4 (A1) SCOPE OF WORK: (A) INSTRUCTIONS TO THE BIDDERS Major works covered in this work are Replacement of insulator strings of 132 kv Ranasan-Vijapur line under buy back. as per specifications and terms mentioned here under. 1. The site of proposed work is situated under Ranasan / Vijapur Transmission division, GETCO. The ground is generally in level. The grading is to be done as per level finalized by GETCO. The subsoil strata are normal. The works shall be carried out as per tenders specifications & detailed work order. (2) Any activity not specifically mentioned in the tender but necessary in the opinion of engineer in charge of work must be carried out for successful completion of the job, on getting approval of competent authority of GETCO. (3) Before taking up construction activity; the agency has to cut the trees which obstruct the working, of any diameter, bushes, vegetations, i.e. roots, plant, shrubs, grass etc including stacking and crediting to GETCO as directed with no extra cost. (4) Site visit: The bidder is advised to visit the site and examine the site condition where in the work is proposed to be carried out and to get himself fully acquainted at his own responsibility for all information that may be necessary for quoting the tender bid and entering in to contract. All cost and liabilities arising out of the site visit shall be at bidder account. (A2) Earnest money Deposit: 1. Bidders are requested to pay an earnest money deposit (1 % of estimated cost) by demand draft only on any Nationalized Bank at Baroda for the amount as specified in the tender notice. Payment of EMD in form of Cheque or any other form shall not be accepted. 2. The EMD shall be submitted along with submission of Technical bid only. In no case it shall be submitted with sealed cover of Price Bid. 3. Tenders not accompanied by EMD shall be rejected. 4. If during the tender validity period, i.e. 180 days, the tenderer withdraws his tender, the EMD shall be forfeited and the tenderer may be disqualified from tendering for further works of GETCO. 5. The EMD will be returned promptly to the unsuccessful tenderer. The EMD will be returned to the successful tenderer after he furnishes the Security Deposit for performance and duly enters in to the contract. If he fails to furnish the SD or to execute the contract for the work offered to him, his Seal and signature of bidder Page 4 of 45

5 EMD shall be forfeited and the tenderer may be disqualified from tendering for further works for GETCO. (A3) COMPLETION PERIOD: The time limit for the completion of the above work will be 03 (Three) Calendar months from the commencement of the work, which will be reckoned on the 10 th day of issuance of L.O.I. (A4) SECURITY DEPOSIT: As per prevailing rules of the Corporation, 5% of the contract value shall be paid as Security Deposit. Out of this, 50 % of S. D. shall be paid at Division Office, Ranasan within 10 days from receipt of letter of intent either a) In form of FDR in favor of "Gujarat Energy Transmission Corporation Ltd. of any Nationalized Bank OR b) In form of Bank Guarantee of any Nationalized Bank as per the approved format of the Corporation. The balance 50 % Security Deposit shall be recovered from first two R.A. Bills in equal installments. Alternatively 100 % S. D. in form of FDR or B. G. may be submitted on receipt of LOI. The security deposit will be refunded only after the completion of 1 year guarantee period of work completed or finalization of final bill whichever is later. If Security Deposit is not paid within 10 days of issue of LOI, EMD paid will be forfeited and Corporation will not deal with party for the period of two years. (A5) Other Instructions: 1 Tenders must be submitted in the enclosed schedule of work & quantities. Those received in any other form will not be accepted. They should be accompanied by a covering letter in which the bidder should give all information as called for in the specifications & any other point which he would like to be considered along with the tender. 2 The Schedule-B shall be filled up with the quoted % above or below & Shall be submitted in sealed envelope superscripted PRICE BID for Replacement of insulator strings of 132 kv Ranasan-Vijapur line under buy back. The Quoted % above or below shall be written both in words, & figures & the units in words. If any discrepancy occurs between words & figures, then words shall prevail. The tender documents shall be written legibly & free from erasure, overwriting or conversions of figures, crossing out, initializing, dating & rewriting, shall be avoided. In case of any deviation in figure and words the rates quoted in words will prevail. The bidder must sign and affix seal of their company in all the documents of tender Including Schedule-B. 3 The bidders shall note that no deviations from the technical specifications or commercial conditions with this bid are acceptable & it will be presumed that the bidder agrees entirely with the specifications & general terms &conditions of the contract. 4 The Corporation reserves the right to accept any tender irrespective of whether it is lowest or not or to reject all the tenders without assigning any reasons there of. Tenders departing from the technical Specification or the method of bidding in a radical manner may also be rejected. Seal and signature of bidder Page 5 of 45

