1 The Vanderburgh County Board of Commissioners met in session this 14 th day of March, 2017 at 3:00 p.m. in Room 301 of the Civic Center Complex with Vice President Cheryl Musgrave presiding. Call to Order Commissioner Musgrave: I want to call to order the March 14 meeting of the Vanderburgh County Board of Commissioners. Attendance Roll Call Commissioner Musgrave: Would you please call the attendance? Madelyn Grayson: Commissioner Shoulders? Commissioner Shoulders: Here. Madelyn Grayson: Commissioner Musgrave? Commissioner Musgrave: Here, and having a quorum we will now proceed to the Pledge of Allegiance. Pledge of Allegiance Commissioner Musgrave: Will you please join me in the Pledge of Allegiance? (The Pledge of Allegiance was given.) Reminder of Final Reading of Ordinance CO Will Be 3/21/17 Commissioner Musgrave: There may be some confusion. If you are here to speak to the Human Relations ordinance, it is not scheduled to be heard today. It is scheduled for next Tuesday, that s March 21 st, and we encourage you to come back at this time. So, today we will not be taking any comments on that. Grow Southwest Local Elected Officials Agreement Chief Elected Official for Region 11 in SW Indiana Commissioner Musgrave: We ll start with our first action item, Jim Heck with Grow Southwest Indiana Workforce is here today. Welcome, Jim. Jim Heck: Thank you. Good afternoon, and thanks for having me back today. At the last meeting I gave you a copy of the Local Elected Officials agreement, and you wanted to look at it and come back. Since then, I ve talked with the Mayor, and as you know, what I m looking for is the Chief Elected Official for this county, and it has to be one of the three Commissioners or the Mayor of Evansville. Since I ve talked with you, I ve talked with the Mayor and he is willing to continue to serve in that capacity, if that s what you guys want. Then, of course, to get you to, to remind you about our elected officials meeting on April 28 th. Commissioner Musgrave: We did have our job fair. Jim Heck: We did have our job fair. Commissioner Musgrave: How did the evening go?

2 Page 2 of 12 Jim Heck: I felt like the job, that went very well. It was the first attempt we ve made with a jobs showcase, where we were trying to showcase certain employers and certain skills in our town. We, unfortunately, competed against a couple of pretty big events that night. So, parking was at a premium, even where we were at the library, but the employers that I talked to were very pleased with it. We had about 20 job seekers show up. So, that was, and what the employers told us was, for the first time we ve tried this, they thought it was a pretty good event. Commissioner Musgrave: Well, um, I was encouraged by the employers who came out, and I would like to hold another one. Jim Heck: Uh-huh. Commissioner Musgrave: Perhaps in September, after school starts and folks get settled down, and perhaps we could expand the range of the employers to regional employers? Jim Heck: We could do that. Commissioner Musgrave: I would really like to do that, and make sure you pick a night where nothing else is happening. Jim Heck: I know, that one was really, if you didn t think anything was ever going on in Evansville, you should have been here that night. Everything was going on downtown. But, I really, if you have never been to one of these, this is where the employers talk about their jobs, their benefits, and the uniqueness of that employer. I was very shocked at some of the things that I learned about some of the employers that we had been working with for a long time, about the benefits that they offer. So, it was worth it, and the job seekers told us that that s what they liked about it, to learn about the benefits, not just the wage. Commissioner Musgrave: Okay. Alright. Commissioner Shoulders: First, thanks for being here, Jim. Jim Heck: Uh-huh. Commissioner Shoulders: Apologies that I couldn t make it that night. It was my daughter s last basketball game. Jim Heck: Oh, I understand that. Commissioner Shoulders: Trophy night too. Jim Heck: Well, yeah. Commissioner Shoulders: So, I will make the motion for Commissioner Musgrave to serve on behalf of the Commissioners within the Region 11 local workforce service area. Old National Events Plaza 2017 Capital Improvement Projects Commissioner Musgrave: Next on the agenda is Dave Rector with the 2017 Old National Events Plaza capital improvement projects. Dave Rector: Good afternoon, Commissioners. I had forwarded to you the request for the 2017 Old National Events Plaza CIP to be funded through Food & Beverage. Harry Cochran and Nick Wallace from SMG are here. Excuse me, my throat here, I ve got a little catch. We did make a revision to this that I ve given you the updated copy, and are here for any questions. Commissioner Musgrave: The building looks spectacular, and I know that these will just continue moving along in that direction. Dave Rector: Thank you. We appreciate your support for the building. It s pushing 20 years old now and I think it still looks good. Commissioner Shoulders: That s hard to believe. Commissioner Musgrave: Just like all of us. None of us have aged any either. Dave