1 The Vanderburgh County Board of Commissioners met in session this 7 th day of August, 2018 at 3:05 p.m. in Room 301 of the Civic Center Complex with President Bruce Ungethiem Presiding. Call to Order President Ungethiem: Good afternoon. I would like to welcome you to the Vanderburgh County Board of Commissioners meeting for August 7, Attendance Roll Call President Ungethiem: Madelyn, attendance please. Madelyn Grayson: Commissioner Shoulders? Commissioner Shoulders: Here. Madelyn Grayson: Commissioner Musgrave? Commissioner Musgrave: Here. Madelyn Grayson: President Ungethiem? President Ungethiem: Here, having three Commissioners present, we do have a quorum. Pledge of Allegiance President Ungethiem: Please stand and join me in the Pledge of Allegiance. (The Pledge of Allegiance was given.) President Ungethiem: Thank you all. Commissioner President Comments President Ungethiem: Any students in the area? Are you here on assignment? Just visiting? Okay. Going to school tomorrow? Alright. We ll start to probably see some students that will have assignments come to the meeting in the next few weeks. Just a word of caution for everyone, most of the schools, I do believe, start tomorrow. So, you re going to see these big, yellow busses running around. Be cognizant of the fact that the traffic is going to change, and there s going to be a lot of kids running around. So, take a little extra time, slow down a little bit in school zones, and let s make sure that all of the children are safe as they go back to school, as I know my six grandchildren are so eager to do. Permission to Open Bids for VC : Road Repairs in Eagle Crossing Sub & Milling of Boonville-New Harmony Road President Ungethiem: Moving on, the first item is permission to open bids for VC This is road repairs for Eagle Crossing Subdivision and milling of Boonville-New Harmony Road. Joe, you have the bids in front of you, correct? So, I would entertain a motion and a second to open the bids. Commissioner Musgrave: So moved. Commissioner Shoulders: Second.

Notice of Public Hearing for RQAW Jail Feasibility Study President Ungethiem: Next action item is the notice of public hearing of RQAW Jail Study on August 21, 2018 at 3:00. This is a normal Commissioners meeting date, which is the 21 st at 3:00. There will be a public hearing on the information that we have gathered to date about the jail. We want to give everybody an opportunity to come in, take a look at that information, ask any questions. There will be a number of items that will be happening in the next month or so regarding the jail. We re looking for consultants to assist us in that jail project, and so, we thought we would give the public an opportunity to ask any questions that they might want to ask at this point in time. Commissioners, any comments about that meeting? Commissioner Musgrave: Not about the meeting, but is the Jail Study already on our website, so that folks could go look at it? President Ungethiem: I don t know Commissioner Musgrave: If it s not, I want to make sure that it is so that they could know what they re talking about. And, I m also willing to just hear comments about the jail in general. If people feel that they want to say something about it, I would like for them to feel free to come forward at this meeting. President Ungethiem: If anybody, yeah, if anybody has any questions, obviously, this is an open meeting. Any questions about the jail, or the study or the information that we have collected to date, anybody have anything they want to talk about today is fine. If you want to wait till the 21 st, that s fine as well. Seeing none, we ll move on. And, we will get that Mark s in the room, we will get that up on the website. We need to get that study on the website. I ll have Kristin Joe Harrison, Jr.: Yeah, we have a thumb drive, but we re going to have to see if we can get that on. So, there s got to be a way to do that. Commissioner Musgrave: And, there s Joe Harrison, Jr.: Mr. Rector has a couple of thumb drives, so. Dave Rector: I m getting some additional ones made. I forwarded to you, earlier, a questionnaire and scope of services Joe Harrison, Jr.: Right. Dave Rector: --and everything that s going to be in the RFQ package. If you get a chance to look at those please. President Ungethiem: Okay. Joe Harrison, Jr.: But, as far as the study is concerned, maybe we can get that up on our website too, somehow. Commissioner Musgrave: And, one more Dave Rector: I m sure we can get somebody that knows how to do that. Joe Harrison, Jr.: Yes, I think we can. President Ungethiem: Or, a link to it, so we can get to it. Okay.