6 5 On acceptance of the tender the name(s) of the accredited representative(s) of the tenderer who would be responsible for taking instructions from the Engineers of the Corporation shall be communicated to the Executive Engineer (TR), Gujarat Energy Transmission Corporation, Division Office, Ranasan All royalties, sales tax, toll tax, local tax, development charges, Works Contract taxes, VAT & any other taxes etc. in respect of this contract shall be payable by the contractor & Gujarat Energy Transmission Corporation will not entertain any claims whatsoever in this aspect. Any statutory variation in future towards the above mentioned taxes and imposing any new tax that shall also be payable by the contractor & Gujarat Energy Transmission Corporation shall not entertain any claim of whatsoever nature, during or after the completion of this tendered work. Proof of such payments made by the Contractor to the appropriate departments shall be produced to Gujarat Energy Transmission Corporation failing which appropriate amount shall be withheld on getting information / instruction from the concerned departments. 6A. Service tax shall be reimbursed on production of proof of such payments made by the contractor to the appropriate department. 7. The successful contractor will have to sign an agreement as per the Gujarat Energy Transmission Corporation rules on stamped paper & the necessary stamp duty charges shall be borne by the contractor. 8. The bidder shall visit the site and carefully study the work to be carried. The Corporation will not pay any extra or rate for any reason in case the contractor claims, after acceptance of contract, to have misjudged the site condition. 9. The percentage quoted shall include cost towards of all materials, & machinery including equipments, fixtures, labour, constructional equipments, fuel, scaffolding, staging, ramps, walkways, approach and haul road, temporary works, etc. bearing permanent or temporary nature necessary for the completion of the work in all respects, except for those items specifically mentioned to be furnished by the Corporation. The contractor must also arrange for the transport of materials & include all such costs in the rates quoted by him for finished work. 10. During the execution of the work if it is found that the work is not progressing as per the Scheduled Progress Program, approved by the Corporation & planned by the Contractor, due to the reasons attributable to the Contractor; suitable action shall be taken as per relevant clauses mentioned in General Conditions of Contract The contract or any part thereof shall not be subject to change without the written permission of the Executive Engineer (TR), Gujarat Energy Transmission Corporation, Division Office, Ranasan or his authorized representatives. 12. Tender shall remain open for acceptance for a period of 180 days from the date of Technical bid opening & during this period no bidder shall be allowed to withdraw his tender. Any such withdrawals, during the said period will entail forfeiture of the earnest money deposited with the tender. The GETCO will take further action as deemed fit like not to deal with bidder in GETCO works. Seal and signature of bidder Page 6 of 45

7 13. Further information required, if any, can be had from the office of the Executive Engineer (TR), Gujarat Energy Transmission Corporation, Division Office, Ranasan. But it must be clearly understood that the tenders must be received complete in every respects by the due date & time 14. The notice inviting tender, general instructions to the contractors & all documents of this tender shall form part of the contract. 15. The works under this contract shall be completed in all respects within stipulated period from the date of commencement order issued by field office. However, interim mile stones to be jointly fixed after issue of LOI. 16. Bidders must quote firm price only, till completion of work under contract, & this is to be confirmed by bidder while submitting his offer. No escalation towards labor and material / fuel shall be paid in this execution of contract. 17. Contractor shall pay minimum wages to his laborers as per the Minimum Wages Act, 1948 & rules there under as applicable from time to time in pursuant to the State Government notification. The concerned contractor shall submit the details of the payment with due certificate of LWO/IRO of the Corporation 18. Once the offer submitted will not be returned back for any reason There of in any case. 19. Each tender shall contain the name, residence & place of business of person or persons making the tender & shall be signed by the tenderer with his usual signature with seal of the company. 20. Tender by partnerships shall furnish the full names of all partners. It shall be signed with the partnership name by one of the members of the partnership or by an authorized representative followed by the name &designation of the person signing. 21. An attested copy of the constitution of the firm with the name of partners shall be furnished. Whenever, whether in submission of the tender or later in other matters, the signatures are made by one person on behalf of Directors or a firm or a corporation, an attested copy of the resolution of the partners or of law shall be supplied by the tenderer authorizing Witnesses & sureties shall be persons of status & probity, &their names, occupation & address shall be stated below their signatures. All signatures shall be dated. 22. Tenders by corporation shall be signed with the legal name of the corporation followed by the name of the state of incorporation & by the signature & designation of the president, secretary or other person authorized to bind it in the matter with rubber seal of the company. 23. The GETCO reserves the right to delete any item of Schedule-B for which contractor shall not have any right to claim on this account. 24. The Bidders shall study the Conditions of site & shall resort to dewatering, where necessary, by appropriate methods & maintain reasonably dry areas to work at and no extra claim will be entertain on this account. 25. The Contractor shall prepare all required roads to execute various items of this Contract & arrange all transport of materials & all such costs shall be taken care of while quoting the rates. No extra payments shall be admissible towards such costs. On completion, this shall be cleared if asked by GETCO at no extra cost. Seal and signature of bidder Page 7 of 45

