1 WELCOME TO THE CLUB! Congratulations! From our family of coaches to your family of snows sports lovers, welcome to SNOWTRACKS Ski and Ride Club. The mountain lifestyle is a special one, and our coaches are excited to share their passion for skiing and snowboarding with our new Rippers all winter long! Please read the following information carefully so you don t miss out on any important information. PROGRAM SCHEDULE: All seasonal programs run every Saturday and Sunday Beginning December 16, 2017 through March 11, 2018 * During select holiday dates, programs will be offered on: December 26-29, 2017 January 15, 2018 February 19, 2018 *All program dates and times are subject to change DAILY SCHEDULE: 9:00am to 3:00PM A typical day of coaching includes: warm up, group and individual instruction, practice time, feedback, free ski/ride runs and a team wrap up. Approximately 11:30am to 12:30pm: Supervised lunch is provided for Little & Big Rippers programs only. A parent or legal guardian must pick up/drop off their child during lunch hour if they are registered in the Master Rippers program. In the event that a child is not picked up for lunch, a $25 fee will be charged to the card on file to provide lunch and supervision for the child during lunch hour. STARTING OFF STRONG We are not just going to give your kids some lessons. We are going to build a relationship with them that is all about trust, fun and achievement. We will kick off the season with a meet & greet/orientation on December 16 th at 9:00am in the Big Top. Please be sure to attend, as we want our coaches and supervisors to get to know you and your kids before we begin the season. MEETING LOCATIONS: SNOWTRACKS will meet for each coaching sessions outside Expedition Station, on snow by the colored flags. Keep in mind that coaches may choose to shuttle their team to Silver Creek for lessons some days, and may have lunch there as well. Be sure to communicate with your childs coach at check in to coordinate any special lunch plans. 1
2 COMMUNICATION: Snowshoe Mountain, Inc. While participation is not required for all sessions, our coaches will be geared up and prepared to teach every scheduled day. If you know your child will not be attendng on a specific day, please skischool@snowshoemountain.com so the coaches will be informed. Coaches will only allow a 10 minute grace period for late participants it is important sessions begin on time. If your child arrives late, they may be required to wait in Kids World until their team comes in for first break. If your childs team is skiing/riding at Silver Creek for the day and have already left, you will be expected to take your child to Silver Creek Kids World to meet with their team at first break. HELMETS: In our continued effort to make the Snowshoe experience safe for guests, helmets are required for participants of the Snowtracks Ski and Ride club. Helmets must be worn while in sessions. ATTIRE: Participants should dress in layers with the outer layer being waterproof. Your child should have waterproof/resistant mitten/gloves, goggles, and a neck up. LUNCH: Our lunch selection varies but always includes a kid-friendly main course and side. Main courses are usually pizza or chicken fingers. Side dishes typically include mixed vegetables or a fruit selection. Remember, lunch is only included in the Little Ripper & Big Ripper programs. A parent or legal guardian must pick up/drop off their child during lunch hour for Master Ripper participants. Little Ripper & Big Ripper ABILITY ASSESSMENT: Beginners: Children are new to snowsports. Cannot stop consistently at will and/or cannot turn. Advanced Beginners: Children can stop consistently and usually turn in both directions on learning terrain (snowboarders may be using one or both edges). Speed control may still be an issue, and narrow, crowded or even moderately steeper terrain proves challenging. Green Intermediate: Children can stop and turn comfortably on any green terrain. Speed is controlled through consistent turning (not just straight runs with hard stops to slow down). Snowboarders MUST be using both the heel edge and toe edge to turn. Blue Intermediate: Completely comfortable on green terrain, may already be on blues, or ready to advance to blue terrain. Big Ripper & Master Ripper ABILITY ASSESMENT: Intermediate: Comfortably turning and stopping on green and blue terrain. Advanced: Comfortable on most terrain the mountain has to offer. Ready to tackle terrain parks, steeps, bumps, etc. 2

