THAT Report No. PRC , dated June 2, 2011, from the Director, Park Services, regarding the Bylaw amendments be received; 2. THAT Bylaw No " Bylaw, 2007, Amendment Bylaw No. 5'' proceed for three readings at the next regular meeting of Council; 3. THAT Bylaw No, , ''Fees and Charges Bylaw, 2006, Amendment Bylaw No. 15", proceed for three readings at the next Regular meeting of Council; and, THAT the Mayor and Corporate Officer be authorized to execute all documents related to this matter. BACKGROUND Each year the Bylaw is reviewed and when required amended to reflect current and effective practices regarding Abbotsford's cemeteries. The proposed Bylaw, 2007 amendments include changes to the adornments policy; memorial tablet dimensions; staff titles; and, placement of the fees and charges for cemeteries into the Fees and Charges Bylaw. The City of Abbotsford manages and operates four cemeteries: Mt. Lehman; Aberdeen; Musselwhite; and Hazelwood. Currently, the Consolidated Bylaw, 2007 Bylaw No has some restrictions with regards to adornments. No Lot may be defined by fence, railing, coping, hedge or by any other marker except a Memorial as permitted under this bylaw. No Lot may be decorated with trees, shrubs or plants, but may be decorated by placing cut flowers. Boxes, shells, toys, wire screens, arbours, trellises, tripods, or any other objects are prohibited on any grave or Lot with the following exceptions: (a) tripods may be used to hold wreaths and sprays of flowers during interment; (b) cut and artificial flowers, wreaths and floral offerings may be placed on graves, but may be removed by the Administrator when their condition is considered to be detrimental to the appearance or proper maintenance of the ; (c) metal or plastic vases which may be set by the Administrator flush with the ground.

2 Report No. PRC Page 2 of 2 Over the years, people have been placing adornments on graves which contravene the bylaw. Staff has been fairly lenient on the removal of these adornments due to the high sensitivity around this issue, ANALYSIS Given the popularity of the metal flower holders, staff recommend that the Consolidated Bylaw, 2007 Amendment No. 5 (attached) be amended to permit metal flower holders that are a maximum of 20 inches tall and secured to the memorial tablet, grave marker and or monument. These fixtures do not interfere with cemetery maintenance. Another amendment is to move the Fees and Charges into the Fees and Charges Bylaw, 2006, Amendment No. 15 (attached). The department budgeted for a three percent fee increase for cemetery services effective July 01, 2011 to keep up with the cost of services. For example, utilities are being increased by five percent and wages by two and a half percent. The attached bylaw outlines the proposed cemetery fee increases. FINANCIAL PLAN IMPLICATION The department budgeted for a 3% fee increase for cemetery services effective July 01, 2011 to keep up with the cost of services and expenses due to increasing costs associated with utilities (5%) and wages (2.5%). The anticipated revenue associated with this increase will be $10,000 by yearend. COMMUNICATION PLAN The revised fees and charges will be posted within the Fees and Charges Bylaw. SUMMARY Each year the Bylaw is reviewed and, when required, amended to reflect current and effective practices with regards to Abbotsford's cemeteries. CITATION Bylaw No may be cited as " Bylaw, 2007, Amendment Bylaw No. 5". 2. AMENDMENTS Bylaw No , cited as " Bylaw, 2007", as amended, is further amended by: (a) deleting and replacing Subsection 4.7 (e), with the following: "(e) every internment of Cremated Remains shall be made in a cremation vault with a lid or in a container encased in concrete not less than 1.5 inches thick and shall be buried with a minimum of 10 inches of fill, except where the concrete encased container of Cremated Remains is used as a foundation base for a tablet Memorial installed on the Lot according to the requirements of this bylaw;'; (b) deleting and replacing Subsection 6.4 (e), with the following: "(e) except as permitted otherwise in Subsection (f), the top surface of Memorial tablets and concrete bases shall not exceed the following measurements: (i) (ii) (iii) on individual or double-depth adult or infant graves 12 inches x20 inches; companion-type memorials identifying: two adjacent adult graves 18 inches x 30 inches; on a grave containing an adult burial and Cremated Remains 12 inches x 20 inches; plus up to six single cremation size 8 inches x 12 inches; or up to three double cremation size 10 inches x 14 inches; (iv) on a cremation grave one or two single size or one double size two adjacent cremation graves or as above."; 8 inches x 12 inches; 10 inches x 14 inches; 12 inches x 20 inches; (c) deleting and replacing Subsection 7.1, with the following: "7.1 Boxes, shells, toys, wire screens, arbours, trellises, tripods, or any other objects are prohibited on any grave or Lot with the following exceptions:

Fees and Charges Every person who: (a) (b) obtains a Right of Interment for a Lot in the ; installs or causes the installation of a Memorial on a Lot; or (c) obtains any other good or service specified in Schedule "F" of Bylaw No , "Fees and Charges Bylaw, 2006" shall pay the applicable fees and charges prescribed in Schedule "F' of Bylaw No Fees and Charges Bylaw, 2006, for such right, good or service"; and
