1 The Vanderburgh County Board of Commissioners met in session this 8 th day of August, 2017 at 3:01 p.m. in Room 301 of the Civic Center Complex with President Bruce Ungethiem presiding. Call to Order President Ungethiem: Good afternoon. I would like to welcome you to the Vanderburgh County Board of Commissioners August 8, 2017 meeting. Commission President Comments President Ungethiem: Just a reminder for everyone out there, and those who are watching us on t.v., that school is starting this week. So, let s be mindful of that and slow down a little bit and watch for those big, yellow things that have a bunch of kids in them, so we don t have any issues with school back in session. First Reading & Permission to Advertise Notice of Public Hearing: Vacation Ordinance CO.V : Vacation of Drainage Easement: Lot 48: Blue Heron: 5122 Bayshore Dr. President Ungethiem: Okay, the first action item is a first reading and permission to advertise notice of a public hearing for vacation ordinance CO.V This is a petition to vacate a portion of the drainage easement at 5122 Bayshore Drive, Lot 48 of Blue Heron Estates. County Engineer President Ungethiem: Moving on, we don t have any other action items, so we ll move on to department head reports. John, do you want to lead off? John Stoll: The first item I have is a final acceptance form for the Heckel Road project. This was for the reconstruction between Oak Hill and Green River. The project is finished, and we just need final acceptance by the Commissioners to close out the project. Commissioner Musgrave: Move approval. Commissioner Shoulders: Second. President Ungethiem: We have a motion and a second to approve the final acceptance form for Heckel Road. Any discussion? All of those in favor signify by saying aye. President Ungethiem: All of those opposed? (None opposed) President Ungethiem: The motion carries. John Stoll: Next I ve got a Notice of Intent for the Peck Road reconstruction. This project will run between Huskie Drive, which is the entrance to North High School, and Baseline Road. We have to send this Notice of Intent to IDEM just to let them know that we ll be doing land disturbing activities. Hopefully, we ll be able to get that project out for bid in the next month, give or take. We re winding down on getting everything taken care of, so it should be ready for bid here shortly. Commissioner Musgrave: Move approval. Commissioner Shoulders: I will second. President Ungethiem: We have a motion and a second. John, a question, if we bid it next month, will it be completed yet this year? Or when is the completion date? John Stoll: I haven t worked with the consultant to set an exact completion date as of yet, but I m going to say somewhere around next fall. It definitely won t get done this year. President Ungethiem: It will be next fall? This is TIF money? John Stoll: Yes. President Ungethiem: It s being used for this? John Stoll: Right.

John Stoll: Next I ve got a contract with American Structurepoint for the reconstruction of Kansas Road, between Petersburg and Green River Road. The contract amount is $1,837,535. This would be paid out of the Burkhardt TIF funds. The contract amount covers design, the right-of-way engineering and right-of-way acquisition services, but not the actual property costs. It also covers the construction inspection. The right-of-way portion of this contract was based on the assumption of 65 right-of-way parcels. So, if there are more parcels, then we would have to deal with a supplemental agreement at a later date. If there are fewer, then we would underrun the right-of-way portion of that contract. In order to come up with a construction inspection fee, some assumptions were made on time tables, which again, since the design is not finished, we don t have exact time tables. So, the inspection portion of it might need to be adjusted at a later date. It s just something we ll have to deal with in the future, depending on when the design is finished and when we know the exact time table. But, I would request your approval of the contract. Commissioner Musgrave: Move approval. Commissioner Shoulders: I second the motion. President Ungethiem: We have a motion and a second. Any further discussion? Can we vote on which side goes first, the east or the west? John Stoll: I m planning on all of it at once. I don t know exactly how we ll phase it, once we get to that point, but the bridge will play a play a part in that, but we ll bid the whole thing at the same time. President Ungethiem: Okay, and we did talk about the turn lanes at the development that s there on, I guess, it would be west Kansas Road, based on this. John Stoll: Yeah, it would potentially affect those turn lanes, but I can talk to the developer about how we can work that out. We may need an agreement that would be similar to other agreements we ve had. In the past there was an agreement for Baseline Road associated with the assisted living place that recently opened up there. Then years ago on the Green River Road project there was an agreement about the turn lane construction for an apartment complex on Green River, just north of Lynch. So, we ve got some examples of when this, where this has been done before, so, I can talk to the developer and we can get something worked out. President Ungethiem: Okay. Any other questions? John Stoll: Last I ve got a right-of-way encroachment agreement for 6001 New Harmony Road. This is for American Legion Post 8. They have an existing sign in the existing rightof-way on New Harmony Road. They want to replace that sign with a new sign, and when