EMERGENCY SITUATIONS PARENT/GUARDIAN MUST REMAIN within a reasonable distance from the SKI AREA PROPERTY and be reachable by telephone or in person while children are at Snowtracks Ski& Ride Club. While on the mountain, If you are skiing or riding on the mountain, pay attention to the chalkboards at the top of the lifts. In case of an emergency, illness, or problem, your name will be placed on these boards. Please return to the location stated on the chalkboards ASAP if your name appears on any boards. 8. TELL US ABOUT YOUR CHILD: In the space below, please describe your child s skiing/riding ability, goals, fears, extra-curricular activities and any other information that will help us with pre-assessment of groups. Our expert coaches will do a full assessment and group children accordingly but a little background on your child will help us get a head start. 4
5 RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS READ CAREFULLY BEFORE SIGNING WARNING, ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNITY AGREEMENT AND CONSENT FOR MEDICAL TREATMENT. Adult means the undersigned adult, being at least 18 years old, signing on behalf of himself/herself and, if applicable, as the parent or legal guardian, signing on behalf of the minor named below so that the minor will be permitted to engage in the activity. Minor means the minor participant named below. Undersigned means the Adult and Minor collectively. The person actually taking part in the activity is referred to herein as Participant. Undersigned understand and agree that skiing, snowboarding, Snowtracks Ski & Ride Club participation and, as applicable, use of rental equipment and/or any other uses of the area, facilities, activities, or equipment, (each hereinafter an Activity or collectively Activities ) of Snowshoe Mountain (the Resort )can be HAZARDOUS. Undersigned understand the following applies whenever Participant uses the Resort s facilities or services or rental equipment. The Undersigned understand and agree that Participant will not be permitted to take part in any Activity unless this Warning, Assumption of Risk, Release of Liability and Indemnity Agreement and Consent for Medical Treatment ( Agreement ) is fully executed. UNDERSIGNED UNDERSTAND AND AGREE THAT THIS AGREEMENT WILL APPLY FOR EVERY DAY PARTICIPANT ENGAGES IN ANY ACTIVITY DURING THE SKI SEASON WITHOUT REQUIRING UNDERSIGNED TO SIGN AN ADDITIONAL AGREEMENT FOR EACH DAY AND/OR EACH ACTIVITY UNTIL UNDERSIGNED REVOKE IT IN WRITING AND THAT WRITING IS ACCEPTED IN WRITING SIGNED BY THE RESORT S AUTHORIZED REPRESENTATIVE. Undersigned are advised, understand and agree that under West Virginia law any person present at a ski area under the control of a ski area operator for the purpose of engaging in the sport of skiing (which includes sliding downhill or jumping on snow or ice on skis, a toboggan, a sled, a tube, a snowbike, a snowboard or any other device utilizing any of the facilities of the ski area) in locations designated as the ski slopes and trails is considered a 'skier and is referred to as a skier and, further, that West Virginia law provides that a skier using the facilities of a ski area assumes certain risks of skiing as provided for in the West Virginia Skiing Responsibility Act (the "Act"). IN ADDITION, ADULT ACKNOWLEDGES, UNDERSTANDS AND AGREES THAT BY SIGNING THIS AGREEMENT, ADULT FOR HIM/HERSELF AND, IF APPLICABLE, ON BEHALF OF MINOR, IS VOLUNTARILY ASSUMING ALL DANGERS AND RISKS OF SKIING, INHERENT OR OTHERWISE, AND IS WAIVING RIGHTS, AND RELEASING CLAIMS IN CONNECTION WITH DANGERS AND RISKS ABOVE AND BEYOND THOSE ADDRESSED BY THE ACT. Undersigned understand and agree that participating in the Activity is HAZARDOUS AND INVOLVES THE RISK OF PHYSICAL INJURY OR DEATH. Undersigned understand and agree that the use of the ski area facilities involves risks including, but not limited to, high elevation, wildlife encounters, falling trees and limbs, marked and unmarked obstacles, deep snow conditions and tree wells, slick or uneven walking surfaces, surfaces covered with ice and snow, unstable ice and snow including but not limited to slides and avalanches, rugged mountainous terrain, acts of other skiers and equipment malfunction. Undersigned understand and agree that there are risks involved in decision-making and conduct of Resort s employees involved with an