1 1.0 INTRODUCTION NOTICE INVITING TENDER (NIT) F TANKAGE WKS F DHT & ASSOCIATED FACILITIES PROJECT OF M/s BHARAT PETROLEUM CPATION LIMITED AT MAHUL, MUMBAI BIDDING DOC. NO.: SG/A MA-TN-6001/1015 (DOMESTIC COMPETITIVE BIDDING) e-tendering 1.1 Bharat Petroleum Corporation Limited (BPCL) has been one of the leading petroleum refining and marketing company in India since its inception in BPCL with its refinery located at Mahul, Mumbai has a capacity to process a wide variety of crude oils. 1.2 BPCL through its Refinery Modernization Project have enhanced its capacity to 12 MMTPA by installing Crude & Vacuum Distillation Unit, Hydrocracker Unit (HCU), Hydrogen Generation Unit (HGU) and Sulphur Block along with Utilities / Offsites facilities. 1.3 Engineers India Limited (EIL) on behalf of Bharat Petroleum Corporation Ltd. (BPCL), invites e-bids for TANKAGE WKS under single stage two bid system from competent bidders with sound technical and financial capabilities fulfilling the Qualification Criteria stated in paragraph 6.0 below. 2.0 BRIEF SCOPE OF WK: The brief scope of work shall include but not limited to the following:- Residual Design, Engineering, Procurement of materials, Fabrication, Erection, Inspection, Testing, Calibration, Insulation (wherever applicable), Painting, Pre-Commissioning and Commissioning Assistance, Supply of the External Floating Roof tanks along with Aluminium Dome, Carrying out modifications in the existing External Floating Roof Tank and all associated works such as civil, structural, electrical, instrumentation works, including assistance provided to BPCL Process group for, cleaning and making it hydro carbon free by opening man way covers, spading/ blinding & fabrication / erection of temporary piping etc., as per the bididng document. The details of the new tank and modification of existing tanks are provided below. A) New Tanks: S. No. Item No. 1 TANK- 428 Qty. For detailed scope of work, refer Bidding Document. 3.0 TIME SCHEDULE F COMPLETION Completion period for entire works in all respects shall be 08 months from the date of issue of Fax / Letter of Acceptance (FOA/LOA). However, Completion period for Tank No. 402 shall be 05 (Five) months from the date of issue of Fax / Letter of Acceptance (FOA/LOA). Page 1 of 15

Physical Bids and Bid through any other mode shall not be acceptable. g) Bid Document Fee & EMD : Bidders are required to submit the Bid Document Fee &EMD (in the prescribed format) in original in the manner prescribed in the Bidding Document in sealed envelope titled Earnest Money Deposit and Document Fee for Bidding Document No. SG/A MA-TN- 6001/1015.However, bidders are required to upload the scanned copy of both Bid Document Fee as well as EMD on e-tendering website along with the e-bid. If the Bidder is unable to submit Bid Document Fee & EMD in original within the due date & time, then bidder shall submit the original Bid Document Fee &EMD within 7 (seven) working days from the date of un-priced bid opening, provided copy of the same have been uploaded on e-tendering Website. In case the bidder fails to submit the same in original within 7 (seven) working days, then their bid shall be rejected, irrespective of their status/ ranking in tender and notwithstanding the fact that a copy of Bid Document Fee & EMD was earlier uploaded by the bidder. h) Opening of Technocommercial (Un priced) Bids i) Cost of Bidding Document (Non- Refundable) : 1400 Hrs. (IST) on : (In presence of authorized representatives of attending Bidders) Rs. 5,000/- ( Indian Rupees Five Thousand Only) In the form of Crossed DD in favour of M/s Bharat Petroleum Corporation Limited payable at Mumbai. 3 j) Bid Security / Earnest Money Deposit (EMD) : Rs. 15,00,000/- (Indian Rupees Fifteen Lakh Only) In the form of Crossed DD in favour of M/s Bharat Petroleum Corporation Limited payable at Mumbai or Bank Guarantee in the prescribed Pro-forma from Scheduled Commercial Bank in India or Indian Branch of Foreign Bank. k) Opening of Priced Bids : To be intimated later, after evaluation and short listing of Un-priced techno-commercial Bids. If any of the dates identified above happen to be a declared holiday in EIL Gurugram, the next working day shall be considered. 4.1 Cost of Bidding Document fee and EMD exemption will be applicable for Micro and Small Enterprises (MSEs) registered with District Industries Centres (DIC) or Khadi and Village Industries Commission or Khadi and Village Industries Board or Coir Board or National Small Industries Corporation (NSIC) or Directorate of Handicraft and Handloom or MSEs having Udyog Aadhaar Memorandum or any other body specified by Ministry of Micro, Small and Medium Enterprises. On opening the un-priced bid, the certificate will be verified for registration. If the Bidder meets this requirement, their bid will be processed further. If not, the Bidder will be asked to submit EMD and bidding document fee. In case the Bidder does not submit the EMD and bidding document fee within 7 (seven) working days of EIL intimation, then their bid shall be rejected. 