Tender fee will be accepted in Cash and by Demand draft in favour of Paschim Gujarat Vij Company Ltd. payable at MORBI, during office hours on working days at Cash counter of Circle Office, Morbi. Bids submitted without Tender fee will not be considered. Cheques will be not acceptable. II. III. IV. All such documents should be strictly submitted by RPAD/speed post along with e-tendering only. Otherwise the offer will not be considered and no any further communication in the matter will be entertained. Any deviation found in Data / Details / Documents between on line offer (e-tendering) and physically submitted documents (Tender document fee, EMD, Technical and commercial Documents etc.) of bidder, offer of the same bidder will not be considered and no any further communication in the matter will be entertained. The Price Bid is to be submitted ON LINE only where as Technical Bid is to be submitted in Both the forms i.e. On Line as well as Physical. V. All interested parties requested to strictly abide by all terms prescribed in this RFP Document and provide accurate information to the best of their knowledge without misleading PGVCL to be considered for participation in this Project. VI. VII. Bidders should be in touch with websites & for information regarding revision/corrigendum/amendment in the Tender Document till due date of online submission and thereafter. No separate information shall be sent in this regards and also not publish in newspaper. The tenders are to be submitted by the intending bidder in single envelope with two separate sealed and super scribed envelopes as listed below: Sealed Cover no. 1 having DD/Receipt for EMD and tender fee with details written on cover as COVER OF TENDR FEE AND EMD. Sealed Cover no. 2 having Technical bid with detail written on cover as COVER OF TECHNICAL BID. Any technical questions, information and clarifications that may be required pertaining to this enquiry should be referred to the Superintending Engineer, PGVCL, Circle Office, Morbi, Old Power House Compound, Vegetable Road, Nr. Natraj Fatak, Sama Kanthe, Morbi -2. PGVCL reserves the right to reject any or all offers without assigning any reasons thereof. 4 SECTION-1 GENERAL INSTRUCTION TO BIDDER [1] GENERAL INSTRUCTION: - 1. The Superintending Engineer, PGVCL, Morbi Circle for and on behalf of "PASCHIM GUJARAT VIJ COMPANY LTD.", having its Office at Power House Compound, Morbi, hereafter called the "PGVCL" intends to INVITE tender for Work for Electrical Concealed Wiring & LAN Wiring Work for Division office Morbi at Second & Third Floor of existing Circle Office Building at Morbi. 2. The tender should be submitted in a sealed envelope on which it should be distinctly indicated the name of work & due date of opening. 3. Bidder must confirm their full acceptance to various terms and conditions of PGVCL`s specification. They should also confirm that offers are based strictly on the specification in all respects. 4. The bidders should not that the completion of above works in all respect in accordance with the time limit given below is very important and should be strictly adhered to Completion in 10 Months from the date of issue of letter for commencement of the work. Failing to complete the work within the period stipulated the contractor will have to pay Compensation as per terms of the agreement; penalty will be levied as per rules. 5. During the execution of Work, if Contractor/Labour are found to violate OR Breking the Safety rules and Regulations, then Engineer-in-Charge will serve a warning Notice on first Instance with Fine of Rs to be charged. On second Instance the amount of Fine will be Rs Even If after above two instances and fines, still Contractor found breaking of Safety Rules and Regulations then Procedures for Stop dealing must be initiated against him as per rules and regulations. 6. The bidders should furnish a list of orders for similar works executed by them and clearly mention the name of the party for whom the works have been completed. The reference of order number and date performance report of such works be finished. 7. The bids should be valid for a minimum period of 180 days from the date of opening of tender. 8. The works covered under these tender shall be carried out and governed by standard Tender and contracts for works booklet of PGVCl except where condition specified in this Tender. 