8 26. Gujarat Energy Transmission Corporation shall not entertain idle charges for any site conditions or any circumstances. 27. The Contractor shall take all requisite & necessary care to observe that no damage is occurred to the Existing structures, if any. For any damage to the Existing Structures of Gujarat Energy Transmission Corporation, the Contractor shall be held responsible. 28. The submission of any bid connected with these document and specification shall constitute on agreement that bidder shall have no cause of action or claim against the GETCO for rejection of his bid. The owner shall always be at liberty to reject or accept split any bid or bids at his sole discretion and any action will not be called into question and the bidder shall have no claim in that regards against the owner. 29. Recoveries: (I) In case of any damage to equipment/machinery or structure/building of GETCO or any public property due to negligence s of contractor or any other reasons attributed to contractor the decision of E.I.C. regarding the amount of recovery shall be final and binding. (II) If the contractor fails to execute the proportionate work as per direction of E.I.C. within the time frame given for completion of part / whole of the work GETCO shall get the work done through any other contractor and the cost of execution of such work along with 15% overhead charges shall be recovered from contractor. 30. Notwithstanding anything contained to the contrary in the specification or tenders in subsequent exchange of correspondence, the conditions of contract shall be binding on the contractor and any change or variations expressed or implied, however made in the said conditions shall not be valid or operative unless expressly sanctioned by the Corporation. The contractor shall be deemed to have fully informed himself and to have special knowledge of the provisions of the conditions of contract herein contained. 31 Submissions of tender by a contractor implies that he has read the instructions and condition of contract herein contained and has made himself aware of the scopes and specifications of the work to be done. 32 These rules and directions shall form part of the contract. 33 Drawings: Drawings required for the works are available with the E.E. (Civil) of Circle Office, Nadiad. They are indicative and for tender purpose only. Bidders shall have to execute the work as per construction drawings issued from time to time by GETCO. 34 Electricity Connection: The electric power, at site, will be made available at one mutually agreed point, free of cost (connection only) by Gujarat Energy Transmission Corporation only. Further distribution will have to be carried out by the contractor as per requirements at their own cost. The necessary consumption charges will be recovered as per the tariff rate of Gujarat Energy Transmission Corporation from time to time as per Corporation s rules. 35 Water Supply Connection: The contractor has to make his own arrangement of water for construction activity at his own cost. However, if possible, on completion of Corporation bore well / open well only, the water supply line from GETCO will be given at one mutually agreed point Seal and signature of bidder Page 8 of 45

9 as per the contractor s request. Further distribution will have to be carried out by the contractor as per their requirements at their cost. Water shall be supplied on chargeable basis and recovery for water charges will be affected at two percent of the cost of items as executed in which the water is supplied by Corporation, is used, as certified by the EIC. 36 Tenders received after time: The tenders received after time and date specified in the tender notice, will not be accepted. Once the offer submitted by the contractor before due date of submission, the contractor will not be allowed to submit revised / additional / modified / other even before due date. However, if the issue and receipt of tender is extended by the Corporation due to any reason, the contractor may submit the revised offer before due date of submission, if he wish to submit. 37 The work shall be completed within the period stipulated in the contract. However it may be noted that drawings shall be released progressively & site clearance arranged accordingly to the progress of work at site. Therefore the contractor has to organize & coordinate the works to suit these. In the event of any delay due to the above or due to any other reason not attributable to the contractor, reasonable extension in the completing the work may be given at the discretion & as decided by the Corporation but no compensation or idle charges will be paid to the contractor under any circumstances. 38 The price bid/proposals will be opened in the presence of the bidder s representatives who choose to attend at the date and time and venue to be notified by the GETCO, after conclusion of the Technical Evaluation and Post Qualification process. 