4.2 The MSME certificate shall be valid as on date of Unpriced Bid Opening. 4.3 There will be no waiver of Bidding Document Fee and EMD for Public sector undertakings of central / state Government undertakings. 4.4 Bidder shall download the Bidding Document in his own name and submit the bid directly. The Bidding Document is non-transferable. Bids submitted by Bidder who have not downloaded the Bidding Document will be rejected. 4.5 Documents to be submitted by MSEs along with un-priced bid : a. Documentary evidence that the Bidder is a Micro or Small Enterprises registered with District Industries Centers or Khadi and Village Industries Commission or Khadi and Village Industries Board or Coir Board or National Small Industries Corporation or Directorate of Handicrafts and Handloom or having Udyog Aadhaar Memorandum or any other body specified by Ministry of Micro, Small and Medium Enterprises. b. If the Bidder does not provide the appropriate document or any evidence to substantiate the above, then it will be presumed that they do not qualify for any preference admissible in the Public Procurement Policy, c. No Purchase Preference shall be given for MSE Bidder for this Tender, since it is a works contract. 5.0 EARNEST MONEY DEPOSIT (EMD) / BID SECURITY 5.1 Bids must be accompanied with Earnest Money Deposit/ Bid Security of value mentioned at 4.0(j) above. 5.2 EMD/ Bid Security shall be in favour of Bharat Petroleum Corporation Limited, Mumbai in the form of crossed demand draft or non-revocable Bank Guarantee on non-judicial stamp paper of value not less than Rs and in the prescribed pro-forma, from any Scheduled Commercial Bank in India/Indian Branch of Foreign Bank. 5.3 Earnest Money Deposit/Bid Security shall be valid for a period of 06 (Six) Months from the date of submission of Bids. 5.4 If the Bank Guarantee towards EMD for this particular Bidding Document is not in the required proforma, but acceptable otherwise (considering amount & issuing bank) the Bidder would be asked to resubmit the same in the required proforma. Such Bids would however, be taken up for evaluation. Page 3 of 15

4 6.0 BIDDER S QUALIFICATION CRITERIA (BQC) Bidder shall fulfil the following qualification criteria in order to qualify for this Work: 6.1 EXPERIENCE CRITERIA:TECHNICAL Bidder shall meet below mentioned experience criteria (Technical) to qualify for this job: During the last seven (7) years reckoned from the due date for submission of bid: a) Bidder shall have fabricated, erected and tested at least one Floating roof (either external or internal) storage tank of diameter not less than 18.0 Meters. and b) Bidder shall have designed at least one floating (either external or internal) roof of tank of not less than 18.0 Meter diameter. and c) Bidder shall have designed, fabricated, erected and tested at least one Aluminium Dome Roof of diameter not less than 21.6 Meters, which shall have completed at least one year of successful operation in the field (one year shall be reckoned from due date of submission of bids) In case bidder on his own does not meet the criteria specified in (b) above in terms of "design" of floating roof tank but meets the criteria in terms of fabrication, erection and testing, he can still be qualified provided: i) The bidder engages a back-up consultant who meets the design criteria specified in (b) above in terms of design. ii) iii) The design documents are prepared by the back-up consultant and fabrication drawings prepared by the Bidder based on back-up consultant documents are also approved by the back-up consultant. The back-up consultant furnishes the back-up guarantee for design, engineering and performance of floating roof to Bidder. However, ultimate guarantee for design, engineering, construction and performance lies with the Bidder. The bidder furnishes, along with his bid, the MOU / Letter of Agreement / Letter of Consent with the proposed Floating Roof design Sub-Contractor confirming the scope of work as defined under (i), (ii) & (iii) In case bidder, on his own, does not meet the criteria specified in (c) above but meets the criteria specified in (a), he can still be qualified, provided: i) The bidder engages an Aluminium Dome Roof Sub-Contractor who meets the criteria specified in (c) above. ii) The Aluminium Dome Roof Sub-Contractor shall furnish the back-up guarantee for design, engineering, fabrication and performance of the Aluminium Dome roof to bidder. However, the ultimate guarantee for design, engineering, fabrication and performance of the entire storage tank shall lie with the main bidder. The bidder furnishes, along with his bid, the MOU / Letter of Agreement / Letter of Consent with the proposed Aluminium Dome Roof Sub-Contractor confirming the scope of work as defined under (i) & (ii). 