1 Terms and Conditions TAB s AFL Footy Finals Promotion 1. General Entry 1.1 Information on how to enter TAB s AFL Footy Finals promotion (the Promotion) form part of these terms and conditions (the Terms and Conditions). 1.2 The promoter is Tabcorp Holdings Limited ABN of 5 Bowen Crescent, Melbourne VIC, phone number (03) (the Promoter). 1.3 Entry is open to any person over the age of 18 who qualifies for entry into the Promotion in accordance with these Terms and Conditions (an Eligible Participant). 1.4 By entering and/or participating in the Promotion, each Eligible Participant agrees to these Terms and Conditions and agrees that the decision of the Promoter on all matters relating to this Promotion will be final and binding. 1.5 The following people are not eligible to participate in the Promotion: (c) (d) anyone who is not an Eligible Participant; directors, officers and employees of the Promoter and its related companies; directors, officers and employees of contractors to the Promoter; and Immediate family of or (c). 2. Term of Promotion For the purpose of these terms and conditions immediate family means a spouse (including de facto), parent, child, grandparent, sibling and stepchild. The Promotion will run from 3 September September 2013 (Promotion Period). 3. How to Enter 3.1 Eligible Bets: To have a valid entry in the Promotion, an Eligible Participant must have a bet, placed either via a Victorian Tabcorp Account or in cash at a Victorian Tabcorp Licensed Venue or Agency (Outlet) which satisfies the following criteria: be a minimum 2 leg multi-bet;

2 only contain legs which are for single bet types on the Eligible Matches and are confined to Eligible Matches within one particular week; be for a minimum amount of $10; be a winning bet that returns a dividend; placed anytime from the Tuesday prior to the first Eligible Match being held on that week (i.e. for Week 1 of the matches, be placed on or from 3 September 2013); and does not fall into the category of bets detailed in clause 3.3 below. A bet which fulfils the above criteria, and is placed at an Outlet but via a person s Victorian Tabcorp Account, will be deemed to be a bet placed through that persons Victorian Tabcorp Account for the purposes of these Terms and Conditions. 3.2 Eligible Matches: The Eligible Matches are as follows: For Week 1 (6-8 September): Each of the AFL Qualifying Finals (i.e. 1v 4 and 2 v 3); and Each of the AFL Elimination Finals (i.e. 5 v 8 and 6 v 7). For Week 2 (13-14 September): Each of the AFL Semi Finals (held on Friday night and Saturday). For Week 3 (20-21 September): Each of the AFL Preliminary Finals (held on Friday night and Saturday). 3.3 Eligible Bets do not include: (c) (d) (e) (f) Pari-mutuel bets placed on FootyTAB; Multi bets which are reduced to a single leg bet and pay a dividend due to a refund/cancellation of one or more of the legs in the original multi-bet in accordance with the TAB betting rules; Bets which have been voided; Bets which contain a leg on something other than an Eligible Match (for example, where one of the legs is on a rugby league match or a horse race); Bets which contain a leg which has been placed on an Eligible Match while that Eligible Match is in-play ; bets placed at Flemington, Caulfield or any other racetrack throughout Victoria.

Selection of Winners Winners of the Promotion will be selected, at random, from the following pools of Eligible Bets: WEEK ONE For Eligible Bets that are placed on Eligible Matches in Week One: conclusion of the second Eligible Match held during Week One: o two Eligible Bets will be selected from those Eligible Bets that have been placed at an Outlet; and o one Eligible Bet will be selected from those Eligible Bets conclusion of the third Eligible Match held during Week One; o three Eligible Bets will be selected from those Eligible Bets that have been placed at an Outlet; and o one Eligible Bet will be selected from those Eligible Bets conclusion of the fourth Eligible Match held during Week One. o three Eligible Bets will be selected from those Eligible Bets that have been placed at an Outlet; and o two Eligible Bets will be selected from those Eligible Bets WEEK TWO For Eligible Bets that are placed on Eligible Matches in Week Two: conclusion of the second Eligible Match held during Week Two: o four Eligible Bets will be selected from those Eligible Bets that have been placed at an Outlet; and

