1 The Vanderburgh County Board of Commissioners met in session this 14 th day of November, 2017 at 3:02 p.m. in Room 301 of the Civic Center Complex with President Bruce Ungethiem presiding. Call to Order President Ungethiem: Good afternoon. I would like to welcome you to the Vanderburgh County Board of Commissioners meeting for November 14, Attendance Roll Call President Ungethiem: Madelyn, roll call please. Madelyn Grayson: Commissioner Shoulders? Commissioner Shoulders: Here. Madelyn Grayson: Commissioner Musgrave? Commissioner Musgrave: Here. Madelyn Grayson: President Ungethiem? President Ungethiem: Here, having three members present, we do have a quorum. Pledge of Allegiance President Ungethiem: If you would like to stand and join Kristen as we Pledge Allegiance. (The Pledge of Allegiance was given.) President Ungethiem: Thank you, Kristen. Introduction of Students in Attendance President Ungethiem: Since we ve already mentioned your first name, go ahead and introduce yourself and where you re from. Kristen Schneider: I m Kristen Schneider. I m a Sophomore at Mater Dei High School. Commissioner Musgrave: Welcome. President Ungethiem: Welcome to the meeting. Commission President Comments President Ungethiem: Okay, one other item on the list that I wanted to just briefly mention, as you ll see, two of the three of us need a shave. Commissioner Shoulders: Yes, we do. Commissioner Musgrave: Yes, you really do. I ll just thrown that in. President Ungethiem: Yes, my wife has explained this to me when I left the house this morning. Commissioner Shoulders: As has mine.

2 Page 2 of 12 President Ungethiem: And, there s a reason for that. It s No Shave November for public awareness for men s health. I just want to take this time to encourage all of the men in the audience and all of the men watching to get your annual checkups, get your PSA for your prostate cancer, and get your colonoscopy for colon cancer. It s something very near and dear to me, because I lost my older brother at age 39 to colon cancer. So, get checked, it can be cured. The rate of cure, if you catch it early, is almost 100 percent. Trust me, I ve probably logged enough colonoscopies for everybody, because of the impact of my brother. So, it s something you ll live through, get it done, and hopefully you ll live a long and very enjoyable life. You won t see me with this next week, because my wife will make me shave it off. ARC of Evansville Presentation President Ungethiem: Okay, action items, we re pleased to have today, the ARC of Evansville here to make a presentation. Who s going to start? Denise? Denise Seibert: Thank you for having us. My name is Denise Seibert, and I serve as the Director of Development with the ARC of Evansville. I know you guys have heard from us many times over the years, but we truly appreciate the support we receive from the Commissioners. You know, everything we do at the ARC of Evansville is about helping those we serve. Those children and adults with disabilities to achieve their full potential and greater independence. Today I have with me Karen Hinderliter. You guys have heard from myself and Deidra several times over the years, but Karen is a longtime family member of people that have utilized ARC s services, as well as a great volunteer with the ARC. So, Karen is going to share her story with you today. Karen Hinderliter: Thank you, Denise. Good afternoon, ladies and gentlemen, I m happy to have this opportunity to share my family s experiences regarding the ARC of Evansville with all of you. Our son, Brad, attended the Vanderburgh Development and Training Center, now known as the ARC of Evansville as an infant in 1975, until the age of five, when he entered the EVSC s special education program, for individuals in the severe and profound range of ability. The EVSC program was wonderful for Brad, and worked well for us, yet we were happy he could return to the ARC at the age of 21, where he thrived until his passing, about a year and a half ago, at the age of 42. The ARC of Evansville continues to hold a very special place in our hearts, as a program that nurtured Brad and supported him in an environment that included cooking classes, music and movement exercises, arts and crafts, fine motor activities and programs that strengthened his socialization and self-help skills with other clients and staff. It remains a vital link in our community, so individuals with disabilities have a comfortable, loving and challenging place to interact. We love the organization so much that our five youngest grandchildren have attended the ARC of Evansville s Child Life Center, and one of them is there currently. We appreciate the fact that there are children with disabilities integrated into the various rooms. This inclusive nature allows for academic growth among the children, while teaching tolerance and acceptance for all. We are grateful for the double security measures, the outdoor play area, the indoor large playroom, the rigorous curriculum, and the caring and capable staff. My husband and I continue to