No tender shall be accepted / opened in case of receipt after due date and time of tender, irrespective of delay due to postal services or any other reasons and the Corporation shall not assume any responsibility for late receipt of tender. The tenders are to be submitted by the intending bidders in single envelop with two separate sealed and super scribed envelopes as listed below: Envelope No.1: Technical bid and Post Qualification bid data, details specification. Envelope No.2: Price Bid. Technical and post qualification bid details specification (envelope No.1) will be opened first and subject to evaluation based on the qualification criteria contained in the individual bid document. Price bids (Envelope No.2) of bidders who are assessed and declared as substantially technically responsive on evaluation of the technical bid will be opened for further commercial evaluation. The Earnest Money Deposit and tender fee will be accepted by Demand Draft on any Nationalized Bank only situated at SURAT, drawn in favor of GUJARAT ENERGY TRANSMISSION CORPORATION LTD. Tender without EMD and tender fee shall be rejected. Two separate demand draft for Tender fee and EMD should be submitted with technical bid. 3 INSTRUCTIONS TO THE BIDDERS. (A) SCOPE OF WORK: Major works covered in this work of Providing Anti-climbing device(barbed wire) to various EHV Line Locations of Ichchhapore s/s Jurisdiction are mentioned here under. I. SCOPE. a) The site of proposed work is situated at Various 220kv & 66kv Lines of 220kv Ichchhapore S/S Jurisdiction. b) Barbed wire to be provided on the locations where required as per instruction of Engineer incharge. c) Barbed wire to be provide as per GETCO s norms. d) Barbed wire & necessary fixing binding wire etc are to be supply by Contractor. e) For missing angle on which barbed wire to be provided, GETCO will supply angle pieces free of cost But Fixing after necessary fabrication to be done by contractor at required locations. f) Work to be carried out without any outage accordingly necessary safety precautions are to be taken. g) Any activity not specifically mentioned in the tender but necessary in the opinion of engineer in charge of work must be carried out for successful completion of the job on getting approval of competent authority of GETCO. h) Before taking up work; the agency has to cut the trees which obstruct the working, of any diameter, bushes, vegetations, i.e. roots, plant, shrubs, grass etc including stacking and crediting to GETCO as directed with no extra cost. i) Site visit: The bidder is advised to visit the site and examine the site condition. Where in the work is proposed to be carried out and to get himself fully acquainted at his own responsibility for all information that may be necessary for quoting the tender bid and entering in to contract. All cost and liabilities arising out of the site visit shall be at bidder account j) Contractor has to carryout the work as per specification, instruction & direction of engineer in charge. k) All necessary tools and tackles to complete the job are to be arranged by the contractor at his own cost. l) All safety measures should be strictly followed as per GETCO s norms. Technician must wear safety shoes, safety belts, safety helmets and all necessary tools tackles required to work on lattice structures, towers. Lacuna in safety measures will leads immediately stoppage of work and termination of contract. m) All the safety rules regarding human life and as per I.E. rules and latest amendment thereof is to be observed by the contractor and for any violation GETCO will not take any responsibility.

4 (B) Payment of Earnest money Deposit and Security Deposits : I. Earnest money Deposit: 1. Bidders are requested to pay an earnest money deposit (1 % of estimated cost) by demand draft only on any Nationalized Bank at Surat for the amount as specified in the tender notice. Payment of EMD in form of Cheque or any other form shall not be accepted. 2. The EMD shall be submitted along with submission of Technical bid only. In no case it shall be submitted with sealed cover of Price Bid. 3. Tenders not accompanied by EMD shall be rejected as non- responsive. 4. If during the tender validity period, i.e. 180 days, the tenderer withdraws his tender, the EMD shall be forfeited and the tenderer may be disqualified from tendering for further works. 5. The EMD will be returned promptly to the unsuccessful tenderer. The EMD will be returned to the successful tenderer after he furnishes the Security Deposit for performance and duly enters in to the contract. If he fails to furnish the SD or to execute the contract for the work offered to him, his EMD shall be forfeited and the tenderer may be disqualified from tendering for further work. II. SECURITY DEPOSIT: As per prevailing rules of the Corporation, 5% of the contract value shall be paid as Security Deposit. Out of this, 50 % of S. D. shall be paid at ICHCHHAPORE DIVISION.within 10 days from receipt of letter of intent either a) In form of FDR in favor of "Gujarat Energy Transmission Corporation Ltd. " of any Nationalized Bank OR b) In form of Bank Guarantee of any Nationalized Bank as per the approved format of the Corporation. The balance 50 % Security Deposit shall be recovered from first two R.A. Bills in equal installments. Alternatively 100 % S. D. in form of FDR or B. G. may be submitted on receipt of LOI. The security deposit will be refunded only after the completion of guarantee period of 1 year of work completed or finalization of final bill whichever is later. If Security Deposit is not paid within 10 days of issue of LOI, EMD paid will be forfeited and Corporation will not deal with party for the period of two years. (C) Commercial Conditions: 1 Sealed Percentage rate tender invited for work of Providing Anti-climbing device(barbed wire) to various EHV Line Locations of Ichchhapore s/s Jurisdiction mentioned here under. Transmission Corporation, Vadodara (herein referred to as Corporation). 