4 o two Eligible Bets will be selected from those Eligible Bets WEEK THREE For Eligible Bets that are placed on Eligible Matches in Week Three: conclusion of the second Eligible Match held during Week Three: o five Eligible Bets will be selected from those Eligible Bets that have been placed by cash at an Outlet; o two Eligible Bets will be selected from those Eligible Bets The total number of Eligible Bets that will be selected to receive a Prize will be twenty-five (25) (subject to any Unclaimed Prize requirements). The relevant person who placed the Eligible Bet that is selected will be considered a Winner for the purposes of these Terms and Conditions. A Cash Winner refers specifically to a Winner who has placed a bet at an Outlet, while an Account Winner refers specifically to a Winner who has placed a bet via a Victorian Tabcorp Account. 5. Prizes 5.1 Prizes Each Winner will receive a double pass to the AFL Grand Final (each double pass valued at $420) for 2013 and 1 x $500 Account Top-Up or (if the Winner does not hold a betting account at the time placing their Eligible Bet), a $500 Victorian Betting Voucher (Prize). The total Prize pool value for the Promotion is $23,000 (being 25 double passes to the AFL Grand Final and 25 x $500 account top-ups or betting vouchers). 5.2 Prize Winner Notification (c) Cash Winners will be notified in person and in writing when they present a winning ticket for payment and, subject to complying with clause 5.2(c), if required, will be sent their prize within 5 days of being notified of the winning ticket. Account Winners will be notified via phone and in writing by the Monday directly following the Weekend on which their Eligible Bet was selected. In order to claim their Prize: (i) Cash Winners will need to have cashed their Eligible Bet and provided their relevant details by 7.00pm on the

5 Monday following the weekend of the Eligible Matches (for example, for Winners of Week 1, the Cash Winners will have cash their Eligible Bet by 7.00pm on 9 September 2013); and (ii) Account Winners will need to accept the call from customer service and supply their full name and address by 5.00pm on the Monday following the weekend of the Eligible Matches (for example, for Winners of Week 1, the Account Winners will have to have accepted the call by 5pm AEST on 9 September 2013) (d) (e) (f) If the Winners do not claim their Prize in accordance with clause 5(c) above, the Prize will be forfeited by that Winner, and clause 10 will apply to the Prize. Upon Winners successfully claiming their Prize, and subject to the Promoter obtaining their relevant details, the Prize will be sent to the Winners within 7 working days. Each Winner must supply their full name and suburb of residence. Their details will be published in The Australian on Friday 27 September Prize Specific Conditions 6. Taxes & Costs All Prizes must be taken as offered cash will not be offered in lieu of any of the Prizes. 6.1 Any taxes which may be payable as a consequence of a Winner receiving a Prize are the sole responsibility of the Winner. The Promoter accepts no responsibility for any tax implications that may arise from any Prize winnings. Independent financial and tax advice should be sought. 6.2 All other costs associated with a Prize, including but not limited to travel, insurance, fuel, and any other ancillary costs are the responsibility of each Winner. 7. Exclusion of Liability 7.1 To the extent permitted by law, the Promoter is not liable for any loss, including, but not limited to, direct, consequential (including economic) or indirect loss or any loss of profits, by reason of any act or omission, deliberate or negligent, by the Promoter or their servants or agents, in connection with this Promotion or the arrangement for supply, or the supply or failure to supply, of any goods or services by any person to a Winner.

