2 TERMS AND CONDITIONS 1. Sealed quotations are invited from original equipment manufacturers or their authorized dealer for supply of necessary items/equipment and complete commission of the LAN & Wi-Fi network at Central University of Rajasthan, Bandarsindri, Ajmer as per list attached/given overleaf by 18 February 2013 before 03:00 P.M. Central University of Rajasthan Bandarsindri Kishangarh, Distt. Ajmer The quotations will be opened at P.M. on 18 February 2013.The covers containing quotations must be marked QUOTATION FOR supply and commissioning of the LAN/Wi-Fi network DUE 18 February 2013 before 03:00 P.M. The agencies must come prepared for the finalization of the work order on 18 February 2013 at 3:00 P.M.. The bid evaluation process will continue up to next day, if required. 2. THE RATES QUOTED SHOULD BE FOR CURaj, Bandarsindri, KISHANGARH inclusive of all charges viz. packing, forwarding, taxes, railway freight, transit insurance etc. and free delivery at University campus. 3. Details of Specifications and make of each item should be clearly supported by the Illustrated pamphlets wherever possible. Quotations without specifying the make and other particulars may be rejected. The payment will be made after the goods have been received, opened, installed & good working, checked & found to be in order to our entire satisfaction. In case the goods are rejected these have to be removed by the supplier at his own cost. Losses or damages in transit will be to the account of the supplier. The supplier may if he/she so desires get the goods insured and include such charges in the tendered rate. 4. The rates should be valid at least for period of six months from the last date of receipt of quotations. 5. Terms of Payment : i) 80% payment for the supply part will be made after certification of received of material in good condition, opened, checked & found in order up to entre satisfaction of university authority.

3 ii) Balance 20% payment due for the supply of material along with commissioning charges will be released after successful installation, commissioning and after acceptance period. 6. Performance security equivalent to 10% of the value of the order will have to be furnished by supplier. Performance security may be furnished in the form of an Account payee Demand Draft / Bank Guarantee from a scheduled bank/ FDR or call deposit etc. This performance security should remain valid for a period of sixty days beyond the date of completion of all contractual obligations including warranty obligation. 7. The penalty Clause is as under :- a) Commissioning of all the material is required to be done in the time period of 30 days. Failure to which penalty of 2% of the total cost per week will be imposed subject to maximum 10% of the total cost. Even if the work is not carried out within extended 5 weeks, the remaining work will be completed at the sole risk and cost of the agency. 8. There will be acceptance period of 30 days from the date of completion commissioning. We shall observe certain things during acceptance period e.g., network maintenance, maintenance response time after network down time, performance of network etc. Down time during acceptance period will be of maximum one hour. The acceptance period is liable to be extended double the period for which network is shutdown. After that a penalty of Rs. 2000/- per 24 hours will be imposed subject to maximum extension up to Rs. 20,000/-. Even if the work is not carried out within extended 5 days, the work will be completed at the sole risk and cost of the agency. 9. The price/make/model/product Details should be quoted on prescribed format for technical bid as per ANNEXURE A and financial bid as per ANNEXURE B must be sent in a properly sealed separate envelopes. 10. All the columns of the annexures attached shall be duly and properly filled in separately. The rates and units shall not be overwritten in the price schedule. The rates shall be quoted both in figures and words. The Tender should be signed by the authorized signatory of the firm. 11. No payment will be made in advance for any supplies under this tender. The valid documentary proof of Sales Tax, VAT/Service Tax Registration No. & details of Income Tax registration (PAN) should be submitted alongwith the quotation. The taxes must be quoted clearly and separately. If the taxes are not quoted separately, it will be presumed that the rates quoted are inclusive of taxes. 12. The University is not bound to accept the lowest tender and may reject any tender or any part of tender giving justification for such an action.

4 13. The University reserves the right to verify/seek confirmation of all original documentary evidence submitted by the vendor in support of the tenders, specifications for eligible criteria. In case any information furnished by vender is found false/incorrect the tender will be rejected. 14. Earnest Money : (a) EARNEST MONEY : - A Demand Draft for Rs 60000/- only in the name of Central University of Rajasthan and payable at Kishangarh, may be enclosed along with quotation as Earnest Money without which no quotation shall be considered. (b) Earnest Money is liable to be forfeited and bid is liable to be rejected, if the tenderer withdraw or amends impairs or derogates from the tender terms & condition in any respect within the period of validity of the tender. (c) The earnest money of all the unsuccessful tenderers will be returned as early as possible after the expiry of the period of the bid validity and after issue of the purchase order. No interest will be payable by the purchaser on the Earnest Money Deposit. 15. Delivery and installation of the items are to be completed within 30 days from the date of receipt of purchase order (Including procurement of items, installation & commissioning). This is the maximum time limit allowed to the agency for successful procurement, installation and commissioning in all respect up to the satisfaction of university authority. 16. Three year comprehensive warranty of all equipment as well as all the functionality of network is required. Down time during warranty period will be of maximum 24 hours. 17. Detailed breakup of commissioning is required to be quoted. 18. All legal proceedings, if necessity arises to university may be any of the parties (University Contractor/ Supplier) shall have to be lodged in the courts situated at Ajmer and not elsewhere. 19. Arbitration Clause: If the dispute cannot be settled by mutual discussions within thirty (30) days period, either party may refer the matter to a panel to three arbitrators. Each party shall be the presiding arbitrator. The arbitration proceedings shall be held under the provisions of the arbitration and Conciliation Act, 1996 or any of its subsequent amendments. 20. The agencies are advised to visit the site of work before submitting the tender document at their own cost and examine its surroundings to collect all information that they consider necessary for proper assessment of the prospective assessment between 9:30 AM to 5:30 PM up to 15 February 2013 on all working days.