2 The scope of work is explained in Tender Specification. The work shall be carried out according to the enclosed General Conditions, Technical Specifications & such of the working drawings approved by the Corporation. 3 Tenders must be submitted in the enclosed schedule of work & quantities. Those received in any other form will not be accepted. They should be accompanied by a covering letter in which the bidder should give all information as called for in the specifications & any other point which he would like to be considered along with the tender. 4 The Schedule-B shall be filled up with the quoted % above or below & shall be submitted in sealed envelope superscripted PRICE BID for Providing Anti-climbing device(barbed wire) to various EHV Line Locations of Ichchhapore s/s Jurisdiction mentioned here under. The Quoted % above or below shall be written both in words, & figures & the units in words. If any discrepancy occurs between words & figures, then words shall prevail. The tender

5 documents shall be written legibly & free from erasure, overwriting or conversions of figures, crossing out, initializing, dating & rewriting, shall be avoided. In case of any deviation in figure and words the rates quoted in words will prevail. 5 The bidders shall note that no deviations from the technical specifications or commercial conditions with this bid are acceptable & it will be presumed that the bidder agrees entirely with the specifications & general terms &conditions of the contract. 6 The Corporation reserves the right to accept any tender irrespective of whether it is lowest or not or to reject all the tenders without assigning any reasons there of. Tenders departing from the technical Specification or the method of bidding in a radical manner may also be rejected. 7 On acceptance of the tender the name(s) of the accredited representative(s) of the tenderer who would be responsible for taking instructions from the Engineers of the Corporation shall be communicated to the Superintending Engineer, Gujarat Energy Transmission Corporation, CO, NAVSARI. 8 All royalties, sales tax, toll tax, local tax, service tax, development charges, Works Contract taxes & any other taxes etc. in respect of this contract shall be payable by the contractor & Gujarat Energy Transmission Corporation will not entertain any claims whatsoever in this aspect. Any statutory variation in future towards the above mentioned taxes and imposing any new tax that shall also be payable by the contractor & Gujarat Energy Transmission Corporation shall not entertain any claim of whatsoever nature, during or after the completion of this tendered work. Proof of such payments made by the Contractor to the appropriate departments shall be produced to Gujarat Energy Transmission Corporation failing which appropriate amount shall be withheld on getting information / instruction from the concerned departments. 8A. Service tax shall be reimbursed on production of proof of such payments made by the contractor to the appropriate department. 9. The successful contractor will have to sign an agreement as per the Gujarat Energy Transmission Corporation rules on stamped paper & the necessary stamp duty charges shall be borne by the contractor. 10. Bidders must submit the schedule of quantities & rates by quoting the % above or below the total estimated cost & other schedules duly signed & seal of the company. Any tender not bearing signature of the bidder & seal of the company on all the documents accompanying the tender is liable to rejection. Further it is specifically instructed that conditional tenders shall summarily be rejected. 11. The bidder shall carefully study the work to be carried. The Corporation will not pay any extra or rate for any reason in case the contractor claims, after acceptance of contract, to have misjudged the site condition. 12. The percentage quoted shall include cost towards of all materials, & machinery including equipments, fixtures, labour, constructional equipments, fuel, scaffolding, staging, ramps, walkways, approach and haul road, temporary works, etc. bearing permanent or temporary nature necessary for the completion of the work in all respects, except for those items specifically mentioned to be furnished by the Corporation. The contractor must also arrange for the transport of materials & include all such costs in the rates quoted by him for finished work. 13. During the execution of the work if it is found that the work is not progressing as per the Scheduled Progress Program, approved by the Corporation & planned by the Contractor, due to the reasons attributable to the Contractor; suitable action shall be taken as per Clause No.3 & 4 appearing in the Corporation s prescribed Booklet for Tender & Contract for Works and Corporation may take such action as it may deem fit to ensure that the work is completed in time at risk & cost of the contractor. 14. The contract or any part thereof shall not be subject to change without the written permission of the Superintending Engineer, Gujarat Energy Transmission Corporation, CO NAVSARI or his authorized representatives. 15. Tender shall remain open for acceptance for a period of 180 days from the date of Technical bid opening & during this period no bidder shall be allowed to withdraw his tender. Any such withdrawals, during the said period will entail forfeiture of the earnest money deposited with the tender. 16. Further information required, if any, can be had from the office of the Executive Engineer, Gujarat Energy Transmission Corporation, DO ICHCHHAPORE. But it must be clearly understood that the tenders must be received complete in every respects by the due date & time 17. The notice inviting tender, general instructions to the contractors & all documents of this tender shall form part of the contract.

