2 2015/16 PROGRAM INFO EARLY REGISTRATION: Early registration to help us plan for the season with a $100 deposit. Balance due on or before October 15 th or spread your payments out with the payment plan option for up to 7 payments starting in July. ALL PROGRAM FEES MUST BE PAID IN FULL BY JANUARY 31, 2016 OR ATHLETE TRAINING AND COMPETITION SUPPORT WILL BE SUSPENDED UNTIL ALL FEES ARE PAID IN FULL. NO SEASON PASS UPGRADES: o All athletes will receive a Winter Park/Mary Jane Resort season pass with their program fees. If you want other resorts you will need to purchase the Super Pass or Super Pass +. You would then take $100 off the program fees. (see fees worksheet) Programs must meet enrollment minimums in order to run (e.g. ATP Friday programs must meet enrollment minimums to run on Fridays). WHAT EVERY ATHLETE/FAMILY SHOULD KNOW: COMMUNICATION IS KEY! The Competition Center communicates pertinent information about our programs, competitions, training schedules and more via , website, and social media. o Constant contact e-newsletters: E-newsletters are the primary way the administrative staff, coaches, and directors communicate with athletes and their families throughout the season regarding schedule info/changes, weekend practice plans, competition information and more. o Like us on facebook General information & program specific information can be found at GENERAL HANDBOOK & TRAVEL HANDBOOKS: All families must review the Competition Center General Handbook which is available in the office or downloadable from the website. The back page must be signed by a parent or legal guardian and submitted to the office. This handbook is a great resource and will answer many questions you may have throughout the season. 3 COMPETITION CENTER WORK DEPOSIT/PARENT HOURS 2015/2016 What is a Work Deposit? The purpose of the work deposit program is to insure that workers are available and motivated to assist with Winter Park Competition Center fundraisers and athletic events. The Competition Center actively pursues many events to be held at Winter Park to give our skiers and riders the home-hill advantage and to ease travel costs related to competitions at other areas. We are one of the only resorts in Colorado to keep a professional competition event staff, but still need many helpers to make the events successful while keeping costs at a reasonable level. Work deposit hours or Parent Hours are time you work towards the refund of the work deposit fee that is paid in addition to the base cost of your child s program. The work deposit amount varies depending on which program your child is enrolled. The work deposit for a one-day Freestyle or Alpine program and all Snowboard and Freeski programs is $200 paid in addition to the base program fee (excluding Masters & All-Terrain Ski Programs). This means that you must work at least 20 hours to receive a full refund of your work deposit. If you work partial hours, you will be refunded at the rate of $10.00 per hour. The work deposit for a multi-day (2 or more) ski program (except multi-day Freeski & Snowboard programs) is $400 paid in addition the base program fee. This means that if your child is enrolled in a multi-day ski program, then you must work at least 40 hours to receive a full refund. If you work partial hours, you will be refunded at the rate of $10.00 per hour. Each family is only charged one work deposit. If there is more than one athlete enrolled in programs requiring a work deposit the greater of the work deposits will be charged. (Example: with one athlete in a 1-day program and one athlete in 2-day program, only the 2-day program deposit will be charged.) Work Deposit Refund Refunds of work deposits will take place twice during the season. We will refund to the credit card originally used or mail a check. For families that complete their total hours by February 1, 2016, payment will be processed by March 1, The remainder of refunds, full or partial, will be processed by May 1, Work hours for refund credit must be completed by April 15 th, Work hours earned during the summer of 2015 events will apply to 2015/2016 fees. Earning Work Deposit Hours Hours may be earned by working at qualifying events held here at Winter Park Resort. The minimum age requirement for working toward work deposit credit is 13. Positions are limited for volunteers under 18. The Volunteer Event Schedule will be available each fall, as soon as event dates are finalized. You may sign up for volunteer opportunities at You are responsible for making arrangements to work off your hours. An event coordinator may contact you based on the information you provided; however, do not rely on a phone call from a coordinator in order to fulfill your hours. Please call or stop by the office and speak with the office staff to get additional information. 