1 TOURISM TASMANIA ON-PITCH CHALLENGE PROMOTION TERMS AND CONDITIONS 1. Information on how to enter the Tourism Tasmania Concourse Promotion ( Promotion ) forms part of the terms of entry. Entry into the Promotion is deemed acceptance of these Terms and Conditions ( Terms and Conditions ). 2. Entry is only open to Australian residents aged 18 years or older. 3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 4. For the purposes of the Promotion, the agencies associated are Tourism Tasmania, Mango Communications and Hawthorn Football Club. 5. The Promotion commences at 6pm on 28/03/17 AESDT and ends 3:00pm on 30/03/17 AESDT ( Promotional Period ). 6. To be eligible to enter, individuals must, during the Promotional Period, log onto the Hawthorn Football Club ( Hawthorn FC ) website ( follow the prompts to the promotion entry page, input the requested details (including, but not limited to, their full name, address, phone number and address) and submit a fully completed application. 7. Incomplete or indecipherable entries will be deemed invalid. 8. Only one (1) entry is permitted per person. 9. The winners will be notified by telephone and in writing an published on the Hawthorn Football Club website ( 10. The Promoter s decision is final and the Promoter will not enter into correspondence regarding the Promotion result. 11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

2 12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. The Promoter reserves the right to request the winner to provide proof of identity, and/or proof of entry validity in order to claim the Prize. In the event that a winner cannot provide suitable proof, the winner will forfeit the Prize in whole and no substitute will be offered. 13. The Promoter accepts no responsibility for any late, lost or misdirected entries not received by the Promoter or delays in the delivery due to technical disruptions, network congestion or for any other reason. 14. The winner selection will take place at Hawthorn FC Office - Level 33 Rialto South Tower, 525 Collins Street, Melbourne, Victoria 3000 at 4:00pm 30/03/17. The judges reserve the right to select additional reserve entries, which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant. The winners will be notified by telephone and in writing. 15. Two (2) entries, as determined by the judges from all entries received during the Promotional Period, will win the opportunity to participate in the Tourism Tasmania Challenge on pitch activity at the Melbourne Cricket Ground, Brunton Ave, Richmond VIC 3002 for a chance to win a major prize. Tourism Tasmania Challenge 16. a. The Tourism Tasmania Challenge will take place at the field at the MCG at a time to be advised by the Promoter. b. To participate in the Tourism Tasmania Challenge each Participant will be required to attend the specified meeting point at the match at a specified time as advised by the Promoter. c. Participants will be responsible for their transport to and from the Tourism Tasmania Challenge. If the Participant cannot attend the Tourism Tasmania Challenge, the Participant may appoint a proxy 18 years of age or older to play the Tourism Tasmania Challenge on his/her behalf provided the Participant gives the Promoter notice to that effect before the start of the Tourism Tasmania Challenge. If a Participant does not attend the Tourism Tasmania Challenge or does not nominate a proxy, they will forfeit their right to participate in the Tourism Tasmania Challenge. d. As a condition of Participating in the Tourism Tasmania Challenge, each Participant must sign any legal documentation as and in the form required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form. e. The Tourism Tasmania Challenge will be a skill-based challenge to be determined by the Promoter in its absolute discretion. Chance will play no part in the determination of the winner of the Tourism Tasmania Challenge. All Participants