6.2 EXPERIENCE CRITERIA:COMMERCIAL The Bidder should have executed and completed one or two or three contract(s) of Storage Tank of value(s) as indicated below in previous 07 (seven) years reckoned from the due date for submission of bid. (i) Single work of value not less than Rs Crore. Page 4 of 15

5 (ii) Two works each of value not less than Rs Crore. (iii) Three works each of value not less than Rs Crore In case Bidder has executed Composite Works which includes any of the qualifying work(s) as stated at clause no above, then value of such qualifying work(s) out of total value of Composite Works shall be considered for the purpose of qualification Experience of only the bidding entity shall be considered. A job executed by a bidder for its own plant/projects cannot be considered as experience for the purpose of meeting requirement of BQC of the tender. However, jobs executed for Subsidiary /Fellow subsidiary/holding company will be considered as experience for the purpose of meeting BQC subject to submission of tax paid invoice(s) duly certified by Statutory Auditor of the bidder towards payments of statutory tax in support of the job executed for Subsidiary/Fellow subsidiary/holding company. Such bidders to submit these documents in addition to the documents specified in the bidding documents to meet BQC A job completed by a bidder as a sub-contractor shall be considered for the purpose of meeting the experience criteria of BQC subject to submission of following documents in support of meeting the Bidder s Qualification Criteria : a. Copy of work order along with S issued by main contractor. Or Or b. Copies of Completion Certificates from the end User/Owner/Consultant and also from the main contractor. The Completion Certificate shall have details like work order no. / Date, brief scope of work, ordered & executed value of the job, completion date etc. 6.3 FINANCIAL CRITERIA The annual turnover of the Bidder shall not be less than Rs Crore as per the audited financial results, in at least one of the immediate preceding three financial years up to the due date for submission of bid Networth The financial net worth of the Bidder as per the latest audited annual report shall be positive. 7.0 DOCUMENTS AND DATA REQUIRED WITH BID The Bidder shall, in his own interest, furnish complete documentary evidence to justify that the Bidder meets the Bidder s Qualification Criteria as given above. The documents to be furnished should include the following: 7.1 For Experience Criteria: Technical Details of Past Experience in clause 6.1.1, & above shall be submitted with bid along with documentary evidence as per format Attachment-I & II enclosed. 7.2 For Experience Criteria: Commercial Bidder must furnish all necessary documents such as copies of work order/purchase order/contract agreement clearly indicating scope of work and value of the contract, completion certificates of similar works executed as mentioned in the Experience Criteria (Commercial) as per clause no. 6.2 above For composite works, in the event the value of the qualifying work(s) cannot be ascertained from the work order/completion certificate submitted by bidder, Copy of Schedule of Rates/Prices (SOP/S), relevant pages of Contracts, Copy of relevant pages of final bill certified by end User for establishing requirement of BQC or written letter from the end User specifying the nature of work with quantities and values can be submitted for qualification. 7.3 For Financial Criteria Bidder shall furnish complete audited annual report including auditor s report, Balance Sheet, Profit & Loss Account Statement and all other schedules for the preceding three financial years, to meet the financial criteria. 