6 18. Work under this contract shall be completed in all respects within stipulated period from the date of commencement order issued by field office. However, interim mile stones to be jointly fixed after issue of LOI. 19. Bidders must quote firm price only, till completion of work under contract, & this is to be confirmed by bidder while submitting his offer. No escalation towards labor and material / fuel shall be paid in this execution of contract. 20. Contractor shall pay minimum wages to his laborers as per the Minimum Wages Act, 1948 & rules there under as applicable from time to time in pursuant to the State Government notification. The concerned contractor shall submit the details of the payment with due certificate of LWO/IRO of the Corporation 21. Once the offer submitted will not be returned back for any reason thereof in any case. 22. The Bidders shall note: I. Percentage rates quoted shall cater for the cost of all materials & labor including all leads & lifts, tools, plants, consumables such as but not limited to fuels, lubricants, etc. cost due to mobilizing / demobilizing, temporary / permanent constructions II. Percentage rates quoted shall include for the details of constructions, which are obviously & fairly intended & which may not have been specifically referred to in these documents but are essential for the satisfactory completion of the work. III. Percentage rates shall be firm for variations up to any extent for individual items. IV. No price escalation on any account, will be payable. 23. Each tender shall contain the name, residence & place of business of person or persons making the tender & shall be signed by the tenderer with his usual signature with seal of the company. 24. Tender by partnerships shall furnish the full names of all partners. It shall be signed with the partnership name by one of the members of the partnership or by an authorized representative followed by the name &designation of the person signing. 25. An attested copy of the constitution of the firm with the name of partners shall be furnished. Whenever, whether in submission of the tender or later in other matters, the signatures are made by one person on behalf of Directors or a firm or a corporation, an attested copy of the resolution of the partners or of law shall be supplied by the tenderer authorizing Witnesses & sureties shall be persons of status & probity, &their names, occupation & address shall be stated below their signatures. All signatures shall be dated. 26. Tenders by corporation shall be signed with the legal name of the corporation followed by the name of the state of incorporation & by the signature & designation of the president, secretary or other person authorized to bind it in the matter with rubber seal of the company. 27. Corporation reserves the right to delete any item of Schedule-B for which contractor shall not have any right to claim on this account. 28. The Bidders shall study the Conditions of site & shall resort to dewatering, where necessary, by appropriate methods & maintain reasonably dry areas to work at and no extra claim will be entertain on this account. 29. The Contractor shall prepare all required roads to execute various items of this Contract & arrange all transport of materials & all such costs shall be taken care of while quoting the rates.no extra payments shall be admissible towards such costs. On completion, this shall be cleared if asked by GETCO at no extra cost. 30. Gujarat Energy Transmission Corporation shall entertain no idle charges for any site conditions or any circumstances. 31. The Contractor shall take all requisite & necessary care to observe that no damage is occurred to the Existing structures, if any. For any damage to the Existing Structures of Gujarat Energy Transmission Corporation the Contractor shall be held responsible. 32. Tenders that do not fulfill all the above conditions & those specified in the documents attached with this contract document or incomplete in any respect are liable to rejection. 33. The submission of any bid connected with these document and specification shall constitute on agreement that bidder shall have no cause of action or claim against the GETCO for rejection of his bid. The owner shall always be at liberty to reject or accept split any bid or bids at his sole discretion and any action will not be called into question and the bidder shall have no claim in that regards against the owner. 34. Site visit: The bidder is advised to visit the site and examine the site condition. Where in the work is proposed to be carried out and to get himself fully acquainted at his own responsibility for all information that may be necessary for quoting the tender bid and entering in to contract. All cost and liabilities arising out of the site visit shall be at bidder account.

