GHANDHY COLLEGE, Majura Gate, SURAT And on the left corner of the envelope agency give the details about of the company. 1. Tender for CWAN i. Tenders are invited for providing maintenance services for CWAN installed at institute DR. S.& S.S.GHANDHY COLLEGE,SURAT and for ARC for CWAN parts. ii. The details of the components of CWAN for AMC are as given in ANNEXURE A. iii. The details of the components of CWAN for ARC are as given in ANNEXURE B. iv. The maintenance support agency (hereafter referred to as agency in this document) is required to submit the tender in a sealed cover super scribed "Quotation for the Annual Maintenance Contract of CWAN to THE PRINCIPAL, DR. S. & S. S. GHANDHY COLLEGE, SURAT. v. As a token of acceptance of all the terms and condition mentioned in this document, the bidder is required to sign all pages of this document with company seal and return the same along with their offer. 2 2. The Annual Maintenance Contract services will consist of a) The maximum response time for maintenance complaint from any of the destinations specified in the college Schedule of Requirements/AMC (i.e. time required for bidders maintenance engineer to report at the installation after a request call/telegram is made or letter is written) shall not exceed two working days. b) Preventive maintenance (Dusting, blower, joint check etc.) two time in year and corrective maintenance as when complaints raised of CWAN at DR. S. & S. S. GHANDHY COLLEGE, SURAT, where the above CWAN is installed. c) The AMC should be comprehensive onsite and will cover only necessary repairs, troubleshooting, configuration, replacement of damaged parts and other accessories of the installed CWAN to keep it fully operational. d) The maintenance services will be provided on all working days from 10.30AM to 6:10PM or as per need on call basis. e) Provision of availability of service engineers on Sunday or other holidays should be made in case of emergency of institute. f) The maintenance service bidder shall provide maintenance services through qualified Experienced and competent engineers. g) Bidder has to temporary replaced their network switch in case of more delay, within two working days of complaints attended, to make it fully operational. h) If any switch is beyond repair, bidder has to produce certificate from authorized service center. After producing certificate of not reparable, bidder has to replace non-working switch with working switch for period of one month. i) CWAN Annual Maintenance contract of our institute include 250 nodes and components of Annaxure-A and it must be Comprehensive. j) All the components as mentioned in ANNEXURE B will be covered for Annual Rate Contract. k) The parts/components/sub-assemblies used for repair/replacement by the bidder will be of the same/equivalent or higher make and functional capability as originally available in the existing one item. l) Force Majeure shall mean and be limited to the following: a) War / hostilities b) Riot or Civil commotion c) Earthquake, flood, tempest, lightening or other natural physical disaster. m) Dr. S. & S.S.GHANDHY COLLEGE, SURAT has a right to discontinue AMC/ARC at any time without giving any reason. n) The contract will be initially for one year. The contract may be renewed for next one year if the bidder will do their job satisfactory and AMC amount will same as quoted for 1 st year which will be applicable for next one year. Institute head reserves the right to continue or terminate the contracts if required. o) Agency has to pay security deposit on obtaining contract as per government norms (5% of total contract value). p) Agency shall be responsible to fully insure their employees for any injury, death, hazards and sickness or any such risks that may be connected to the services for entire period of contract. OWNER shall not be responsible for any liability towards employees of agency. q) Agency employee must have their Identity card during visit of institute. r) Agency shall comply at its own cost with all the provisions of Labour Laws and other Statutory enactments /Rules/Regulations like provisions of Employees Provident Fund Page 2 of 6

3 Act, Contract Labour (Abolition and Regulation) Act 1970, Minimum Wages as may be applicable from time to time in relation to performance of its services/obligations under the Contract. s) In respect of all labour, directly or indirectly employed in the WORK the Agency shall at his own expense arrange for all the safety provisions as per safety codes of Indian Standards Institution, the Electricity Act, Regulations, Rules and Orders made there under and such other Acts as applicable. t) The Contract shall be governed by and interpreted in accordance with laws of India excluding any choice of law rules which would refer the matter to the law of another jurisdiction and subject to clause 2.15 (Settlement of Disputes) below the courts of Surat, Gujarat shall have exclusive jurisdiction over any disputes between the Parties to deal with any matter arising out of or/and in relation to the Contract. 3. Pre-Qualification Criteria The Applicant to meet the following minimum criteria for pre-qualification: a) Bidder should have at least 2 years experience in setting up LAN system / solutions, and should have installed minimum 5 (100 Nos. of Nodes per LAN) LAN systems, out of which, 1 system should have minimum 250 nodes installed and operational in the same campus. Copy of Purchase order and Certificate of Successful Completion from Customer should be submitted. b) Definition of Works i.e. The Company / Firm should have rendered their services for maintenance of works of value min Rs. 1 lakh. c) Attested copy of PAN/TIN/GST/Service Tax No. etc. to be enclosed with tender document. d) The maintenance service agency shall provide maintenance services through qualified experienced and competent engineers. e) Attach necessary documents for evidence. 4. General Conditions a) The last date for receiving the quotation is 18/08/ HRs. b) DR. S. & S. S. GHANDHY COLLEGE, SURAT has the right to accept or reject any quotations without assigning any reason whatsoever, or increase or decrease of quantities of any item of the work and the successful servicing agency shall perform the same at the rate quoted. c) Comparative statement for tender will be based on amount of AMC(annexure-A). d) Service tax and other government tax as applicable time to time. e) EMD DD of non qualifying parties will be return after 30 Days. f) Your rates should be F.O.R. Rate should be inclusive of all charges except GST. g) The validity period for the quotation should be 3 months from the date on which the tender is due. h) The bid is non transferable. Page 3 of 6

4 i) Successful bidders will have to sign the contract upon receiving the Purchase order with the purchaser(s) within 10 working days from the date of Purchase order. j) No changes shall be entertained in the bid, once the bid is submitted unless required by Dr. S. & S. S. GHANDHY COLLEGE, SURAT in writing. k) The bid received after due date will not be entertained or considered. l) This office will have an absolute right to cancel the biding process at any stage without any prior notice and without giving any reason what so ever. 5. Payment Terms and condition a) The payment to the Agency will be made on quarterly basis at the end of each quarter of year against invoice with PAN number, raised by the agency and based on past performance. b) The maintenance charges quoted by the agency for all item shall be on yearly basis exclusive of all taxes applicable. 6. Penalty Clause 1. During AMC period, if the complaint is not resolved within 72 hrs the penalty of Rs. 500 per day for Networking Switch will be levied. However, if the complaints not resolved within 7 days then from 8th day to 14th day, penalty would be 150% and from 15th day onwards 200% of the above rates would be levied. 2. In case an item is not usable beyond the stipulated maximum downtime the bidder will be required to arrange for an immediate replacement of the same till it is repaired. Failure to arrange for the immediate repair/replacement will be liable for penalty of RS. 500 per day for Networking Switch. 3. The amount of penalty will be recovered from the Performance bank guarantee/security Deposit or may be subtracted from current bill during AMC period.
