1 CIMB Bank Berhad s Terms and Conditions for Birthday Privilege Campaign ( the Campaign ) 1. The Campaign Period The Campaign is organized by CIMB Bank Berhad ( CIMB ) jointly with Sun Life Malaysia Assurance Berhad ( Sun Life Malaysia ) and runs from 1 September 2014 until 31 December 2014, both dates are inclusive ( Campaign Period ). CIMB reserves the right to change with reasonable notice the duration, commencement date and or expiry dates of the Campaign Period. 2. Eligibility a) The Campaign is opened to y selected CIMB s individual Debit Card customers aged 18 to 60 years old during the Campaign who are Malaysian citizens or permanent residents of Malaysia who receive a birthday greeting from CIMB via edm to their address or short messaging service (SMS) to their hand phone number in the Bank s records and who thereafter receive a confirmation call from CIMB during their birthday month. ( Eligible Customer ) subject to the terms and conditions contained herein. b) Permanent and/or contract employees of CIMB Bank Berhad, CIMB Islamic Bank Berhad, CIMB Investment Bank Berhad shall not be eligible to participate in this Campaign. 3. The Campaign consists of: a) Birthday Gift of 500 Bonus Points; and b) Birthday Privilege - Secret Recipe Slice Cake & Iced/Hot Beverage Voucher worth RM20 (collectively, the Gifts ) 3a) Birthday Gift of 500 Bonus Points i. During the Campaign Period, Eligible Customers who are contacted and who answers a confirmation call from CIMB will be entitled to receive a Birthday Gift of 500 Bonus Points to be credited into their CIMB Bank Debit Card account ( CIMB Debit Card ) within 60 days after their birthday month. i CIMB has the sole discretion to fix the appointed date and time to make the telephone calls to the Eligibe Customers. CIMB shall not be held responsible for calls made to Eligible Customers which are (i) not completed or disconnected due to any reasons whatsoever (ii) not answered or proceeded with due to the unavailability of the Eligible Customer at the appointed date and time and /or due to any other whatsoever reasons. The telephone call(s) made to the Eligible Customers will be based on the telephone number(s) supplied by the Eligible Customers and maintained in CIMB s records. It shall be the Eligible Customer s responsibility to ensure that their phone numbers provided are current and updated with CIMB in the event of any changes being made to the same by the Eligible Customer. CIMB reserves the right to record these telephone conversations. For the avoidance of any doubt, CIMB is not liable for any telco charges, roaming or phone charges which is to be borne by the Eligible Customer, whether in or outside Malaysia. 3b) Birthday Privilege - Secret Recipe Slice Cake & Iced/Hot Beverage Voucher worth RM20 i. During the Campaign Period, Eligible Customers who are betwen 18 to 60 years old at the point of purchase of selected Bancassurance products determined by CIMB from time to time within their birthday month via CIMB telemarketing channel, will be entitled to receive a Secret Recipe Slice Cake & Iced/Hot Beverage Voucher worth RM20. The list of is selected Bancassurance products available upon request and is subject to change from time to time by the Bank at its absolute discretion. The Secret Recipe Slice Cake & Iced/Hot Beverage Voucher worth RM20 will be delivered to the correspondence address of the Eligible Customer via courier service or in any other manner as Sun Life Malaysia deems fit within 90 working days after the birthday month of the Eligible Customer and after collection of the first premium amount, whichever shall be later. 4. Other Conditions i. By participating in the Campaign, the Eligible Customer is deemed to have read, understood and agreed to be bound by the terms and conditions stated herein. The 500 Bonus Points and Secret Recipe Slice Cake & Iced/Hot Beverage Voucher worth RM20 are not transferable or redeemable or exchangeable for cash or credit of any kind.