Recoveries: (I) In case of any damage to equipment/machinery or structure/building of GETCO or any public property due to negligence s of contractor or any other reasons attributed to contractor the decision of E.I.C. regarding the amount of recovery shall be final and binding. (II) If the contractor fails to execute the proportionate work as per direction of E.I.C. within the time frame given for completion of part / whole of the work GETCO shall get the work done through any other contractor and the cost of execution of such work along with 15% overhead charges shall be recovered from contractor. 36. Notwithstanding anything contained to the contrary in the specification or tenders in subsequent exchange of correspondence, the conditions of contract shall be binding on the contractor and any change or variations expressed or implied, however made in the said conditions shall not be valid or operative unless expressly sanctioned by the Corporation. The contractor shall be deemed to have fully informed himself and to have special knowledge of the provisions of the conditions of contract herein contained. 37 Tenderer shall be deemed to have full knowledge of relevant documents, site conditions etc. whether inspected or not by him. 38 Submissions of tender by a contractor implies that he has read the instructions and condition of contract herein contained and has made himself aware of the scopes and specifications of the work to be done. 39 These rules and directions shall form part of the contract. 40 In case of any deviation in any terms and conditions between Instruction to the bidders and Tender and contract for works, the terms and conditions mentioned in Instruction to the bidders will prevail. 41 Drawings: Drawings required for the works are available with the E.E. (Tr) of Division Office, Ichchhapore. They are indicative and for tender purpose only. Bidders shall have to execute the work as per construction drawings issued from time to time by GETCO. 42 Electricity Connection: The electric power, at site, will be made available at one mutually agreed point, free of cost (connection only) by Gujarat Energy Transmission Corporation only. Further distribution will have to be carried out by the contractor as per requirements at their own cost. The necessary consumption charges will be recovered as per the tariff rate of Gujarat Energy Transmission Corporation from time to time as per Corporation s rules. 43 Water Supply Connection: The contractor has to make his own arrangement of water for construction activity at his own cost. However, if possible, on completion of Corporation bore well / open well only, the water supply line from GETCO will be given at one mutually agreed point as per the contractor s request. Further distribution will have to be carried out by the contractor as per their requirements at their cost. Water shall be supplied on chargeable basis and recovery for water charges will be effected at two percent of the cost of items as executed in which the water is supplied by Corporation, is used, as certified by the EIC. 44 Validity Of Tender: Tender shall remain open for acceptance for a period of 180 days from the date of Technical bid opening & during this period no bidder shall be allowed to withdraw his tender. Any such withdrawals, during the said period will entail forfeiture of the earnest money deposited with the tender, and Corporation will take further action for not dealing with party etc. 45 Separate Provident Fund Code: The contractor shall have a separate Provident Fund Code of RPFC in the name of company. The contractors, who do not posses such separate P.F. code, shall not be considered for acceptance of tender. The contractor has to submit such certificate showing P.F. code along with tender. 46 Tenders received after time: The tenders received after time and date specified in the tender notice, will not be accepted. Once the offer submitted by the contractor before due date of submission, the contractor will not be allowed to submit revised / additional / modified / other even before due date. However, if the issue and receipt of tender is extended by the Corporation due to any reason, the contractor may submit the revised offer before due date of submission, if he wish to submit. 47 The price proposals will be opened in the presence of the bidder s representatives who choose to attend at the date and time and venue to be notified by the GETCO, after conclusion of the Technical Evaluation and Post Qualification process. 48 The Schedule-B shall be filled up with the quoted % above or below & shall be returned & submitted in sealed envelope superscripted Price Bid Annual Major works covered in this work are Providing Anti-climbing device(barbed wire) to various EHV Line Locations of

8 Ichchhapore s/s Jurisdiction mentioned here under. so as to reach the office of Executive Engineer, Gujarat Energy Transmission Corporation, ICHCHHAPORE DIVISON. Schedules for tools & tackles, equipments, personnel details etc., and all other necessary details shall also be submitted, in Envelope I, i.e. Technical Bid. Tenders will be opened on the day & time indicated in the tender notice in the presence of such bidders who wish to remain present. Any tender not bearing signature of the bidder & seal of the company on all the documents accompanying the tender is liable to rejection. Further it is specifically instructed that conditional tenders shall summarily be rejected. (D) Use of Materials: I. The contractor shall have to use the best quality of materials in the work, as per the specifications and relevant I.S. codes. In case Corporation desires to carry out any field test/laboratory test for any materials required for the work, the contractor shall arrange for the same at his own cost. Further, for any finished works such as masonry, plastering, cube testing for all important concreting work etc., if any testing is required same shall be arranged by the contractor at his own cost. The contractor shall have to maintain the regular records for such testing and shall submit along with each R.A. bills. II. No collection of materials shall be made before it is got approved from the Engineer-in-charge. III. Materials, if and when rejected by the Engineer-in-charge shall be immediately removed from site IV. of work. All installations pertaining to water supply and fixtures thereof as well as drainage lines and sanitary fittings shall be deemed to be completed only after giving satisfactory tests by the contractor. V. Approval to the samples of various materials given by the EIC shall not absolve the contractor from the responsibility of replacing defective material brought on site or materials used in the work found defective at a later date. The contractor shall have no claim to any payment or compensation whatsoever on account of any such material being rejected by E.I.C. VI. Approval to any of the executed item for the work does not in any way relieve the contractor of his responsibility for the correctness, soundness and strength of the structure as per the drawing and specification. 