39 GETCO will not issue any material required for the work. 11 Qualification Requirement 1 Registration : Bidder quoting for the bid shall have registration in appropriate class with GETCO/Central/State Government / Railway/Semi. Govt. Organizations. 2 Experience: Bidder should have experience of similar work including RCC frame structure building under single contract as main contractor for minimum of 50% value of estimated cost of the tender with GETCO/ GEB / Central / State Government / Railway / Semi- Government / Public Sector Organization within last 5 years. Attested xerox copy of work orders executed from GETCO/ GEB / Central / State Government / Railway / Semi- Government / Public Sector Organization and satisfactory completion certificate from respective department should be submitted. 3. Solvency : Latest bank solvency certificate from any Nationalized/Scheduled Bank of a sum of minimum 20 % of the estimated cost shown in the tender. 4 Provident Fund Code: Separate provident fund code number towards firm registered with Regional P. F. Commissioner. 5 Profit & Loss Account Statement: The Bidder should submit certified Xerox audited copy of the Balance sheet with profit and loss account of last three Years. 6 Nature of Firm : Attested copy of Power of Attorney, if any, for signing the bid documents in case of partnership firm & self affidavit for proprietorship firm. 7. VAT Registration: The Bidder shall be registered under the GUJARAT VALUE ADDED TAX ACT. The certified Xerox copy of such registration under Gujarat VAT Act indicating TIN shall have to be submitted along with the bid by the bidder. 8. I.T. PAN CARD: The bidder should submit the attested zerox copy of PAN Card of their firm. 14 ** GENERAL CONDITION ** 1. The erection work should be carried out according to the specification and as per instructions and programmed laid out by the Executive Engineer-in-charge of the work. 2. The quantities mentioned in the accompanying schedule are only approximate. Actual quantities will be decided after detailed survey and the same may decrease or increase according to the local conditions, the department reserves the rights for revision or committing any of the quantities. The quantities actually executed by the contractor will be calculated at the rate given in the contract schedule or the rates. 3. The tenders shall remain open for acceptance at least for a period of Six Months, from the date of opening of tenders. 4. The Gujarat Energy Transmission Corporation Limited does not bind itself to accept the lowest or any tender. The Executive Engineer (TR) Ranasan reserves the right to reject any or all tender without signing any reasons whatsoever. 5. The contractor should employee as Supervisor with sufficient qualification and experience who could supervise the execution of work thought. He should always be present on the site. 6. The erection work should be commenced immediately from the date of receipt of instructions from office and should be completed within thereafter. 7. As regard damage to the materials, equipment and worker of the contractor, he himself will be responsible. If there is any compensation to be paid in respect of WORKMAN compensation act of any other statutory provisions, the same will have to be paid by the contractor direct. If he thinks fit he may take necessary insurance cover, at his cost. 8. Security deposit :- The successful tenderor will have to pay the Security Deposit of 5% value of the work order in cash within seven days from the date of receipt of intimation given by the office. 9. The tender includes all minor accessories and items of work which may not have been specifically mentioned in the specification schedule etc. but are essential for completion of work. The contractor will not be eligible for any extra payment in respect of such minor accessories and items of work. 10. The time allowed for completion the work is 2 months from the date of the commencement of the work, failing which the penalty ½% per week or part there of on delayed portion of work and / or supply value subject to ceiling of 10% of the total contract value will be imposed. 11. Guarantee :- It is the responsibility of the contractor to handover the complete work free of all defects. If within a period of one year from Seal and signature of bidder Page 14 of 45

15 the date of handing over the work it is noticed that any defects occurs due to bad workmanship, it is the duty of the contractor to rectify / replace the same at his own cost. If within seven days from the date of receipt of such notice, the contractor does not take up the work, same will be carried out at his risk and cost as decided by Executive Engineer (TR) Ranasan. 12. Tender should be issued to those contractors who have P. F. Code No. 13. Service tax will be paid as per prevailing norms on production of service tax registration Government documentary proof Any bid received by GETCO after the time and date fixed or extended for submission of bids prescribed by GETCO, will be rejected and not considered for evaluation. 15. GETCO will award the contract to the successful Bidder, whose bid has been determined to be substantially responsive and has been determined as the lowest evaluated bid, providing further that the Bidder is determined to be qualified to perform the contract satisfactorily. GETCO shall be the sole judge in this regard. 16. If two or more terms are contradictory, then the most beneficial term to the GETCO shall be considered. 