BID EVALUATION CRITERIA The following information must be provided by the bidder in his offer and shall form the basis of evaluation of his offer. a. EMD of Rs /- (Rupees Ten Thousand Only) in form of Demand Draft in favour of GAIL (India) Limited, payable at Surat should be submitted. b. The bidder should have separate Provident Fund Account No. /code No. and a copy of the same in support of having a separate PF code should be enclosed with the technical bid. c. The bidder must have turn-over of not less than Rs Lakh (Rupees Five Lakh only) in any of the previous three years. d. The bidder should have carried out at least any type of civil construction / maintenance work valuing not less than Rs lakh (Rupees four Lakhs only) in any of the previous five years. Note: - - The bidder is required to submit the proof of having executed job of required nature in any of the state or central govt. departments/public sector/ reputed private organization. The credentials like work orders, completion certificates, Copy of TDS certificate etc. against work order mentioned for qualification are to be enclosed along with the tender. If completion certificate not issued by the organization, then, bidder can submit the certified copy of bill showing total executed value, detail of jobs covered along with detail of the concerned authority under which the work executed. 6 SPECIAL CONDITIONS OF CONTRACT Special conditions of contract shall be read in conjunction with the General Conditions of Contract, specification of work, drawings and any other documents forming part of this CONTRAT wherever the context so requires. The same is enclosed alongwith the Tender Documents. Notwithstanding the sub-division of the documents into these separate sections and volumes every part of each shall be deemed to be supplementary to and complementary of every other part and shall be read with and into the CONTRACT so far as it may be practicable to do so. Conditions of Contract unless a different intention appears the provisions of the Special Conditions of Contract shall be deemed to over-ride the provisions of the General Condition of Contract and shall to the extent of such repugnancy, or variations, prevail. 1. SCOPE OF WORK : The scope of work shall include but not limited to items mentioned in bill of quantities and instruction and direction if EIC. Name of work: RPROVIDING AND FIXING OF RAIN PROTECTION SHED OVER TERRACE OF COMMUNITY HALL BUILDING IN NEW GAIL COLONY AT MAGDALLA, SURAT. 2. LOCATION OF SITE: Compressor Station, Hazira, Surat It will presumed that Bidder has seen the site, therefore Bidder has to ensure to visit the site before quoting the Rates. 3. COMPLETION TIME The duration of the Contract is of LOI. 2 Months to be reckoned from the 7 th day of the issue 4. INSPECTION Prior to using the materials contractor shall get the approval from the EIC or his authorised representative. 3

7 5. SUPPLY OF WATER There is no use of water for this work, however, the water required will be provided by GAIL free of cost. 6. SUPPLY OF POWER Power requirement shall be provided by GAIL free of cost. 7. PAYMENT TERMS AND CONDITONS a. All measurements shall be recorded in the standard measurement sheet and submitted with soft copy (Floppy) as well as hard copy of 4 sets. b. Payment shall be made for the completed portion of the works in the running bill with in the 15 days of the certification of the EIC and 30 days in case of Final bill. c. The payment will be released by Sr. Manager (Finance & Accounts), GAIL (India) Limited, Hazira after due certification of EIC. d. It may be noted that 100% of the payment will be released against completed job/ item claimed in bills.. e. All payment will be released through Electronic mode (E-banking) from ICICI Bank/ HDFC/SBI and accordingly contractor shall provide details of their bank account number to which payment shall be released electronically. f. GAIL shall be entitled to deduct Income Tax/Work contract Tax or any other applicable Tax at source from the payment made to the contractor against the running bills in accordance with the relevant Indian Income Tax Laws or any other law as applicable from time to time. Necessary certificates of deduction of Income Tax/Works contract tax shall be furnished by GAIL to the contractor as per provisions of the said Act. g. The contractor will submit Indemnity Bond in prescribed format on stamp paper duly motorized before releasing final payment. 8. SERVICE TAX: The quoted rates should be inclusive of all taxes and duties applicable during the contract period except Service tax and education cess thereon. Service tax and cess thereon shall be paid extra as applicable from time to time, on submission of documentary evidence/invoice(s), however service tax component will not be considered for arriving the lowest bid. The bidders shall indicate in its bid the Service Tax registration no. and in case the service tax registration no. is not available, the bidder will give confirmation for obtaining registration with a copy of application for registration. 4