Rector: Yes, some of us. Commissioner Shoulders: It looks great, Dave, thanks. Commissioner Musgrave: Is there a motion? Commissioner Musgrave: And, I ll second. Alex Yeager: HIP Employer Link Program Presentation Commissioner Musgrave: Next on the agenda is Alex Yeager to talk about the Healthy Indiana Plan Employer Link Program, a presentation. I m very excited to hear this presentation. I got a preview a couple of weeks back. Local employers could benefit their employees through this plan. Their employees would be able to afford their co-pays. Alex Yeager: Yes, so, good afternoon. Thank you for having me. My name is Alexandria Yeager, and I work for the State of Indiana in the FSSA Agency. So, I met a couple of weeks ago with Commissioner Musgrave and also Brian, and we discussed the program and we are going through the process of getting Vanderburgh County enrolled into the program so their employees can benefit. So, it is an extension off of the Healthy Indiana Plan, but it s going to benefit individuals who are currently enrolled in their employersponsored insurance. So, it s going to benefit the Evansville county and the, or the

4 Page 4 of 12 Vanderburgh County and the Evansville City employees. It will help them to better afford your health insurance. So, it s going to offer them premium assistance for their employersponsored insurance, and also help them with their out-of-pocket expenses. So, their copayments, their co-insurance and help them meet their deductibles. So, you do, this is a program offered by the State of Indiana, a newer program, a lot of people don t know about it, but you do have to be an approved employer for your employees to be able to benefit. So, again, we are almost through the process of approving you all, and then once you have been approved for this, your eligible employees will be able to enroll. So, this is going to be for your lower income employees, or your lower income families to be eligible for this type of program. It s great because it does save the State money, instead of people enrolling into Medicaid, they re getting on to their employer-sponsored insurance, and we re helping them pay for that instead. So, it does also promote workforce development in the fact that they do have to have access to their employer s insurance. So, it s a great new program, and I just wanted to talk to you a little bit about how that works. Are there any specific questions? Commissioner Musgrave: Well, I just want to recap it. Alex Yeager: Yeah. Commissioner Musgrave: So, an employer, like Vanderburgh County, or any other employer, can sign up to be a member of this plan. The employer offers health insurance and there s a premium co-pay by the employee. Under this plan, under the means test for the employee, if they re low income and that rate is established by this, by the federal government, I think. Alex Yeager: Yes. Commissioner Musgrave: They would qualify, if they did, to have part of their premium for their employer s health insurance paid, plus they would get a certain amount of money placed into, what is that, health insurance account? Alex Yeager: Yes, we call it a Power Account, and the idea is to give the member the power behind their health spending. So, they do get that premium assistance, so they get a reimbursement back for a large portion of their premiums, but we do require them to contribute a portion of their income towards the cost of the coverage, and they will also receive a HIP Employer Link card and it acts as secondary insurance when they go to their provider, pharmacy. So, basically, their co-payments, co-insurance, it s going to help them to meet their deductible too, with your high deductible health plan. Commissioner Musgrave: Well, at first glance, I know that you and Brian Gerth, the Auditor, have met, does it look like Vanderburgh County families, employee families, might qualify for this plan? Are there some instances where even local government employees would qualify? Brian Gerth: I think we re going to have some. It s going to be, I think it s going to depend on the family size that s on the plan. So, it s definitely a benefit. Commissioner Musgrave: So, if employees of Vanderburgh County might qualify for this new program, then it s likely that many employers in our community, and this is open not just to Vanderburgh County, it s open to the entire State, right? Alex Yeager: Exactly. So, and I think too, with presenting it to you all, and just with your representation of the county, and just being able to get the word out, because it can benefit any employer in the State of Indiana that does employ Indiana residents. So, it s a great new resource. I think it s sometimes hard to gauge again, we talked about this in our meeting, who would qualify, because it is based on a combined household income, but, you know, family situations are always changing. If someone loses a job and they re down to a single income, or another member is added to the family, that threshold and those guidelines are always changing. I really think it s just a great thing to offer, because, again, it has no cost, and anyone who would be eligible then would be able to receive these extra benefits.