9 Qualification Requirement Bidder to satisfy all the following Qualifying Requirements The tender documents are for two separate bids i.e. technical bid (i.e. qualifying bid) and price bid (i.e. commercial bid). Following credentials shall be submitted with the technical bid for qualification. 1 Registration: Bidder quoting for the bid shall have registration in appropriate class with GETCO/Central/State Government / Railway/Semi. Govt. The bidder shall have Registered under Service Tax Act and should have PF Registration Certificate. 2 Experience: Contractor should produce evidence of having experience in executing similar nature & magnitude of jobs preferably photo copy of orders secured from GETCO / Central / State Government / Railway / Semi- Government and satisfactory completion certificate from respective department. The bidder shall have individually executed minimum three numbers of similar job of 66KV and higher volt in last five years. (Supporting documents / Certificates of original customer to be submitted). Satisfactory completion certificate from the original customer shall have to be submitted for at least one Contract out of above. 3. Solvency : Latest bank solvency certificate from any nationalized bank of a sum of minimum 20 % of the estimated cost shown in the tender. 4. Provident Fund Code: Separate provident fund code number towards your firm registered with Regional P. F. Commissioner. 5. EMD: The Earnest Money Deposit and tender fee will be accepted by Demand Draft on any Nationalized Bank only situated at SURAT, drawn in favor of Gujarat Energy Transmission Corporation Ltd.. Tender without EMD and tender fee shall be rejected. Two separate demand draft for Tender fee and EMD should be submitted with technical bid. Any tender submitted without tender fee and E. M. D. will be disqualified. 6. Tools and tackles :The details of tools and tackles, owned and available for using in this work. 7. Profit & Loss Account Statement: Contractor should produce audited copy of the Balance sheet with profit and loss account of last three Years. Minimum Annual Turn over (MAT) for best three individual years out of last five financial years shall not be less than the estimated amount of this tender. (Supporting documents shall have to be submitted). 8. Nature of Firm : Attested copy of Power of Attorney, if any, for signing the bid documents. The commercial bid (i.e. Price bid) shown in tender documents comprising schedule B shall be submitted in separate self-addressed envelope provided with tender documents. 9. VAT Registration: The Bidder shall be registered under the GUJARAT VALUE ADDED TAX ACT. The certified Xerox copy of such registration under Gujarat VAT Act indicating TIN shall have to be submitted along with the bid by the bidder. 10. I.T. PAN CARD: The bidder should submit the attested zerox copy of PAN Card of their firm. 11. Service Tax Registration No: The bidder should submit the attested zerox copy of Service Tax Registration No. The technical bid shall be opened at 3.00 pm, if possible on due date. After scrutinizing of the technical bid, if party fails to fulfill the above requirement for qualification, the price bids of such parties will not be opened. The price bid of qualifying parties thereafter shall be opened on the date and time communicated to qualified parties afterwards in the presence of parties. The bid should be clearly subscribe with our reference number due date and title of work. The offer should be valid for acceptance for a minimum period of 6 months from the date of opening of technical bid. 10 TENDER AND CONTRACT FOR WORKS (APPLICATION FOR WORKS CONTRACT) : GENERAL RULES AND DIRECTIONS FOR THE GUIDENCE OF CONTRACTOR : 1 Notwithstanding anything contained to the contrary in the specification or tenders in subsequent exchange of correspondence, the conditions of contract shall be binding on the contractor and any change or variations expressed or implied, however made in the said conditions shall not be valid or operative unless expressly sanctioned by the Corporation. The contractor shall be deemed to have fully informed himself and to have special knowledge of the provisions of the conditions of contract herein contained. 2 Copies of specifications, design, drawings, estimated rates, scheduled rates and any other documents required in connection with the work which will be signed by the Engineer-in-Charge for the purpose of identifications shall be open for inspections by the contractors at the office of the Executive Engineer during office hours. 3 Whether the works are proposed to be executed according to the specifications recommended by the contractor and approved by a competent authority on behalf of the Gujarat Energy Transmission Corporation Ltd., such specifications with designs and drawings shall form part of the accepted tender. 4 The Tenderer s receipts for payments made on account of any work, when executed by a firm should be signed by all the partners except where the contractors are described in their tender as a firm, in which case the receipt shall be signed in the name of firm including the partners or some other person having authority to do so. 5 The Tenderer at shall fill up the usual form stating at what percentage above or below rates specified, he is willing to under take the work. Only one rate or such percentage on all the estimated rates or schedule rates shall be mentioned. 6 Tenderer which propose any alternation in the work specified in the form in invitation to tender or in the time allowed for carrying out the works or which contain any other conditions of any sort, will be liable to rejection. 