8 The Contractors liable to pay Service Tax for the work / service rendered to GAIL, shall specifically mention the Service Tax registration No. in their invoice(s). Further, the amount and rate of Service Tax shall be separately and distinctly specified in the invoice (s) For payment of service tax, serially numbered invoice / bill shall be issued by the service provider and should also specify following: 1. The name, address and registration no. of the service provider. 2. The name, address of the recipient of the taxable service. 3. Description, classification and value of taxable service provided and 4. The service tax payable on such services. The above details are required to enable GAIL to avail CENVAT credit for the Service tax payment. 9. EARNEST MONEY DEPOSIT All bidders shall have to deposit EMD of Rs /- in the form of demand draft/bankers cheque in favour of GAIL (India) Ltd. Payable at Surat. EMD of unsuccessful bidders shall be returned to the party after the award of work to the successful bidder. The EMD of successful bidder shall be adjusted against the Security Deposit. 10. SECURITY DEPOSIT: Total 10% of the value of work done shall be retained as Security Deposit and the same will be recovered from the bills submitted by contractor. The Security Deposit shall carry no interest. The Security Deposit shall be released only after successful completion of defect liability period. 11. DEFECT LIABILITY PERIOD The Defect Liability Period shall be one year from the date of completion of the contract. 12. General Conditions of Contract : The detailed GCC is available in Office of Chief Manager (C&P) and also on GAIL Website; interested bidders can collect the same during office hours. The GCC is also a part of contract, therefore, it will be presumed that contractor is fully aware about all terms and conditions mentioned in GCC. 5

9 13 TESTS: All tests as directed by EIC shall be carried out by the Contractor in the reputed laboratory and testing charges shall be born by the contractor only. 14. QUANTITIES: The quantities mentioned in the Schedule of Quantities are indicative. They are bound to vary as per actual site conditions and shall be executed as per the instructions of the Engineer in Charge. The bidders are advised to verify the quantities at site before starting the job. 15. GAIL reserves the right to revise/amend/add any conditions clause and other terms for speedy and timely execution of job by issuing the orders. 16. Compensation for Delay (Liquidated Damages): Time is the essence of the contract, in case the contractor fails to complete the work within the stipulated period, then, unless such failure is due to owner s default, the contractor shall pay to the owner, by way of compensation for delay and not as penalty, a sum at the rate of 1/2% (half percent) percent of total contract price per complete week of delay or part thereof subject to a maximum of 5% of the value of the contract, by way of reduction in prize for delay. The said amount will be recovered from amount due to the contractor/contractor s contract performance security payable on demand. The decision of the Engineer In charge in regard to applicability of compensation for delay shall be final and binding on the contractor. 17. ARBITRATION All disputes or differences whatsoever arising between the parties out of or relating to the construction meaning and operations or effect of the contract or the break thereof shall be settled by arbitration in accordance with the provisions as contained under the Indian Arbitration and Conciliation Act 1996 and rules made thereunder and the award made in pursuance thereof shall be binding on the parties. No verbal agreement or inference from conversation with any officer or employee of the GAIL or consultant either before or after the execution of the contract agreement shall in any way effect or modify any of the terms or obligations herein contained. 18. SITE CLEANING The contractor shall take care for cleaning the working site from time to time for easy access to work site and also from safety point of view. Working site should be always kept clean upped the entire satisfaction of EIC. Before handing over any work to owner the contractor in addition to other formalities to be observed as detailed in document shall clear the site to the entire satisfaction of EIC. In case the contractor fails to clean the site, GAIL shall have the right to clear the same at the cost of the contractor including 20% supervision charges of GAIL. 6

10 19. MATERIAL TO BE SUPPLIED BY THE CONTRACTOR:- Supply of all required materials, manpower, equipments and consumable shall be in the scope of contractor and the quoted rates shall be inclusive of all necessary input to complete the job. 20. SUPERVISION OF WORK: -Contractor or his authorised representative shall supervise the work, during the progress of the work and will be fully responsible for proper execution and safety of the workers and the work 21. ADHERENCE TO SAFETY REGULATIONS:- The contractor shall ensure that all safety instructions/regulations required to be observed at all times during the execution of the job are followed by his supervisors and workers. 22. NUISANCE:- The contractor or his representative shall not at any time cause any nuisance on the site or do anything which shall cause unnecessary disturbance to the owners or tenants or occupants of their properties near the site and to the public generally. 23. ADHERANCE TO TECHNICAL SPECIFICATIONS:- a) The work shall be carried out as per standard specifications and as directed by Engineer In Charge. The specifications for the entire work shall be in accordance with CPWD latest specifications as per latest edition with all corrections also. b) In the absence of any detail specifications of CPWD latest IS specification shall be followed whenever, these codes are silent, the same shall be governed by sound engineering practice and the decision of the Engineer Incharge in matter of interpretation shall be final and binding on the contractor. c) CPWD latest specification in respect of civil/public health work which will be generally followed for execution of works have not been attached with these documents but they form the part of this tender. d) It will be assumed that specifications have been fully read and understood by the tenderer irrespective of the fact whether they have done so or not and no claim on this shall be entertained at a later date. e) Aggregate and sand will be used of good quality and locally available. The EIC has authorized to reject or accept the construction material and free to send the same in laboratory for testing purpose. The charges to be borne by the contractor only. 7