Activity, including, but not limited to, the risks involved with rescue operations and/or medical care conducted or provided by Resort personnel inside or outside of Resort boundaries, the risks association with decisions made by Resort personnel to open and/or close terrain, or some aspect of Participant s mental, emotional or physical condition that may make a certain portion of any Activity appropriate or inappropriate for the Participant. Undersigned are advised that snowmobiles, snowmaking and snow-grooming equipment, or other vehicles or equipment may be encountered at any time and that Participant must be alert for and avoid such equipment. Undersigned agree not to enter a CLOSED area and understand that entering or skiing in a CLOSED area is illegal and more dangerous to Participant and others than skiing in open areas of the ski area. The Undersigned also understand and agrees that falls and collisions occur and injuries are a common and ordinary occurrence of the Activity. RECOGNIZING AND ACCEPTING THE RISKS, ADULT VOLUNTARILY CHOOSES TO TAKE PART IN THE ACTIVITY OR VOLUNTARILY CHOOSES TO ALLOW MINOR TO TAKE PART IN THE ACTIVITIES. Participant accepts the responsibility of maintaining control at all times while skiing. Adult agrees to read, to have Minor read and, if necessary explain to Minor, all posted signs and warnings including instructions on the use of lifts and rental or other equipment. Participant agrees to obey all signs and warnings posted at the Resort. Undersigned understand that Participant must have the physical dexterity and knowledge to safely load, ride and unload the lifts without assistance. Undersigned assume the risks of Participant riding the lifts and engaging in Activities accessible from the lifts. ADULT UNDERSTANDS AND AGREES THAT MINOR WILL BE USING SKI LIFTS WITHOUT A SKI INSTRUCTOR OR OTHER ADULT PRESENT AND THAT MINOR MAY ENTER AND USE FREESTYLE TERRAIN INCLUDING NATURAL AND MAN-MADE FEATURES. PARTICIPATION IN THE CHILDREN S SNOWTRACKS SKI & RIDE CLUB DOES NOT AND CANNOT ELIMINATE THE DANGERS AND RISKS OF SKIING OR USING SKI LIFTS. Undersigned agree to inspect before use all equipment offered for use by Resorts including, but not limited to, rental skis or snowboard, boots, bindings, or any other equipment ( Equipment ) and ask questions of Resort s employees if Participant does not fully understand how to use the Equipment or Resorts facilities. Undersigned warrant that information provided to rental technicians and personnel will be accurate and complete. Adult understands that he/she may not be available or present when the Minor s Equipment is fitted and adjusted and hereby waives the opportunity to verify the helmet size and fit and binding settings and authorizes employees of the Resorts, other than the technician performing the fitting and adjusting, to verify the helmet size and fit and binding settings. Undersigned understand and agree that, although Participant may be wearing a helmet, a helmet cannot guarantee Participant s safety and no helmet can protect the wearer against all potential head injuries or prevent injury to the wearer s face, neck or spinal cord. Undersigned understand and agree that bindings may not release at all times or under all circumstances where release may prevent injury or death. It is not possible to predict every situation in which bindings will release. In snowboarding, the binding system will not ordinarily release during use. These bindings may not be designed to release as a result of forces generated during ordinary operation. Undersigned accept for use AS IS any Equipment Participant uses for an Activity and to return for replacement or repair any Equipment believed by Participant to be damaged or defective. Adult accepts full responsibility for the care of the Equipment used for an Activity and agrees that Adult will be responsible for the replacement at full retail value of any 5