remain faithful financial supporters, including sponsoring a table at the Really Big Show, and for several years I have served on the ARC of Evansville s Donor and Community Relations Committee, working to raise awareness and funding throughout the community for this amazing organization that provides services that have nurtured our son, and many other individuals, in a safe and secure environment so we could work and continue to contribute to our family and our community. Thank you. President Ungethiem: Thank you, Karen. Karen Hinderliter: Any questions? Am I supposed to ask that? No? Thank you. Denise Seibert: Well, we just want to say thank you. You know, the ARC of Evansville receives funding through Medicaid waivers and other State funding, but as you guys have heard, that s been cut several times over the last ten years. So, the support that we get from the County Commissioners has been critical in helping us to continue these vital services, like Karen talked about today. I think Deidra says it frequently, but it is true, our successes and the successes of those we serve are your successes as well. So, thank you very much. If you have any questions we are here. Denise Seibert: Thank you. President Ungethiem: We have the ability to do some advertising here. So, can you explain to the people Denise Seibert: Okay. President Ungethiem: --the Really Big Show Commissioner Shoulders: Yeah. President Ungethiem: --when it is, how to get tickets? Denise Seibert: Yes, the Really Big Show, we re getting ready to prepare for our 16 th show. It s a community variety show. It will take place on February 10 th, right across the street at the Old National Events Plaza. Commissioner Shoulders: It s a fun evening. Denise Seibert: We have Jeff Lyons, lots of people know him as our co-host, along with Mark Scott, but, you know, there s several people, I think, in this room have been involved with the show over the years. Just great community talent. It s a very family-friendly event, and at the end of the day, we re increasing awareness and raising some significant funds for the ARC of Evansville. Last year we raised over $91,000 for our services. President Ungethiem: And, how do they get tickets? Denise Seibert: Tickets will go on sale January 2 nd at the Old National Events Plaza box office, all Ticketmaster locations, or if you want a table or a $100 VIP ticket, it s on our website, or you can call , extension 310. President Ungethiem: Alright. Denise Seibert: Thank you. President Ungethiem: Thanks. Commissioner Shoulders: Thank you. Final Reading of Ordinance CO : Amending the County s Stormwater Drainage Control Ordinance President Ungethiem: Alright, next on the agenda, final reading of ordinance CO , amending the county s stormwater drainage control. I would entertain a motion to approve final reading of that ordinance. Commissioner Musgrave: So moved. Commissioner Shoulders: Second. President Ungethiem: We have a motion and a second. Any questions or comments? Jeff, do you want to make any final comments before this long adventure in your life is complete? Jeff Mueller: I did notice tonight we didn t get a sports update before the meeting. I didn t know why that didn t happen.

4 Page 4 of 12 Commissioner Shoulders: Yeah, why was that? I m just curious. President Ungethiem: Oh, by the way Jeff Mueller: There is still one high school that s involved. President Ungethiem: --Memorial s going on to the semi-state. Jeff Mueller: Couldn t resist that. I did want to bring up that, you know, this thing, a number of changes; one, the biggie is that it adds a tech memorandum, which will be brought up for your approval at the Drainage Board on December 5 th, assuming you guys pass the final reading tonight. As I ve said before, it cleans up and eliminates a lot of language in the code. We re going to get the code a little smaller, references to more technical manuals. We do allow smaller pipes, in lieu of orifice plates, and just a whole bunch of other changes. This is the second change in the code since I ve been in office, and just trying to get this thing a little bit more cleaner, and a little bit easier to use for folks. President Ungethiem: Okay, any questions or comments for Jeff? Commissioner Musgrave: Well done. Jeff Mueller: Thank you. Commissioner Shoulders: Thanks, Jeff. President Ungethiem: Thank you very much for your work on this. Madelyn Grayson: The one thing I think we wanted to clarify, Jeff, you said it s going to become effective January 1 st of 18, is that right? Jeff Mueller: That was my intent, yes. Commissioner Musgrave: I ll amend my motion to make it effective on January 1, Commissioner Shoulders: I will second that motion. President Ungethiem: Okay. We have a motion and a second. Vanderburgh County Deputy Sheriff s Collective Bargaining Agreement President Ungethiem: Okay, the next item is Vanderburgh County Deputy Sheriff s collective bargaining agreement. Who wants to lead off? Chris? Chris Roe: Good afternoon, Commissioners. I would like to recognize you guys that can participate