17. The contractor has to follow all the safety norms of GETCO. In case of violation of safety norms, a penalty up to 5% of the contract value will be recovered/imposed. Following credentials shall be submitted with the technical bid with the for pre-qualification. 1 Contractor should produce evidence of having experience in executing similar nature of jobs of not less than 60 % of tender amount and or quantity in a single contract along with the documentary evidence, preferably photo copy of orders secured from GETCO / Central / State Government / Railway / Semi- Government and satisfactory completion certificate from respective department. 2 Latest bank solvency certificate from any nationalized bank for a sum of Minimum 20% of estimated cost. 3 Separate provident fund code number towards registration of your firm with Regional P.F. Commissioner. 4 Contractor should submit evidence as a register contractor in appropriate class With Govt./ Semi. Govt. 5 The details of tools and tackles, owned and available for using in this work. 6 Contractor should produce audited copy of the Balance sheet with profit and loss account of last three Years. 7. Attested copy of Power of Attorney, if any, for signing the bid documents. The commercial bid (i.e. Price bid) shown in tender documents comprising schedule B may please submitted in separate self addressed envelope provided with tender documents. The technical bid shall be opened at 3.00 pm, if possible on After scrutinize of the technical bid if it is seen that the party has failed to fulfill the above requirement for pre-qualification, the price bids of such parties will not be opened. 17 GENERAL CONDITION 1. The contractor shall be responsible for breakages, losses & thefts of material during transit or erection after the materials are issued from stores will, the completed work is taken over by the GETCO. 2. The erection work should be commenced within seven day from the date of receipt of instructions from an office of the GETCO and should be completed within months there after. 3. WORKING MONTHS: In case, it is not possible for the contractor to continue, the work either due to heavy rains or other reasonable causes, such facts should be immediately brought to the notice of the Executive Engineer in writing If the reasons for stopping the work are genuine the Engineer may ask the contractor in writing to stop work be cases (for such stoppage) are overcome and the Engineer will ask the Contractor to start the work again in written, the period of such stoppage will not be considered as a part of working month moreover the contractor cannot claim compensation for such work. 4. As regard damages to the materials equipment and none of the contractor, himself will be responsible. If there is any compensation to be paid in respect of "Workman" compensation Act. Or any other statutory the same will have to be paid by the contractor direct if he Thinks fit he may be taken but necessary insurance cover at this cost. 5. TERMS OF PAYMENT : Bills will normally be prepared according to the progress of the work and payment will be made as under % of the payment will be made of submission of the bills in triplicate and after recording the measurement provides the work as done satisfactorily 1 st & 2 nd R.A Bill shall be prepared only after satisfactory completion 30 % & 60 % of the total work respectively % payment will be made after the entire work is completed in all respect. 3. Payment will be made through account payee Cheque only. 7. SECURITY DEPOSIT : The successful tender will have to pay the security deposit of 5% value of the work order in case, within seven days from the date of receipt of the order, & further 2 1 /2 % will be deducted from the two R.A bills & higher percentage of security may be fixed at the discretions of the Executive Engineer/Superintending Engineer. Contractor will be required to produce a fresh SOLVENCY CERTIFICATE FOR AN AMOUNT AS DECIDED BY E.E. as per norms & also to produce his income tax clearance certificate and latest P.F receipt. 9. The tender includes all minor accessories & items of work which may not have been specifically mentioned in the specification schedule etc. but are essential for completeness of work the contractor will no be eligible for any extra payment in respect of such minor accessories and o item of work. 10. The contractor will be governed by the GETCO's general conditions work contract. The booklet will be available in the concerned office on any working days. In the even of placing of order, the contractor will have to sign this booklet along with other documents, and agreement, all the usual terms and condition of the GETCO. Through the same might have not been mentioned in this specification or contract booklet will applicable to this contract and the decision of the Executive Engineer / Superintending Engineer shall be finding on the contractor. 11. PROGRESS OF WORK : If it is found that the work is unsatisfactory or not progressing as per the programme, any action taken by the GETCO, as may be deemed fit, to see that work is completed as required by the GETCO, would be at the risk and cost of the contractor. If the work is not completed within time limit penalty of 1/2 % of the contract value per week will be levied, Maximum 10% of order value unless time extension as granted for valid reasons by the competent authority. 