4 Page 4 of 12 they came in to get their sign permits, they were notified that they needed county approval to have it encroach in the right-of-way. I worked with the County Attorney on preparing this agreement, and he said it was acceptable. So, I would request approval. Commissioner Musgrave: Move approval. Commissioner Shoulders: Second. John Stoll: No, it s basically going in the same spot. President Ungethiem: Okay. John Stoll: Based on the exhibits they gave us, it looked to be fairly similar. I don t know the exact dimensions compared to the existing sign, but from what they provided it looked very, very similar, as far as size. President Ungethiem: Okay. Any other comments? Commissioner Shoulders: Thanks, John. John Stoll: Thanks. President Ungethiem: Any other department head reports? Seeing none. New Business President Ungethiem: Moving on to new business. Last week, was it Thursday or Wednesday? Commissioner Musgrave: Thursday. Commissioner Shoulders: Thursday. President Ungethiem: Thursday, we had a road hearing at the Tech Center out on Lynch Road. There was some information presented at that hearing. We thought it was good information to have, so we ve asked John and Scot to present that here tonight, just to give everybody an idea of the type of information that we ve been collecting for road projects in Vanderburgh County. With that, I ll turn it over to those two gentlemen and let the show begin. John Stoll: It s not cooperating.

5 Page 5 of 12 Commissioner Musgrave: It says it configuring. Do you have to let it configure? John Stoll: Pardon? Commissioner Musgrave: Does it have to configure? John Stoll: It looks like it s probably not been loaded on this version before would be my guess. It s updating. That s the only thing I can figure. President Ungethiem: Well, while we re waiting, we have another new piece of business that was added. Commissioner Musgrave has been working with the you guys don t have to go away, you can make it work. John Stoll: It might be a while. President Ungethiem: Or do whatever. Has been working with the Building Commissioner and several other folks to try to streamline some of the licensing and requirements for contractors in Vanderburgh County. We have a proposed change that she would like to enter in for the record. We re not going to vote on it this evening, but just enter it in for the record, to make sure that everybody has a chance to look at it, make comments before we actually do vote on it. Commissioner Musgrave: Yes, Commissioners, if you ll recall, back in January or February we appointed a task force to look at various building and licensing issues. The task force met multiple times, and came up with a set of concepts. The first concept that we enacted was a few weeks back when we created an ordinance that allows farmers to build or construct non-human inhabited properties, without having to have a Vanderburgh County building license. That puts the farmers on an even footing with all of the farmers in surrounding counties and allows them to build, you know, things like silos and animal, equipment storage facilities. So, we ve moved on to a second proposed change, and this is just for your information today, it s been sent to the relevant boards; like the HVAC Board, the Electricians Board and so forth, so that they can take a look at it before we actually vote on it on first reading. But, it has met with the approval of several of the key folk, including the Building Commissioner thought that it looked pretty good. It will do a couple of things, it impacts continuing education, and it impacts the ability to issue a provisional license. So, let me just go through these four points; the continuing education part is proposed, and this may be tweaked by the boards, looking forward to their responses, current license holders would be required to complete six hours of continuing education in a three year time frame. This replaces the current requirement of three hours every year. So, this would be a cut by one third of continuing education required hours over a three year time frame. So, that s loosening it up a little bit. The continuing education hours are proposed to be valid for all licenses held by a person. Some contractors hold multiple licenses, and so right now you have to have three hours per license per year. This would make three, sorry, six hours for three years. Depending on how many licenses a person does hold, it could be a cut of more than one third of the current required continuing ed hours. Again, that has been suggested to the boards for their input. Some boards may have different concepts of the number of hours that they think is appropriate per year, and I look forward to hearing that. Secondly, it took, it currently takes a minimum of 60 days between the application for a license, taking the test, before you will actually get a license. That process was, is lengthy, and we were looking for ways to make, to reduce that time, but not impact