1 2015 ICC Cricket World Cup Final Promotion Conditions of entry Promoter CUB Pty Ltd (ABN Entry Restrictions ), 77 Southbank Boulevard, Southbank, VIC Open only to Australian residents who: (a) (b) (c) are aged 18 or over; if they enter the major prize draw, are able to take the major prize on 29/03/15 in Melbourne, Victoria; and are not prohibited from entering the Crown Casino or the Crown Entertainment Complex in Melbourne for any reason. Directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the agencies, companies or participating venues associated with this competition are not eligible to enter. Competition Period 11.30am (AEDT) on 17/02/15 to 11.59pm (AEDT) on 22/03/15. Venues Entry Method Instant Win Minor Prize Determination Participating liquor licensed venues at the Crown Entertainment Complex in Melbourne, Victoria, namely: 1. The Sports Bar; 2. Lagerfield Bar & Beer Garden; 3. Jackpot Bar; 4. Velvet Bar; 5. Double Up Bar; and 6. Las Vegas Bar. During the Competition Period, entrants must: (a) (b) (c) purchase a schooner of Victoria Bitter beer (Eligible Purchase) for on premise consumption from any participating Venue to receive an entry form containing a unique code (subject to entry form stocks remaining in that Venue); then to enter to see if they ve won a minor prize instantly, send a SMS from their mobile phone to (maximum cost 55 cents (inc GST)) stating in one message and in the following order, the unique code found on the entry form, surname and postcode (errors and omissions excepted in the Promoter s discretion); and/or to enter the major prize draw, fully complete the entry form and place it in the entry box located at that Venue. There are 40 minor prizes to be won instantly and randomly based on pre-determined times during the Competition Period via a computer generated random system at Prime Focus, 403/62 Beach Street, Port Melbourne VIC 3207 (Prime Focus). Each entrant will receive a return SMS (at no additional cost to the entrant) confirming their successful entry into the instant win element of the competition and notifying the entrant whether they have won a minor prize and details

By entering this competition, entrants consent to receiving this electronic message. Each instant win minor prize is a cricket bat (signed by player/s of team/s as determined by the Promoter) valued at $250 (inc GST). Minor prize winners will be notified instantly in writing (by SMS). Instant minor prizes must be claimed by 5.00pm (AEST) on 23/04/15. All major prize draw entries will be forwarded to the draw location and combined. The draw will take place at 11.00am (AEDT) on 23/03/15 at Prime Focus. The major prize winner will have until 5.00pm (AEDT) on 25/03/15 to claim the major prize. If, after making all reasonable attempts, the Promoter cannot contact the drawn major prize winner (or the drawn major prize winner does not contact the Promoter) by 5.00pm (AEDT) on 25/03/15, the Promoter reserves the right to discard that entry and to draw another major prize winner at 11.00am (AEDT) on 26/03/15 (at Prime Focus) who will be given until 5.00pm (AEDT) on 27/03/15 to claim the prize. The first valid entry randomly drawn from all valid entries in the major prize draw element that are received during the Competition Period will win the major prize. There is 1 major prize to be won. The major prize is valued at $10,140 (inc GST) in total and is a Platinum Lounge Package ticket for each of the winner and 5 companions (who must be aged 18 or over) to attend the 2015 ICC Cricket World Cup Final on 29/03/15 at the MCG, Melbourne VIC. The major prize winner will be notified by phone and in writing immediately after the major prize draw and their name and state/territory of residence will be published at (Website) on 24/03/15 for a period of 28 days. 5.00pm (AEDT) on 25/03/ am (AEDT) on 26/03/15 at Prime Focus. Any major prize winner in the Unclaimed Major Prize Draw will be notified by phone and immediately after the Unclaimed Major Prize Draw and their name and state/territory of residence will be published on the Website on 26/03/15 for a period of 28 days. The total instant win minor prize pool is valued at $10,000 (inc GST). The total major prize pool is valued at $10,140 (inc GST). The overall total prize pool is valued at $20,140 (inc GST). 3 1 Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions. 2 The competition will be conducted during the Competition Period. 3 Entries must be received during the Competition Period. SMS entries are deemed to be received at the time they are received by the Promoter s database and not at the time of submission by the entrant. Major prize draw entries must be on the original entry form. Each instant win entry must be based on a separate unique code. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple phone numbers or aliases may be disqualified. In the event of a dispute regarding a instant win minor prize awarded to an SMS entrant, the instant win minor prize will be awarded to the owner of the relevant mobile phone number. Automatically generated entries may be disqualified. 4 Entry is only open to consumers with an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. Consumers should check with their network service provider to see if their mobile phone is compatible. The SMS service provider is Prime Focus. Unique codes and entry forms are void if stolen, forged, mutilated or tampered with in any way. 6 The Promoter is not liable for late, lost, incomplete, misdirected, incorrectly submitted, delayed or illegible entries, correspondence or claims for prizes due to error, omission, tampering, theft, destruction or otherwise including failure of any participating Venue to forward entry forms to the major prize draw location. 7 The major prize draw will be conducted at the time, on the date and at the location as stated in the Major Prize Draw Details. 8 The minor prizes are as stated in the Instant Win Minor Prize Details. 9 The major prizes are as stated in the Major Prize Details. The Platinum Lounge Package includes a premium ticket, selected food and beverages, a match program and premium entertainment (all as determined by the Promoter and/or prize supplier/s). The major prize winner and their companions are responsible for making their own way to and from the MCG in Melbourne, Victoria on 29/03/15 to take the prize. All costs associated with the major prize that are not specified, including but not limited to any transport or transfer costs, meals, and other ancillary costs, are the responsibility of the major prize winner and his/her companions, as incurred. The major prize is subject to any additional terms and conditions specified by the prize supplier/s including any conditions of entry into the MCG (including but not limited to behaviour requirements and applicable dress codes). 10 The instant minor prize winners will be notified in accordance with the Instant Minor Prize Winner Notification section of these conditions. The major prize winner will be notified in accordance with the Major Prize Winner Notification and Publication section of these conditions. By entering this competition, each entrant requests that his or her full address not be published. 11 The winners (and the major prize winner s companions) must, at the Promoter s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their names and images in promotional material. 12 The Promoter may require the winners to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter s discretion.

