N/A If not budgeted, explain funding source: N/A Appropriation Amount: N/A Summary: This ordinance amends the Kane County Code, Chapter 10: Fireworks. Under the current requirements for multi-event, one year permits, all displays must be concluded by ten thirty o'clock (10:30) P.M. Single event one day permits must be concluded by eleven o clock (11:00) P.M. The Kane County Cougars have requested that displays at Northwestern Medicine Field (Cougar s Stadium) be allowed to be concluded by eleven o clock (11:00) P.M. This change will allow additional time for fireworks displays which would otherwise be cancelled if games are delayed by weather and/or have extra innings. During the past six (6) seasons, nineteen (19) fireworks shows were cancelled, an average of over three (3) shows per season. This change would also make the end time for multi-event permits the same as single event permits. The following will still apply to all fireworks permits: Any further conditions or restrictions, including, but not limited to, special provisions for audible and visual fireworks, as may be reasonably determined by the county board chairman based upon the location of the venue and the character of the surrounding area. AMENDING THE KANE COUNTY CODE, CHAPTER 10: FIREWORKS WHEREAS, the Kane County Code, Chapter 10: Fireworks provides rules and regulations for permits for pyrotechnic displays; and WHEREAS, pyrotechnic displays for multi-event, one year permits must be concluded by ten thirty o'clock (10:30) P.M.; and WHEREAS, pyrotechnic displays for single event, one day permits must be concluded by eleven o'clock (11:00) P.M.; and WHEREAS, the Kane County Cougars, a permit applicant for multi-event, one year permits for over 25 years, providing pyrotechnic displays as part of their family friendly entertainment; and WHEREAS, the current end time required for multi-event permits has, during the past six (6) seasons, resulted in the cancellation of nineteen (19) fireworks shows, an average of over three (3) shows per season; and WHEREAS, the Kane County Cougars desire to provide their fans with the fullest extent of entertainment value for the cost of their admission; and WHEREAS, the Kane County Cougars state that the vast majority of the shows would not have been canceled if they would have been allowed an additional fifteen to twenty (15-20) minutes; and WHEREAS, amending the Kane County Code for multi-event permits will make the end time the same as for single event one day permits. NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that Chapter 10 of the Kane County Code be amended by deleting and adding the following: Chapter 10 FIREWORKS ARTICLE II. PERMITS Sec Generally 6. A multievent, one year permit shall be purely a personal privilege, good for not to exceed one year after issuance, unless sooner revoked and shall not constitute property, nor shall it be subject to attachment, garnishment, or execution, nor shall it be alienable or transferable, voluntary or involuntary, or subject to being encumbered or hypothecated. Such license shall not descend by the laws of testate or intestate devolution, but it shall cease upon the death of the licensee. 31 a. That all displays of any nature whatsoever be concluded by ten thirty o'clock (10:30) eleven o clock (11:00) P.M., b. Shall not be permitted after seven thirty o'clock (7:30) P.M. the evening before the public schools located in the location of the pyrotechnic display will be in session with the exception of Memorial Day, and c. Any further conditions or restrictions, including, but not limited to, special provisions for audible and visual fireworks, as may be reasonably determined by the county board chairman based upon the location of the venue and the character of the surrounding area. A multievent, one year permit may be suspended or revoked by the chairman of the county board upon good cause shown. In addition to or in lieu of any suspension or revocation, the chairman may impose a fine on the applicant, owner, operator, or any or all of them, in the maximum amount of five hundred dollars ($500.00) for each violation. Notwithstanding any language herein to the contrary, all multievent, one year permits shall expire and may be renewed commencing May 1 of each year. 10. No single event one day pyrotechnic display shall be conducted after eleven o'clock (11:00) P.M. and shall not be permitted after seven thirty o'clock (7:30) P.M. the evening before the public schools in the location of the pyrotechnic display will be in session with the exception of Memorial Day. 34 