the quality of the licenses or the process in any way. So, in this proposal, applicants for a license would be able to take an exam, upon completion of an application, which would be reviewed by the Building Commissioner, using criteria set by the respective boards. Now, this replaces the current requirement of board approval to take the exam, and it potentially saves about 30 days for the applicant. Then, secondly, applicants who pass the exam are eligible for the Building Commissioner to issue a provisional license. This replaces the current requirement that the board review the application, the test, before a license is issued. This potentially saves another 30 days for the applicant, but the board would still have final approval. So, you take the test, the Building Commissioner sees that you ve passed, he can issue a provisional license, but it still has to go to the board for final approval, but the applicant can take the provisional license and go ahead and get to work for those 30 days. So, this is kind of a small step. It gives the Building Commissioner something, maybe a little bit more authority. It saves

6 Page 6 of 12 a little bit of time for the applicants, not only in the application process, but also in the continuing ed. So, not a big change, but, you know, something that cuts red tape. President Ungethiem: Uh-huh. Commissioner Musgrave: Alright, I m done, and it looks like they re done too. John Stoll: Finally. President Ungethiem: Okay, before we move on there, just to make everybody aware, this is going to be in the form of an ordinance, and it will, in all likelihood, be at our next meeting, which is on the 22 nd, two weeks. Commissioner Musgrave: (Inaudible. Microphone not on.) President Ungethiem: Two weeks for first reading. Okay. John Stoll: Since this was a little later than what we ve usually done, Scot and I put these slides together to show the projects that we re already working on. For starters here in the presentation, this is a project of the repaving of Boonville-New Harmony between Green River and I-69 that was awarded just a couple of weeks ago. We ve submitted it for a Community Crossings grant on this, which, hopefully, if awarded, will get 50 percent of the project cost back from INDOT. This was a, I believe, a $210,000 contract, somewhere in that neighborhood. Eagle Crossing is a project we had already awarded. As you can see from these pictures, this was some of the concrete patching that was going on. This was a $150,000 project, and it was also submitted for Community Crossings. Community Crossings announcements are supposed to be made by the end of August, so, hopefully, we ll know soon whether or not we see any reimbursement on these projects. Mt. Pleasant is another project that was bid out recently. It was, the contract was awarded, I believe it was at the last Commissioner s meeting, or maybe the one before, but it s about a $175,000 project, between 41 and Baumgart. This will be milled and resurfaced, and, again, it s another Community Crossings request. The paving of Red Bank Road between Upper Mt. Vernon and New Harmony was actually a 2016 Community Crossings project. This was awarded earlier this year. The project cost is around $450,000, if I remember correctly. Actually, they are going to start the patching work on that tomorrow. Once the patching is completed, then they will do the milling and resurfacing. Like I said, this was part of last year s Community Crossings, so, half of this cost is covered through the INDOT grant. Rusher Creek is another project that s going to start here anytime now. It is patching, milling and resurfacing of Rusher Creek, between 41 and the dead end. This project was also submitted for Community Crossings. It s a $111,000 contract. A couple of the other projects that we were looking at for Community Crossings money were; Keystone Subdivision, there are a number of streets out there; Pebble Stone, Sandstone, Rimridge, Quakerbridge and Drakewick that needed some patching and resurfacing. As it stands now it didn t look like we would have enough money to bid that project in 2017, unless we received the Community Crossings money. So, if we receive the money we ll bid that yet this year. It s just, depending on time tables, we may not see the work done until next spring. Pollack Avenue is another one, between Green River and the county line, this one was submitted for Community Crossings. If we receive the money we can bid this. Likewise, if we don t receive Community Crossings money, it didn t look like there would be enough funding yet this year to bid this project out. It may have to be carried to next year. There s the grand total of about $1.1 million in projects that are currently contracted. Then we had another $427,000 that was proposed, if we receive the grant funds. I ll let Scot go over the projects his office is working on. Scot Wichser: Okay, these are the resurfacing projects for this year. County Line Road, it runs between Boonville-New Harmony and Baseline. That is put in for Community Crossings also. Alta Vista, this has been completed, off of Broadway. Commissioner Musgrave: Can I ask a question? Scot Wichser: Yes. Commissioner Musgrave: On Alta Vista, the striping wasn t done in that picture. Has the striping been done?