5 Page 5 of 12 Commissioner Musgrave: Well, let s put on the record, how does an employer, or an interested employee who might convince their employer, how do they reach you? How do they get a hold of this new program? Alex Yeager: Yes, so for the employer themselves, they re going to visit the website at hipemployerlink.in.gov. Commissioner Musgrave: Say that one more time. Hip Alex Yeager: Hipemployerlink.IN.gov. Sorry, that was a little fast. Or they can Google the program, and it would come up in a Google search, Hip Employer Link. Through the website, the employer, there s a button at the top, it says For Employers, and it will take you to the online portal where you register. The reason we do have the employers register is because we have requirements on the type of plan that they offer, things like that. So, a very simple process, and then once you re approved, then your employees can enroll. How we tell the employees about it, is once their employer is approved, we come onsite for an outreach event or we work with you, as the employer, to figure out how we re going to best tell your employees about that, and they ll get all of the information there on how they should enroll. Commissioner Musgrave: Okay. Alex Yeager: Yeah. Commissioner Musgrave: Alright, well, thanks so much, Alex, for coming and telling us about this. I m sure we ll get an announcement from Brian as soon as the county is up and running. How long will that take? Alex Yeager: Well, we re just waiting on one last document. We have approved your Anthem plan, and then we re waiting on the second plan with, I think, that you offer to your union employees, that plan to be approved. Once that happens, it should just be in the next couple of weeks, I think, so. Commissioner Musgrave: And there s no cost to the employer, because you are doing all the work. Alex Yeager: Exactly, yes, there s no cost. So, thank you so much. Commissioner Musgrave: Thank you, Alex. Commissioner Shoulders: Thanks, Alex. First Reading of Ordinance CO : Community Corrections Credit Card Commissioner Musgrave: Next on the agenda is the first reading of ordinance CO , the Community Corrections credit card. This is virtually identical to some ordinances we ve had in the past couple of meetings, and these were suggested by the State Board of Accounts. Did you have something to say about this? Jodi Uebelhack: I m Jodie Uebelhack, the Community Corrections Director. I just came if you had any questions. Commissioner Musgrave: Alright, do you have any questions, Ben? Is there a motion? Commissioner Musgrave: I ll second. All those in favor signify by saying aye. Commissioner Musgrave: Aye, and the motion carries. Commissioner Musgrave: Thank you very much.