11 24. CARE OF WORK: - From the commencement to completion of the work, the contractor shall take full responsibility for the care for all works including all temporary works and in case of damages, loss or injury, the total responsibility will lie upon the contractor. 25. DEFENCE OF SUITS:- If any action in court is brought against the owner or an officer or agent of the owner, for the failure, omission or neglect on the part of the contractor to perform any acts, matters, convenient or things under the contract or damage or injury caused by the alleged omission or negligence on the part of the contractor, his agents, representative or his subordinate or in contractor s workmen suppliers or employees, the contractor, shall in such cases indemnify from all losses, damages, expenses or decrees arising out of such action. The job of emergency nature shall be carried out immediately after getting the instructions from the engineer-in-charge. In case of failure it is lawful for the GAIL to get the job executed through some agency at the risk and cost of the contractor. Contractor has to keep full time qualified experienced supervisor who will have to be present at site for supervision of work and will arrange to execute the job as per requirement. Contractor/ Contractor s Supervisor will be responsible for the quality and quantity as well as for following : a) He will take the instructions in the prescribed proforma and will be available at site all the time for inspection. b) Daily feedback of the work done by contractor s men should be made available to the Engineer- in- Charge by the contractor s supervisor The contractor shall take measurement of the work done and shall get the same verified/checked by the Engineer -in charge or his Authorised representative. If the contractor fails to take final measurements and get the same verified / checked by the Engineer-in-Charge or his authorised representative then the measurements taken by the Engineer-in-Charge or his authorised representative shall be taken to be the correct measurements of the work and shall be final and binding on the contractor. No claim whatsoever shall thereafter be entertained regarding the accuracy and classification of the measurements. In absence of qualified Supervisor, the recovery at the rate of Rs. 4000/- per month will be done from the bill. Therefore, bidder has to keep in mind while quoting the rates for subject job. The decision of EIC shall be final and binding about recovery as the supervisor has to take prior permission of EIC before proceed for leave etc. 8

12 26. COMPLIANCE OF INSTRUCTIONS: Whenever the contractor fails to comply with the instructions of the Engineer-in-charge it shall be lawful for Engineer-in-charge to have work done through other contractor or departmentally by giving 7 days notice to the contractor. In case contractor fails to execute specified job in the time limit specified, GAIL reserves the right to execute such job through other agency at the risk and cost of the contractor and excess amount incurred by GAIL will be recovered from the payment of the contractor for such failure including 20% supervision charges of GAIL. 27. STATUTORY COMPLIANCE WITH LABOUR/INDUSTRIAL LAW a) It shall be the sole liability of the contractor (including the Contracting firm/company) to obtain and to abide by all necessary licenses/permissions from the concerned authorities as provided under the various Labour Legislations including labour license obtained as per the provisions of the Contractor Labour (Regulation & Abolition) Act, Licensing of Contractors Chapter 1 and Section 1 (4) (b) of the Contract Labour (R&A) Act provides that the Act shall be applicable to every contractor who engages or engaged twenty or more persons on any day of the proceeding twelve months. It is therefore advised that in case you desire to engage twenty or more workmen, this should be brought to the notice of your Engineer-In-charge of Work Center who would in turn, issue necessary certificate in form V to the effect that the applicant has been employed by you as a contractor in relation to his establishment and that he undertakes to be bound by all the provisions of the Act and the rules made there under. b) The Contractor shall discharge obligations as provided under various applicable statutory enactments including the Employees Provident Fund & Miscellaneous provisions Act, The Employees State Insurance (ESI) Act The Inter-State Migrant Workmen (Regulation of Employment & Conditions of Service) Act, 1979, the Minimum Wages Act, 1936, the Workmen s Compensation Act, 1923 Building Construction Works and other relevant Acts, Rules and Regulations enforced from time to time. The Successful Bidder must have valid PF Code No. and Labour License as applicable, issued by the Competent Authority. The Successful Bidder has to comply with Insurance Provisions for the personnel deployed at the time of commencement of work. c) The Contractor shall be responsible for required contributions towards PF, Pension, ESI or any other statutory payments to be made in respect of the contract and the personnel 9