8 RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS READ CAREFULLY BEFORE SIGNING WARNING, ASSUMPTION OF RISK, RELEASE OF LIABILITY AND INDEMNITY AGREEMENT WINTER PARK RESORT COMPETITION CENTER PROGRAM ( COMP CENTER ) PARTICIPANT Adult means the undersigned adult Comp Center participant, being at least 18 years old, signing on behalf of himself/herself and if applicable, the parent or legal guardian signing on behalf of the minor named below so that the minor will be permitted to engage in Comp Center activities. Minor means the minor participant named below. Undersigned means the Adult and Minor collectively. The person actually taking part in the Comp Center activities is referred to herein as Participant. Undersigned understand and agree that skiing, snowboarding, including skiing and snowboarding races, competitions, demonstrations, and performances, strength and endurance training and/or any other uses of the facilities, activities, or equipment of Steamboat and/or Winter Park Resort (collectively Resorts ), or such other venue as may be utilized by the Resorts, (collectively and each hereinafter an Activity ) can be HAZARDOUS. The Undersigned understand and agree that Participant will not be permitted to take part in the Activity unless this Warning, Assumption of Risk, Release of Liability and Indemnity Agreement ( Agreement ) is fully executed. UNDERSIGNED UNDERSTAND AND AGREE THAT THIS AGREEMENT WILL APPLY FOR EACH AND EVERY DAY PARTICIPANT ENGAGES IN ANY ACTIVITY DURING THE SKI SEASON, INCLUDING PRE AND POST SEASON, WITHOUT REQUIRING UNDERSIGNED TO SIGN AN ADDITIONAL AGREEMENT FOR EACH DAY AND/OR EACH ACTIVITY UNTIL UNDERSIGNED REVOKE IT IN WRITING AND THAT WRITING IS ACCEPTED IN WRITING SIGNED BY THE RESORTS AUTHORIZED REPRESENTATIVE. Undersigned are advised, understand and agree that under Colorado law any person using a ski area for the purpose of skiing, which includes, without limitation, sliding downhill or jumping on snow or ice on skis, a toboggan, a sled, a tube, a snowbike, a snowboard or any other device; or for the purpose of using any of the facilities of a ski area, including but not limited to ski slopes and trails is considered a skier and, further, that Colorado law provides that a skier using the facilities of a ski area assumes certain inherent dangers and risks of skiing as defined in the Colorado Ski Safety Act (the Act ). IN ADDITION, ADULT ACKNOWLEDGES, UNDERSTANDS AND AGREES THAT BY SIGNING THIS AGREEMENT, ADULT FOR HIM/HER SELF AND, IF APPLICABLE, ON BEHALF OF MINOR, IS VOLUNTARILY ASSUMING ALL DANGERS AND RISKS OF SKIING, INHERENT OR OTHERWISE, AND IS WAIVING RIGHTS, AND RELEASING CLAIMS IN CONNECTION WITH DANGERS AND RISKS ABOVE AND BEYOND THOSE ADDRESSED BY THE ACT. Adult agrees to read, to have Minor read and, if necessary explain to Minor all posted signs and warnings including instructions on use of lifts and rental or other equipment and Undersigned agrees that Participant will obey all signs and warnings posted at the Resorts and will obey instructions from Resorts staff. Participant accepts the responsibility of maintaining control at all times while skiing. Undersigned understand and agree that Participant must have the physical dexterity and knowledge to safely load, ride and unload the lifts without assistance. Undersigned assume the risks of Participant riding the lifts and engaging in activities accessible from the lifts. Adult understands and agrees that Minor will be using ski lifts without a ski instructor or coach, Resorts representative or other adult present. Undersigned are advised that snowmobiles, snowmaking, snow-grooming and other equipment or vehicles may be encountered at any time and that Participant must be alert for and avoid such equipment. Undersigned understand that entering or skiing in a CLOSED area is illegal and more dangerous to Participant and others than skiing in areas of the ski areas that are open to the public and/or Comp Center. Undersigned understand and agree that the use of ski area facilities and participation in any Activity involves risks including but not limited to the risks mentioned above, as well as high elevation, varying weather and snow conditions, marked and unmarked obstacles, slippery, slick or uneven surfaces, surfaces covered with ice