12. GUARANTEE: It is the responsibility of the contractor to handover the line free of all defects on completion of the work. If within a period of six months from the date of handing over the line it is noticed that any defects occurs due to bad workmanship like slanting of cross arms. Bad painting of poles, defects in guy sets conducting etc. It is the duty of the contractor to rectify the same at his own cost within seven days from the date of receipt of such notice. The Contractor do not take-up the work, the work will be carried out at his own risk and cost decided by Executive Engineer (TR) Ranasan. 13. The contractor will be responsible for loss, distribution or deterioration of the materials, stores or articles supplied to him by the GETCO, even if such a less distribution of deterioration has occurred under any circumstances whatsoever beyond his control as if the materials, stores or articles so supplied were his property. 14. The contractor shall see the line route before quoting the rates. 15. The contactor shall co-operative with the GETCO in recording measurement etc. as expeditiously as possible and he shall fulfill the all the requirement which are necessary to finalizes the accounts on the basic of its records and pay him such amounts as if found due to him, together with the amount of security deposit if any remaining payable to him Seal and signature of bidder Page 18 of 45

19 after deduction there from the amount due by him to the GETCO. The GETCO shall not entertain further claim from thereafter. 16. The competent authority can delete any items in schedule of the tender, if he Feels that the rate quoted by contractor are abnormally high Compared to the estimated rates. 17. Contractor has to submit work completion certificate. 18. Contractor has to submit their working schedule along with tender to complete the line in view of time limit given in tender. Bar chart is also to be submitted. 19. Time limit extension will be given if line material is not supplied in time, outage could not be availed and farmer's objection not cleared in time but if material given in time and farmer's objection cleared in time, then no time limit extension will be grant and penalty will be imposed as per rules. 20. DELIVERY MATERIAL : All material / equipment required for this work as per schedule shall be Delivered from any store center of Nadiad Circle & contractor has to take delivery from these stores at his own cost only. 21. In case of any farmer's objection, contractor has to mobilize his all efforts to clear the objection in consultation with GETCO authority No. extra Charge will pay for such effort. 22. The contractor shall not refuse to execute this work order at any time & it will be his sole responsibility to execute & complete this work as per the Instruction of Engineer-in-charge. Above Terms & condition are part and partial of tender & will be observed strictly WORK & SAFETY REGULATIONS 21.1 The Contractor shall ensure proper safety of all the workers, materials, plant and equipment belonging to him or to GEB/GETCO or to others, working at the Site. The Contractor shall also be responsible for provision of all safety notices and safety equipment required both by the relevant legislations and the Engineer, as he may deem necessary All equipment used in maintenance work of EHV lines by Contractor shall meet Indian/International Standards and where such standards do not exist, the Contractor shall ensure these to be absolutely safe. Safety instructions and clearances to be maintained as per Guidelines/rules of Indian electricity Acts/rules and GEB/GETCO guidelines in this regard. Seal and signature of bidder Page 19 of 45

20 21.3 Periodical examinations and all tests for all lifting/hoisting equipment & tackles shall be carried-out in accordance with the relevant provisions of Factories Act 1948, Indian Electricity Act 1910, Electricity Act 2003 and associated Laws/Rules Regulations in force from time to time. A register of such examinations and tests shall be properly maintained by the Contractor and will be promptly produced as and when desired by the Engineer or by the person authorized by him The Contractor shall provide suitable safety equipment of prescribed standard to all employees and workers according to the need The Contractor shall provide safe working conditions to all workers and employees at the Site including safe means of access, railings, stairs, ladders, scaffoldings etc. The scaffoldings shall be erected under the control and supervision of an experienced and competent person. For maintenance, the Contractor only shall use good and standard quality of material In case any accident occurs during the maintenance or other associated activities undertaken by the Contractor thereby causing any minor or major or fatal injury to his employees due to any reason, whatsoever, it shall be the responsibility of the Contractor to promptly inform the same to the Engineer in prescribed form and also to all the authorities envisaged under the applicable laws The Contractor shall not be entitled for any damages/compensation for stoppage of work due to safety reasons and the period of such stoppage of work will not be taken as an extension of time for completion of work and will not be the ground for waiver of levy of liquidated damages It is mandatory for the Contractor to observe during the execution of the works, requirements of Safety Rules, which would generally include but not limited to following a) Each employee shall be provided with initial indoctrination regarding safety by the Contractor, so as to enable him to conduct his work in a safe manner. b) No employee shall be given a new assignment of work unfamiliar to him without proper introduction as to the hazards incident thereto, both to himself and his fellow employees. c) Employees must not leave naked fires unattended. Smoking shall not be permitted around fire prone areas and adequate fire fighting equipment shall be provided at crucial location. d) There shall be a suitable arrangement at every work site for rendering prompt and sufficient first aid to the injured. 