9. CO-ORDINATIONS WITH OTHERS : The contractor shall have to execute the above works with the concern agencies who are Consultants/Architects/Structural co-operates in all aspects and exchanges the necessary Technical data/drawings with the consultants/architects/architects/structural Engineers/ Contractors under intimation to Engineer-in-charge to ensure proper co-ordination and satisfactory completion of the work in time. 5 10. The successful contractor shall have to sign an agreement & bond as per PGVCL`s rules on a stamp paper and necessary stamp duty charges shall be born by the contractor. [2] TENDER FEE & EMD COVER: - EMD: - The EMD is payable by Demand Draft in favour of the Paschim Gujarat Vij Company Limited payable at Morbi on any scheduled/nationalized banks or by Bank guarantee from any scheduled nationalized bank decided by Government of Gujarat time to time only. The EMD Amount is 1 % of the Tender Estimated Cost. If EMD Amount is below Rs , then EMD can also paid in Cash will be accepted. EMD of the successful bidder to whom a contract is awarded will be returned after the said bidder provides the contract performance guarantee and signs the contract agreement. If the successful bidder fails to submit a Security Deposit within 15 days from the date of LOA of the contract or fails to sign the contract agreement, then the EMD amount will be forfeited by PGVCL without any notice or proof of damages etc. The EMD of all unsuccessful bidders except that of the successful bidder will be returned after the award of the contract. No interest will be payable by the PGVCL on the above Deposit. EMD can be exempted as per Industries & Mines Department, GoG New Purchase Policy Resolution No. SPO/1095/2636(97)/CH dated for Small and Micro Scale Industries. In cases, where EMD need not to be paid, valid exemption Certificates duly notarized has to be produced/attached in place of EMD documents as per the Tender Terms and Conditions. The Micro and Small Scale Industrial (manufacturing) Units registered under Small Scale Industries of Gujarat State and holding subsequent registration with NSIC/DGS&D, Registration Certificates for the item under Tender will be eligible for exemption from payment of EMD on submission of attested copies of their SSI (SSI/ MSME Part-II) & NSIC/DGS&D Registration Certificates and Udhyog Adhar Certificate/Memorandum in EMD Cover. This benefit of exemption will not be admissible if they take part in the tender indirectly either through their dealers, agents, distributors or other intermediates. The Certificates should indicate the manufacture/service/works of items/work offered. Tenders submitted without Earnest Money Deposit by the firms, who are not eligible for any exemption, will be rejected without entering in to further correspondence in this regard and no reference will also be made. Note: The bid will be rejected out rightly; if above mandatory documents are not submitted in physical form. After tender submission date and time, bidder cannot edit their offer submitted in any case. No written or online request in this regard shall be granted. 3.2 Bidder shall submit their offer, i.e. Technical Bid as well as price bid in Electronic format on above mentioned website and date shown in tender details before digitally signing the same. 3.3 Offers submitted without digitally signed will not be accepted. 7 3.4 Offers only in physical form will not be accepted in any case. SECTION-2 Commercial Bid: General Conditions of Work: - 1. Bidder has to submit all required documents mentioned at in Instructions to Bidder. 2. Successful Bidder has to follow all the rules and Regulations of Work Safety. Required tools and Tackles for Safety are to be arranged by Bidder only. 3. Bidder is responsible to any type theft/damages of Company s material and also responsible to any type damages to any property and any kind fatal/non-fatal accidents to anybody during the execution of work. Insurance of all workers is compulsory, who are involved in Execution of Tendered work. There will be no any financial liabilities of PGVCL for damage charges paid such way. Rules and Regulations of PGVCL Works and Contracts Book are abide to Bidder. 4. Work must be completed in in specified Schedule narrated in Tender. If concerned Engineer not satisfied with quality of work, no any Time limit extension will be granted and Penalty with applicable GST will be levied on delayed portion of work. 5. Agreement must be executed within 15 (Fifteen) Days from the date of issue of LOA/LOI. Security Deposit (In form of DD/BG) within this time limit i.e. 15 (Fifteen) Days. 6. Agreement and Indemnity Bond is to be executed on Rs. 100/- Stamp Paper and cost of stamp paper is to be borne by Bidder. 7. PGVCL have full rights to accept or reject the offer received against the Tender. 8. Letter of Intent (LOI)/Letter of Acceptance (LOA) shall be issued to the short listed Bidders indicating the quantity allocated to them and the security deposit amount to be deposited by them with PGVCL. Short listed Bidders will be required to deposit the requisite security deposit within one week of issuance of LOI/LOA failing which the letter of intent will stand cancelled. The detailed work order will be issued to the short listed Bidders only after receipt of requisite Security Deposit. 