7 Page 7 of 12 Scot Wichser: I don t know if there was striping on Alta Vista. Commissioner Musgrave: Oh, okay. Scot Wichser: It s a dead end. I don t think it was striped. Boehne Camp Road, from 66 to Hogue Road. There s some pipe work and some other work that needs to be done, so that will probably be near the end of the paving season before we get to it. Broadway Avenue, from city limits to Nurrenbern. Evansville Sewer and Water has informed us that they are planning on doing, putting in a water line, and there s also a county resident that has been hauling in some fill with triaxles. So, this may be put off, and we do temporary patches until that s all done, because we would hate to pave the road and the thing get tore up. Bentwood Estates, off of Browning Road. Diefenbach Road, that started today, hopefully, it will be completed by the end of the day tomorrow. Heckel Road, that is from Green River east to the dead end, that is completed. Old Mt. Vernon Road, that is completed, and that is another one that has been put in for Community Crossings. Pine Gate Subdivision, that is also completed, that is off of Boonville-New Harmony Road. South Red Bank/Nurrenbern Road, that is basically from the city limits, which is about at Ogden to right past the park entrance. Stacer Road, that runs from Highway 41 to Old Princeton Road. The total funds of the County Highway projects are $640,000. John Stoll: This is a slide that listed some of the projects we ve seen carry over from years past. Actually there was one media account that said that these were the roads that were going to be paved yet this year, which that s not correct. I wish it was, but these are carry over projects that we ll have to continue to prioritize for future years. Part of the way we evaluate this now, as a result of some of the INDOT mandates associated with Community Crossings, they require us to have a pavement management inventory. In the pavement inventory there are a number of criteria they look at, but in this table the number that s of concern is the PCI, Pavement Condition Index. That just gives a numerical value on the current condition of the road. These are continually updated. They are done on a scale of zero to 100, 100 is the best, zero is the worst. It just gives us some more direction on the condition of the roads as we look at what roads need to be paved each year. This is a table that kind of summarizes the different condition ratings associated with those PCI values, and the types of repair methods that would be done in conjunction with the different ratings. This is just a curve kind of summarizing how the, the basis behind the asset management plans and the condition ratings, where if you get the road work done before the road gets in terrible condition, you can save quite a bit of money. They go against the attitude of always do the worst first, on the premise that if a road is in terrible shape, if you wait till the next year, the cost isn t going to go up significantly. But, based on curves such as this, if you catch the road soon enough, and keep it from getting in incredibly bad shape, you can save a significant amount of money. So, that s kind of the theory behind all of that, and, like I said, it s supposed to give us numerical guidelines to go off of for prioritizing roads, rather than just making it complaint driven and just going out and doing the worst projects first. Part of, another program that we ve got going on right now is a Capital Improvement Plan. That is to just develop an inventory of all of the county s road needs. Not taking cost into consideration, it s just to get an overall list of all of the work that s needed. Currently they re gathering data, meeting with people to find out what people s thoughts are. I know they met with the Commissioners, they re going to meet with me and Scot next week, and I know there are a number of other people that will be meeting with the consultants to develop this plan. But, it s to get everybody s input to find out what the overall needs are. It s from the perspective of safety, drainage, economic development, road capacity issues, any criteria that would be valid. We just want to know what needs to be on the list, and the cost is not the driving force right now. It s just to try and find out what do we need to get finished. Since the road hearing last week, we had the road hearing, and then after the road hearing we received some additional requests from some of the residents to look at. This is one that came up at the road hearing, it was a sight distance concern at the intersection of Boonville-New Harmony Road and Young Road. You can see from the picture on the left that Young Road intersects Boonville-New Harmony right in the middle of the curve. The concern is you can t see as you re pulling out from Young Road on to Boonville-New Harmony. We ll take a look at that and see if there are any sight distance issues. My guess is that it s more a function of the high speeds of the traffic exceeding the speed limit out on Boonville-New Harmony than anything, because this was a federal aid project. So, it should have met all appropriate design standards, and the sight distance would have