and snow, falling trees and limbs, deep snow conditions and tree wells, unstable ice and snow including, but not limited to, slides and avalanches, rugged mountainous terrain, wildlife encounters, acts of other skiers, equipment malfunction, dehydration, overexertion, travel to and from venues where an Activity takes place, sharing facilities and venues with people directly involved and/or not directly involved in the Activity, and overnight stays in lodging facilities. Undersigned understand and agree that there are risks involved in decision-making and conduct of Resorts employees involved with an Activity, including, but not limited to, the risks involved with rescue operations and/or medical care conducted by Resort personnel inside or outside of Resorts boundaries, decisions made by Resort personnel to open and/or close terrain, and the risk that a coach/counselor may misjudge weather, snow conditions, route/terrain selection, or some aspect of Participant s abilities, conditioning, mental, emotional or physical condition that may make a certain portion of any Activity appropriate or inappropriate for the Participant. Adult acknowledges on Adult s and Minor s behalf that falls and collisions occur and INJURIES or DEATH may result from participation in any Activity. Undersigned agree to inspect all equipment before use and ask questions of Resorts employees if Participant does not fully understand how to use the equipment. Undersigned accept for use AS IS any equipment Participant uses for an Activity and to return immediately for replacement or repair any equipment believed by Participant to be damaged or defective. Adult accepts full responsibility for the care of the equipment used for an Activity including rental and/or demo ski and snowboarding equipment and agrees that Adult will be responsible for the replacement at full retail value of any equipment damaged or not returned. Undersigned understand and agree that, although Participant may be wearing a helmet, a helmet cannot guarantee Participant s safety and no helmet can protect the wearer against all potential head injuries or prevent injury to the wearer s face, neck or spinal cord. Undersigned understand and agree that bindings may not release at all times or under all circumstances where release may prevent injury or death. It is not possible to predict every situation in which bindings will release. In snowboarding, cross-country, telemark skiing, snowblading, and ski boarding, the binding system will not ordinarily release during use. These bindings may not be designed to release as a result of forces generated during ordinary operation. As a participant in the Activity, Participant will be involved in racing, competition, performance or special event programs. Undersigned recognize, understand and agree that participation in such programs is more hazardous and dangerous than recreational skiing. Undersigned further understand and agree that as a participant in a racing, competition, performance or special event program, Participant is a competitor at all times, whether warming up, practicing for competition or in competition. Participant will always be provided an opportunity to conduct a reasonable inspection of the training, competition, event or race course and make his/her own decision about whether to participate, given the conditions at the time. Undersigned understand, agree and represent that Participant will always engage in reasonable inspection and decisionmaking pertaining to participation. Undersigned freely assume all risk of all course or venue conditions including but not limited to, course or feature design, course or feature construction, course or feature layout, course or feature terrain, jumps, and obstacles and course or feature Page 8

9 maintenance. Participant will be entering into and using Freestyle and Extreme Terrain that contains, among other features, moguls, jumps, hits, ramps, banks, jibs, rails, fun boxes, half-pipes, quarterpipes, snowcross, freestyle bumps, cliffs and drops, and other constructed and natural features. UNDERSIGNED UNDERSTAND AND AGREE THAT USE OF FREESTYLE AND EXTREME TERRAIN IS MORE HAZARDOUS AND DANGEROUS THAN ORDINARY RECREATIONAL SKIING AND CAN INCREASE THE RISK OF SERIOUS INJURY OR DEATH. UNDERSIGNED UNDERSTAND AND AGREE THAT BECOMING INVERTED DURING AN AERIAL MANEUVER SUBSTANTIALLY INCREASES THE RISK OF SERIOUS INJURY OR DEATH. Undersigned understand and agree that coaching or other supervised participation in the Activity does not in any way eliminate the risks of skiing