in the No Shave November. Unfortunately, I got left out of that sometime throughout the years, but, nonetheless, that s amazing that you guys are doing that. Well, we are going into our next generation of the collective bargaining agreement for deputies. You know, we ve met numerous times throughout the year, kind of talking about the things that we re looking to implement. You know, those things have been put before the Commissioners, and also sent some copies over to the Council. I don t think that there s any questions that have came up, as of late. So, if you guys have any now, I would be happy to answer them. President Ungethiem: Any questions for Chris. Commissioner Shoulders: I do not have any additional questions. Mine have been answered over the last several weeks. So, thank you for clarifying numerous things, Chris. Chris Roe: Thank you. President Ungethiem: Anything? Commissioner Musgrave: No, mine have all been answered. President Ungethiem: Do you see all of the yellow tabs? I m not going to bore you with all of those, because the Sheriff and I have talked, and I think I ve got most of the things clarified. So, Chris, if you would, just give a brief summary of the changes from the previous contract to this contract. Chris Roe: Sure. President Ungethiem: So, everybody understands it. In fact, there s not a salary increase in this updated contract. So, if you could just, I think there s like four bullet points or something. Chris Roe: Okay, sure. The Deputies in the contract team understand the recent budget restraints that the Council and the county has fallen under. When we sat down as a team to try to put together the best package that we could provide to the Deputies, with the Commissioners and Council s approval, we decided not to ask for pay raises. We tried to be a little bit more creative, and maybe thinking of some other ways that, you know, we could still recruit qualified applicants and retain the ones that we currently have. So, we decided to look at maybe doing some academic incentive increase, and we looked at, you know, the cost of clothing our Deputies, through uniforms, has really increased over the years, so we asked for an additional increase in that. But, overall, the things that we had initially came to the table with, there s some good negotiating on the part of the Commissioners and the Council, as well as the contract team. We were able to bring our initial numbers way down to a reasonable amount that all parties agreed on. So, I feel that, through the college incentive, the clothing allowance, that keeps us right there with other agencies with recruitment and retention. President Ungethiem: Okay. Anybody have any questions? I would entertain a motion to approve the collective bargaining agreement between, this is actually between the Sheriff of Vanderburgh County and the Board of Commissioners of Vanderburgh County with the Fraternal Order of Police Lodge 73. Commissioner Shoulders: So moved. Commissioner Musgrave: Second.

Chris Roe: Commissioners, we appreciate your help over the past year, and we appreciate your vote tonight. Our Deputies appreciate it. Thank you. President Ungethiem: Okay, thank you. Commissioner Shoulders: Thanks, Chris. EVCBA: Evolving Evansville Energy President Ungethiem: The next item on the list is the Evansville-Vanderburgh County Building Authority Evolving Evansville Energy. Dave Rector is here to talk about that. Dave Rector: Good afternoon, Commissioners, Dave Rector, Building Authority. A couple of weeks ago, I think, I had forwarded to you all from U of E a flyer. A brief description, this is kind of a mini version of a performance contracting for energy savings opportunities, at an extremely reasonable price. It s a not to exceed $5,000, with the University of Evansville. It s a project, a group of majors take on. There s Engineering majors in there, there s Finance majors, there s Marketing majors, and we re proposing that we use this at the Old National Events Plaza, and have them go through there. We have an RFP on the street now for performance contracting for our buildings. I think this would be a real good, inexpensive way to let the U of E class go through and identify opportunities we think we have, and then we would know, do we want to go ahead and jump on a full blown performance contract when those RFP s come in. So, I m requesting, suggesting that we go ahead and use this class at U of E to do this mini energy savings contract over at the Old National Events Plaza. Commissioner Musgrave: Will it be an actual written contract? Dave Rector: Joe would, I know Joe s not here, Harrison. Commissioner Musgrave: We gave him the day off. Dave Rector: Yeah, would document something for us to have. Commissioner Musgrave: Okay. Commissioner Shoulders: We like real good, inexpensive. So, I will make the motion. Commissioner Musgrave: Second. President Ungethiem: We re talking about $5,000 roughly Dave Rector: Yes, somewhere in that range. President Ungethiem: --roughly, somewhere in range? Dave Rector: It may not be that.

