PURPOSE AND SCOPE In adpting this Plicy, NHS Dumfries & Gallway recgnises the value f secndments in creating a mre flexible rganisatin respnsive t the mdernisatin agenda by increasing staff knwledge, abilities and skills thrugh bradening their experience and sharing resurces acrss all rganisatins prviding health and scial care in Dumfries & Gallway This Plicy has been develped n behalf f ur Partnership Frum and emplyees within NHS Dumfries & Gallway frm existing gd practice, the Secndment Pin Plicy dcument and t cnfrm t Emplyment Law. This Plicy is designed t: Prvide pprtunity t make full use skills and experience f staff acrss rganisatinal bundaries Prvide equitable access t learning and develpment pprtunities within NHS Dumfries & Gallway Prmte the develpment f learning and develpment plans linked t service plans and persnal develpment plans Ensure effective cmmunicatin and accuntability arrangements are in place fr all secnded staff The scpe f this plicy is Bard wide. 2. POLICY AIMS 2.1 This plicy aims t: ensure that all plicies, prcedures, guidelines and guidance dcuments are in line with NHS Dumfries and Gallway purpse and bjectives. detail the prcesses fr the develpment, implementatin and review f plicies, prcedures and guidelines in NHS Dumfries and Gallway. detail the management respnsibilities, and supprting rganisatinal and mnitring arrangements fr ensuring that plicies, prcedures and guidelines are cmplied with. define what is meant by strategy, plicy, prcedure, guideline and guidance dcument 2.2 NHS Dumfries & Gallway defines Secndment as the temprary lan f an emplyee t anther rganisatin, r t a different part f the same rganisatin fr a specific purpse fr a specific time t mutual benefit f all parties. 2.3 This Plicy applies t all secndments f 3 24 mnth duratin perid. Secndments will nt last lnger than 24 mnths, depending n circumstances, but may be extended, by mutual agreement. The perid f secndment will be agreed and clearly defined in a Secndment Agreement, signed by all parties cncerned, e.g. secnding manager/rganisatin, the secndee and the hst manager/rganisatin. 4 2.4 It shuld be nted that frm June 2010, the rganisatin was required t implement a prcess fr the management f vacancies, including secndments. The rganisatin s Hiring/Authrising Vacancies/Redeplyment Cntrl Grup will cntinue t review, n a weekly basis, all vacancy staff cntrl frms, including secndments, and apprval must be received prir t advertising a secndment. 2.5 The Plicy specifically includes: Internal secndment pprtunities within NHS Dumfries & Gallway Internal secndment with NHS Sctland, e.g. ther NHS Bards r Scttish Executive External secndment, e.g. Lcal Authrity, Trade Unins, Prfessinal Organisatins and Vluntary Sectr. 3. RESPONSIBILITIES AND ORGANISATIONAL ARRANGEMENTS 3.1 It is the respnsibility f the Wrkfrce Directrate t ensure the cntents f the Secndment prcess is maintained. NHS Dumfries & Gallway recgnises the fllwing: Secndment pprtunities shuld be made available fr all staff and these will nt be unreasnably refused; Secndment pprtunities may arise thrugh a variety f circumstances. The mst bvius f these shuld be identificatin f a jb requiring t be dne and shuld be advertised by the nrmal recruitment methds, with all vacancies being reviewed by the afrementined Hiring/Authrising Vacancies/Redeplyment Cntrl Grup; Individuals may als identify thrugh appraisal and review their develpment needs. In these circumstances individual secndment arrangements will apply; Arrangements fr accessing secndment shuld take accunt f the fllwing pints; Clear reasns identified fr secndment Clear arrangements fr start and finish dates Training requirements and training needs during and fllwing a perid f secndment Replacement csts Statutry bligatins Appraisal arrangements What the benefits are Mnitring arrangements fr this shuld be clearly dcumented by relevant manager within the secndment cntract T cnsider all secndment requests and nly refuse a request if there are clear, demnstrable business reasns why it is nt practicable. 5 Reasns fr refusal shuld be cmmunicated t the emplyee in writing and a recrd f refusal and its reasns sent t the crdinatr 3.2 Terms and Cnditins f Emplyment Secnded staff are entitled t maintain their terms and cnditins f emplyment. Where the terms and cnditins fr the secndment pprtunity wuld be greater r lwer than thse in the substantive pst, the apprpriate terms and cnditins f the secndment pst wuld apply fr the temprary perid f secndment. Fr certain staff, the statutry requirements fr maintenance f prfessinal registratin, must be explicit within the secndment arrangements. Secndments ut with the NHS may require a return t NHS duties fr shrt perids during the term f secndment t assure registratin. Arrangements fr appraisal and Persnal Develpment Plans will be clearly dcumented in the secndment cntract, particularly fr thse staff n Executive, Senir Manager terms and cnditins. In such circumstances the hst emplyer will cmplete the dcumentatin fllwing NHS Dumfries & Gallway appraisal system. Where secndment is t a pst f a higher substantive band; credit will be given fr time spent in this pst in line with Agenda fr Change terms and cnditins f service. Agreement must be reached at the start f the secndment regarding arrangements fr review. The perid fr review will be specified in the secndment cntract. Secndment pprtunities shuld be allwed t run their curse. Hwever, the rganisatin reserves the right, in exceptinal circumstances, t recall staff prematurely if required. Terminatin, prir t expiry f the secndment, will nrmally be subject t an agreed ne mnth perid f ntice. The emplyee wh is in pst t backfill the Secndee wuld therefre be given ntice as per the Fixed Term Cntract Plicy. Hst Manager T fulfil their agreed bligatins under the secndment agreement, including: Liaising with the Secndee s Accuntable Manager in rder t have input t any appraisal utcmes/ perfrmance issues Liaising with the Secndee s Accuntable Manager n any prpsal t change, terminate r extend the secndment. 