or risks involved in riding ski lifts or using Extreme or Freestyle Terrain. RECOGNIZING AND ACCEPTING THE ABOVE AND ALL OTHER RELATED RISKS, UNDERSIGNED FREELY ACCEPT AND FULLY ASSUME ALL RISKS, DANGERS AND HAZARDS ASSOCIATED WITH THE ACTIVITY, USING THE SKI AREA AND ALL FREESTYLE AND EXTREME TERRAIN INCLUDING TERRAIN PARKS, AND THE POSSIBILITY OF LOSS, PERSONAL INJURY OR DEATH RESULTING THERE FROM AND, ADULT VOLUNTARILY CHOOSES TO TAKE PART IN THE ACTIVITY OR VOLUNTARILY CHOOSES TO ALLOW MINOR TO TAKE PART IN THE ACTIVITY. By signing this Agreement Adult on his/her own behalf and, if applicable, on behalf of Minor acknowledges the risks and dangers associated with an Activity and the use of the facilities of Resorts generally and, as a condition to Participant engaging in any Activity agrees to (1) ASSUME ANY AND ALL RISKS OF INJURY OR DEATH to Participant as a result of participation in any Activity; (2) WAIVE, RELEASE, and NOT SUE, MAKE ANY CLAIMS OR FILE ANY ACTIONS against Steamboat Ski & Resort Corporation, Intrawest/Winter Park Operations Corporation, Winter Park Recreational Association, the City and County of Denver, Intrawest Resorts Holdings, Inc., the United States, Winter Park Village Company Master Association, Inc., and each of their insurance carriers, subsidiaries, affiliates, officers, directors, shareholders, members, representatives, assignees, employees, volunteers and agents, as well as any Activity sponsors and Equipment manufacturers and distributors (hereinafter the Indemnified Parties ) that are based on, arise or result from, in whole or in part, participation in any Activity; (3) INDEMNIFY, DEFEND AND HOLD THE INDEMNIFIED PARTIES HARMLESS, from any and all claims, demands, actions, causes of action, losses or liabilities whatsoever arising from or related to participation in any Activity and any loss, damage or injury, including death, that may be sustained by Participant or caused to others or their property by Participant. Undersigned agree to pay all costs, including reasonable attorneys fees and disbursements, incurred by any Indemnified Party in defending an investigation, claim or suit brought by or on behalf of Undersigned. Undersigned give Resorts permission to take and use photographs, video recordings, or movies of Participant taken during an Activity for any purpose, and use and sublicense such materials, in promoting the Resorts or related activities of the Resorts in print, brochures, advertisements, films or videos and on broadcast presentations of any sort. The Resorts shall have the right to confiscate tickets or passes or revoke the privileges conferred by a ticket/pass where in the sole judgment of its representative Participant: 1) acts in any manner that endangers or may endanger the safety of Participant or any other person; 2) violates the law; 3) provides ski lessons, guided tours or related services for compensation without express authorization; 4) engages in misconduct or creates a nuisance; 5) violates Your Responsibility Code ; 6) skis recklessly (high speed, jumping or tucking, out of control or straight down a run) when skiing Participant must avoid other skiers, trail groomers, maintenance vehicles or objects below them; 7) skiing on closed trails or in closed terrain; 8) is impaired from or uses alcohol or drugs; 9) uses abusive language (swearing or cursing); or 10) displays poor or unsafe etiquette including skiing at speeds higher than rest of traffic on a trail. Some of these acts may also be prosecuted as a criminal offense. A ticket/pass is NOT TRANSFERABLE and CANNOT BE RESOLD. A ticket/pass may be confiscated with no re-issue, if in the sole judgment of a representative of the Resorts, it is used in a fraudulent, reckless or dangerous manner. Re-issued passes may be subject to a replacement fee. Undersigned acknowledges their affirmative duty to immediately notify the Resorts if Participant s ticket/pass is lost or stolen. Adult warrants that the Participant has the skills, dexterity and endurance to safely participate in the Activity, AND WILL AT ALL TIMES PARTICIPATE WITHIN HIS/HER ABILITIES and there are no special problems with the care of Participant that have not been provided to the Comp Center on the Consent to Medical Treatment form. In consideration for accessing the facilities of the Resorts, ADULT agrees for him/herself and MINOR that ALL claims arising from or related to any Activity, including for injury to person or property and/or death shall be GOVERNED BY COLORADO LAW, without regard to conflicts of law