2 GOVERNMENT OF UTTAR PRADESH Engagement of Consultant to Conduct Study For Reforms in Passenger Road Transport Sector in Uttar Pradesh through Public Private Partnership 1. PURPOSE The Government of Uttar Pradesh (GoUP) intends to Conduct Study for reforms in Passenger Road Transport Sector for providing adequate & efficient transport facilities to the people of State of Uttar Pradesh(UP) on Public Private Partnership Model. A brief profile on Passenger Road Transport Sector in Uttar Pradesh is enclosed at Annexure-I. Further information in respect of the same can be accessed on websites wwr.uptransport.org or or or obtained from Sri Rajendra Kumar Tewari, Nodal Officer & Transport Commissioner, GoUP, Tehri Kothi, MG.Marg,Lucknow (Tel.: Fax : ). 2. SCOPE OF WORK To undertake a comprehensive study of the private sector transport and Uttar Pradesh State Road Transport Corporation in the State and recommend:- What would be the model for providing best transport services for the people of UP. For providing best quality of services in Passenger Road Transport Sector in UP: Should UPSRTC continue in its present form? If UPSRTC has to be restructured/unbundled/replaced, then what should be a successful model for better services and its asset management? Modifications, if any, needed in the regulatory system/ rules/ processes of the passenger road transport sector in the state of UP to improve its services & management of assets. 3. PROPOSED SCHEDULE FOR COMPLETING THE ASSIGNMENT - Sl. Stages Time schedule No. 1 Inception Report 2 weeks from date of assignment 2 Draft Report 3 weeks after Stage I 3. Final Report 4 weeks after stage II or 15 days from receiving comments on draft report from Transport Department, GoUP, whichever is later. Note: The consultant shall have discussions/feedback sessions with various stakeholders such as Transport Associations, officials of Transport Department & UPSRTC etc. 2

3 before preparing Inception Report and also after submission of draft report for incorporating the same in the final report. 4. LAST DATE FOR SUBMISSION OF EOI The interested bidders may submit their EOI in one sealed cover subscribing on the top of the envelop Expression of Interest for Appointment of Consultant to study Passenger Road Transport Sector in UP positively by 13:00 hrs (IST) on 2 nd August 2007 or before on any working day between hrs. and hours (IST) to the Nodal Agency i.e. The Managing Director, The Pradeshiya Industrial & Investment Corporation of U.P. Ltd., (PICUP), PICUP Bhawan, Vibhuti Khand, Gomti Nagar, Lucknow , Tel Facilities/Assistance to the appointed Consultant 5.1 Transport Department, GoUP & UPSRTC shall provide all necessary information for conduct of the assignment available with them. 5.2 Transport Department, GoUP & UPSRTC shall provide copies of earlier studies and reports conducted and available with them. 5.3 The Consultant shall station such staff at Lucknow as may be decided by Transport Department, GoUP and Consultant. 6. Minimum Eligibilty Criteria 6.1 The Consultant should have atleast 5 years experience of conducting multidisciplinary consultancies. 6.2 Consultants should have experience of conducting one multidisciplinary study of GoI/State Government Agency/Undertaking/Corporation engaged in Road Transport having turnover of more than Rs. 200 crores. The consultant shall have to submit clients certificate as documentary proof. 6.3 The firm should have annual average turnover of atleast Rs.20 crores from infrastructure & services consultancy for any three years out of last 4 preceding years i.e. with effect from FY duly supported by a certificate from the auditor of the company. The applicant shall also submit audited annual accounts for relevant years. 6.4 The Consultant should have following staff on their roll or on contractual arrangements: SNo Key Position Minimum Minimum Experience Qualification (Yrs.) 1. 4 6.5 Even though Consultant satisfy the above requirements, they are subject to be disqualified if they have: Made untrue or false representation in the form, statements and attachments submitted for EoI Records of poor performance such as abandoning work, improperly completing contract, financial failures or delays in completion. 7. OTHER TERMS AND CONDITIONS 7.1 Overwriting shall be avoided and corrections, if any, shall be made by crossing out, initialing, marking the date and rewriting. All pages of the application shall be numbered, initialed and submitted as a package. All the information/details to be supported by authentic documents duly certified by the authorized signatory. 7.2 All supporting documents shall be signed by the applicant. 7.3 The Consultant is advised to attach any additional information he thinks would be necessary in regard to his capabilities. No further information will be entertained after submission of applications. 7.4 RFP shall be issued only to the Consultants who apply for EOI and are short listed. 7.5 The Government reserves the right to reject any or all Expression of Interest without assigning any reason thereof as well as the right to add/delete/modify any one or more of the terms and conditions. 7.6 Government reserves the right to discontinue the services of the appointed Consultant at any point of time on account of force majeure or non-satisfactory performance by the Consultant. 7.7 Fee may be paid in stages in the form of advance. However, the Consultant will have to provide performance guarantee in the form of Bank Guarantee equivalent to the advance fee requested for. 7.8 The sealed cover (as mentioned in 4.1) above should contain Application Covering letter as per Annexure II & Information as per format at Annexure III. 7.9 The Bid should be unconditional The travel related expenses and all other expenses including those related to duediligence would have to be borne by the Consultant. 8. 5 Transport Department Government of Uttar Pradesh ANNEXURE - I Background: The Uttar Pradesh Transport Department is one of the largest revenue earning departments in the state, fetching an annual revenue of over Rs 1100 crores for the state s exchequer. It functions through the Transport Commissioner's organization, which has its headquarters located at Tehri Kothi, MG Marg, Lucknow, and over 70 Regional Transport Offices & Assistant Regional Transport Offices spread all over the state. The Transport Commissioner s organization is primarily concerned with the entire gamut of activities related to the regulation of road transport sector, like issue of driving licenses, registration of motor vehicles, grant and renewal of permits, collection of taxes / fees, and all the other regulatory and enforcement functions assigned to it under provisions of the various Acts and Rules governing this sector. Activities: The activities undertaken by the Transport Commissioner s organization are as follow: Registration of vehicles Issue of fitness certificates to vehicles Issue of permits to passenger / goods vehicles Issue of Driver / Conductor licenses Collection of various fees and taxes Enforcement of the various Acts & Rules related to the road transport sector. Acts & Rules: The Acts & Rules which are enforced by the Transport Commissioner s organization are: Motor Vehicles Act, 1988 Central Motor Vehicle Rules, 1989 UP Motor Vehicle Rules, 1998 UP Motor Vehicle Taxation Act, 1997 Revenue Heads The main heads which account for the revenue generated by the Transport Commissioner s organization, as well as the head-wise revenue generated in the past fiscal year are: Head of Revenue Revenue (in Rs lakhs) Taxes & Fees Addl Tax (Goods) Addl Tax (Pass - Pvt) Addl Tax (Pass - UPSRTC) TOTAL REVENUE