6 7.3.2 In case a Bidder (a Parent Company) is having wholly owned subsidiaries but only a single consolidated annual report is prepared and audited which includes the financial details of their wholly owned subsidiaries, consolidated audited annual report shall be considered for establishing the financial criteria subject to statutory auditor of the Bidder certifying that separate annual report of Bidder (without the financial data of subsidiaries) is not prepared and audited Further, in case a Bidder is a subsidiary company and separate annual report of the Bidder is not prepared & audited, but only a consolidated annual report of the Parent Company is available, consolidated audited annual report shall be considered for establishing the financial criteria subject to statutory auditor of the parent company certifying that separate annual report of Bidder is not prepared and audited In case the financial year closing date is within 9 months of bid due date and audited annual report of immediate preceding financial year is not available, Bidder has the option to submit the financial details of the three previous years immediately prior to the last financial year. Otherwise, it is compulsory to submit the financial details of the immediate three preceding financial years. Example, In case, audited annual report of immediate preceding financial year (year ending 31 st March) is not available and where bid closing date is up to 31 st December, the financial details of the three previous years immediately prior to the last financial year may be submitted. However, in case the bid closing date is after 31 st December, it is compulsory to submit the financial details of the immediate three preceding financial years only If the Bidder could not be able to submit the complete set of audited annual financial statements, Bidder can submit a letter from the Statutory Auditor/ Chartered Accountant (CA) (*) (as per Annexure A) or a letter from the Bidder duly certified by Statutory Auditor/ Chartered Accountant (CA) (as per Annexure B). (*) Chartered Accountant (CA) - (not being an employee / Director and not having any interest in the Bidder s company) certificate is acceptable where audited accounts are not mandatory as per law. The above financial details, as per Annexure-A or B, shall be submitted without any reservation / qualification remarks. In case of any qualification remarks, complete booklet of audited annual financial statements along with auditor s report shall also be submitted with the bid. 7.4 All supporting documents, pertaining to Bid Qualification Criteria including MSE shall be submitted. a) Duly certified by Statutory Auditor of the Bidder or a practicing Chartered Accountant (not being an employee or a Director and not having any interest in the Bidder s company) where audited accounts are not mandatory as per law, b) Duly notarized by any notary public in the Bidder s country, c) Bidder shall submit self-certified documents in original from any one out of CEO or CFO or Company Secretary of the Bidder (Limited company only) along with Self-Certification as per Annexure C. This option shall not be applicable to Proprietorship/ Partnership firms. Requirement of above certification shall not be applicable to published audited annual financial statements in English, if original booklets are submitted. 7.5 Submission of authentic documents is the prime responsibility of the bidder. Wherever BPCL/EIL has concern or apprehension regarding the authenticity/correctness of any document, BPCL/EIL reserves the right of obtaining the documents cross verified from the document issuing authority. 7.6 Failure to meet the above BPCL / EIL reserve the right to complete the evaluation based on the details furnished by the bidder in the first instance along with their bid without seeking any additional information. In absence of requisite document, BPCL/ EIL reserve the right to reject the bid without making any reference to the Bidder. 7.7 Bidders shall be required to submit the required documents for meeting Bidder Qualification Criteria (BQC) along with Earnest Money Deposit, Document Fee, Integrity Pact, Power of Attorney in a separate booklet in original within 7 (Seven) working days Page 6 of 15

7 from the date of opening of Un-priced Bid in sealed envelope titled Documentation against Bidder Qualification Criteria for Bidding Document No. SG/A MA-TN-6001/1015 with proper index and page numbering. However, bidders are required to upload the scanned copy of all BQC documents on e-tendering website along with the e-bid. Sealed envelopes shall be addressed to: Kind Attention: Ms. Sangitta Ghuliani-AGM (C&P), Engineers India Ltd., R&D Complex, Tower-1, 3rd Floor, Sector-16 (On N.H.