Kane County Development & Community Services Department Planning & Special Projects Division Monthly Report March 2018 In addition to regular on-going activities, the following are highlights of regional land, agriculture and other Planning Division activities of the past month. The Startup Guide to Business in Kane County In partnership with the College of DuPage Small Business Development Center, Chris Toth hosted a seminar on February 6 th about what small businesses need to start a small business in Kane County. This free, public event gave potential entrepreneurs the information on the skillset and resources they would need to have the best chance to succeed in starting a business. Chicago Wilderness Oak Ecosystem Recovery Working Group Karen Miller attended the meeting on February 22 nd to discuss the Oak Ecosystems Connectivity Mapping Model which is being used to identify at least one core/buffer/corridor complex in each county. Food to Market Catalyst On March 5th Janice Hill and Matt Tansley participated in a conference call discussion with the administrators of the Food to Market Catalyst grant. Kane County staff updated the administrators on the progress of grant funded activities, including the Fresh & Local Rx Program, and discussed future needs to fulfill Growing for Kane objectives. Fox River Ecosystem Partnership (FREP) Karen Miller represented FREP at the One Earth Film Festival s showing of Rancher, Farmer, Fisherman on March 5 th, hosted by FREP. Foreign Direct Investment 101 On February 21st, Chris Toth attended the Foreign Direct Investment 101 seminar hosted by Select Chicago. Speakers from different organizations representing local businesses and government, as well as other countries, spoke about how to attract and retain foreign businesses in the Chicago Region. Fresh & Local Rx Team Meetings Janice Hill and Matt Tansley held discussions with current and new healthcare partners including Rush- Copley Medical Center, VNA Health Care and the Community Health Partnership of Illinois in preparing a grant application for the AstraZeneca HealthCare Foundation. The grant would fund expanded activities for the Fresh & Local Rx (prescription vegetables) project in Packet Pg. 34

35 Janice Hill and Matt Tansley participated in weekly conference call meetings with the Fresh & Local Rx Core Team. Fabulous Fox! Water Trail During the monthly meeting, co-chaired by Karen Miller, the Core Development Team celebrated the Wis. Dept. of Natural Resources Grant awarded earlier this month to the Water Trail Initiative; reviewed the existing conditions data, budget and second draft of the Water Trail Map to be developed for the 6 th Annual Fox River Summit on March 23 rd in Burlington, Wis. FamilyFarmed Training Workshop On March 7th Matt Tansley and Janice Hill hosted a farmer training workshop for farmers participating in the Fresh & Local Rx program. The training session was led by FamilyFarmed s instructor, Pam Benike, and was focused on providing farmers with best practices for crop planning and wholesale production within the context of the Rx program. Anderson, Jr., Plat Officer Date: March 20, 2018 Re: Highland Meadows Lots 8 and 12 Minor Adjustment (HM-18-01) Request an Abrogation of a Drainage and Utility Easement and Plat of Consolidation - Parcels: and Section 22, Plato Township Mr. & Mrs. Andrew Peterson are requesting approval to abrogate the existing drainage and utility easement between lots 8 and 12 within Highland Meadows Subdivision. They also desire to consolidate the two (2) lots into one (1) in accordance with Section Validity and Adjustment of the Kane County Subdivision Regulations. The proposed minor adjustment includes the following: Abrogation of the existing drainage and utility easement between lots 8 and 12 and the consolidation of the two (2) lots into one (1) within Highland Meadows Subdivision. We did not receive any objections to this request. The Technical Staff has reviewed the request and finds the following: 1. The proposed adjustment will not increase the density of the P.U.D. 2. The proposed adjustment will not decrease open space nor will it affect the physical layout and design of other lots in the neighborhood. 3. There will be no impact to the public health, safety and general welfare. RECOMMENDATION: The Technical Staff recommends the Development Committee approve this request for a minor adjustment to abrogate the existing drainage and utility easement between lots 8 and 12 and the consolidation of the two (2) lots into one (1) within Highland Meadows Subdivision.