First Reading of Ordinance CO : Amending I (3): Secondary Plat Approval Commissioner Musgrave: We have the first reading of CO , an ordinance amending section , is that Joe Harrison, Jr.: I. Commissioner Musgrave: -- I (3)? Joe Harrison, Jr.: Yes. Commissioner Musgrave: Of the Vanderburgh County Code of Ordinances. Joe, will you just describe briefly, what this ordinance does? Joe Harrison, Jr.: It has to do with the secondary plat approval process. If there s an issue with Area Plan Commission regarding a modification to the primary plat that was previously approved, and someone, the developer, wishes to appeal such determination either by the Area Plan Commission or the Director of the Area Plan Commission, regarding the possibility of having to resubmit the whole plat for a redo, to start all over again, if that was to occur and someone wanted to appeal that determination by the Area Plan or the Executive Director of Area Plan, they could appeal such determination to the Board of Commissioners of Vanderburgh County by submitting a written application. Then the County Commissioners would hold a public hearing, or during a public meeting and determine the issue after all of the documentation has been submitted to the Board of County Commissioners for consideration. So, this is the first reading of that particular ordinance change, and the second reading, if it passes, would be next Tuesday. Commissioner Musgrave: Alright, is there a motion? Commissioner Musgrave: And I will second. All those in favor signify by saying aye. Commissioner Musgrave: We ll have second reading next week. County Engineer Commissioner Musgrave: Department head reports. Are there any department heads here for a report? We have some things to vote on, I believe, for the County Engineer. John Stoll: The first item I have is a change order on the Heckel Road project. This is change order number eight. This is for an increase of $1, This is to cover the cost to put an alternate casting in on an area drain along the south side of the road. The casting

7 Page 7 of 12 that was planned would not fit, and this is the increased cost associated with making that switch. Commissioner Musgrave: Okay, are there any questions? Do you want to do the entire group and we ll vote on them as a group? Or would you prefer that they be done one at a time? Joe Harrison, Jr.: You might want to do them separately. John Stoll: Okay. Commissioner Musgrave: Okay, is there a motion for change order number eight? Commissioner Musgrave: And, I ll second. All those in favor signify by saying aye. John Stoll: Next, I have a letter that needs to be submitted to the Water & Sewer Department to request acceptance of the sanitary sewer that was constructed as a part of the Heckel Road project. This is just part of their standard procedure as far as closing out a project and getting it accepted by them for maintenance. This letter says that the county will maintain, will correct any defects in the first year, and it establishes the value of the sanitary sewer. We ll submit this, along with the as-built plans to the Sewer Department and formally request the acceptance. It just needs Commissioners approval. Commissioner Shoulders: So moved, unless there s a question. Commissioner Musgrave: I ll second. I call for the vote on the Water and Sewer letter acceptance for Heckel Road. All those in favor signify by saying aye. John Stoll: Next I ve got an administrative settlement request for parcel 51 on Green River Road. This is a request to increase the offer by $5,070 to cover the cost of replacing a fence on that property. The property owner provided an appraisal, an estimate to cover the cost of that fence. So, that way it was their basis for saying they were entitled to additional funds for this. I discussed it with the County Attorney, and we both agree that this should be approved. Commissioner Musgrave: What was that address on Green River Road? John Stoll: I didn t put that on the list. I gave it to Madelyn. Commissioner Musgrave: Is there a motion to accept the administrative settlement for the parcel on Green River Road? John Stoll: Parcel 51. Commissioner Musgrave: Parcel 51. Commissioner Musgrave: And I will second. All those in favor signify by saying aye. Commissioner Musgrave: Aye. Any opposed? (None opposed)

8 Page 8 of 12 Commissioner Musgrave: The motion carries. John Stoll: Next, I ve got requests for approval to make several offers on Green River Road. The parcel numbers, the owners and the amounts are as follows; parcel 9, Barton Farms, LLC, the offer amount would be $65,500; parcel 25, owned by Grimmer, the offer would be $500; parcel 26, owned by Grimmer, $12,800; parcel 27, owned by Kiegel, $1,925; parcel 28, owned by Niemeier, the offer would be $2,050; parcel 29, owned by Myers, the offer amount will be $5,300; parcel 34, R&H Truck & Trailer Sales, Incorporated, $25,150, and parcel 50, owned by Young, the offer amount would be $5,125. All of these offer amounts are based upon appraisals done by the county s appraiser. So, if you approve this, then we ll get the offers made to these property owners. Commissioner Shoulders: What was the last amount you said? John Stoll: $5,125. Commissioner Shoulders: Okay. Commissioner Musgrave: Is there a motion? Commissioner Musgrave: I ll second. All those in favor signify by saying aye. John Stoll: Next, I have a letter to, from the Evansville Water and Sewer Department to request closure of Waterworks Road for them to do some soil borings. The request would be for up to two weeks. They need to do some soil borings to do some aquifer testing. They said they had tried to get some temporary right-of-way to get on to private properties located outside the road, but they were unsuccessful in that. So, then they asked if they could close the road and do the soil borings within the right-of-way. They would provide all of the detour signs and barricades to close the road, and we ll work with them to send out the media notification on when the actual closure will take place. On that basis, I didn t have any problems with it, so I would recommend approval. Commissioner Musgrave: And exactly where on Waterworks is this? John Stoll: They didn t give me the exact location other than it would be between LST Drive and 41. Commissioner Musgrave: Okay. John Stoll: They re going to do a number of soil borings, but they didn t give exact spots. Commissioner Musgrave: This is the Waterworks Department? John Stoll: Yes. Commissioner Musgrave: Do we know why they re doing aquifer testing? John Stoll: It s for aquifer testing, but they didn t give me all of the details as far as what they re hoping to find out from the testing. Commissioner Musgrave: Okay. Is there a motion? Commissioner Musgrave: And I will second. All those in favor signify by saying aye.