-8), Gurugram , Haryana, India 8.0 SUBMISSION OF BIDS& VALIDITY 8.1 Bids are required to be submitted through Central Public Procurement Portal website only, on or before the Bid submission date and time. Bidders are required to register themselves at Central Public Procurement Portal website Various links such as Help for Contractor, Information about DSC, FAQ, Resources Required, Bidders Manual Kit etc. are available on home page of facilitating Bidders to participate in the bidding process. Bidder are advised to download & utilize the available information/documents under these links for activities like Registration in CPPP, obtaining User ID & Password, uploading & submission of e-bids etc. 8.3 Bidders are advised in their own interest to carefully go through Instructions for E-tendering Methodology provided as Annexure-I to ITB of Biding Document and other related document available against various help links so as to ensure that bids are uploaded in E-tendering website well before the closing date and time of bid submission. Bidder is required to complete certain activities like Registration in e-tender website, obtaining User ID & Password, Enabling of Bidder and mapping of Digital Signature Certificate etc. before they can load their e-bid on website. In the event of failure in bidder s connectivity with CPPP website during the last few hours on account of problem on bidders account, they are likely to miss the deadline for bid submission. Due date extension request due to this reason will not be entertained. In view of the same, bidders are advised to upload their bid in advance. 8.4 No physical Bids / Offers or bids through any other mode shall be permitted. The Offers submitted through e-tendering system shall only be considered for evaluation and ordering. Bids submitted through Fax/ /courier/computer floppy/cd/pen Drive shall be rejected. 8.5 Validity of bid shall be 4 (four) months from the final due date of opening of Techno-commercial (Un-priced) Bids. 9.0 GENERAL 9.1 Bidder should submit Solvency Certificate from Nationalised/Scheduled banks. 9.2 Bidder should have valid PF/VAT/Service Tax registrations and PAN. In case any Bidder is not able to submit the same at the time of Bidding, the Bidder shall submit an undertaking that the same shall be submitted by them within 2 months of award, in case the work is awarded to them. 9.3 Notification of Corrigendum/Addendum/Bid Due Date Extension(s), if any, to the NIT & Bidding Document shall not be published separately. Hence bidders shall view the EIL /BPCL/CPPP websites regularly. 9.4 BPCL/EIL reserves the right to reject any or all the bids received at its discretion without assigning any reason whatsoever. 9.5 In case any Bidder is found to be involved in cartel formation, his Bid will not be considered for evaluation / placement of order. Such Bidder will also be debarred from Bidding in future. 9.6 For detailed specifications, terms and conditions and other details, refer complete Bidding Document. 9.7 Techno-commercial part of the Bids shall be opened at 1400 Hrs. (IST) on the due date for submission of Bids, in the presence of authorized representatives of bidders. Bidders may also view the Bid opening through e-tendering portal at Time and date of opening of Price Bids shall be notified to the qualified and acceptable bidders at a later date. Page 7 of 15

8 9.8 Bids from Consortium/Unincorporated Joint-Venture shall not be accepted. 9.9 BPCL/EIL shall not be responsible for any expense incurred by bidders in connection with the preparation & delivery of their bids, site visit, other expenses incurred during bidding process and regardless of the conduct or outcome of the bidding process 9.10 BPCL/EIL reserve the right to assess bidder s capability and capacity to execute the work using in-house information and by taking into account other aspects such as concurrent commitments and past performance etc Bidder submitting his bid should not be under liquidation, court receivership or similar proceedings Canvassing in any other form by the bidder or by any other agency on their behalf may lead to disqualification of their bid Unsolicited clarifications to the offer and/or change in the prices during its validity period would render the bid liable for outright rejection Bids received by way of Fax or shall not be considered Bidder shall submit Integrity Pact enclosed with the Bidding Document duly filled, signed & stamped in line with provision stipulated in the Bidding Document Unsolicited bids shall not be opened and shall not be considered for evaluation Central Government Public Sector Undertaking/ Enterprises shall be extended purchase preference as per Government of India guidelines as applicable The Bidders who are on Holiday / Negative List of BPCL/EIL on due date of submission of Bid / during the process of evaluation of the Bids, the Offers of such Bidders shall not be considered for Bid Opening / Evaluation / Award.