6 3.3 Cntinuity f Emplyment Time spent n secndment with anther emplyer within r ut with the NHS will nt adversely affect cntinuity f emplyment. In circumstances where the emplyee s substantive rle may nt be available fr their return, then this must be understd and agreed by the Accuntable Manager and the Secndee prir t the cmmencement f the secndment, r at the time f any subsequent prpsed extensin. In such cases, r where the substantive pst is subsequently subject t change during the secndment, relevant rganisatinal change prvisins will apply. In all cases the Accuntable Manager shuld seek guidance frm HR. In circumstances where a secndment is refused and the emplyee seeks t undertake the pprtunity n a fixed term basis, t liaise with HR t ensure that the emplyee is fully aware f the circumstances as utlined in the Fixed Term Plicy. 3.4 Befre the Secndment Secndment agreements must be cmpleted and authrised by the necessary parties in advance f the secndment cmmencing, In all instances a clear ratinal fr Secndment will be identified, alng with an apprpriate Persn Specificatin / KSF Outline, utlining the Knwledge, Skills and Experience required, what training will be given and the benefits t bth the rganisatin and the individual. The Secndment Cntract (attached) will clarify and cntain start and finish dates, appraisal and mnitring arrangements, csts and statutry bligatins. 3.5 During the Secndment Effective inductin is essential. Where apprpriate the hst rganisatin shuld rganise a briefing package fr the secndees, prviding backgrund infrmatin n the rganisatin, functins f the hst wrkplace, duties and respnsibilities f the pst, ffice prcedures etc. The implementatin f the Secndment Cntract will be frmally mnitred by relevant manager thrughut the perid f secndment, including any Inductin and Persnal Develpment Plan. Secnded staff are entitled t maintain their Agenda fr Change terms and cnditins f emplyment. 7 Secndments ut with the NHS may require a return t NHS duties fr shrt perids during the term f secndments t assure registratin. Fr secndments that cmmence part way thrugh an appraisal year r where the secndment is fr less than 12 mnths duratin, then appraisals will be undertaken jintly by the hst rganisatin/department and the emplyee s substantive line manager. Secndment pprtunities shuld be allwed t run their curse. Hwever, in exceptinal circumstances, the rganisatin reserves the right t recall staff prematurely if required. Likewise, the secndee has the right t request t return t their substantive pst. Terminatin, prir t expiry f secndment, will nrmally be subject t an agreed perid f ne mnth. Time spent n secndment with anther emplyer within r ut with the NHS will nt adversely affect cntinuity f emplyment. 3.6 Keeping in tuch during Secndment Keeping in tuch with staff n secndment thrughut the perid is essential. Arrangements fr this shuld be clearly dcumented. The respnsibility fr this is mutual, where bth the secndee and their Line Manager will be respnsible fr keeping in tuch. The Line Manager will act as the cntact pint and keep the secndee in tuch with develpments. Accunt must be taken f individuals' requirements, including: Mnitring arrangements Appraisal Maintaining prfessinal registratins Evaluatin f secndment Retraining requirements upn return frm secndment All staff undertaking a secndment pprtunity must have an effective inductin prgramme. 8 3.7 After the Secndment Secndments will be evaluated against the bjectives as set ut at the start f the secndment and Persnal Develpment Plan by the Hst Manager. Frmal plans shuld be put int place fr the secndee by the Line Manager t be re-intrduced t their substantive pst. The Secndment Plicy applies t all secndments f 3 24 mnth duratin perid. Secndments will nt last lnger than 24 mnths, but may, in exceptinal circumstances by mutual agreement. Only in exceptinal circumstances shuld a secnd perid f secndment be cnsidered and HR staff must be cntacted if a third perid f secndment were t be cnsidered. Secndments will nt autmatically lead t permanent psitins withut applicatin f NHS Dumfries & Gallway Recruitment Plicy. Fllwing cmpletin f the Secndment: 3.8 Expenses Secndees might find it valuable t maintain the cntacts and netwrks they have built Secndees shuld reprt back t clleagues and managers n their return and t ffer advice t fellw clleagues cnsidering a secndment The rganisatin will maximise the benefits f applied learning, when the secndee returns frm secndment t their substantive pst. Secndees t participate in an evaluatin f learning fllwing cmpletin f the secndment t ensure that newly develped knwledge r skills can be identified and used t the benefit f the service. Expenses incurred as a result f the secndment will be reimbursed in line with the prvisins f NHS Terms and Cnditins f Service, nrmally by the hst emplyer with any variatins agreed prir t cmmencement and clearly detailed in secndment cntract. 3.9 Health & Safety The hst emplyer will be respnsible fr the Emplyers Liability Insurance and have a duty f care under the relevant Health and Safety legislatin fr the secndee. 4. MONITORING Amendments r variatins t the Secndment Plicy will nly be made will nly be made by agreement with the Area Partnership Frum.
