1 ISUZU D-MAX MEMORABLE MOMENTS PROMOTION TERMS AND CONDITIONS 1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 2. The Promoter is Rugby League World Cup 2017 Limited (ABN ) of Level 16, 24 Campbell Street, Haymarket, NSW 2000, telephone Entry is only open to Australian residents aged 18 years or over, who can travel to Brisbane to attend the Rugby League World Cup Final if drawn as a winner. 4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, exspouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, step-sister or 1 st cousin. PHASE 1 ENTRY & VOTING 5. Entries open for Rounds (defined below) on 05/10/2017 and end for Rounds (defined below) at 11:59pm AEDT on 26/10/2017 ( Round Period ). 6. To receive an entry into the draw, individuals must complete the following steps during the Round Period: Online Entry visit follow the prompts to the promotion entry page, input the requested details (including their full name and address), vote for their favourite Moment (as defined below in clause 7) and submit the fully completed online entry form. Event Entry visit the Rugby League World Cup stand at an Event (as defined below in clause 10), input the request details into a tablet device provided by a member of staff at the stand (including their full name and address), vote for their favourite Moment (as defined below in clause 7) and submit the fully completed entry form. 7. During the Round Period, there will be eight (8) rounds ( Rounds ) of voting. In each Round, two (2) moments from previous Rugby League World Cups ( Moments ) will be posted, with individuals able to place a vote for their favourite Moment out of the two (2). The Moment from each Round that receives the most votes will go through to a Final Round at the end of the Round Period. In the event of a tie, the Rugby League World Cup Committee will decide the Moment that will go through to the Final Round, based on which Moment they, in their sole discretion, deem to be the most entertaining and skilful. Entries/votes for each Round open once the Moments for that Round are posted by the Promoter and close once the Moments for that Round are removed by the Promoter. 8. There will also be one (1) final round ( Final Round ) at the end of the Round Period. In the Final Round, individuals will be able to vote for their favourite Moment, from the eight (8) winning Moments from the previous Rounds, between 27/10/2017 to 11:59pm AEDT on 13/11/2017 by visiting and following the prompts. The Moment that receives the most votes in the Final Round will be deemed the overall winning Moment. Each individual that submits a vote in the Final Round will receive an entry into the draw. In the event of a tie for most votes, the Rugby League World Cup Committee will decide the overall winning Moment, based on which Moment they, in their sole discretion, deem to be the most entertaining and skilful. 9. There is a limit of one (1) vote/entry per Round and one (1) vote/entry in the Final Round, with a total of nine (9) entries/votes permitted per person in the promotion. All valid entries/votes received, will also go into the draw, as outlined in clause 11 below.

Individuals will be able to enter the promotion in accordance with clause 6 above at Rugby League World Cup community team events, held Australia wide from 05/10/2017 to 13/11/2017 (each an Event ). PHASE 2 DRAW 11. The draw will take place at the Promoter s office, Level 16, 24 Campbell Street, Haymarket, NSW 2000 on 14/11/2017 at 10am AEDT. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified in writing within two (2) business days of the draw and their names will be published at from 17/11/ The Promoter s decision is final and no correspondence will be entered into. 13. The first two (2) valid entries drawn will win a trip for two (2) adults to the Rugby League World Cup Final in Brisbane, QLD valued at up to $2,000, depending on point of departure ( Trip ). Trip includes: Two (2) x return economy airfares from winner's nearest capital city to Brisbane, QLD (If a winner resides within a 100km radius of Brisbane the airfare component of the prize will be forfeited and not redeemable for cash); Two (2) nights twin share 5 star accommodation at the Sofitel Brisbane; Two (2) x Category A tickets to the 2017 Rugby League World Cup Final; and The opportunity to participate in Phase 3 and Phase 4 of the promotion. Spending money, meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Trip must be taken to coincide with the Rugby League World Cup Final held on 02/12/2017 at Brisbane Stadium, with flights departing on 01/12/2017 and is subject to booking and flight availability. Winners and their companions must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with a winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points will not form part of the prize. Winners may be required to present their credit card at time of accommodation check in. PHASE 3 THE GAME 14. Each winner ( Participant ) will also have the opportunity to play a game ( Game ) during half time at the 2017 Rugby League World Cup Final for the chance to play to win an Isuzu D- MAX 17 MY 4x4 LS-T Automatic in Venetian Red Mica paint valued at up to $60,550 including registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State by State). Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. If the car is won, the Promoter may, in its absolute discretion, accommodate the winner s colour preference (excluding metallic options), subject to availability. If the car is won, the winner must collect the prize from their nearest authorised Isuzu dealership. 15. The Game will take place at half time during the 2017 Rugby League World Cup Final on 02/12/2017 at Brisbane Stadium. If the drawn Participant cannot attend the Game, the Participant may appoint a proxy over 18 years of age to play the Game on his/her behalf provided the Participant gives the Promoter written, signed notice to that effect before the start of the Game. The proxy cannot be an employee (or immediate family member) of the Promoter or an agency associated with this promotion. 16. The two (2) Participants (or proxy, as applicable) will compete against each other in the Game by completing the following tasks: Correctly catch one (1) ball from a ball machine (i.e. catch the ball without the ball hitting the ground); 2