Commissioner Musgrave: We, in conjunction with the Building Authority, we are publishing an ad on Thursday, calling for proposals for jail design, architectural and engineering. Joe Harrison, Jr.: Yes. Commissioner Musgrave: So, look for that in Thursday s Courier. President Ungethiem: Okay. That s a public notice for the Commissioner Shoulders: RFP. Joe Harrison, Jr.: RFP. Dave Rector: RFQ. President Ungethiem: RFQ Commissioner Shoulders: Q. President Ungethiem: --for the various vendors to get the information and get in touch with us. Okay, any other action items? County Engineer President Ungethiem: Moving on to department head reports. John? John Stoll: The first item I have is a request for a sidewalk waiver in Harmony Hollow Acres Subdivision. That s located off of New Harmony Road, about three quarters of a mile west of Resurrection. The Plan Commission recommended, by a vote of eight to one, to recommend approval of the waiver. So, I would also recommend approval of the waiver. Commissioner Musgrave: Motion to approve the waiver. Commissioner Shoulders: I will second to approve the waiver. President Ungethiem: We have a motion and a second to approve the sidewalk waiver on Harmony Hollow Estates. Any further discussion? Any discussion from the audience? Seeing none, all of those in favor signify by saying aye. All Commissioners: Aye. President Ungethiem: Opposed? (None opposed) President Ungethiem: The motion carries. (Motion approved 3-0) John Stoll: The other item I have is a letter to submit to INDOT to request a project number for University Parkway. This would be in conjunction with the environmental study that would, that is going to be done between Diamond and I-64. This letter would be to try to get it in their system and proceed from there, as far as getting the environmental reviews done. We can then submit the letter to INDOT and find out where we go from here. Commissioner Musgrave: Do you need a motion to approve the letter? Joe Harrison, Jr.: It wouldn t hurt. Commissioner Musgrave: Okay, so moved. Commissioner Shoulders: Second.

4 Page 4 of 12 President Ungethiem: We have a motion and a second to send the letter to INDOT for University Parkway, and this is Diamond Avenue all the way to I-64. So, it s the full length. John Stoll: Right, the environmental study, correct. President Ungethiem: The environmental study for the full extension of University Parkway. Okay, any further discussion? Any comments from the public? Seeing none, all of those in favor signify by saying aye. All Commissioners: Aye. President Ungethiem: Opposed? (None opposed) President Ungethiem: The letter will be approved. (Motion approved 3-0) County Attorney President Ungethiem: John, stand by. Joe, do we have Joe Harrison, Jr.: Yes. President Ungethiem: --numbers? Joe Harrison, Jr.: We do have numbers. This is the bid submissions on VC , street repairs in Eagle Crossing Subdivision and milling of Boonville-New Harmony Road. There were two bids that were submitted. The first bid is from J.H. Rudolph, that bid amount is $370, The second bid is from E&B Paving, and that bid amount is $331,109. So, there were two bids, J.H. Rudolph and E&B Paving. I would ask that these bids be taken under advisement and reviewed, and Mr. Stoll will come back with a recommendation at our next meeting on the 21 st of August. Commissioner Musgrave: Motion to take the bids under advisement. Commissioner Shoulders: I will second the motion. President Ungethiem: We have a motion and a second to take these bids under advisement. John, do you know how much we had estimated for this? John Stoll: I don t remember off the top of my head. The last estimate I saw we had the numbers for Eagle Crossing, but I can t remember what it was off the top of my head with the milling included on top of that. President Ungethiem: Okay. John Stoll: I ll look it up and I ll send you an and let you know. President Ungethiem: Alright. Any further discussion? All of those in favor signify by saying aye. All Commissioners: Aye. 5 Page 5 of 12 New Business President Ungethiem: Under new business, the first item is a discussion of the U.S. 41 and the Lloyd Expressway corridor studies. There are two studies that are currently underway, and my understanding is these studies were commissioned by the Indiana Department of Transportation. A consultant, one consultant is doing the corridor Highway 41, basically from the northern county line all the way to the southern county line. And, a second consultant is doing a study on Lloyd Expressway, for our purposes, from county line to county line, but, I think it actually extends into, a little bit into Warrick County for sure, and I don t know if it goes into Posey County or not. These are studies to put together recommendations for improvements to the road. So, for those of you who have not been following that, that s what these studies are for. They do the traffic studies, and they do accident reports, they try to figure