principles, and that EXCLUSIVE JURISDICTION shall be in the District Court in Grand County, Colorado, or in Federal Court for the District of Colorado. UNDERSIGNED VOLUNTARILY AND IRREVOCABLY WAIVE ANY OBJECTION TO SUCH LAW AND JURISDICTION. This Agreement shall be binding to the fullest extent permitted by law. If any provision of this Agreement is found to be unenforceable, the remaining terms shall be enforceable. WARNING, ASSUMPTION OF RISK, RELEASE OF LIABILITY AND INDEMNITY AGREEMENT AND CONSENT FOR MEDICAL TREATMENT EVENT PARTICIPANT Adult means the undersigned adult participant taking part in an event ( Event ), being at least 18 years old, signing on behalf of himself/herself and, if applicable, as the parent or legal guardian, signing on behalf of the minor named below so that the minor will be permitted to participate in the Event. Minor means the minor participant named below. Undersigned means the Adult and Minor collectively. The person actually taking part in the special event activities is referred to herein as Participant. Undersigned understand and agree that skiing, snowboarding, including skiing and snowboarding competitions, events, demonstrations and performances, strength and endurance training and/or any other uses of the facilities, activities, or equipment (each hereinafter an Activity or collectively Activities ) of Steamboat and/or Winter Park Resort (collectively Resorts ), or such other venue as may be utilized by the Resorts can be HAZARDOUS. The Undersigned understand and agree that Participant will not be permitted to take part in any Activity unless this Warning, Assumption of Risk, Release of Liability and Indemnity Agreement and Consent for Medical Treatment ( Agreement ) is fully executed. UNDERSIGNED UNDERSTAND AND AGREE THAT THIS AGREEMENT WILL APPLY FOR EACH AND EVERY DAY PARTICIPANT ENGAGES IN AN ACTIVITY DURING THE SKI SEASON, INCLUDING PRE AND POST SEASON, WITHOUT REQUIRING UNDERSIGNED TO SIGN AN ADDITIONAL FORM FOR EACH DAY AND/OR EACH ACTIVITY UNTIL UNDERSIGNED REVOKE IT IN WRITING AND THAT WRITING IS ACCEPTED IN A WRITING SIGNED BY THE RESORTS AUTHORIZED REPRESENTATIVE. Undersigned are advised, understand and agree that under Colorado law any person using a ski area for the purpose of skiing, which includes, without limitation, sliding downhill or jumping on snow or ice on skis, a toboggan, a sled, a tube, a snowbike, a snowboard or any other device; or for the purpose of using any of the facilities of a ski area, including but not limited to ski slopes and trails is considered a skier and, further, that Colorado law provides that a skier using the facilities of a ski area assumes certain inherent dangers and risks of skiing as defined in the Colorado Ski Safety Act (the Act ). IN ADDITION, ADULT ACKNOWLEDGES, UNDERSTANDS AND AGREES THAT BY SIGNING THIS AGREEMENT, ADULT FOR HIM/HER SELF AND, IF APPLICABLE, ON BEHALF OF MINOR, IS VOLUNTARILY ASSUMING ALL DANGERS AND RISKS OF SKIING, INHERENT OR OTHERWISE, AND IS WAIVING RIGHTS, AND RELEASING CLAIMS IN CONNECTION WITH DANGERS AND RISKS ABOVE AND BEYOND THOSE ADDRESSED BY THE ACT. Participant assumes the responsibility of maintaining control at all times while skiing. Adult agrees to read, to have Minor read and, if necessary explain to Minor all posted signs and warnings including instructions on use of lifts and equipment and Undersigned agree that Participant will obey those signs and warnings located on the property or at any facility or premise of the Resorts and to obey instructions from Resorts staff. Adult understands and agrees that Minor will be using ski lifts without a ski instructor, Resorts representative or other adult present. Undersigned understand and agree that Participant must have the physical dexterity and knowledge to safely load, ride and unload the lifts. Undersigned assume the risks of riding the lifts and engaging in any Activity accessible from the lifts. Undersigned are advised that snowmobiles, snowmaking, snow-grooming and other equipment or vehicles may be encountered at any time and that Participant should be alert for and avoid such equipment. Undersigned understand and agree that the use of ski area facilities involves risks including, but not limited to, all of the risks mentioned above, as well as high elevation, marked and unmarked obstacles, wildlife encounters, falling trees and limbs, slick or uneven surfaces, surfaces covered with ice and snow, deep snow conditions and tree wells, unstable ice and snow including but not limited to snow slides and avalanches, rugged mountainous