6 Equipment damaged or not returned. Undersigned understand that additional fees may be required for use of the facilities, Equipment, ski instruction or other services provided by the Resorts and that age and height restrictions may apply to limit participation in some Activities and at some facilities By signing this Agreement, Adult on his/her own behalf and, if applicable, on behalf of Minor acknowledges the risks and dangers associated with the Activities and the use of the facilities of Resorts generally and, as a condition to Participant engaging in any Activities agrees to (1) ASSUME ANY AND ALL RISKS OF INJURY OR DEATH to Participant while or as a result of participating in any Activity; (2) WAIVE, RELEASE, and NOT SUE, MAKE ANY CLAIMS OR FILE ANY ACTIONS against Snowshoe Mountain, Inc, Intrawest Resorts Holdings, Inc., and each of their insurance carriers, subsidiaries, affiliates, officers, directors, shareholders, members, representatives, assignees, employees, volunteers and agents, as well as any Activity sponsors and Equipment manufacturers and distributors (hereinafter the Indemnified Parties collectively, the Indemnified Party individually) that are based on, arise or result from, in whole or in part, participation in any Activities; (3) INDEMNIFY, DEFEND AND HOLD THE INDEMNIFIED PARTIES HARMLESS, from any and all claims, demands, actions, causes of action, losses or liabilities whatsoever arising from or related to participation in any Activity and any loss, damage or injury, including death, that may be sustained by Participant or caused to others or their property by Participant. Undersigned agree to pay all costs, including reasonable attorneys fees and disbursements, incurred by any Indemnified Party in defending an investigation, claim or suit brought by or on behalf of Undersigned. Undersigned acknowledge and agree that as a condition of Participant s attendance and participation in Snowtracks Ski & Ride Club, Undersigned agree that Undersigned and Participant will abide by the policies of the Snowtracks Ski & Ride Club and instructions of Snowtracks Ski & Ride Club and Resort staff. Undersigned understand that the Resort has the right to refuse or remove any participant who fails to obey such policies or instructions Adult authorizes the Indemnified Parties and/or their authorized personnel to call for medical care, treatment and/or procedures (collectively Care ), for Participant or to transport Participant to a medical facility or hospital if, in the opinion of such personnel, medical attention is needed. Adult agrees that upon Participant s transport to a facility or hospital that the Resort and its personnel shall not have any further responsibility for Participant. Adult also consents to the Care given by an emergency caregiver or under the instructions and directions of a licensed physician. It is understood that reasonable efforts will be made to notify Adult at the earliest possible time in the event such Care is undertaken for a Minor. Adult knowingly and voluntarily consents in advance to such Care to encourage the physicians and the Resort to exercise its best judgment in undertaking such Care. Further, Adult agrees on behalf of Adult and Minor to pay all costs associated with such Care and related transportation provided for Participant and to indemnify and hold harmless the Indemnified Parties from any resulting costs. Undersigned give Resort permission to take and use photographs, video recordings, or movies of Participant taken during an Activity and use and sublicense such material for any purpose in promoting the Resort or related activities of the Resort in print, brochures, advertisements, films or videos and on broadcast presentations of any sort. Adult agrees for him/herself and Minor, if applicable, that ALL claims arising from or related to any Activity, including for injury to person or property and/or death shall be GOVERNED BY WEST VIRGINIA LAW, without regard to conflicts of law principles, and that EXCLUSIVE JURISDICTION shall be in the District Court of Pocahontas County, West Virginia, or in the United States District Court for the Northern District of West Virginia. UNDERSIGNED VOLUNTARILY AND IRREVOCABLY WAIVE ANY OBJECTION TO SUCH LAW AND JURISDICTION. This Agreement shall be binding to the fullest extent permitted by law. If any provision of this Agreement is found to be unenforceable, the remaining terms shall be enforceable. THE UNDERSIGNED PARENT OR LEGAL GUARDIAN REPRESENTS AND ACKNOWLEDGES THAT HE/SHE IS ENTITLED TO AND IS SIGNING THIS AGREEMENT ON BEHALF OF MINOR AND THAT MINOR WILL BE BOUND BY ALL THE TERMS OF THIS AGREEMENT. UNDERSIGNED UNDERSTAND AND AGREE THAT IF THIS AGREEMENT IS NOT SIGNED ON BEHALF OF MINOR, MINOR WILL NOT BE PERMITTED TO PARTICIPATE IN ANY ACTIVITY. This Agreement shall be binding upon Undersigned s assignees, subrogors, distributors, heirs, next of kin, executors and personal representatives.