21 e) Requirements of ventilation in underwater working to licensed and experienced divers, use of gum boots for working in slushy or in inundated conditions are essential requirements to be fulfilled The Contractor shall follow and comply with all GETCO Safety Rules, relevant provisions of applicable laws pertaining to the safety of workmen, employees, plant and equipment as may be prescribed from time to time without any demur, protest or contest or reservations. In case of any discrepancy between statutory requirement and GETCO Safety Rules referred above, the latter shall be binding on the Contractor unless the statutory provisions are more stringent. Contractor shall be liable to pay following amount of the compensation to workman/employees, in addition to the other statutory liabilities. a. Fatal injury or accident causing death Rs. 1, 00,000/- per person these are applicable for death. b. Major injuries or accident causing 25% or more permanent disablement Rs. 20,000/- per person injury to any person, to Workmen or employees whosoever. Permanent disablement shall have same meaning as indicated in Workmen s Compensation Act. The compensation mentioned above shall be in addition to the compensation payable to the workmen/employees under the relevant provisions of the Workmen s Compensation Act and rules framed there under or any other applicable laws as applicable from time to time. In case GETCO is made to pay such compensation then the Contractor is liable to reimburse GETCO such amount in addition to the compensation indicated above Safety Requirement: Kick off Meeting exclusively for safety shall be done in each contract in presence of contractor s site in charge and supervisor. Safety document shall be handed over and vital safety norms and key points of safety related to project shall be explained and recorded for commitment by erection contractor. Such records are mandatory for clearing first erection bill During site visit by GETCO official of Executive Engineer and above rank, the following checks during execution of work shall be covered. (a) Permit to work (b) Earthing at the place of work. (c) Adequate supervision [iii] T & P physical Check. (Healthiness and Quality) (a) P.P.rope. (b) Wire rope and sling. (c) Earthing rod If above-mentioned safety requirements found violated in any of the above three conditions shall attract penalty of Rs.1000/-per occasion. 23 SPECIAL TECHNICAL TERMS AND CONDITIONS: 1. Successful contractor will give contact numbers of himself and his supervisor to the engineer in charge and will remain constantly in touch with engineer in charge. 2. The Contractor will take all safety and security measures while executing contract. 3. The Contractor will permitted on line only after getting line clear permit/permit to work as per the procedure of GETCO with the approval of competent authority. At the time returning LCP, PTW contractor will confirm the removal of man, material, tools, tackles along with any loose earthing provided on site. 4. The Contractor will execute the work in minimum time for line clear outage required for the work assigned. 5. The contractor shall work to the entire satisfaction of engineer in charge. Any rectification work to be carried out will be without any extra cost of the GETCO. 6. Contractor will engage well-experienced and educated supervisor, skilled, semi-and unskilled workers for completion and execution of work with minimum time. 7. All tools, tackles and plants required to execute this contract will be arranged by the contractor., 8. Safety checks and calibration of equipments shall conduct regularly as per safety norms to all its tools, plants, machines and instruments. 9. Contractor will have sufficient number of vehicles for mobilization of workers, tools, tackles, material and execution of work such as Jeep, truck, tractor etc. 10. GETCO will supply only line material i.e. insulators and its accessories. No tools, plants and machines shall be provided by GETCO. 11. Material for the maintenance of line shall be issued from the nearest division/circle store. 12. 24 13. No handling charges shall be admissible. 14. Line outages will be given at the earliest subject to confirmation of system condition and approval by the competent authority. 15. Required water for gator washing as per the directive of engineer in charge will be arranged by the contractor at his cost. 16. Contractor will work on line in a way that no crop is damaged in the field. In case work can not be done without damaging crops, prior approval of engineer in charge should be taken. 17. Contractor has to work in hot and cold condition. In case of any may be i.e. working of single circuit of double circuit tower with other circuit in live condition. 18. 