9 Page 9 of 12 John Stoll: The last item I have is for parcel 32 on Green River Road. The parcel is owned by Murphy Homes, Incorporated. We ve got a waiver for the requirement to have a corporate resolution for authorizing his signature on this acceptance of this right-of-way offer. It s $3,200, if I remember correctly. On lower dollar amounts like that, INDOT procedures will allow you to waive the requirement for the corporate resolution authorizing approval. I ran this past the County Attorney, he agreed that we could proceed this way, and since we re following INDOT procedures, I would recommend approval of the waiver. Commissioner Musgrave: Alright, is there a motion to approve the waiver for parcel 32? Commissioner Musgrave: And I will second. All those in favor signify by saying aye. Commissioner Musgrave: Other department heads with action items that are not already on the consent agenda? Okay. New Business/Old Business Commissioner Musgrave: New business? Is there any new business? Any old business? Public Comment Commissioner Musgrave: Secretary, has there been anyone sign in for public comment? Madelyn Grayson: No. Commissioner Musgrave: No? Alright. Consent Items Commissioner Musgrave: Then we move now to the consent agenda. As you can see there s a long list, and we have already heard the County Engineer s department head report. Is there a motion for the consent agenda? Commissioner Shoulders: Comment, perhaps first? Commissioner Musgrave: Yes? Commissioner Shoulders: I did want to address, in regards to letter C in the consent items, under employment changes. I believe, effective Monday, April 3 rd we would be hiring Part Time Campgrounds Manager, Zelma Tuley, and Director of Burdette Park, Patrick Tuley. A little bit about Patrick, for those of you who don t know, he s held progressive responsibility and operational leadership of the third largest school corporation the last 20 years, serving as Chief Facilities Officer, one year as Chief Financial Officer as well. As Chief of Facilities, he s managed oversight of nearly five million square feet of schools and support buildings, as well as approximately 700 acres. He s managed custodial services, maintenance, remodeling and construction of all buildings. Full time staff consisted of 166 custodians, ground crew, 46 maintenance workers and so forth. Vanderburgh County native, grew up here as well. So, as you all know, our sole focus is finding the best qualified individuals to manage these two county

10 Page 10 of 12 positions, and Patrick and Zelma, each in their own right, have a long history of competent public service to Vanderburgh County. I did want to provide those comments at this time. Commissioner Musgrave: So, is there a motion to approve the consent items with the employment changes as outlined? Commissioner Musgrave: And I will second. All those in favor signify by saying aye. Madelyn Grayson: Rezonings. Commissioner Musgrave: Oh, rezonings, boy, and I m a member of Area Plan. I nearly forgot to do that. We have two first readings tonight, and I will read them both into the record together, and, I think, one vote will be sufficient. We have a first reading of rezoning ordinance VC , change from Ag, agriculture to C-4 with a use and development commitment. So, we will have a motion to approve this rezoning ordinance and to send it to the Area Plan Commission, as well as a first reading of rezoning ordinance VC , a rezoning from agriculture to C-2 with a use and development commitment. Is there a motion to approve these two rezoning ordinances on first reading and to send to the Area Plan Commission? Joe Harrison, Jr.: Why don t you go ahead and just take two separate votes.