6 7.2 Nothing in these Terms and Conditions affect, nor is intended to affect, any rights that an Eligible Participant might have that are not able to be excluded under applicable Australian consumer protection laws. 8. Use of Personal Information / Marketing 8.1 The Promoter complies with the National Privacy Principles contained in the Privacy Act 1988 (Cth). 8.2 Any information Eligible Participants provide will be used by the Promoter for the purpose of conducting this Promotion. 8.3 The Promoter may disclose Eligible Participants' personal information to its contractors and agents to assist in conducting this Promotion or communicating with Eligible Participants. 8.4 By entering the Promotion, Eligible Participants consent to their personal information being collected, used and disclosed by the Promoter, its agents, affiliates, related business companies, other companies associated with this Promotion, and business partners for any promotional activities, including the Eligible Participant's personal participation in reasonable promotional activities as requested by the Promoter, and any marketing and publicity purposes without any further reference, payment or other compensation to the Eligible Participant. 8.5 Eligible Participants consent includes authorising the Promoter, its agents, affiliates, related business companies, other companies associated with this Promotion and business partners to send the Participant future electronic messages including but not limited to, SMS, MMS, and regarding any promotional, marketing and publicity activities. 8.6 Eligible Participants' personal information may be disclosed to State and Territory lottery departments and Winners' names published as required under the relevant lottery legislation. The Promoter will use reasonable endeavours to provide the Eligible Participant reasonable prior notice where their personal information is going to be disclosed to State and Territory lottery departments or published under lottery legislation. A request to access, update or correct any personal information should be directed to the Promoter at its address set out in 1.2 of these Terms and Conditions. 8.7 All Eligible Participants consent to the publication of their name and suburb of residence (however their full address will not be published) and agree to participate in Promotion activities as requested by the Promoter. 8.8 For more information, refer to the Promoter s Privacy Policy located on the Promoter s website 9. 7 9.1 The Promoter, its employees, officers, agents, and its subsidiaries are not responsible for and shall not be liable for: any condition caused by events beyond the control of the Promoter that may cause the Promotion to be disrupted or corrupted; any injuries, losses (including, without limitation, loss of profits), or damages of any kind caused by the Prize or resulting from acceptance, possession, use, or misuse of the Prize, or from participation in the Promotion or downloading material from or any other website operated by the Promoter; or any printing or typographical errors in any materials associated with the Promotion. 9.2 The Promoter reserves the right, in its sole discretion, to: (c) (d) (e) cancel or suspend the Promotion, should the security, fairness, integrity, or proper operation of the Promotion be compromised in any way by way of any virus or bugs in the IT system used for this Promotion; unauthorized human intervention; or other causes beyond the reasonable control of the Promoter; disqualify any Eligible Participant who engages in offensive, illegal or objectionable conduct in respect of this Promotion or otherwise brings the Promotion and/or the Promoter into disrepute; disqualify any Eligible Participant who tampers with the entry process, or who submits an entry that is not in accordance with these Terms and Conditions; cancel, terminate, modify or suspend the Promotion in accordance with any written directions given by any relevant government or regulatory authority to do so; request a Winner provide proof of age, identity or proof of residency at the nominated Prize delivery address. 9.3 In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest or strikes, the Promoter may in its absolute discretion cancel the Promotion or part of the Promotion and recommence it from the start on the same conditions subject to Australian law. 9.4 By entering this Promotion, Eligible Participants acknowledge that it is a condition of accepting a Prize that they may be required to sign a legal

8 release in a form determined by the Promoter and agreed to by the Winner, acting reasonably. 9.5 To the extent that a situation or issue arises for which these Terms and Conditions make no provision or in relation to which the relevant Terms and Conditions are unclear, the Promoter will make a decision regarding such situation. The Eligible Participant will have the right to request an internal review of the Promoter s decision. Subject to any regulator direction to the contrary, the decision of the internal review will be final and binding. 9.6 In the event that the Winner is identified as a minor, self excluded patron, involuntarily excluded patron or any other person who is in breach of these Terms and Conditions (the Refused Winner), the Promoter reserves the right to refuse to allow the Winner to take part in, or receive, any or all aspects of the Prize, and the Promoter will notify any relevant regulator accordingly where required by law to do so. 9.7 Decisions of the management of the Promoter are final. No correspondence will be entered into. 9.8 The Terms and Conditions are governed by and must be construed in accordance with the laws in force in the state in which the Eligible Participant placed the winning bet. The Promoter and each Eligible Participant submits to the jurisdiction of the courts of that state and the Commonwealth of Australia in respect of all matters arising out of the Terms and Conditions. 10. Unclaimed Prize Draw If, as a result of the operation of these Terms and Conditions, a Prize for either Week 1 or Week 2 is not given away, that Prize will be added to the Prize pool for the following week (i.e. if a Cash Winner does not claim their Prize, then for the next week of the Promotion there will be an additional Cash Winner). If at the completion of Week 3 of this Promotion, the Prizes have not been completely given away or claimed, the left over Prizes (regardless of whether they were a Cash Winner or an Account Winner) will be given away using the following procedure: A random draw will be conducted on all Eligible Bets that were placed via a Victorian Tabcorp Account throughout the Promotional Period, and a number of additional Winners will be selected based on the number of Prizes that are unclaimed. The random draw will be held at the NSW office of Tabcorp Holdings (495 Harris Street, Ultimo, NSW) on Tuesday 24 September at 12 noon Each Winner of the unclaimed prize draw must supply their full name and suburb of residence.