6 Road Network: The state of Uttar Pradesh has around 1.2 lakh km long network of motorable roads, out of which around kms of the main routes are nationalized. These nationalized routes are being covered by over 7000 public transport buses operated by the state owned UP State Road Transport Corporation (UPSRTC). The remaining road length is covered by about private transport buses, along with maxi-cabs and motor-cabs, which constitute the backbone of the passenger road transport services in the state. Issue of Permits Under provisions of the MV Act, 1988 no transport vehicle shall ply without valid permit issued by the Transport Department. The issue of permits to commercial vehicles is done through the State Transport Authority & Regional Transport Authorities, which are constituted as under; State Transport Authority: 1. Transport Commissioner, UP Chairman 2. Special Secretary & LR, Govt of UP Member 3. Director Traffic Member 4. Non-government persons Member Regional Transport Authority 1. Divisional Commissioner Chairman 2. Non-government persons Member However, the Government of Uttar Pradesh has recently rescinded the notification under which the Regional Transport Authorities were constituted, and the powers to issue permits are being delegated to Regional Transport Officers and Assistant Regional Transport Officers (Administration). Issue of Driving Licenses: The Transport Department issues driving licenses under provisions contained in the Motor Vehicles Act, 1988 and UP Motor Vehicle Rules,1998. The process involves issue of a learning license valid for 6 months, subsequent to which a permanent driving license is issued on the basis of the driving tests conducted by officials of the department. Driving licenses are categorized on the basis of motor vehicles, like two wheelers, light motor vehicles, medium goods / passenger vehicles, heavy goods / passenger vehicles etc. In order to provide training to applicants for grant of driving licenses, the MV Act has provided for the establishment of Driver Training Schools where driving lessons are provided to citizens. These schools are run by private agencies, under guidelines and monitoring of the Transport department. For obtaining license to drive commercial vehicles, it is mandatory for the applicant to obtain a training certificate from a Driver Training School. 6