out where we have issues on those roads, and then put together potential recommendations for improvements to the road. So, then, from that I ll open it up to the Commissioners, any discussion about these studies? Commissioner Musgrave: Yes, I have questions for Seyed. If he would please come forward to the microphone. Seyed Shokouhzadeh: Seyed Shokouhzadeh, Executive Director for Evansville MPO. Before you ask your question, there was a note that I m supposed to come here and it says it s not about the studies. So, I don t know what kind of answer I can give you. Commissioner Musgrave: Okay. Who authorized the studies? Seyed Shokouhzadeh: Who authorized the studies? Commissioner Musgrave: Uh-huh. Seyed Shokouhzadeh: The study is commissioned by INDOT. I guess that would be a good question for INDOT. Commissioner Musgrave: Okay, so, the MPO didn t authorize them? Seyed Shokouhzadeh: No, that s the question for INDOT, yes. Commissioner Musgrave: INDOT? Okay, and, so the State government then probably paid for it? Seyed Shokouhzadeh: That, again, would be a very good question for INDOT. Commissioner Musgrave: Okay. You said, in your , that it would be done soon. Do you have any kind of timeline on that? Seyed Shokouhzadeh: I do not. That would be a good question for INDOT. Commissioner Musgrave: But, you said it would be done soon, so you must have some idea. Seyed Shokouhzadeh: No idea. Commissioner Musgrave: Okay. After it gets done, what s the next step? Seyed Shokouhzadeh: questions for INDOT. That, again, look, I hate to repeat this, these are all good Commissioner Musgrave: Okay. Seyed Shokouhzadeh: This is their project. They are running it, and these are excellent questions for INDOT. President Ungethiem: And, Seyed, when you say INDOT, who would we need to Commissioner Shoulders: It would be Rusty. President Ungethiem: --contact?

6 Page 6 of 12 Seyed Shokouhzadeh: I would start with the District. President Ungethiem: The District Director Commissioner Shoulders: Rusty, is that Rusty? Commissioner Musgrave: Rusty? President Ungethiem: --who is Rusty. Seyed Shokouhzadeh: Yeah, that s where I would start. President Ungethiem: Okay. Commissioner Musgrave: Okay. Commissioner Shoulders: He s usually in town once a month maybe? Seyed Shokouhzadeh: Absolutely. Commissioner Shoulders: Okay. Seyed Shokouhzadeh: He s a member of our policy board. Commissioner Musgrave: I know that as part of these studies they held an invitation only meeting for both the 41 study, and then another invitation only meeting for the Lloyd study, and then they held a meeting at the Chamber of Commerce, and that was part of their, the contractors/the consultants, written contract. They were contracted to do that, because I did ask if they could come and make these presentations here, at the Commission Office, and Rusty Fowler said no. Commissioner Shoulders: Fowler, yeah. Commissioner Musgrave: Right, they couldn t do it. But, at the Chamber of Commerce meeting, I was there, and there were, I don t know, 40 or 50 people there, one of the intersections on 41 came up, and that was the proposed stoplight at Hillsdale. Just so you know, the 41 study calls for the western side of Hillsdale to have no access to U.S. 41. Right now it has full access, just as the eastern side has full access. In other words, you can turn right, you can turn left, you can go straight across. At the Chamber meeting folks were discussing it, and it was brought out that the western part of Hillsdale is proposed to be closed so that there will be no access to 41 at all, and the eastern part was to have right in/right out. So, that you could go right out, go up a distance, do a u-turn and then go back. Now, the Hillsdale intersection has been, I ve had at least two inquiries in the last six weeks from folks wanting to know the status of the stoplight. So, I ve been ing that question to John, and John s been talking to, about setting up a meeting with INDOT. Well, I was absolutely horrified to hear, I believe it was Pam Drach from your office, announce at this Chamber meeting that, based on this draft study that isn t done and you don t know when it s going to be done, that you didn t commission, that s been commissioned by the State, that the MPO had decided that, to tell INDOT not to put a stoplight there. So, my question to you is, when did the MPO vote on this? And, other than making an executive decision, was there some sort of official decision made to tell INDOT to pull any proposal for a stoplight at Hillsdale and U.S. 41? Seyed Shokouhzadeh: Well, good question, but I m not ready to answer that. I ll research it and get back with you. Commissioner Musgrave: When will you get back with me? Seyed Shokouhzadeh: As soon as I get the answer. Commissioner Musgrave: Can I have it in writing so that, and have it sent to all of the Commissioners? Seyed Shokouhzadeh: Absolutely. Commissioner Musgrave: Will it be within a week? Seyed Shokouhzadeh: I have no idea.