25 GENERAL : a. ELECTRICITY RULES : All the works shall be carried out in accordance with latest under Electricity Act b. TESTING : Complete installation shall be put to the necessary test as required and should be approved by Government Electricity inspector. c. THE INTERPRETATION OF SPECIFICATION DOUBTS ETC. In case of any doubts about what is intentioned in specification or schedule. Of else were, the tender should get all doubts cleared from the department in writing and in advance of filling in the tender. In case of difference of opinion about interpretation of specification etc. the decision of Executive Engineer (TR) Ranasan or its Supt. Engineer (TR) will be final and shall be binding to the contractor. d. GUARANTEE PERIOD: If during the six months from the date of handing over charge after completion of tester the erected line are found defective in workmanship that should be rectified by the contractor free of charge in case, the contractor fails to rectify the defects, the same will be get rectified by the GETCO at the risk and cost of the contractor. e. ACCOUNTS OF MATERIALS ISSUED: The contractor shall have to maintain accurate day to day item wise account of use of issued materials which shall be got checked from time to time by the representative of the GETCO the contractor will be responsible for custody and preserving the issued materials till the work is handover by the contractor after completion. f. The contractor has to maintain site Register covering all the daily details of materials receipt & utilization. 26 GUJARAT ENERGY TRANSMISSION CORPORATION LIMITED TRANSMISSION DIVISION OFFICE - RANASAN TERMS & CONDITIONS REGARDING INDUSTRIAL LAWS AND OTHER RELATED MATTERS (1) Wages to be paid at time of payment etc. by the contractor. (A) (B) The contractor shall pay minimum prevailing rates per day or as may be specified hereafter or rates fixed under the minimum wages Act. Whichever is higher. The wages or very contract labour employed by him under this contact shall be paid by him before the expiry of 7 th day of the month in respective of which the wages are payable ( i.e. wages of a month have to be paid by him in the first week of the next month). The payment shall be disbursed in the presence of management representative during the working hours in GETCO premises and the contractor shall get the entries certified in the register of wages by the representative of the GETCO. Any default will result in cancellation of contract forthwith or also the contractor shall be paid punishable to the extent of Rs.100/- fine per each day. The contractor shall give his telephone number and address to the GETCO so that in case of labor troubles etc. the contractor can be contacted. The contractor shall arrange to have his office outside the GETCO premises and the contractor shall keep himself present through out the working hours. (2) Labor Laws :- (A) Person below the age of 18 years shall not be employed for the work. (B) No. female worker shall be employed in the night shift between 7 p.m. to 6 a.m. (C) Contractor shall maintain a valid labor license under the contract labour (Regulation and Abolition) Act for employing necessary manpower to be required by him. In the absence of such license the contract shall be liable to be terminated without assigning any reason thereof. (D) The contractor shall at his own expenses comply with all labour laws and keep the GETCO indemnified in respective thereof. Some of the major liabilities under various labour and industrial laws which the contractor shall comply with are as under :- (1) Payment of contribution of wages employers contribution towards provident fund, Family pension Scheme, Deposit linked insurance Scheme, administrative charge etc. at the rate made applicable from Seal and signature of bidder Page 26 of 45

27 time to time by Government of Gujarat/ Government of India or other statutory authorities. (2) Payment of deposit in respect of each contract labour of the rate of Rs.307- with the office of the commissioner of labour as per the contract labour (Regulation & Abolition) act. (3) License fee as prescribed under the contract labour (Regulation and abolition) Act and rules framed there under depending upon the number of workmen employed by the, contractor. (4) Paid leave facility and wages as per the provision of the factories act at the rate of one day for every 20 days of working. (5) Identity cards as prescribed under the factories Act with photo affixed There to, the same for identification, is to be issued by the contractor to his labours. (6) Payment of retrenchment compensation, notice pay and other liabilities as per industrial Disputes Act. Payment to the contractor employees arising out of any claim of disputes under the industrial act or any other laws. (7) Payment of compensation in case of accidental injury (8) Provision of crèche if the female labour employed is more than 30 numbers. (9) Maternity leave as per the provision of the maternity benefit Act. The above are some of the major liability of the contractor in addition to their liabilities prescribed under the various Labour Laws in force from time to time from statutory Authorities like state government /government of India which the contractor shall have to comply with. (3) Provident fund & Family pension Scheme :- The contractor shall submit along with his bill (month wise) a statement regarding deduction against employees provident fund and family pension scheme in respective of each concerned employee, provident fund and family pension scheme at the rate at admissible ( or at the rate made applicable by the Government from time to time ) of the wages. The contractor s contribution and his workers contribution towards provident fund and family pension scheme shall be deposited by the contractor with regional Provident Fund Commissioner, Ahmedabad. (4) Deposit Linked Insurance Scheme :- The contractor shall have to deposit ½ % of the wage in respect of employees who is a member of the Provident Fund as the contribution to the deposit.