3 must compete against each other in accordance with the rules set out by the Promoter. The Promoter will announce the rules of the Tourism Tasmania Challenge to all Participants prior to its commencement. The Participant that wins the Tourism Tasmania Challenge in accordance with the rules set by the Promoter in its absolute discretion will win f. By participating in any Tourism Tasmania Challenge, the Participant agrees to do so at their own risk and accept responsibility for their own safety and personal possessions. g. The Participant acknowledges and agrees that they are aware and accept any and all risks that may be involved in or may arise from participation in any element of any Tourism Tasmania Challenge and, to the maximum extent permitted by law: i) release and forever discharge the Promoter, and their directors, officers, servants and agents or any of them; and ii) indemnify and hold the Promoter, and their directors, officers, servants and agents or any of them harmless, against all actions, claims and demands relating to or in connection with any damage, injuries or costs including legal costs, suffered or incurred by the Participant arising out of or resulting from the Participants' involvement in any element of any Tourism Tasmania Challenge. 17. Two Major Prizes will be awarded, one Major Prize to each winner, to the value of $1,500 AUD each and includes a return flights two (2) from Melbourne (Tullamarine) to Launceston; 2 (two) nights accommodation for two (2) adults in the Launceston CBD and two (2) tickets to see Hawthorn vs St Kilda at University of Tasmania Stadium on Saturday 29 April. 18. Total prize pool value is $3,000 (GST inclusive). The Prize value is based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for a change in the Prize value between now and the Prize redemption date. 19. If the Prize winner is from Tasmania, then the Prize does not include airfares and the airfare component of the Prize is not redeemable for cash. 20. The Prize winner (and their companion) are responsible for all other expenses including travel to and from the departure point, petrol, car hire excess, spending money, food provisions, drinks, transfers, laundry charges, activities (unless specified), incidentals, taxes, energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.

The Prize winner and his/her companion must comply with regular terms and conditions of the elements of the Prize, including, but not limited to, the travel retailer, accommodation and experience providers, and airline. 22. The Prize must be booked by 24 April The Prize must be taken between 27 April 2017 and 1 May 2017 and is subject to booking and availability. The Prize is not valid for any travel other than the dates specified above. 23. Frequent flyer points will not form part of the Prize. 24. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card or make a cash deposit at time of accommodation check in for all incidental charges. If the winner does not take the Prize (or an element of the Prize) by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited. 25. Any other ancillary costs with accepting the Prize and attending the Event will be the responsibility of the winner and his or her companions, including, but not limited to, travel to and from the Event. The winner and their companion must abide by any Hawthorn FC and stadium entry terms and conditions. 26. If for any reason a winner does not take the Prize (or an element of the Prize) at the time stipulated by the Promoter, then the Prize (or that element of the Prize) may be forfeited at the Promoter s absolute discretion. 27. If any Prize (or part of any Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification. 28. The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken as cash. 29. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. 30. The Promoter reserves the right to refuse to allow the winner to take part in any or all aspects of the Prize, if the Promoter determines, in their absolute discretion, that the winner is not in the mental or physical condition necessary to be able to safely participate in the Prize.

As a condition of accepting the Prize, the winner (and his/her companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. 32. The Prize will be awarded to the person named in the Entry. 33. Should an entrant s contact details change, it is the entrant s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter. 34. By participating in any Tourism Tasmania Concourse Promotion, the Participant agrees to do so at their own risk and accept responsibility for their own safety and personal possessions 35. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter s ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions, subject to any written directions given under State Regulation. 36. Any cost associated with accessing any promotional website is the entrant s responsibility and is dependent on the Internet service provider used. 37. If the Prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the Prize for a prize of equal or specified value, subject to Tasmanian State Government Regulations. 38. Entrants consent to the Promoter and Hawthorn FC using their name, likeness, image and/or voice in the event they are a Participant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), the Promoter s sponsorship and promoting any products manufactured, distributed and/or supplied by the Promoter or Hawthorn FC. 39. If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Promotion, subject to any written direction given under Tasmanian State Government Regulation.

6 40. Any cost associated with accessing any promotional website is the entrant s responsibility and is dependent on the Internet service provider used. 41. All entries become the property of the Promoter. 42. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter s legal rights to recover damages or other compensation from such an offender are reserved. 43. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ( Non-Excludable Guarantees ). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 44. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the AFL match is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) taking/use of and/or participation in the prize. 45. The Promoter collects personal information ( PI ) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Personal Information Protection ( PIP ) Policy, which can be viewed at In addition to any use that may be outlined in the Promoter s PIP Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. All entries become the property of the

7 Promoter. The Promoter will not disclose entrant s personal information to any entity outside of Australia. 46. The Promoter is Tourism Tasmania, the body corporate established pursuant to section 4 of the Tourism Tasmania Act 1996 (Tas) (ABN )