President Ungethiem: Opposed? (None opposed) Dave Rector: Thank you, and if I may add something else on that I m not on here, because it just happened. In Commissioner Musgrave s prior term on the Commission, she spearheaded an effort over at the Old National Events Plaza for landscaping and improvements and planters. That was what, 12 years ago, we just figured? One has just, in the last week, burst, and we had to remove it. Besides being planters, they re also a bollard for protection, traffic protection. I would like to recommend that we use Food & Beverage for that also, to replace that planter at about $3,500. Commissioner Musgrave: And, you re going to check with the company to see if they ll stand behind it first? Dave Rector: Yeah, I m going to. Commissioner Musgrave suggested that I see if there s any warranty on it. It s Longshadow out of Illinois. It s actually compressed, crushed limestone that s then poured back into a mold. So, I ll follow up and see. Commissioner Musgrave: Yeah, they re really nice. Okay, move approval. Commissioner Shoulders: In lieu of them supporting it, I second. (None opposed) Dave Rector: Thank you all. Commissioner Shoulders: Thanks, Dave. President Ungethiem: Thank you, Dave. County Engineer President Ungethiem: Moving on to department head reports. John, do you want to lead off? John Stoll: I ve got two contracts to award today. First is contract VC , concrete repairs in Brookview Subdivision. I request that this be awarded to JBI Construction for $283, JBI provided the low bid on the project. Commissioner Musgrave: I ll move approval, but when was the start and completion date on that roughly? John Stoll: The completion date is next May. I don t have a start date, as of yet. It will probably be sometime in the spring, but, I guess, if we had a mild winter they could also start sometime over the course of the winter. Commissioner Shoulders: Second. President Ungethiem: We have a motion and a second. Any other discussion? Roll call please.

President Ungethiem: Yes, and it is approved by a 3-0 vote. John Stoll: Next I would like to request to award contract VC , milling and resurfacing of roads in Keystone Subdivision to E&B Paving for $162,569. This project will cover paving on Pebble Stone, Pebble Place, Sandstone, Rimridge, Drakewick and Quaker Bridge. Again, this has a May completion date of next year. Commissioner Musgrave: Move approval. Commissioner Shoulders: Second. President Ungethiem: We have a motion and a second. One question on this, John, what percentage of Keystone would get repaved in this? John Stoll: I ll have to go back and figure that. President Ungethiem: Just roughly, is it 25 percent, 50 percent? John Stoll: This wouldn t, this would probably be 25 percent tops. President Ungethiem: Okay. John Stoll: We ve paved a number of roads out there over the last several years, and this pretty well covers the remainder of the ones that were in bad shape. I can take a look at it and see, but I would guess in the neighborhood of 25 percent. President Ungethiem: I guess, the reason I was asking is, I wanted to understand whether I was going to get a phone call from somebody that didn t get their road paved in this process, as to when they were going to get their road paved, but if we ve already repaved most of them, then this is the last portion? Commissioner Musgrave: In Keystone. John Stoll: We did President Ungethiem: In Keystone, yes. John Stoll: Yes. We did Cobble Field Drive, I believe it was the beginning of last year, and then we did a number of streets a few years prior to that. I believe this is pretty well going to take care of the ones that needed more immediate repairs. That s not to say we might not need to go out there again in the future, but I think this covers the most extensive problems out there. President Ungethiem: Okay. Commissioner Musgrave: John, I did get a call from a taxpayer who thought that Bellemeade was in worse shape than Keystone, and besides that Keystone was a subdivision and wasn t it true that subdivisions took care of their own roads? I just, you know, I had to tell them that we don t do Bellemeade, even though the County Wheel Tax was increased by the County Council, not this body, a different body, and explained that those revenues were apportioned between the city and the county. But, I did have to explain that the subdivisions were generally built by the contractor, but then those roads are turned over to the county and that we maintain them going forward. So, I know that there exists a great deal of confusion out there about who pays for what, when and why. So, we can never do enough explaining, I think.