The Eligible Customer hereby authorises Sun Life Malaysia to disclose information relating to the address and contact details of the Eligible Customer to such other parties as Sun Life Malaysia may engage for the delivery of the Secret Recipe Slice Cake & Iced/Hot Beverage Voucher worth RM20 ( Gift ) to the Eligible Customer. The delivery of the Gift shall be at the risk of the Eligible Customer and should Sun Life Malaysia require the Eligible Customer to collect the Gift at such time and place to be notified by Sun Life Malaysia, the same shall be collected at the sole cost, expense and risk of the Eligible Customer. To the fullest extent permitted by law, CIMB expressly excludes and disclaims any representations, warranties, or endorsements express or implied, written or oral, including but not limited to any warranty of quality, merchantability or fitness for a particular purpose in respect of the Gift. v. Any enquiries and complaints directly and solely in relation to the Gift must be referred to the Merchants or the respective merchandise distributor's customer service centre or on the label of the merchandise(s) or its customer service representatives. CIMB shall not be bound to deal with any enquiries and complaints in respect of the Gift and CIMB shall bear no responsibility for resolving such disputes or for the dispute itself. vi. v vi ix. Any and all decision made by CIMB and Sun Life Malaysia in relation to every aspect of the Campaign, shall be final and conclusive. CIMB shall not be held liable in any manner whatsoever for any loss or damages howsoever arising in connection with the Campaign. Furthermore, CIMB shall not be liable for any default in respect of the Campaign due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, drought, storm or any event beyond the reasonable control of CIMB. CIMB reserves the right to cancel, terminate or suspend the Campaign upon giving adequate notice. For the avoidance of doubt, cancellation, termination or suspension of the Campaign shall not entitle any of the Eligible Customer to any claim or compensation against the CIMB for any losses or damages suffered or incurred by the Eligible Customer as a direct or indirect result of the act of cancellation, termination or suspension CIMB reserves the rights upon giving adequate notice to vary (whether by addition, deletion, modification, amendment or otherwise howsoever) ( the Amendment ) any of the terms and conditions herein. Notification to the Eligible Customer in respect of the Amendment shall be effected at CIMB s absolute discretion through any one of the following means of communication, namely, by ordinary mail to the Eligible Customer s last known address or by posting a notice regarding the Amendment at each of CIMB s branches or by effecting an advertisement regarding the Amendment in one newspaper of CIMB s choice, or via CIMB s website or via SMS or edm or by any other means of notification which CIMB may select and the Amendment shall be deemed as binding on the Eligible Customer as from the date of notification of the Amendment or from such other date as may be specified by CIMB in the notification. x. CIMB is merely a distributor of Bancassurance products underwritten by Sun Life Malaysia and will not be responsible for or be held liable in any way in respect of any matter or claims arising under the Bancassurance products provided by Sun Life Malaysia.These terms shall prevail over any provisions or representations contained in any other promotional materials relating to the Campaign. Sun Life Malaysia being the licensed insurer and underwriter of the Bancassurance products shall undertake the full insurance obligations. The Bancassurance products is not a Bank product and therefore not an obligation of / nor guaranteed by the Bank. xi. 3 Terma-terma dan Syarat-syarat bagi Kempen Tawaran Istimewa Harijadi ( Kempen ) CIMB Bank Berhad 1. Tempoh Kempen Kempen ini dianjurkan oleh CIMB Bank Berhad ( CIMB ) bersama-sama dengan Sun Life Malaysia Assurance Berhad ( Sun Life Malaysia ) dari 1 September 2014 hingga 31 Disember 2014, termasuk kedua-dua tarikh tersebut ( Tempoh Kempen ). CIMB merizab hak untuk mengubah tempoh, tarikh permulaan dan/atau tarikh akhir Tempoh Kempen dengan memberikan notis yang cukup. 2. Kelayakan a) Kempen terbuka kepada pelanggan Kad Debit individu terpilih CIMB Bank Berhad, berumur dari 18 hingga 60 tahun semasa tempoh Kempen yang merupakan warganegara Malaysia atau pemastautin tetap Malaysia yang menerima ucapan hari jadi daripada CIMB melalui edm ke alamat e-mel mereka atau perkhidmatan pesanan ringkas (SMS) ke nombor telefon bimbit mereka dalam rekod Bank dan yang kemudiannya menerima panggilan pengesahan daripada CIMB pada bulan hari lahir mereka ( Pelanggan Layak ) dan tertakluk kepada terma dan syarat yang terkandung di dalam ini. b) Kakitangan tetap dan / atau kontrak CIMB Bank Berhad, CIMB Islamic Bank Berhad, CIMB Investment Bank Berhad tidak layak menyertai Kempen ini. 3. Kempen ini menawarkan:- a) Hadiah Hari Jadi sebanyak 500 Mata Bonus; dan b) Tawaran istimewa Harijadi - Baucar Kek & Minuman Sejuk/Panas Secret Recipe bernilai RM20 (secara kolektifnya, Hadiah ) 3a) Hadiah Hari Jadi bernilai 500 Mata Bonus i. Semasa Tempoh Kempen, Pelanggan Layak yang dihubungi dan yang menjawab panggilan pengesahan daripada CIMB layak menerima Hadiah Hari Jadi sebanyak 500 Mata Bonus yang akan dikreditkan ke dalam akaun Kad Debit CIMB Bank ("Kad Debit CIMB") mereka dalam tempoh 60 hari selepas bulan hari jadi mereka. i CIMB mempunyai budi bicara tunggal untuk menetapkan tarikh dan masa untuk membuat panggilan telefon kepada Pelanggan Layak. CIMB tidak akan bertanggungjawab atas panggilan yang dibuat kepada Pelanggan Layak yang (i) tidak selesai dibuat atau terputus tidak kira apa jua sebabnya (ii) tidak dijawab atau diteruskan kerana ketiadaan Pelanggan Layak pada tarikh dan masa yang ditetapkan dan / atau atas apa-apa jua sebab lain. Panggilan telefon yang dibuat kepada Pelanggan Layak adalah berdasarkan nombor telefon yang dibekalkan oleh Pelanggan Layak dan disimpan dalam rekod CIMB. Pelanggan Layak bertanggungjawab memastikan bahawa nombor telefon yang diberikan adalah terkini dan dikemaskini dengan CIMB sekiranya berlaku apa-apa perubahan yang dibuat oleh Pelanggan Layak. CIMB berhak untuk merakam perbualan telefon ini. Untuk mengelakkan sebarang keraguan, CIMB tidak bertanggungjawab atas apa-apa caj syarikat telekomunikasi, perayauan atau caj telefon yang hendaklah ditanggung oleh Pelanggan Layak, sama ada di dalam atau di luar Malaysia. 3b) Tawaran Istimewa Hari Jadi Baucar Kek & Minuman Sejuk/Panas Secret Recipe bernilai RM20 i. Semasa Tempoh Kempen, Pelanggan Layak yang berumur antara 18 hingga 60 tahun pada masa pembelian produk Bancassurance terpilih yang ditentukan oleh CIMB dari semasa ke semasa dalam tempoh bulan hari jadi mereka melalui saluran telepemasaran CIMB, Baucar Kek & Minuman Sejuk/Panas Secret Recipe yang bernilai RM20. Senarai produk Bancassurance terpilih boleh didapati apabila diminta dan tertakluk kepada perubahan dari semasa ke semasa oleh Bank mengikut budi bicara mutlaknya. Baucar Kek & Minuman Sejuk/Panas Secret Recipe yang bernilai RM20 tersebut akan dihantar ke alamat surat-menyurat Pelanggan Layak melalui perkhidmatan kurier atau sebarang cara lain yang dianggap wajar oleh Sun Life Malaysia dalam masa 90 hari selepas bulan hari jadi Pelanggan Layak, dan selepas pungutan jumlah premium pertama, yang mana kemudian.
