditions of this tender and schedule attached hereto, shall be void and of no force and effect unless specifically approved and expressly modified by the GSECL. You will also be deemed to be fully aware of the GSECL s general conditions of contract for the work of plant, equipment and materials and any ignorance of these conditions will not exempt you from your liability to abide by the same. However if you need, you may ask for the copy of the booklet of the GSECL s having General Terms & conditions. 2.1 Gujarat State Electricity Corporation Ltd. invites offer in accordance with this Tender No.KHEP/TECH/10/3/07 from well experienced and resourceful contractors who have executed similar type of work order in GSECL / Govt. / Semi Govt. / Public Sector undertaking / Big Industrial house. 2.2 Bidder has to submit the details of the similar work order executed by him. Tenders without such details will be liable to be rejected without any correspondence. 2.3 The Bidder shall be responsible for obtaining all the clearances if required for work order at his cost. 2.4 The bidder has to quote his firm and fixed price item wise in Schedule B. This price will remain firm and fix throughout the term of contract. No price escalation will be permitted on any account. Tender will be evaluated based on this quoted amount. 2.5 The tender should be submitted in two parts / covers-a&b as under: a) TECHNO-COMMECIAL BID i.e. PART/COVER-A. b) PRICE BID i.e. PART/COVER-B. c) DD/ Receipt of Tender Fee and EMD ( DD/ Receipt of Tender Fee and EMD should be placed in a separate cover superscribing EMD cover. Engineer, Gujarat State Electricity Corporation Ltd, Kadana HEP, Diwada colony , Dist: Panchmahal. 2.7 If the tenderer, wishes, he may familiarize himself with the site conditions by contacting Purchaser's site offices/premises. For this purpose the tenderer should write to the Supdt. Engineer, KHEP, GSECL, Diwada colony , Dist: Panchmahal (giving tender No. etc.), who will give necessary instructions in the matter. 2.8 As this is a two-part bid method, the bidder will be assessed based on its Technical qualifying documents submitted in Cover-A. If he qualifies then only price bid Cover-B (filled up in Schedule-B) will be opened, otherwise, i.e. price bid of technocommercially qualified bidders will be opened. 2.9 Rates should be quoted unconditional. Conditional tenders will not be accepted Bidder has to submit his offer by R.P.A.D. only, super scribing name of Tender & due date of opening on Technical bid, price bid and EMD cover. 6 2.11 The general terms and conditions relating to supply as standardized by the GSECL, but not specifically brought out herein shall also be made applicable to the proposed contract and will be binding to the successful tenderer The contractor shall indemnify the GSECL against all suits, actions, Proceedings, etc. arising out of any claim or demand for breach of any rules, regulations, default, etc. on part of the contractor, his agents or servants in the course of performance of this contract The GSECL shall not be responsible for any loss / damage to the property of the contractor or any injury fatal / non-fatal to him or any of his agents or servants during the course of performance of the contract It shall be the sole responsibility of the contractor to maintain all relevant Forms registers or record in accordance with the various statutes, laws, enactments, etc The detailed scope of work and time limit are indicated in Section The contractor not having P.F. 7 Section 3 General terms and conditions of contract SPECIFICATION: Specification shall mean the specification annexed to these general conditions and the schedule thereof (if any) Tender papers are not transferable. Tender Fee paid for Tender paper is not refundable This tender is invited for the work of KHEP/TECH/10/3/07 for Repairing, Renovation & fixing of components for Sumesh make 5000 LPH Transformer oil filter machine at KHEP In case of divergence between rates in figures and words, it will be constructed to read the rates most favorable to the GSECL NO TENDER WILL BE CONSIDERED UNLESS FOLLOWING DETAILS ARE SUBMITTED IN SEPARATE ENVELOPE OF EMD COVER. (i) (ii) The Earnest Money Deposit as specified in tender is paid along with tender. The required details as specified in Clause No are not submitted along with offer. 