13 employed for rendering service to GAIL and shall deposit these amounts on or before the prescribed dates. Every contract shall submit the proof of depositing the employees and employer s contributions. The contractor shall also be responsible to pay any administrative/inspection charge thereof, wherever applicable, in respect of the personnel employed by him for the work of GAIL. d) The contractor shall regularly submit all relevant records/documents to GAIL representative for verification. e) The Contractor shall be solely responsible for payment of wages and other dues to the personnel deployed by him latest by 7 th of the subsequent month. The contractor shall be directly responsible and indemnify the company against all changes, dues, claims etc. arising out of the disputes relating to the dues and employment of personnel deployed by him. Bills preferred by the successful bidder must carry the proof of Payment of Wages, Copy of the PF/Insurance Challan, Copy of the Attendance Register and other registers, as per the prescribed format which are as given below :- Section 21(3) also provides that it shall be the duty of the contractor to ensure the disbursement of wages in the presence of the authorized representative of the Principal Employer The Rules 72 & 73 of the Contract Labour R&A) Central Rules which provide the manner in which wage is to be disbursed to the contract labour are reproduced below : a) Muster Roll Form XVI b) Register of Wages Form XVII c) Wages/Muster Roll Form XVIII d) Register of deduction Form XX e) Register of Fines Form XXI f) Register of Advance Form XXII g) Register of Overtime Form XXIII f) The contractor shall indemnify the Company against all losses or damages, if any, caused to it on account of acts of the personnel deployed by him. g) The contractor shall ensure regular and effective supervision and control of the personnel deployed by him and gives suitable direction for under taking the contractual obligations. 28. AHR ITEMS- The items having rates more than 50% high from the estimate will be treated as AHR items. The rate of such items will be restricted only for the BOQ quantity. If the quantity of such items exceed above the BOQ quantity, the rate for the exceeded quantity will be least of the followinga) Rate given in the BOQ. b) Rate derived from a similar item of BOQ, provided this item is not an AHR item itself. c) Rate derived on the basis of market rate analysis. (The cost of material and manpower deployed + 10% C.P.) 10

TIME EXTENSION FOR COMPLETION DUE TO ADDITION, ALTERATION AND SUBSTITUTED WORK a) The contractor shall not be entitled to increase in prices or any compensation whatsoever on account of the extension of time allowed. b) Any extension of time granted under the provision of this clause shall be without prejudice to other conditions of the contract and will not absolve the contractor from the obligation of other clauses under the contract. c) The decision of the owner in this regard will be final and binding on the contractor. 30. EXTRA ITEMS If any job required to carry out for completing the whole work but the item is not available in SOR then that will be treated as Extra Item. The payment towards extra item shall be made as per following procedure: a) If there is a similar item in SOR then the rate will be derived from a similar item of SOR. b) If the item is not covered in SOR and rate can not be derived from a similar item of SOR also then rate analysis will be made on the basis of prevailing market rate plus 10% for contractor s profit and overheads. Reasonability of rate shall be decided by EIC and the contractor has to arrange required supporting document Voucher/cash-memo/quotation etc. 31. ENVIRONMENTAL AWARENESS The contractor & his representative shall ensure safety on the environmental aspects, impacts, legislative requirement & about emergency response & preparedness before executing the job. 32. Interested contractors may collect the drawings / Required Information about the work from the Civil Engineering Dept., Hazira and see the site on their own. 33. The contractor shall not assign the contract and sublet any portion of the contract without the consent of the owner 34. If the work is awarded the contractor shall enter into an agreement with GAIL in the prescribed Performa. The cost of stamp paper shall be bond by the contractor. 35. The contractor may be allowed to work during late hours also but no extra payment will be paid for such extended stay. 36. 15 DETAILED SCOPE OF WORK / INSTRUCTION TO BIDDERS The scope of work for providing shade over terrace of community hall is not limited to nomenclature of item mentioned in BOQ/SOR attached with Bid document : The bidders are advised to visit the site before submitting bid as required scaffolding, breaking of parapet wall ( Ht. 1.0 M) for erecting the vertical post and grouting the same, repairing jobs for making good the wall all are in the scope of bidder. The design for required supporting frame structure to be submitted by contractor for approval of GAIL and the job to done as per approved design. The gutter for disposal of rain water also to be provided, the material will be similar as used in roofing. The gutter will be of minimum 230 mm wide and paid in Running meter. The roofing sheet will be used as per instruction of EIC and nothing will be paid extra for wastage, overlapping. The necessary proof of roofing sheets purchased from authorized dealer to be submitted for record purpose. Supporting structure will be made by using sections of reputed brand only and to be approved by EIC before using the same. The material can be tested in approved lab if found necessary and charges will be born by Contractor only. 12