9. Security Deposit: Successful Bidders will be required to deposit the requisite security deposit within 15 days from the date of issuance of LOI/LOA) of an amount equivalent to 5 % of the end cost value of the work order as a Security Deposit for satisfactory execution of the ordered. Such Security Deposit will be payable either through D.D. OR Bank Guarantees. Bank Guarantees from Scheduled / Nationalized Banks as per Govt. GR No. EMD / 10 / 2014 / 570 / DMO dated will be acceptable, SECTION-3 Commercial terms and Condition: 1. TAXS and Duties: GST The prices are excluding GST and Cess as applicable which will be paid extra on a given taxable goods and/or services. 8 indicated separately. (GST/Cess means all applicable Tax/Cess under GST Laws. GST Laws means IGST Act, GST (Compensation to the State for Loss of Revenue) Act, CGST Act, UTGST Act and SGSCT Act, 2017 and all related ancillary legislations). 2. Applicable welfare cess will be deducted from contractors each bill by PGVCL to pay the same to the respective Govt. Department. Tax will be deducted as per applicable statutory rules. 3. Statutory Deduction Statutory deduction will be made as per applicable rules & rates for TDS, GST TDS, welfare cess or any other taxes applicable time to time etc. All other statutory liabilities towards this contract will be on your part. 4. DELAYED AND LATE TENDERS: No tender shall be accepted/opened in any case which are received after due date and time of the receipt of tender irrespective of delay due to postal services of any other reasons and company shall not assume any responsibility for late receipt of tender. Any correspondence in the matter will not be entertained. 5. ARBITRATION: Any question, dispute or difference whatsoever arises between PGVCL and Bidder, in connection with this agreement except as to matters, the decision for which has been specifically provided, either party may forthwith give to the other notice in writing of existence of such questions, dispute, difference and the same shall be referred to the sole arbitration of a person nominated by Managing Director, PGVCL. This reference shall be governed by Indian Arbitration Act prevailing at the time of dispute and the rules made there under. The award in such arbitration shall be final and binding on all the parties. Work under the agreement shall continue during the arbitration proceedings unless the PGVCL or the Arbitrator directs otherwise. 6. The contractor will be responsible for complying with all rules and regulations and labour laws applicable to him and the PGVCL will not be responsible for any lapses committed by them. If there is any claim from any Government authority pertaining to the contractor s bill then same will be deducted from RA bill /Final bill/security deposit etc. or from any due payments. 7. The land required for office, Godowns and for Labour Camp will not be given by the PGVCL. The contractor has to arrange at his cost. 8. The contractor s rates should be firm and no variation clause is to be quoted by the contractors and PGVCL will be accept the same, during contractual period including extended time limit if any. 9 NOTES FOR SCHEDULES:- 1. All the columns in schedule should be filled in INK. 2. Rate quoted include clearance of site prior to commencement of work and after Completion of work in all respects and hold good for work under all conditions site, Moisture, Weather etc. 3. It may very at the time of Execution and contractor shall have to execute the work as per approved drawings given at the time of execution. 4. Certain changes may be incorporated during Electrical Wiring Work and as a result there may be increase or decrease in the above stated quantities up to any extent. In such an event, it should be noted that the contractor should not claim anything extra. These will be paid on the basis of actual quantities executed. 5. The percentage rate shall be quoted both in the words and figures. If there is any discrepancy between the rate quoted in words and figures, rate quoted in words shall prevail. 6. Further, should there be any discrepancy between the rate and amount, the rate will prevail. 7. Some items also may not be executed. For which contractor would have no claim for any loss Sustained by them. 8. The materials which are used should be Standard ISI marks only. 9. All prevailing rules of PGVCL regarding purchase are applicable to vendor which are not mentioned in this tender copy. 10. If any matter, public dispute arise between PGVCL and Vendor, Vendor is permitted to represent the matter up to tender issuing authority only and decision of the tender issuing authority will be final and biding to vendor. 11. You must maintain secrecy of drawing, technical specification and commercial conditions. 12. The guarantee / warrantee for the product should be clearly mentioned in your offer letter,also bind to you maintanence for this period if any problem.