4 13 If a winning entry is deemed not to comply with these conditions of entry, including if the major prize winner is unable to take the prize on 29/03/15, the entry will be discarded and a new winner of that prize will be determined in accordance with these conditions. 14 The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person (including without limitation a winner or any of the major prize winner s companions) who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate. The major prize winner is fully responsible for the acts and omissions of their companions and the Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, the major prize winner and any or all of their companions if any of their companions breaches these conditions, whether or not legally bound by them. 15 The Promoter may in its absolute discretion cancel the major prize or otherwise cease to provide any benefit of the major prize to the major prize winner (and their companions) if the major prize winner (or their companions), in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate. 16 The Promoter s decision is final and no correspondence will be entered into. 17 The prizes are not transferable or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in prize value. If a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the relevant gaming authorities if required. 18 Notwithstanding paragraph 17, if the 2015 ICC Cricket World Cup Final on 29/03/15 is abandoned, called off or postponed for any reason, the major prize winner and their companions forfeit the tickets to the event and no cash or alternative tickets will be substituted in lieu. The major prize winner (and their companions) acknowledge and agree that ICC Development (International) Limited (IDI) will not be liable if it changes the schedule of matches comprising the ICC Cricket World Cup 2015 which it may do so in its absolute discretion. Neither the Promoter nor IDI shall be responsible for any such eventuality and the major prize winner (and their companions) undertakes not to claim any compensation from the Promoter or IDI in this regard. 19 There will be a total of 5,000 entry forms printed. 20 Printing and other quality control errors outside the Promoter s control will not invalidate an otherwise valid instant win minor prize claim. Every instant win minor prize claim in excess of the advertised instant win minor prize pool will be honoured, unless such claim is rejected due to fraud or ineligibility under these conditions. 21 If, after making all reasonable attempts, the Promoter cannot contact the drawn major prize winner (or the drawn major prize winner does not contact the Promoter) by the Major Prize Claim Date and Time, the relevant major prize winner s entry will be deemed invalid and the Promoter will conduct a further draw in accordance with the Unclaimed Major Prize Draw Details as is necessary to distribute the major prize, subject to any requirements of the VIC gaming authority. Any major prize winner in such draw will be notified as stated in the Unclaimed Major Prize Draw Winner Notification and Publication. 22 The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death which is suffered or sustained

5 (whether or not arising from any person s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth). 23 Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to prizes or be liable for any damage that occurs to prizes whilst displayed on premise at a Venue. Prizes will be delivered in Australia only. 24 The Promoter may communicate or advertise this competition using Facebook. However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability. 25 As a condition of accepting or participating in any prize the major prize winner s companions accept these conditions. 26 If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the VIC gaming authority if required. 27 The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office s stated view that where the parties are at arm s length, goods and services exchanged are of equal GST inclusive market values. 28 The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Guidelines to Reduce Health Risks from Drinking Alcohol. A full version of these Guidelines is available at Entry and continued participation in this competition is subject to each Venue s liquor serving policy. Crown practises the responsible service of alcohol. 29 All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The information entrants companions provide will be used by the Promoter for the purpose of fulfilling the prize and otherwise administering this competition. The Promoter may collect entrants or their companions personal information (including through its contractors or agents) or disclose entrants or their companions personal information to its related companies, contractors and agents to assist in conducting this competition, storing data or communicating with entrants or their companions. Those disclosures may include disclosures to organisations in locations such as the USA, the UK, India and Germany. By entering this competition, entrants consent to the storage of their personal information on the Promoter s database and the Promoter may use this information to contact the entrant with special offers, news and information about its products, including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or messages from the Promoter that do not contain any functional unsubscribe facility. The Promoter is bound by the Privacy Principles in the Privacy Act 1988 (Cth). The Promoter s Privacy Policy, located at contains information about: (i) how entrants or their companions can seek access to the personal information the Promoter holds about them and seek the correction of such information; and