9 A Profile of UPSRTC State participation in passenger road transport services in U.P started on 15th May, 1947 with the operation of bus service on the Lucknow - Barabanki route by the erstwhile U.P. Government Roadways. Subsequently, during the fourth Five Year Plan, the erstwhile UP Government Roadways was incorporated as Uttar Pradesh State Road Transport Corporation (UPSRTC) on under the provisions of the Road Transport Act, 1950 with the following objectives: For the development of the road transport sector correlated to which would be the overall development of trade & industry. For coordination of the road transport services with other modes of transport. For providing an adequate, economical & efficiently coordinated road transport service. The corporate office of the corporation is situated at Lucknow. The Corporation has been reconstituted on with the formation of a separate Corporation in the State of Uttarakhand. At the time of establishment of the Corporation it had a fleet of 4253 buses which were operating on 1123 routes. The corporation's earned kilometers operated at that time were crore kilometers. While the total number of passengers carried by its buses totaled crores. At the end of the Corporation had 6561 buses apart from 784 hired buses operated under its control. The Corporation operates different kind of services for different segments of population. The various kind of services are as under : - 1. The conventional ordinary buses for general cross section of population. 2. The low fare Janta services for rural masses. 3. The PAWAN services for intercity services aimed at service/business needs of people. 4. The PAWAN GOLD comfortable 2x2 configuration buses for inter-statal needs. 5. The Non Airconditioned Sleeper services for overnight journey. 6. For urban/sub urban mobility buses in 6 important towns 7. Air Conditioned buses have also been divided into following categories to serve different needs these are: Low fared, high capacity Sheetal buses The Comfortable Shatabdi buses for long distances The Sleeper services for overnight journey. The Corporation is operating on 2222 routes. During the Corporation earned crores Kilometers and carried crores passengers. The buses of UPSRTC are primarily operated on nationalized routes of the State and neighboring State. In addition, a limited number of buses are also operated on some non nationalized routes / segments on public demand. 9

10 U.P. has about Kilometers of motorable roads out of which only kilometers (14%) is nationalized. The Corporation is an autonomous body corporate. For general superintendence, direction and management of affairs and business the power is vested in the Board of Directors. The management of UPSRTC is done by the Board of Directors through its Managing Director who is the Executive Head. The Board is headed by the Chairman and will consists of at least 5 or at most 17 Directors.One-third of Directors are to be Central government nominee and two-thirds from the state government. The management comprises of the Additional Managing Director, Secretary Corporation, Finance Controller, Chief General Manager (Administration), Chief General Manager (Operations), Chief General Manager (Technical), Legal Advisor and the General Managers of the functional areas. The corporation has 65 class I officers, 250 class II officers, class III (including over conductors & drivers) and 7448 class IV staff in a total staff strength of around Additionally there are 151 daily wages & part time workers. For efficient functioning the corporation has been divided into 4 Zones, 23 Regions out of which 06 regions operate urban and suburban services. 16 regions have regional workshops, where major repair and maintenance work as well as assembly reconditioning work is performed. Each region has been further divided into operational units called depots. The total number of depots in the corporation is 108, including car-section. 101 depots have depot workshops attached to it, to provide supportive maintenance facilities. For heavy maintenance and repair of vehicles, reconditioning of major assemblies, renovation of buses and construction of bodies on new chassis, two Central workshops have been established in Kanpur: Central Workshop, Rawatpur and Dr. Ram Manohar Lohia Workshop, Allen Forest. Six tyre retreading plants are established at Gorakhpur, Ghaziabad, Bareilly, Kanpur, Saharanpur and Allahabad to provide in-house tyre retreading facilities. For repairs and maintenance of staff cars belonging to the State Government and the Corporation, a separate unit named Car Section is established in Lucknow. For imparting training to drivers and technical staff, a Training School is established in Kanpur. The brief details of the various Regions and the No. of depots in the Regions is as under:- S. For the convenience of the passenger the Corporation generally has rest rooms, canteens, booking offices, toilets, drinking water, timetable & fare chart display, enquiry counters, public address systems, lights, fans, seats & benches and PCO etc. Cleanliness of the bus stations and buses are accorded priority. Suggestions &/or complaint books have been made available to Station Incharges and passenger feedback through them is invited and monitored. TURN AROUND UPSRTC earned a loss to the tune of Rs crores during After that UPSRTC had made reforms by inducting more than 1000 buses on an average in subsequent years in its fleet to strengthen it and streamlined its operation with the result the loss was reduced to Rs crores during and achieved a cash profit of Rs.0.82 crores. During UPSRTC further reduced its losses to Rs crores and increased its cash profit to the tune of Rs crores. During UPSRTC earned a net profit of Rs crores and cash profit of Rs crores. In subsequent years UPSRTC increased its net profit to Rs crores and cash profit of Rs crores. During UPSRTC earned remarkable net profit of Rs crores and cash profit of Rs crores AT A GLANCE UPSRTC inducted 1134 new buses in its fleet. UPSRTC has a fleet of 6561 corporation buses and 784 hired buses at the end of the year. 11

12 Fleet utilization of UPSRTC is 96% which is equivalent to the last year. UPSRTC achieved bus utilization of 321 kms/bus/day which is 6 kms/bus/day is more than previous year. UPSRTC achieved 62% Load factor which is 3% more than previous year. UPSRTC earned a total revenue of Rs crores which is Rs crores more than previous year. UPSRTC earned a net profit of Rs crores and cash profit of Rs crores. Fuel average of UPSRTC buses is 5.33 km/ltr. Which is 0.17 km/ltr more than previous year. 12