terrain, dehydration, overexertion, acts of other skiers and equipment malfunction. Undersigned also understand and agree that there are risks involved in decision-making and conduct of Resorts employees involved with an Activity, including, but not limited to, the risks involved with rescue operations and/or medical care conducted or provided by Resorts personnel inside or outside of Resorts boundaries and the risks associated with decisions made by Resort personnel to open and/or close terrain. Undersigned understand and agree that entering or skiing in a CLOSED area is illegal and more dangerous to Participant and others than skiing in open areas of the ski area. Undersigned agree to inspect all equipment before use and ask questions of Resorts employees if Participant does not fully understand how to use the equipment. Undersigned accept for use AS IS any equipment Participant uses for an Activity and to return immediately for replacement or repair any equipment believed by Participant to be damaged or defective. Adult accepts full responsibility for the care of the equipment used for an Activity including rental and/or demo ski and snowboarding equipment and agrees that Adult will be responsible for the replacement at full retail value of any equipment damaged or not returned. Undersigned understand and agree that, although Participant may be wearing a helmet, a helmet cannot guarantee Participant s safety and no helmet can protect the wearer against all potential head injuries or prevent injury to the wearer s face, neck or spinal cord. Undersigned understand and agree that bindings may not release at all times or under all circumstances where release may prevent injury or death. It is not possible to predict every situation in which bindings will release. In snowboarding, crosscountry, telemark skiing, snowblading, and ski boarding, the binding system will not ordinarily release during use. These bindings may not be designed to release as a result of forces generated during ordinary operation. Adult acknowledges on Adult s and Minor s behalf that falls and collisions occur and INJURIES or DEATH may result from participation in an Activity. As a participant in the Activity, Participant will be involved in racing, competition, performance, demonstration or special event programs. Undersigned recognize, understand and agree that participation in such programs is more hazardous and dangerous than recreational skiing. The Undersigned further understand and agree that as a participant in a racing, competition, performance, demonstration or special event program, Participant is a competitor at all times, whether warming up, practicing for competition or in competition. Participant will always be provided an opportunity to conduct a reasonable inspection of the training, competition, event or race course and make his/her own decision about whether to participate, given the conditions at the time and taking into account Participant s skill level and experience in courses or venues of similar difficulty. Undersigned understand, agree and represent that Participant will always engage in reasonable inspection and decision-making pertaining to participation. Undersigned freely assume all risk of all course conditions including but not limited to, course design, course construction, course layout, course terrain, course jumps, features and Page 10

11 obstacles and course maintenance. Participant may be involved in travel to and from an Activity or events over snow or ice covered roads in inclement weather and Undersigned accept such risks. Participant may also be entering into and using extreme or freestyle terrain that contains, but may not be limited to cliffs or drops, moguls, jumps, hits, ramps, banks, jibs, rails, fun boxes, half-pipes, quarterpipes, snowcross, freestyle bumps and other constructed and natural features. Participation in the Activity shall not in any way eliminate the risks of skiing or risks involved in riding ski lifts. RECOGNIZING AND ACCEPTING THE ABOVE RISKS AND RESPONSIBILITIES, ADULT VOLUNTARILY CHOOSES TO TAKE PART IN THE ACTIVITY OR VOLUNTARILY CHOOSES TO ALLOW MINOR TO TAKE PART IN THE ACTIVITY. By signing this Agreement Adult on his/her own behalf and, if applicable, on behalf of Minor acknowledges the risks and dangers associated with the Activity and the use of the facilities of Resorts generally and, as a condition to Participant engaging in any Activity agrees to (1) ASSUME ANY AND ALL RISKS OF INJURY OR DEATH to Participant resulting from the participation in