Rolling Stone Magazine named him as one of the 100 Greatest Drummers of All Time and the readers of Modern Drummer Magazine named him the #1 Pop/ Rock Drummer and #1 Studio Drummer. The list of artists he s worked with on the road and/or in the studio is a who s who of the music industry s top talent. With a style of playing that combines power and finesse, his unique and versatile sound has been instrumental on over 60 GRAMMY-nominated or awarded recordings representing over 300 million in sales, with more than 1,300 that were RIAA certified Gold, Platinum or Diamond. He is the drummer on four Billboard #1 Hits, and dozens of Top Ten hits. Kenny s winning approach to drumming, collaboration, leadership, and life has given him the ability to sustain a successful career for over four decades. This session is open to all attendees. A panel of very experienced insurance company claim representatives will answer your questions on any matter timely to the insurance claims market. This is a behind the scenes look at what drives the insurance market, how your understanding can be a competitive advantage and ask questions and get responses from client representatives from across the country. Moderated by President-Elect Joel Moore, the session enables our experienced panel of National Advisory Council members to share their experiences and wisdom. Session 2: Lunch & Learn (12:00 pm - 1:00 pm) Handling Claims at the Happiest Place on Earth Barry Dillard, Director, Risk Strategies, Insurance and Compliance for Walt Disney World Resort. Barry will discuss the challenges and benefits of operating as a selfinsured and self-administered entity on a property twice the size of Manhattan. His talk will give an overview of the Risk Management function at the Walt Disney World Resort, as well as a glimpse into liability claim handling. News of mergers and acquisitions are quite common and have been on the rise over the past several years. Many experts believe this trend will continue. Understanding how business value is determined is a major part of a successful merger/acquisition. In this presentation, Will Rodriquez will discuss items that drive the value of closely held businesses, methods used to determine the value of a business and will review different exit strategies. Tampa, FL Session 4: (2:15 pm - 3:30 pm) Risk Managment for the IA As an I.A. is simply the agent of a disclosed principal, what does that really mean and what protection or assurances does that provide the I.A.? What should I be wary of when asked by an insurance company client to sign a service contract or service agreement? Why are I.A. s, who are simply the eyes and ears of their insurance company clients, sued as often as they are, and are there some states where this is more prevalent than others? In situations where I have not been named as a defendant, but my deposition has been noticed, should I report this to my E&O carrier? Should I appear for my deposition with no prior preparation by legal counsel? Should I attend the deposition without counsel to defend me at my deposition? When and how should I notify my E&O carrier of a potential E&O exposure? When served with a lawsuit, when and how should I tender my defense to my principal, the insurance company I performed the service for? How can I convince them it is in their best interests to provide me with a defense and why are they reluctant to defend me? If the insurance company advises me up front that they will defend me, should I report the matter to my E&O carrier anyway and why would that matter? How might I get around the insurance company s conflict of interest concerns? What exactly is a Joint Defense Agreement with a waiver of conflict provision and how does it work? Can I be sued for bad faith? I hear that happened to an adjuster in the State of WA and that it was upheld by the Court.
