The Tender Form along a copy of Tender Notice with all the Annexures/Certificates indicated from Clause 2 to 7 indicated below must be returned intact duly filled and signed and packing should be done as per Clause 12 of Terms & Conditions (Submission of Tender Form) Annexure I (Compliance Statement). Infringement of this condition shall render the tender liable to rejection. 2. Tenders must be submitted on the prescribed Tender Form (either Purchased from Principal, Guru Gobind Singh Medical College obtained by submission of a Demand Draft for Rs.1000/- in favour of Principal, Guru Gobind Singh Medical College, Faridkot payable at Faridkot OR it may be downloaded from University website In case Tender Form is downloaded from University Website it must be accompanied a Tender Fee of Rs.1000/- in the shape of Demand Draft in favour of Principal, Guru Gobind Singh Medical College, Faridkot payable at Faridkot is attached. 3. The tender(s) should be accompanied Earnest Money for Rs.50,000/- for Medical College and Medical Hospital (Rupees fifty thousand only) in the shape of Demand Draft in favour of Principal, Guru Gobind Singh Medical College, Faridkot, payable at Faridkot. 4. An affidavit as per specimen copy must attached (Annexure II). 5. Rates to be quoted should be filled in the prescribed format of Financial Bid as per Annexure III. 6. List of items with rates to be provided in the Nestle Outlet must be attached. 7. Attach a signed copy of Terms and Conditions. 8. All copies of documents attached with the tender should be self attested. 9. Each page of the tender should be signed by the Tendered. 10. The Principal reserves all the rights to accept or reject any tender without any reason and also to impose/relax any term and condition.

ALLOCATION OF SPACE: a) On outlet will be allocated in the Canteen of Guru Gobind Singh Medical College & Hospital (New Building near Sadiq Chowk), Faridkot b) Three outlets will be allocated to the successful bidder in the Guru Gobind Singh Hospital, Faridkot one on the Ground Floor of 10x12 Sq. Ft. and second on the First Floor of 8 x 10 Sq. Ft and third on the Second Floor of 8 x10 Sq. Ft. 13. SUBMISSION OF TENDERS : a. ENVELOPE NO. I The Tender Form along a copy of Tender Notice with all the Annexures/Certificates indicated from Clause 2 to 7 indicated in INSTRUCTIONS TO THE TENDERERS. b. ENVELOPE NO. II (PRICE BID) Rates quoted filled in the prescribed format of Financial Bid as per Annexure III, ENVELOPE NO. III Envelope III should contain sealed Envelope I and Envelope II as indicated in 13(a) and 13(b) above. Envelope 3 should be super-scribed Tender Enquiry No. Licensing out of Nestle Outlet. 14. OPENING OF TENDERS : All the Tenders received up to 2.00 pm on will be opened at 3.00 pm on the same day. First of all ENVELOPE I will be opened and all the documents required will be checked. In case the Tendered has submitted all the documents required from Sr. 2 to 7 as indicated in Instructions to Tenders, only then the Price Bid will be opened, otherwise the Tender will be rejected. *******

3 Page 3 of 7 TERMS & CONDITIONS 1. The reserve price bid will be Rs.4,00,000/- (Rupees four lacs only) for all the Nestle Outlets in the College and Medical Hospital. 2. The bidder should quote the price on annual basis. 3. The bidder will be responsible for inspection of space to be allocated for Nestle outlets 4. The successful bidder will have to sign an agreement for three years with a condition that the final rates agreed will be revised every with yearly increment of 10%. 5. The successful bidder will deposit 25% of the final amount as security deposit within 5 days from the date of signing of agreement. 6. On receipt of Security Deposit, Earnest Money will be refunded to the bidder. 7. The bidder will deposit the final amount in the shape of 12 equal installments per year. 8. The successful bidder will deposit the monthly installments on or before 7 th Day of every month in the office of the Principal, failing which, a penalty of Rs.100/- per day will be imposed. 9. The successful bidder will have to provide Tea/Coffee/Cold Drinks with all the Nestle Products only. 10. The successful bidder will provide list of items with reasonable rates to the Office of the Principal, GGS Medical College, Faridkot. 11. The successful bidder shall not transfer or sublet the Outlet by any way, to any other person. 12. The successful bidder will have to pay their Electricity and water supply bills by managing Sub meter of their own or have to pay bill according to the power load to the institution on Govt. flat rates charges. 13. Price list of all the items must be visible to all the Customers in the shape of Price Board affixed in the cafeteria. 14. The successful bidder cannot increase the rates of the items/products without the permission and cannot add any type of item to the outlet without prior permission. 15. The successful bidder will be responsible for cleanliness in the Cafeteria and disposal of waste material. 16. The successful bidder will have to obey laws according to the Food Adulteration Act, Industrial Laws Labor Act, other various Laws Acts etc and the license holder is directly/indirectly responsible for breaking laws. 17. If Principal GGS Medical College, Faridkot found complaint against the outlet license holder for charging more than the quoted price as well as misbehaving with the customers, then the necessary action will be taken against him and the contract of outlet will be liable to be cancelled.

The successful bidder will be responsible for any damage to the property of institution. 20. Selling of illegal products will be prohibited and if the successful bidder is found of selling any such products, he will be responsible for that and action will be taken as per rules. 21. After the completion of time period of contract, the successful bidder will have to leave the place in good condition as provided in the given time otherwise 10 times of the license fees will be charged monthly. 22. Any taxes applicable by the Govt. will be paid by successful bidder. 23. If the successful bidder violates any terms and conditions of the tender then the deposited security will be forfeited. 24. Arbitration:- If at any time, any question/dispute/difference whatever shall arise between tenderer and the Principal, Guru Gobind Singh Medical College, Faridkot upon or in relation to or in connection with the supply, either of the parties may give to the other notice in writing of the existence of such a question dispute or difference and the same shall be referred to the sole arbitrator, to be appointed/nominated by the Vice-Chancellor, Baba Farid University of Health Sciences, Faridkot who shall decide the case as per the Arbitration & Reconciliation Act. 25. Jurisdiction: The Courts of Faridkot alone will have the jurisdiction to try any matter, Dispute or reference between the parties arising out of this agreement/contract. It is specifically agreed that no court outside and other than Faridkot shall have jurisdiction in the matter.