8 Page 8 of 12 been one of those. So, probably speeding traffic is an issue out there, but we ll look into it and figure out if any changes are needed. Another request we received was for Brookview Subdivision. This is one we ve looked at in the past, and it s got a number of issues relative to the concrete pavement deterioration. It s carried over from year to year, and it needs some work. Scot s crews at the Highway Department have actually done some work in Brookview Heights right next to this. So, it may be a combined effort from his office and contractors, but this is one we ll have to look at in the future. Maasberg Road was a complaint relative to the width of the road, which you can see how narrow it is in the picture on the left. Then sight distance issues associated with the Boonville-New Harmony intersection, which is there on the right. I haven t had a chance to look into the right-of-way that the county has for Maasberg Road, but I believe it s pretty narrow. Any widening that would be done, I think would require reconstruction of ditches, moving ditches, things like that and it would get pretty costly fairly quickly. In regard to sight distance issues up there, I don t think there s a lot of right-of-way up there either. So, if there is a sight distance limitation, it may be outside the county right-of-way. So, either the county would have to acquire right-of-way, or nothing could be done, if the sight distance restrictions are on private property. This is an that came in on Marlene Avenue. Overall this didn t seem to be in too bad, the condition wasn t too bad. There is some cracking and there are some utility cuts that have settled a little bit, but overall I wouldn t say that this needed a resurfacing at this point. Maybe some time in the future, but it s definitely not as in need of repairs as many of the other roads we ve seen. Memory Lane was another one that was ed, and this one, you can tell, has more significant deterioration. This is an asphalt overlay on a concrete street, so we ll have to go out and mill the asphalt off and resurface it. It would probably require some patching prior to the resurfacing as well. Since it would require milling, that would be something that will have to be done on a contract basis. Oak Ridge Subdivision, this was a complaint from the road hearing last week. The drain on the right was added to address some drainage concerns that Scot, Jeff Mueller and I all had heard about. The perimeter of the drain needs a little bit of concrete repairs in order to fix where the concrete is broken out. Then, the picture on the left shows some deterioration of the concrete. I forget the name of the street, but when you go in the subdivision, it s the first cul-de-sac to the west, that s about the extent of the concrete deterioration. There s similar conditions in a few other places in the subdivision, but overall that subdivision needs probably crack and joint sealing more than it needs extensive concrete work. That s all we have received to this point. President Ungethiem: Okay, thank you very much. Commissioner Shoulders: Thank you. President Ungethiem: Very informative, and it looks like we re going to be somewhere upwards of $2 million worth of road repair and replacement this year, which is significantly higher than it was in past years. That s mainly due because we re getting an influx of money to be able to do that, and with Community Crossings, that s helping. So, keep up the good work. John Stoll: Thanks. Scot Wichser: Thank you. President Ungethiem: Any other comments from the Commissioners? Commissioner Musgrave: I just want to throw out a thank you to the legislators for enacting the changes that has brought the road funding. I want to thank you two for all the work that you did on this. I also want to mention, or highlight, that the farming community came out