3 Fully complete an obstacle course including swerving through posts; and Kick one (1) ball over the goal posts, from the distance of 10m and from the placement indicated by the Promoter. The objective of the Game is to be the first Participant (or proxy, as applicable) to successfully complete all tasks. Participants (or proxy, as applicable) must follow all reasonable directions of the Promoter at all times for the duration of the Game. Participants (or proxy, as applicable) must not attempt to interfere with any other Participant (or proxy, as applicable) for the duration of the Game. Any Participant (or proxy, as applicable) deemed to be in breach of this condition, or who in the absolute discretion of the Promoter is deemed to be behaving in an inappropriate, aggressive, offensive or unsportsmanlike manner, may be disqualified by the Promoter in its discretion. 17. The first Participant to successfully complete all tasks will be deemed the winner of the Game ( Game Winner ). In the event of a tie, each Participants will be required to submit a twentyfive (25) word or less answer to the following question Why do you want to win the prize? to the Promoter by the time indicated by the Promoter. Each answer will be individually judged based on literary and creative merit of the answer provided to the promotional question. The best answer, as determined by the judges, will be deemed the winner of the Game ( Game Winner ). 18. In the event that both Participants do not successfully complete all tasks, each Participant will be required to submit a twenty-five (25) word or less answer to the following question Why do you want to win the prize? to the Promoter by the time indicated by the Promoter. Each answer will be individually judged based on literary and creative merit of the answer provided to the promotional question. The best answer, as determined by the judges, will be deemed the winner of the Game ( Game Winner ). PHASE 4 CONTINGENCY CAR KEY GAME 19. In phase 4, there will be three (3) car keys on display. The Game Winner will have first choice at choosing one (1) of the three (3) car keys. Only one (1) of the three (3) car keys will be the key to open the Isuzu D-MAX car prize. The Game Winner must choose one (1) car key without touching, handling or interfering in any way with any of the other car keys on display. If the Game Winner is found to have breached this condition, he/she will be disqualified. If the Game Winner selects the correct car key, they will be able to put the key into the car door and open the Isuzu D-MAX, and subject to verification by the judges, the Game Winner will win the Isuzu D-MAX. If however the car key chosen does not successfully open the car door, then the other Participant will be able to choose a car key from the remaining two (2) car keys. The other Participant must choose one (1) car key without touching, handling or interfering in any way with any of the other car keys on display. If the Participant is found to have breached this condition, he/she will be disqualified. If the Participant selects the correct car key, they will be able to open the Isuzu D-MAX, and subject to verification by the judges, the Participant will win the Isuzu D-MAX. If however the car key chosen does not successfully open the car, then the Game Winner will be able to choose the remaining car key, which will open the Isuzu D-MAX, and subject to verification by the judges, the Game Winner will win the Isuzu D-MAX. For the removal of doubt, the Participant who does not successfully open the car will not win a prize (regardless of whether they won the initial Game or not). GENERAL 20. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. 3

4 21. Incomplete or indecipherable votes/entries will be deemed invalid. 22. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 23. If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion. 24. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority. 25. Subject to the unclaimed prize draw clause, if for any reason a winner does not take / redeem a prize (or an element of the prize) at / by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited. 26. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. 27. The 2017 Rugby League World Cup Final ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize. 28. Total prize pool value is up to $64, Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash. 30. A draw for any unclaimed Trip prizes may take place on 21/11/2017 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw and their names will be published at from 24/11/ In the event that the Isuzu D-MAX prize remains unclaimed by the winner, the other Participant (who took part in the Game but did not win the Isuzu D-MAX in phase 4) will be awarded the Isuzu D-MAX prize. If the Isuzu D-MAX prize remains unclaimed by both Participants, an unclaimed prize draw for such a prize may take place on 05/03/2018 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw and their names will be published at from 09/03/ Participants (and their proxy, where applicable) consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 33. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the 4

5 Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 34. Any cost associated with accessing the promotional website is the entrant s responsibility and is dependent on the Internet service provider used. The use of any automated entry or voting software or any other mechanical or electronic means that allows an entrant to automatically enter or vote repeatedly is prohibited and will render all entries/votes submitted by that entrant invalid. 35. The Participants of the Game acknowledge that the Game is a dangerous activity that may result in injury or death, and participate at their own risk. Participants must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Game organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Game; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Game organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Game organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any Participant from participating in the Game if, at any time, they reasonably believe that the Participant poses a safety risk or for any other reason; and/or (b) cancel the Game if the conditions are deemed dangerous. If the Game is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered. 36. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia ( Non-Excludable Guarantees ). Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 37. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the 2017 Rugby League World Cup Final event is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) attendance at an Event, taking of the Trip or participation in any game. 38. As a condition of accepting the prize, winners (and their companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. 39. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at In addition to any use that may be outlined in the Promoter s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages 5

6 or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant s PI to any entity outside of Australia. 40. The Promoter may also disclose PI to Isuzu UTE Australia ( IUA ). IUA collects PI in order to assist in awarding prize(s) and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. IUA will handle PI in accordance with its Collection Statement (which can be viewed at and their Privacy Policy (which can be viewed at In addition to any use that may be outlined in the Privacy Policy, IUA may, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.