7 Page 7 of 12 Commissioner Musgrave: I mean, you were sitting next to Pam Drach when she said this. Seyed Shokouhzadeh: I have no idea Commissioner Musgrave: And, you didn t contradict her. Seyed Shokouhzadeh: This, me coming here, I have no idea why I m here and what I do, so I m not prepared to answer any questions. Commissioner Musgrave: Okay, but you were at the meeting? Seyed Shokouhzadeh: Absolutely. Commissioner Musgrave: Right. Okay, so, apparently the MPO is making decisions on behalf of the board without even talking to the board about these decisions. Next, I want to address a comment that you made about the Burkhardt overpass at the Chamber meeting. One of the key elements of the Lloyd Expressway study is the lack of any future overpasses. There are several other traffic moving proposals in there, that perhaps there was something called a Michigan left, and taking other intersections and making them right in/right out, but not one overpass. One of the things that Mr., I can t pronounce your last name. I ll just call you Seyed. Seyed Shokouhzadeh: I ve been called worse, so, try, whatever you like. Commissioner Musgrave: I would love to get it right, but I don t want to mangle it. Seyed Shokouhzadeh: Don t worry about it. Him. Commissioner Musgrave: Seyed said at the Chamber meeting was, you announced that the public had decided some years ago that they didn t want any more overpasses. Seyed Shokouhzadeh: I did not say that. Commissioner Musgrave: And you specifically referenced the Burkhardt Seyed Shokouhzadeh: I did not say that. Commissioner Musgrave: Well, do you want to tell me what you said? Seyed Shokouhzadeh: I referenced let me finish please. What I referenced was, any project that INDOT bring to the table, it goes to the public process. Commissioner Musgrave: Alright. Seyed Shokouhzadeh: And that project went to the public process, and public decided that s not how they want it, and it went away. That s what I said. Commissioner Musgrave: I was Commissioner in 2005 when that was proposed, there was never a public process. Seyed Shokouhzadeh: There was a public meeting scheduled, and, I don t want to get into the detail at this point, but we can discuss that, what happened later. Commissioner Musgrave: There was no public hearing. Seyed Shokouhzadeh: It was scheduled, and it was killed. Commissioner Musgrave: And it was killed not in the public, and I can tell you that it was killed by then Mayor Weinzapfel. Seyed Shokouhzadeh: That s public. Commissioner Musgrave: Who was.no, he, no more public than if I called you up and said don t do that. Seyed Shokouhzadeh: He speaks for public. Commissioner Musgrave: So do I, and please stop interrupting me, Seyed.