7 No single tender shall include more than one work, but contractors who wish to tender, for two or more works, shall submit a separate tender for each work. Tender shall have the name and the number of the works, of which they pertain, be super scribed on envelope. 8 The Engineer-in-charge or his duly authorized assistant will open tenders in the presence of any intending contractors who may be present at the time and will enter the amount of the several tenders in a comparative statement in a suitable form. In the event of a tender being accepted, the contractor shall there upon, for the purpose of identification, sign copies of the specifications and other documents. In the event of tender being rejected, the officer (Engineer-in-charge) shall authorized the paying officer concerned to refund the amount of the earnest money deposited to the contractor making the tender on his giving a receipt for the return of the money. 9 The officer, competent to dispose off the tenders, shall have the right of rejecting all or any of the tenders, without assigning any reasons thereof. 10 No receipt for any payment alleged to have been made by contractor in regard to any matter relating to tender of the contract shall be valid of binding on the Corporation unless it is signed by the Engineer-in-charge 11 The memorandum of work to be tendered for and the schedule of materials to be supplied by the GETCO and their rates shall be filled in and completed by the office of the Engineer-in-charge before the tender form is issued if a form issued, to an intending tenderer has not been so filled in and uncompleted he shall request the said office to have this done, before the completes and delivery his tender. 12 All works shall be measured, meet by standard measure and according to rules are custom and usual in the use in the Gujarat Energy Transmission Corporation Ltd., and no proposal to adopt

11 alternative method will be accepted, the Engineer-in-charge decision as to what is the usual method in use in the Gujarat Energy Transmission Corporation Ltd. shall be final. 13 Every contractor shall, except the registered contractor on the approved list of the Corporation, produced, along with the tender a solvency certificate from the collector of the District within which he resides, of a banker s certificate of his financial stability, if he fails to produce such a certificate his tender will not be considered. 14 All corrections and addition or pasted slips should be initialed. 15 Tenderer shall be deemed to have full knowledge of relevant documents, site conditions etc. whether inspected or not by him. 16 Submissions of tender by a contractor implies that he has read the instructions and condition of contract herein contained and has made himself aware of the scopes and specifications of the work to be done and conditions and rates at which stores materials etc. will be issued to him and local conditions and other factors bearing on the execution of the work. 17 Under no circumstances shall any contractor be entitled to claim enhanced rates for any item of contract without prior sanction of the competent authority. 18 These rules and directions shall form part of the contract. 13 GUJARAT ENERGY TRANSMISSION CORPORATION LIMITED TRANSMISSION DIVISION ICHCHHAPORE PART-I - ITB INSTRUCTIONS TO BIDDERS A. INTRODUCTION 1.0 General Particulars 1.1 The Gujarat Energy Transmission Corporation Ltd., Baroda hereinafter called GETCO / OWNER intends to receive bids for above work as detailed in the accompanying specifications in accordance with Terms and Conditions herein. The bids shall be prepared and furnished as per these Instructions. Qualification Requirements of Bidders To be qualified for award, the bidder shall provide following satisfactory evidence to the Owner of his capability and adequacy of resources: He is a qualified and registered contractor who is regularly executing jobs of 66KV H- frame or tower line erection including all works in the scope of the tender specification and has adequate technical knowledge and practical experience and has executed successfully at least 5 Five nos. of shifting of H- frame/tower line of 66KV and above voltage class in last Three years (the Bidder shall submit documents defining legal status, registration and principal place of business; written power of attorney of the signatory of the bid to commit the bidder, performance record as contractor for erection /Shifting of 66KV tower / H-frame transmission line in last Three years) and details of works on hand in the past Three years & contracts on hand. He has adequate financial capability and stability to meet the financial obligations arising out of the scope of works. In addition, the Qualifying Requirements if any, in the Special Conditions of Contracts shall also be applicable. The registration with P.F. authority and labor license as per GETCO norms is mandatory The above-cited requirements are only indicative. The owner reserves the right to requisition any other relevant information and also reserves the right to reject the Bid proposal of any Bidder, if in the Owner s opinion the Qualification data is incomplete and Bidder is not qualified to perform the Contract satisfactorily. Bidding Costs All costs/expenses in the preparation and submission of the Bid (including any post Bid discussions/presentations) shall be fully borne by the Bidder. Owner will not be responsible / liable for these costs irrespective of the course and conclusion of this Bidding. B. BID DOCUMENTS Details of Documents The following Bid documents apart from Invitation to Bid detail the material and equipment specifications/characteristics, the bidding procedures and the terms & conditions of contract: Instructions to Bidders (ITB-Part I) General Conditions of Contract (GCC-Part I) Erection Conditions of Contract (ECC-Part I) Special Conditions of Contract (SCC-Part I) Technical Specifications (TSP-Part IIA) Technical Data Sheets (TDS-Part IIB) Bid Form and Price Schedules (BF/PS-Part III) Knowing the Bid Documents Every intending Bidder is to examine and understand all instructions, forms, terms, conditions and specifications in the Bid Documents and fully know himself all the conditions and contents therein, which may in any manner, affect the scope & content of work and the costs thereof. Submission of a Bid not substantially responsive to the Bid Document in all respects and/or failure to furnish all information required by the Bid Document may entail rejection of the Bid at the Bidder s risk.