1. Names of partners and other details are not indicated EARNEST MONEY DEPOSIT: The Earnest Money should be paid by in Cash or by a Demand Draft in favour of GUJARAT STATE ELECTRICITY CORPORATION LTD. on Bank of Baroda at Diwada Colony. E.M.D. in cash will be accepted up to Hrs. P.M. up to the date of opening of the Tender. Tenders without E.M.D. or with part payment of E.M.D. will not be considered in any circumstances. The details of E.M.D. paid should be submitted separately in a letter giving details of payment of E.M.D. i.e. Cash or Demand Draft and GSECL s Money Receipt No. In no case Demand Draft for E.M.D. should be put inside the cover containing tender, such tender may not be considered No interest will be paid on E.M.D The E.M.D. of those successful Bidder will be liable to forfeited who do not accept GSECL s order or if Bidder withdraws their offer during the stipulated period of validity of offer PERIOD OF CONTRACT & TERMINATION: The contract shall be valid for period stipulated in section 4 under the heading time limit GSECL reserves the right to terminate the contract at any time without assigning any reasons whatsoever by giving fifteen days notice in writing. The contractor(s) shall not be entitled any compensation by reasons of such termination of contract. 3.4 SECURITY DEPOSIT: Contractor shall have to remit amount of security 5% of ordered value within 15 days. Such amount can be paid by cash or by Demand Draft drawn on Bank of Baroda, Diwada Colony Branch favouring GUJARAT STATE ELECTRICITY CORPORATION LTD. only. You can keep your security deposit against Performance Guarantee if you desire The security deposit shall be refunded only after completion of the contract or on its termination. The GSECL reserves the right to recover any dues, outstanding against contractor from S.D. or towards any loss caused to the GSECL by neglect or default of the contractor, his servants or agents. 8 3.4.3 If contractor fails to carry out work as per order & terms & conditions as laid down in booklet of Tender & Contract for works in such case, S.D. shall not be refunded & will be forfeited, at once No interest will be paid on S.D. Amount. 3.5 VALIDITY:- The validity of Offer shall be not less than 120 days from the date of opening of Tenders by the GSECL and they shall be legally bound to honors any commitment relating to tenders during this period including accepting of work order. In case of non-compliance, E.M.D. will be forfeited apart from taking any other action as may be considered suitable under the circumstance. 3.6 GENERAL TERMS AND CONDITIONS OF WORKS: GSECL will check that all the required standard for personnel engaged in labour contract and documents such as. 1) Labour Licence. 2) Insurance coverage. 3) Regional Provident Fund Commission registered code no. 4) Solvency certificate. 5) Experience certificate The contract labour force should be experience contractor / who have executed the work previously Contract will be initially for the period as per requirement of the GSECL. The contract can be terminated by the GSECL giving 15 days notice if the performance of the party is not found satisfactory You shall have to make your own arrangement for residential accommodation etc. for your worker staff. However if needed hostel accommodation can be given if possible charging the amount of Rs.50/- per day per person GSECL will reserve the right of retrenching or dismissing any labour of the whole contingent of contract. If there is any complaint against any personnel of your staff regarding misbehaving or misconduct or disloyalty towards the job then such personnel should immediately be removed on written request from our SUPDT. ENGINEER of Kadana Hydro Electric Project The contract rate shall include for any incidental and continent work although not specifically mentioned in the contract but is necessary for its completion in an efficient and workmen like manner No part of the contract nor any share of interest therein shall in any manner or degree be transferred assigned or subletted by contractor directly or indirectly to any person, firm or corporation whatsoever The contractor shall be responsible for the proper behavior of the persons employed by him and exercise control over them. He shall also be bound to prohibit and prevent his employees for taking any direct or indirect interest and / or support, assist, which may be any way be detrimental or prejudicial to the interest of the GSECL, community or of the properties or occupiers of land / properties in the neighborhood. In the event of any such action by his person or persons, contractor shall keep the GSECL harmless and indemnified from any consequential claims, actions, suits proceedings, losses or damages or any ground whatsoever All persons of the contractor entering on work premises shall be properly and neatly dressed and shall wear badges while working on premises of the GSECL including work site. 9 In case GSECL considers presents of any of the labour of the contractor undesirable for whatever reasons including integrity, conduct, competency 24 hours notice in writing will be given by the GSECL to the contractor. On receipt of said notice, such a