9 Page 9 of 12 John Stoll: We do have a list of county maintained roads on the county website, so that is available to the public. It s just a report form, it s not on a GIS map, at this point, but it at least lets people know what roads are the county s to maintain at this point. Like you said, the developers build the roads, and then the county accepts them after they re completed. President Ungethiem: Do you know if the city also has that on their website? John Stoll: I do not know. President Ungethiem: So, if a person lives on a road and they need to understand whether it s being maintained by the city or the county, if they go to the county and it s not there, then it s probably the city s? John Stoll: I don t think they have one, but there s actually one GIS map that INDOT put together that shows all of the roads statewide, and I don t remember the web address, but if you go through iindotgov/indot and then go through mapping, there is a map, that if you turn the right layers on, it will show whether the roads are city streets, county maintained roads, state roads, it s a pretty comprehensive map. So, that is probably the best tool relative to city streets that I know of. Commissioner Musgrave: Maybe you could find that link and we could put it on our respective websites John Stoll: Okay. Commissioner Musgrave: --with all of the right layers turned on. Okay, thanks. President Ungethiem: Okay. Commissioner Musgrave: Did we already make a motion? President Ungethiem: Any other department heads? Brian Gerth: Bruce, I had something I wanted to kind of mention. Something we re working on in the office, I wanted to just bring you guys up to speed. You know, we get all kinds of requests from employees and taxpayers and we administer decisions that the Commissioners and Council make, but, so I feel like we re more reactive. So, I m trying to be more proactive on something, and what we re working on is a statement of benefits report, that we want to give out to the employees, probably in January, like when we give them their W-2 s. What this will show, it s just an informational report, but it will show, obviously what they made, but also what I like about this it shows what the county is paying on their behalf. So, like the employer share for health insurance, or Met Life, things

10 Page 10 of 12 of that nature. The only thing it won t show is usage at the clinic, because of the HIPPA rules there s no way we can get that information. President Ungethiem: Right. Brian Gerth: But, that s what we re working on, we re going to upload it into Self Service so that it will always be there for them to see, but we actually want to give them a paper copy in January, along with their W-2, so they actually read it. President Ungethiem: So, it will come out with the W-2? Brian Gerth: Yes. President Ungethiem: Okay. Brian Gerth: Yes. President Ungethiem: Good. Thank you. Brian Gerth: Uh-huh. New Business President Ungethiem: Okay, under new business, a discussion of the Commissioners calendar, and although we re not complete with that, we still have some negotiating to do, the first Commissioners meeting for 2018 will be January 2, I guess we need a motion to accept that. Commissioner Musgrave: At 3:00. President Ungethiem: At 3:00 p.m. Commissioner Musgrave: So moved. Commissioner Shoulders: Second. President Ungethiem: We have a motion and a second. I think the State statute says that we don t have to do it till February 1 st, but we ll get that done by the end of the year. I ve looked that up, and I m thinking Commissioner Shoulders: Wow! President Ungethiem: --you don t even establish it until February the 2 nd? Okay, but we ll have that done by the end of the year, hopefully at the next meeting. Any other new business? Old Business President Ungethiem: Old business? Public Comment President Ungethiem: Any public comment? Please come forward. Don Gibbs: I didn t sign up on the sign up sheet, so, Madelyn, please don t hate me. Don Gibbs, 3310 East Gum Street, Evansville. Bruce, I just wanted to underscore what you d said earlier. It kind of hit me about the men s health. I want to say it, because it can t be said enough, early detection, early detection and early detection. The reason I m passing this on, like you, I have someone who is very close to me that was affected by prostate

11 Page 11 of 12 cancer, and diagnosed in 2003, and is still, is thriving. So, 14 years and it s looking good, but early detection is the key. It s not just for this, it s for any kind of the carcinogenic things, but it can t be said enough, that s why I stand up here and say it again, get it in at the first of the meeting, toward the end of the meeting, a bookend thing here. So, that s all I ve got. Thank you. President Ungethiem: Okay, thank you. Commissioner Shoulders: Thanks, Don. President Ungethiem: And, correct me if I m wrong, I think the clinic can do the PSA testing. It s just a blood test, right? We ll have to look into that, but you may be able to go to the clinic and get that test completed. Okay, any other public comment? Consent Items President Ungethiem: Okay, I would entertain a motion to approve the consent items as listed on the agenda. Commissioner Shoulders: So moved. Commissioner Musgrave: I ll second, but I would like to say that, is, are we signing the monthly claims forms? Madelyn Grayson: No. Commissioner Musgrave: I would like to say that I ve been still trying to get a meeting with Council. No response. President Ungethiem: Kristin, can we see if we can work on that a little harder? Since we don t have a meeting next week, and I don t think they do either, maybe we can set something up for early next week. Commissioner Musgrave: Very early next week. President Ungethiem: Very early next week, since next week is Thanksgiving. Commissioner Shoulders: I think we were supposed to meet with them anyway, as it relates to the recent meeting we had before. President Ungethiem: Yeah. Commissioner Shoulders: So, we actually President Ungethiem: We ll continue to try to get that to happen. So, we have a motion and a second on the consent items. Any further discussion?