8 Page 8 of 12 Seyed Shokouhzadeh: (Inaudible. Talking over each other.) He s a public official. Commissioner Musgrave: I m going to ask you stop interrupting me. Seyed Shokouhzadeh: I have to respond to the Commissioner Musgrave: There was, there is a public process, and the public process was voided by a single elected official, because he wanted, he, uh, there was some discussion among car dealers that they didn t want an overpass at that site, because it would disrupt the view of the car lots. So, Seyed, I want you to stop saying that the public, in Evansville, chose to not have anymore overpasses, because that clearly did not go through a public process. And, I would like you to stop relying on that incident as the reason for supporting the Lloyd, or any other study, that doesn t have overpasses in it. My communication with the public indicates that they think that the Lloyd Expressway will be an expressway, in actuality, and not just in name, and I believe that you are misleading INDOT by offering this verbal support, by saying that there was a public process and the public decided something. Seyed Shokouhzadeh: Now, may I answer? I do appreciate your suggestion, but I do make my decision on what I can hear, and what I heard. Thank you for the suggestion. Commissioner Musgrave: What decisions are you making? Seyed Shokouhzadeh: What my opinion is. Commissioner Musgrave: And, what would that be? Seyed Shokouhzadeh: Any opinion that I like to have about things, yeah, any opinion. Commissioner Musgrave: I think that you are permitted, as the Executive Director of the MPO, to have the opinion of the board Seyed Shokouhzadeh: No Commissioner Musgrave: --and until you ask the board, you don t have one. Seyed Shokouhzadeh: --and if you don t like my opinion, you are more than welcome to the board and voice opinion. Commissioner Musgrave: I will be, and I am now. Seyed Shokouhzadeh: Absolutely, you re quite welcome. Commissioner Musgrave: So, I would like you to stop expressing something that didn t occur. Seyed Shokouhzadeh: Well, I appreciate your opinion. President Ungethiem: Okay, any other discussion about the Expressway corridor studies themselves? Anybody have anything they want to talk about? Again, this is in a, my understanding is that the studies are in a preliminary situation right now. That INDOT has not made them public, at this point in time. In fact, I think Rusty has made that, Rusty Fowler who is the INDOT District Leader for Vincennes, has made that clear that he s not willing to release that information at this point in time. So, until we get that information released from INDOT, it s just somebody s thoughts, at this point in time, about what they need to do. I have seen both studies Commissioner Shoulders: Uh-huh. President Ungethiem: --there are things in both of those studies that I don t agree with, and I had voiced my opposition to those at the select hearings where I was invited. They ve taken those down and recorded those. I have not seen anything come back from a standpoint of INDOT coming back with a secondary plan, or any kind of additional information, after having gotten some of that public opinion. So, I would suggest we contact INDOT, see when that next set of information is going to come out, and let s see where they fall on some of these intersections that are in drastic need of improvement in our county.

9 Page 9 of 12 Commissioner Musgrave: Let me just say this, just like when Mayor Weinzapfel could make a single phone call and kill an overpass at a crucial intersection, without benefit of a public hearing in any way, drafts tend to become reality, and if the draft doesn t say what we want the reality to be, we are in a really tough spot later. I have a copy of, it was at that time, the draft for the Lloyd Expressway, if you want to me at my official address, I can give you that one. I do not have a copy of the U.S. 41 study, and Rusty Fowler has, in writing, refused to give that to me. Saying, again, that it s a draft, it s still a public record, whether or not it s a draft. So, you know, I think he s mistaken in his withholding of that information. But, the public should be speaking loudly, engineers speaking loudly, business owners up and down 41 and the Lloyd. Once they issue a final document, it s likely that that will be the final document, and they will start planning it. What really disturbed me about the MPO s decision, all by themselves, to pull any discussion or any future action by INDOT on the traffic light at Hillsdale, is that none of the things in either of these studies, none of the proposed projects are on a funded list, and the funded list that they have now is like five years into the future. So, for years, even if they decided they were going to do every single one of them, you wouldn t see any funding for five years, and, we re having deaths and accidents at Hillsdale and 41. I think we should be taking interim action to save lives. So, I m particularly troubled by this one. President Ungethiem: audience. Any other discussion on this? We have a person from the Commissioner Shoulders: Seyed, thanks for taking your time. Seyed Shokouhzadeh: You re welcome. President Ungethiem: Thank you, Seyed. Seyed Shokouhzadeh: Sure. Commissioner Shoulders: Absolutely. Commissioner Musgrave: (Inaudible. Talking over each other.) Eldon Maasberg: I hate seeing him leave, that s why I m talking. President Ungethiem: Please state your name. Eldon Maasberg: Eldon Maasberg, with University Parkway the man decided, we ve got to have someone killed there first? Is that his theory, what he just said? Commissioner Musgrave: We have had people killed there. Eldon Maasberg: I mean, with that intersection in front of the school, with not making an overpass out of it, somebody is going to get killed there. And, school s starting tomorrow, I think it is for college kids too. Commissioner Musgrave: Which intersection? Eldon Maasberg: The University Parkway in front of the school, the overpass with the kids going to school, the farmers and people coming from the Mt. Vernon area and wanting to head back toward north, cannot get on the University Parkway, because the traffic is stacked full. It amazed me, when I went to those hearings, they, just about what he said awhile ago, it s falling on deaf ears. While I m up here, I would like to also, a lot of my neighbors are a little surprised to see that University Parkway is going to be extended, because they, I was under the impression the 9,000 and some odd dollars that you passed for a feasible study, now has went all the way to I-64, and here we ain t fixed the first bridge, the first mile we put in umpteen years ago. Commissioner Musgrave: Wait, the Lloyd study does have the Eldon Maasberg: No, University Parkway. Commissioner Musgrave: Yeah, the Lloyd study that we were just talking about Eldon Maasberg: Yeah.