labour will not be reemployed without the express and written authorization of officer in charge of the GSECL Any failure on the part of the GSECL at any time to enforce the strict observance of the performance of any of the terms and condition of this contract or non-expressed of any right mentioned in the contract shall not constitute a waiver of such terms, conditions of rights and shall not effect or deprive the GSECL to exercise the same at any later stage GSECL shall not be liable for or in respect of any damages or compensation for any injury or for any occupational disease peculiar to the employment to any person engaged through the contractor and the contractor shall keep the GSECL Indemnified thereof The contractor shall ensure that all labour are provided with the protective clothing like the helmets, gloves, safety shoes etc. as may be required from safety points of view and all his persons shall follow the instructions issued by the GSECL from time to time in connection with safety and security During the currency of job, if the work progress does not commensurate with the time elapsed in respect of any person / persons engaged, the contractor shall be liable to pay the GSECL compensation as may be considered reasonable by the G.E.B Final payment will be made only after satisfactory completion of the work The GSECL for any reason whatsoever and of which the GSECL shall be the sole judge may terminate this contract by giving notice of 03 day and the contractor and his labour shall vacate the site work place on the expiry of such period. In the event of such termination of the contract the contractor shall be paid for all the work executed up to the period of termination including refund of security deposit subject to deduction of any dues, penalties, other recoveries etc., within a stipulated period of the discretion of officer in charge The contractor shall be liable for making good all damages, losses arising out of theft, breakage, pilferage of any office furniture equipment s, fittings and fixture whatsoever as may be caused direct or indirectly by the person engaged through him and work carried out by them Contract shall inclusively be liable for non-compliance of the provision of any acts, laws, rules and regulations have bearing over engagement of workers directly or indirectly execution of work and the contractor hereby undertake to indemnity the GSECL against all actions suits proceeding claims, losses, damages etc., Workman Compensation Act., Persons Injury (compensations insurance) Act., EST Act., Fatal Accidents Act., Industrial Dispute Act., Shops & Establishment Act., Employees Provident Fund Act., Family Pension and Deposit Linked Insurance Scheme any other or status not herein specifically mentioned but having direct or indirect application for the person engaged under this contract. 10 Contractor has to execute an agreement on Stamp of Rupees hundred cost of which is to be borne by the contractor. 3.7 CONTRACTOR S UNDERTAKING: - I / We have carefully read all the terms and conditions contained in these specifications and am / are agreeable to the same. In taken thereof, I / We have laid out signature and seal here under. The Bidder must return be entire specification sheets along with the bold offer duly signed. 3.8 If the contractor is not carried out the same work, GSECL can be carried out this work by the other party at the risk & cost by the contractor and recovered of the w.o. amount of 15% supervision charges. 11 SECTION - 4 SEPCIAL TERMS AND CONDITION. 4.1 ACCURANCY OF LINES, LEVELS AND GRADES. The work shall be true to line, level and grade. The periodical checking of these by the GSECL's staff shall not relieve the contractor from his responsibility regarding the accuracy and quality of the work. In case of any deviation or discrepancy in line, level or grade at the meeting faces, the contractor shall make good the discrepancy at his own cost and without any extra compensation for the additional work involved. 4.2 SPEED OF WORK: The contractor shall at all times, maintain the speed of work. The contractor has to arrange sufficient resources for maintain the speed of work at his own cost. 4.3 ERRORS, OMISSIONS AND DISCREPANCIES: - In all the cases of errors, omissions doubts or discrepancies in the dimensions or discrepancies in the drawings and items of work in specifications, references shall be made to the SUPDT. ENGINEER whose decision is final. The contractor shall be hold responsible for any error that may occur in the work through lack of such reference and precautions. 4.4 TIME LIMIT: The time limit for completion of work is 01 MONTH from the date of issue of the work order / site clearance given. 4.5 SAFETY MEASURES: The contractor shall take all necessary precautions for the safety of the workers. 