to our road hearing, and had a number of comments. I would like to find a way to help make sure that their equipment, some of their equipment is wider than the roads there. So, not only are they risking the equipment when they drive down the roads, they are also damaging the roads, because they re at the very edge of the roads. We talked a little bit with them, and I also spoke with Senator Jim Tomes and gave him my wild idea, and that s making the circuit now, which is to make it possible for rural landowners to donate their right-of-way. Well, not quite donate, to sell their right-of-way to the county in exchange, not for cash, but for a tax credit. Whether it s a property tax credit that would be paid out over a number of years, or some other tax. I know we have County Option Income Tax, all of that would require legislative approval, and, you know,

9 Page 9 of 12 there are issues that you would have to work out. You know, like any random road, or one that we actually plan to work on, that sort of thing. Would we cap it in order to prevent, you know, draining the county treasury in tax credits to farmers. So, it s just an idea that might help us supplement the amount of money that we have available to buy right-ofway, because that is the problem in the county. You ve told me this over the years, John, that those roads are, they have no right-of-way. You have the roadway, you have the ditch, you re done. So, in order to reconstruct the roads, as you would have to do, it s not just a simple paving job, because you have to move the ditch. To reconstruct the roads you have to have right-of-way, you have to have a lot of funds to do that. I respect the amount of money that s being spent on the farm equipment, and I respect the role that farmers play in our community, and I certainly would love to find a way to address the problem. Commissioner Shoulders: I will just say, again, thank you, Scot and John, for your presentation, and for everyone who attended the road hearing we got some good feedback; anything from drainage to street concerns and everything in between. So, thanks to everyone who took time that evening, and especially thank you two gentlemen for the presentation. Scot Wichser: Thanks. President Ungethiem: Thank you. Any other new business. Any further comments on that? Any other old business? We talked about this previous ordinance that we had passed. I talked with Joe on that, and he thinks that there is a, he s got to do some more investigation on when it actually becomes effective. So, we ll wait on that. He thinks that did not become effective till late last week, so it may be a moot point. So, hopefully that will be behind us. Any other old business? Joe Harrison, Jr.: (Inaudible. Microphone not on.) President Ungethiem: For? Joe Harrison, Jr.: Ron London. President Ungethiem: Oh, yes, there is a, there was an sent to Joe, here it is. There was an sent to Joe from Dirck Stahl on August the 2 nd in which they were wondering about an ordinance that we had passed for accessory uses and structures. There was, there seemed to be a conflict between one paragraph and the other. What Area Plan was requesting, I guess, is some direction as to which way we wanted to go on this. On the accessory uses and structures, under B, paragraph two, it says, except as otherwise provided in this subsection, accessory structure uses must be subordinate in height, area, lot coverage and purpose to the principal residence or structure use. But in paragraph seven, under section B, it says, accessory structures may exceed the height in area of the principal residence structure. So, there s, in one case it says there is a subordinate height and area coverage, and in one section it says, that it may exceed. Area Plan is just wanting some more direction as to which way we want this to actually read. We just took out the 2.50 acres. Commissioner Shoulders: Yeah. Joe Harrison, Jr.: So, if that s put back in, then we would then delete , no, I guess, that would stay in. Joe Harrison, Jr.: Yeah, right, right, and it would apply to that. So, that would stay in. Commissioner Musgrave: So, we would uncross out 2.5 acres? Joe Harrison, Jr.: Yes. President Ungethiem: Yes. Commissioner Musgrave: Okay, do we need a motion to that effect? Joe Harrison, Jr.: We should. Commissioner Musgrave: Okay, so moved. Commissioner Shoulders: I will second the motion of the uncrossed out 2.5 acres. President Ungethiem: We have a motion and a second. Any discussion? All of those in favor signify by saying aye.