10 Page 10 of 12 Commissioner Musgrave: --does address University Parkway overpass. Eldon Maasberg: But, he didn t say much about it at that meeting that we were at at Central Library. Commissioner Musgrave: I ll send you Eldon Maasberg: I was at that too with ya. Commissioner Musgrave: --except that they re not going to change anything. Eldon Maasberg: Yeah, I know. Commissioner Musgrave: INDOT says it s just fine. Eldon Maasberg: I know, that s why I made that remark. It looks like somebody has to get killed there before they re willing to address the problem. Commissioner Musgrave: I m not even sure that will make a difference. President Ungethiem: Eldon, we understand your frustration. I was at that meeting Eldon Maasberg: I know you were. Both of you were. President Ungethiem: --and I made the comment Eldon Maasberg: And here he walked out. President Ungethiem: --I made the comment about that being a very busy intersection and that it needed to be fixed, and I was frustrated as well that INDOT wasn t paying more attention to the fact that, you know, 10,000-15,000 people go through that intersection everyday, and a lot of them are 18, 19 & 20 year old college students. Eldon Maasberg: Right, I think, I was hoping he would stay and hear what I had to say, but it sounded like to me he didn t want no part of it. Thank you anyway. President Ungethiem: Alright. Commissioner Musgrave: Thanks, Eldon. President Ungethiem: Thanks, Eldon. Old Business President Ungethiem: Alright, we ll move on to old business, and we will talk about the Vanderburgh County Transportation Capital Improvement Plan and Program, C-I-P-P, CIPP for short. This is a plan that was put together, has been in the process of being put together for about six months now, I think. We just recently got the final version of that, and I will open it up for any discussion that the Commissioners want to have on it. Commissioner Musgrave: A couple things, first I ve asked that it be placed on our website as well, so that interested members of the public can go ahead and look at it. Second, the projects that are our top priority, that s under constant review and adjustment. So, it s not like this is fixed in stone. We will always be addressing those numbers, or those needs, and if funding becomes available for something that s in the middle of it, then it Commissioner Shoulders: Adjust. Commissioner Musgrave: --would get moved. So, I just wanted to say that. I also wanted to thank John Stoll, the County Engineer, for the tremendous amount of hard work that he put in. It, along with American Structurepoint, but I know that John had to do a great deal of work, behind the scenes, and I really appreciate that. President Ungethiem: Any comments? Commissioner Shoulders: I just want to echo Commissioner Musgrave, kudos to John Stoll for the continued work on this and working with Structurepoint, among others.

11 Page 11 of 12 President Ungethiem: This is a study that has, like I said, has been in the works now for about six months. It is a comprehensive study of all of Vanderburgh County. It is 132 pages long, so it s not something that we would necessarily print out, which is the reason why we want to get it up on the website, for those of you who want to take a look at it. It will be on the website hopefully by the end of the week. You can go in and take a look at how decisions, how the rankings were done on the various roads, the estimated cost of fixing the roads. There are maps included that show the various corridors, both north and south and east and west. So, there s a lot of good information about that. I would love to be able to tell you that we ve got enough money to do all of this, but, obviously we live in the real world, and that s not the case. So, there s the reason for the prioritization of the projects, and doing the one s that are needed and are most highly traveled first.