4.6 PROVIDENT FUND AND FAMILY PENSION SCHEME: The contractor shall submit along with his bill (Month wise) a statement regarding deduction against employee s provident fund and family pension scheme in respect of each concerned employees. Providing fund and family pension scheme is at the rate of 12% (or at the rates made applicable from time to time by Government) of the wages. The contractor s contribution and his workers contribution towards provident fund and family pension scheme shall be deposited by the contractor with Regional provident fund commissioner Ahmedabad. 4.7 TOOLS & PLANTS: All the required machinates, tools and tackles shall be arrange by contractor at this own cost. 4.8 INSURANCE: The contractor shall procure or arrange for the sub contractor to procure insurance coverage in amount sufficient to protect against the following risks arising out of the work. Accidents and professional and non professional sickness of all laboures and personnel engaged in the work as required by law pursuant to work men s. Compensation Act Injury or death to third party including without limitation injury or death caused by any of the construction aids or other vehicles or rented equipment used by the contractor or sub contractor whether at the site or else where. Damage to contractor tools, plants, construction equipment, form works, scaffolding, construction material due to any come. The cost of the insurance shall be borne by the contractor. 12 4.9 COMPENSATION FOR DELAY: Compensation for delay as per clause No. 3 of the Tender and contract for works booklet shall apply in the event of work not completed in time. The time allowed for carrying out the work shall be strictly observed by the contractor. In failure of the completion of work in stipulated period, the contractor shall pay as compensation for delay an amount equal to one present or such smaller amount as the competent authority may decide of the amount of the contract cost of whole work for everyday that the work remains uncommented or unfinished after the proper date. Provided that the total amount of penalty shall not exceed 10% of the contracted cost of the work as shown in the tender TERMS OF PAYMENT: 80% payment will be made against TRC within 60 days and balance against S.R. Note within 75 days from the date of receipt of material at site in good condition subject to availability of fund. OR, Payment will be made by running account bill monthly after taking joint measurement and following procedure given in clause 10 to 11 of the Tender and contract for works booklet. No R.A. Bill payment shall be made before executing the agreements. The final joint measurement of the completed work and final bill prepared and will be paid as soon as possible there after TECHNICAL SPECIFICATION: The work shall be carried out as per the detailed specification issued in the tender and any sub-sequent modification in specification issued by the GSECL if necessary AGREEMENT: As per GSECL s rules, you will have to enter in to an agreement with the GSECL on stamp paper of appropriate value in the prescribed form within 15 days of issue of work order. The cost of the stamp paper fee shall be borne by contractor. The tender with the specification, schedule B and contract booklet shall be signed by the contractor UNSATISFACTORY PROGRESS OF WORK: If the work is found unsatisfactory or not progressing according to schedule given by the GSECL, the GSECL may take such action as may be deemed fit to see that the work is completed in time at the risk and cost of the contractor FAILURE TO EXECUTE THE ORDER: In case of failure to cope up with the works within the specified period, the same will be got executed through other agency at the risk and cost of you even at higher rates, and the difference in the amount any will be recovered from you PENALTY: You have to complete the work within stipulated period of 15 days for each transformer. In case any delay is there beyond stipulated period, penalty of ½ % (Half percent) per week of the order value maximum up to 10 (Ten) % will be charged GUARANTEE: You have to give performance guarantee for the trouble free operation of the transformer for the period of one year from the date of charging the transformer, for the work attended only. During this period, if any defect/trouble found in transformer, it will be attended by contractor at free of cost. During execution of work any damage to the transformer, any property of GSECL or part there of will have to be repaired/replaced free of cost by you. All major repairs/replacement work noticed other than the scope of works during inspection will be attended by you at an extra cost. The reasonable cost will be decided mutually. Tender No KHEP doc