14 Clarifications on Bid Documents In case an intending Bidder finds any discrepancy or omission in the documents and specifications or is in doubt as to the true meaning of any part, he shall make a request, in writing not later than the date of pre Bid discussion, to the owner in triplicate. The owner will issue explanations, interpretations and clarifications as deemed fit in writing as a response to this request. On receipt of such interpretations/clarifications, the Bidder may submit his Bid within the date and time stipulated in the Bid invitation, All such explanations, interpretations and clarifications from the Owner shall be deemed as part of Bid Documents and shall invariably accompany the Bidder s proposal. Any verbal/telephonic clarifications and information given by the Owner or his employee (s) or his representative(s) will not in anyway be binding on the Owner. Amendment of bidding document: At any time prior to the deadline for submission of Bids the Owner may, for any reason, whether at his own initiative or in response to a clarification requested by the intending Bidder, modify the Bidding Document with amendment(s). The amendment will be notified in writing or Fax /web site to all intending Bidders who have received the Bidding Document at the address contained in the letter of request for issue of Bidding document from the Bidders. Owner will bear no responsibility or liability arising out of non-receipt of the same in time or otherwise. In order to afford prospective bidders reasonable time in which to take the amendment into account in preparing their bids, the Owner may, at his discretion, extend the deadline for the submission of bids. Such amendments, clarifications etc. shall be binding on bidders and will be given due consideration by the Bidders while they submit their bids and shall invariably enclose such documents as a part of the bid. C. PREPARATION OF BIDS Language Of Bid: The Bid prepared by the Bidder and all correspondence and documents relating to the Bid, exchanged by the Bidder and the Owner, shall be written in the English language, provided that any printed literature furnished by the Bidder may be written in another language so long as accompanied by an English translation of its pertinent passages. Failure to comply with this may disqualify a bid. For purposes of interpretation of the bid, the English translation shall govern. Bid Format Bidders have to make the Bid in the formats furnished with this Document. Verbatim without adding any printed/typewritten text of their own. Local Conditions: It will be imperative on each Bidder to fully inform himself of all local conditions and factors, which may have any effect on the execution of the Contract covered under these documents and specifications. The Owner shall not entertain any request for clarifications from the bidders, regarding such local conditions. 9.2 It must be understood and agreed that such factors have properly been investigated and considered while submitting the proposals. No claim for financial adjustment to the Contract awarded under these specifications and documents will be entertained by the owner. Neither any change in the time schedule of the Contract nor any financial adjustments arising thereof shall be permitted by the Owner, which are based on the lack of such clear information or its effect on the cost of the works to the Bidder Documents comprising the Bid: 10.1 The Bidder shall complete the Bid form inclusive of Price Schedules; Technical Data Requirements etc. furnished in the Bidding Documents, indicating, for the services to be rendered, a brief description of services, quantity and price The Bidder shall also submit documentary evidence to establish that the Bidder meets the Qualification Requirements as detailed in Clause 2.0 above and Special Conditions of Contract (including Clause 11 of I TB) All Tender Documents/ formats are to be returned completed and filled in all respects and signed by the Company Authorized Signatory wherever specified The Bid Guarantee shall be furnished in a separate cover in accordance with clause specific ITB Scope of the proposal 11.1 The Scope of the proposal shall be on the basis of a single Bidder s responsibility, completely covering all the equipment erection and other installation services specified under the

15 accompanying Technical Specifications. It will include among others as specified therein the following:- e) Receipt of equipments and material from GETCO VAV construction store and transportation, storage, preservation and conservation of equipment at the Site. f) Pre-assembly, if any, erection, testing and commissioning of all the equipments. g) Reliability tests and performance and guarantee tests on completion of commissioning As specified in the Special Conditions of Contract, no deviation whatsoever to certain conditions of the bidding documents permitted by the Owner and therefore, the Bidders are advised that while making Bid Proposals and quoting prices these conditions may appropriately be taken into consideration. Bidders are required to furnish a certificate in this regard as per the format provided in Special Conditions of Contract in a separate sealed envelope containing Bid security, which shall accompany the Technical Bid. Any Bid not accompanied by such certificate shall be rejected by the Owner and shall not be opened Bids not covering the above cited entire scope of works may be treated as incomplete and hence rejected The Bidder shall complete all the schedules & annexure in the Bid Proposal Sheets, Technical Data Sheets and specified elsewhere. The Qualifying Data should be filled in the required schedule of Bid Proposal Sheets Bid Price: 12.1 The Bidder shall indicate percentage above/below of total bid price indicated in the appropriate price Schedules, enclosed in bid proposal sheets for erection, testing and commissioning, and other services it proposes to furnish under the contract. The %ge above/below indicated shall be inclusive of all taxes and duties applicable inclusive of VAT and service tax applicable on required inputs and services The Bidder shall specifically note that the Tenders are invited on percentage rate increase/decrease based in relation to unit rates of tender price schedule Price Basis: 13.1 The Price shall be quoted on firm basis The Price quoted by the bidder shall remain fixed during the bidder's performance of