any Activity; (2) WAIVE, RELEASE, and NOT SUE, MAKE ANY CLAIMS OR FILE ANY ACTIONS against Steamboat Ski & Resort Corporation, Intrawest/Winter Park Operations Corporation, Winter Park Recreational Association, the City and County of Denver, Intrawest Resorts Holdings, Inc., the United States, Winter Park Village Company Master Association, Inc., and each of their insurance carriers, subsidiaries, affiliates, officers, directors, shareholders, members, representatives, assignees, employees, volunteers and agents, as well as any Activity sponsors and Equipment manufacturers and distributors (hereinafter the Indemnified Parties ) that are based on, arise or result from, in whole or in part, participation in any Activity; (3) INDEMNIFY, DEFEND AND HOLD THE INDEMNIFIED PARTIES HARMLESS, from any and all claims, demands, actions, causes of action, losses or liabilities whatsoever arising from or related to participation in any Activity and any loss, damage or injury, including death, that may be sustained by Participant or caused to others or their property by Participant. Undersigned agree to pay all costs, including reasonable attorneys fees and disbursements, incurred by any Indemnified Party in defending an investigation, claim or suit brought by or on behalf of Undersigned. Undersigned gives Resorts permission to take and use photographs, video recordings, or movies of Participant taken during an Activity and use and sublicense such material for any purpose in promoting the Resorts or related activities of the Resorts in print, brochures, advertisements, films or videos and on broadcast presentations of any sort. Adult agrees that upon Participant s transport to a facility or hospital that the Resorts and their personnel shall not have any further responsibility for Participant. Adult also consents to the Care given by an emergency caregiver or under the instructions and directions of a licensed physician. It is understood that reasonable efforts will be made to notify Adult at the earliest possible time in the event such Care is undertaken for a Minor. Adult knowingly and voluntarily consents in advance to such Care to encourage the physicians and the Resorts to exercise their best judgment in undertaking such Care. Further, Adult agrees on behalf of Adult and Minor to pay all costs associated with such Care and related transportation provided for Participant and to indemnify and hold harmless the Indemnified Parties from any resulting costs. In consideration for accessing the facilities of one or more Resorts, Adult agrees for him/herself and Minor that ALL claims arising from or related to any Activity, including for injury to person or property and/or death shall be GOVERNED BY COLORADO LAW, without regard to conflicts of law principles, and that EXCLUSIVE JURISDICTION shall be in the District Court residing where the alleged incident occurred or in Federal Court for the District of Colorado. ADULT UNDERSTANDS AND AGREES THAT MINOR WILL BE USING SKI LIFTS WITHOUT A SKI INSTRUCTOR OR OTHER ADULT PRESENT AND THAT MINOR MAY ENTER AND USE FREESTYLE TERRAIN INCLUDING NATURAL AND MAN-MADE FEATURES. PARTICIPATION IN THE CHILDREN S OR ADULT S SKI/RIDE SCHOOL DOES NOT AND CANNOT ELIMINATE THE DANGERS AND RISKS OF SKIING OR USING SKI LIFTS. Undersigned agree not to enter a CLOSED area and understand that entering or skiing in a CLOSED area is illegal and more dangerous to Participant and others than skiing in open areas of the ski area. Adult understands and agrees that he/she may not be available or present when the Minor s Equipment is fitted and adjusted and hereby waives the opportunity to verify the helmet size and fit and binding settings and authorizes employees of the Resorts, other than the technician performing the fitting and adjustment, to verify the helmet size and fit and binding settings. Undersigned understand and agree that, although Participant may be wearing a helmet, a helmet cannot guarantee Participant s safety and no helmet can protect the wearer against all potential head injuries or prevent injury to the wearer s face, neck or spinal cord. Undersigned understand and agree that additional fees may be required for use of the facilities, Equipment, ski instruction or other services provided by the Resorts and that age and height restrictions may apply to limit participation in some Activities and at some facilities. Undersigned understand and agree that the Resorts may offer for use an electronic system (the System ) that aids in tracking the location of Participant on the mountain.