the contract and shall not be subject to variation on any account save for change in quantity. A bid submitted with an adjustable price quotation shall be treated as non-responsive and rejected Taxes and Duties: 14.1 Works contract-tax: The Civil, structural and architectural portion of the contract shall be treated as works contract Consequently, any sales tax payable on the cost of these items of supply under the works contract shall also be included by the bidder in his total bid price and the owner shall have no liability whatsoever in respect of such works contract tax. However, the owner will deduct works contract tax out of the supplier s bills as per statutory rules As regards the income Tax, surcharge on income tax and any other corporate tax, including service tax at prevailing rate the owner shall not bear any tax liability whatsoever. The bidder shall be liable and responsible for payment of such taxes as attracted under the provisions of the law Notwithstanding the tax liabilities as per the sub-clause14.1 to14.4 above the owner shall have the right to make deduction at source from the amounts payable to the contractor in respect of Income Tax (on the cost of items of supply included in the works contract) as may be mandatory in terms of the law. The owner shall not bear any liability in this regard but shall issue necessary certificate in respect of such deduction made In case any tax or duty is newly introduced by the Government applicable for this contract with effect from the next day of the date submission of the bid and if the contractor is required to pay additional tax or duty, then the owner shall reimburse the contractor the additional tax or duty so paid by the contractor against submission by the contractor of documentary evidence to the satisfaction of the owner. This provision will not be applicable to transaction between the contractor and his sub-contractors. Besides the said statutory variation, no other statutory variation shall be payable by the owner The owner s liability for all taxes and duties under the contract shall be limited to those indicated by the Bidder in the Bid Proposal Sheets, subject to the statutory variations and variations as per Clause No supra.

16 If the cost to the Contractor during the performance of the Contract shall be increased or reduced by reasons of the making, passing or promulgation of any law after the date of submission of bid or by any order, regulation or bye-law having the force of law the amount of such increase or reduction shall be added to or deducted from the Contract Price as the case may be for direct transactions between contactor & owner, and not for bought out items. It is the Bidders responsibility to furnish details of taxes, duties, levies etc. applicable as on the date of submission of the bid No claim for any increase towards the statutory variation regarding enhancement of existing tax or duty or introduction of a new tax or duty applicable shall be entertained by the Owner during the extended period of contract, if any, provided the extension of the contract is required by causes attributable to the contractor The provision of statutory variation regarding enhancement of existing tax or duty or introduction of a new tax or duty will be applicable only to the direct transaction between the contractor and the owner Before quoting, the bidder may ascertain from the concerned tax authorities of Government of Gujarat the applicability of Work Contract Tax. Entry Tax, Service Tax, etc. in respect of this work and include the same in the quoted price. The Owner in this regard will entertain no separate claim, as it is the responsibility of the Bidder to pay all these taxes In addition, the conditions detailed under Special Conditions of Contract shall apply Time Schedule: 15.1 The basic consideration and the essence of the contract, shall be strict adherence to the time schedule for performing the specified works The Owner s requirements of completion schedule for the Works are mentioned in the accompanying Special Conditions of Contract The completion schedule as stated in the special conditions of contract shall be one of the major factor in consideration of the bids Contract Quality assurance: 16.1 The Bidder shall include in his proposal the Quality Assurance Programme containing the overall quality management and procedures which he proposes to follow in the performance of the Works during various phases as detailed in relevant clause of the General Technical Conditions At the time of Award of Contract, the detailed Quality Assurance Programme to be followed for the execution of the Contract will be mutually discussed and agreed and such agreed Programmer shall form a part of the Contract The Bidder shall clearly specify the list of sub-vendors from whom the bought out items are being supplied wherever specifically indicated in the tender document shall supply only from those vendors. Such details shall be accompanied by their list of previous supplies made performance reports etc. However, in case of orders are placed, specific approval shall be obtained from the owner for the vendor-supplied materials Insurance: The Bidder s insurance liabilities pertaining to the scope of Works are detailed out in Clauses titled Insurance, in General Terms and Conditions of Contract and in Erection Conditions of this Part-I. Bidder s attention is specifically invited to these clauses. Bid price shall include all the costs in fulfilling all the insurance liabilities under the Contract Erection Tools and Tackles: The Bidder under a separate schedule, in his proposal shall include a list of all-special equipment tools & tackles etc. which he proposes to bring to site for the purpose of erection, handling, testing and commissioning including performance and guarantee tests of the equipment. If any such equipment is listed anywhere else in the proposal and not specially mentioned in the above schedule, it shall be deemed to have been included in the Bidder s proposed scope of supply Brand Names: 19.1 The specific reference in these specifications and documents to any material/equipment by brand name makes or catalogue number shall be construed as establishing standards of quality and performance and not as limiting competition. However, Bidders may offer other similar material/equipment provided they meet the specified standard, design and performance requirements.