4 4. Syarat -syarat Lain i. Dengan menyertai Kempen ini, Pelanggan Layak dianggap telah membaca, memahami dan bersetuju untuk terikat oleh terma-terma dan syarat-syarat yang dinyatakan di sini. i iv. 500 Mata Bonus dan Baucar Kek & Minuman Sejuk/Panas Secret Recipe yang bernilai RM20 ( Hadiah ) tidak boleh dipindahkan atau ditebus atau ditukar dengan wang tunai atau kredit dalam apa jua bentuk. Pelanggan Layak dengan ini memberi kuasa kepada Sun Life Malaysia untuk mendedahkan maklumat berkaitan dengan alamat dan butir-butir hubungan Pelanggan Layak kepada mana-mana pihak lain yang diambil oleh Sun Life Malaysia untuk penghantaran Hadiah kepada Pelanggan Layak. Penghantaran Hadiah adalah atas risiko Pelanggan Layak dan sekiranya Sun Life Malaysia memerlukan Pelanggan Layak memungut hadiah pada masa dan di tempat yang akan dimaklumkan oleh Sun Life Malaysia, Hadiah hendaklah dipungut atas kos, perbelanjaan dan risiko Pelanggan Layak semata-mata. Setakat yang dibenarkan oleh undang-undang, CIMB dengan nyata mengecualikan dan menafikan sebarang representasi, jaminan atau pengindorsan, nyata atau tersirat, bertulis atau lisan, termasuk tetapi tidak terhad kepada sebarang jaminan mutu, kebolehdagangan atau kesesuaian Hadiah bagi sebarang tujuan khusus. v. Sebarang pertanyaan dan aduan yang secara langsung dan semata-mata berhubung dengan Hadiah mestilah dirujuk kepada Peniaga atau pusat perkhidmatan pelanggan pengedar barangan berkenaan atau pada label barangan atau wakil-wakil perkhidmatan pelanggannya. CIMB tidak terikat untuk menangani apa-apa pertanyaan dan aduan berkenaan dengan Hadiah dan CIMB tidak akan menanggung sebarang tanggungjawab untuk menyelesaikan pertikaian sedemikian atau atas pertikaian itu sendiri. vi. v vi ix. Sebarang dan semua keputusan yang dibuat oleh CIMB dan Sun Life Malaysia berhubung dengan setiap aspek Kempen ini adalah muktamad dan konklusif. CIMB tidak akan, dalam sebarang keadaan pun jua, bertanggungjawab atas sebarang kehilangan atau kerosakan yang timbul berhubung Kempen. Seterusnya, CIMB tidak akan bertanggungjawab atas apaapa keingkaran berkenaan dengan Kempen disebabkan oleh bencana alam, peperangan, rusuhan, mogok, sekat masuk, pertikaian perusahaan, kebakaran, banjir, kemarau, ribut atau apa jua perkara di luar kawalan munasabah CIMB. CIMB merizab hak untuk membatalkan, menamatkan atau menggantung Kempen ini dengan memberikan notis yang mencukupi. Untuk mengelakan sebarang keraguan, pembatalan, penamatan atau penggantungan Kempen oleh Bank tidak akan memberikan hak kepada Pelanggan Layak untuk membuat sebarang tuntutan atau mendapat sebarang pampasan terhadap CIMB atas sebarang kerugian atau kerosakan yang dialami atau ditanggung oleh Pelanggan Layak yang diakibatkan langsung atau tidak langsung oleh tindakan pembatalan, penamatan atau penggantungan. CIMB merizab hak dengan memberikan notis cukup untuk mengubah (sama ada dengan menambah, memotong, memodifikasi, meminda, atau sebaliknya walau bagaimanapun jua) ("Pindaan") manamana terma dan syarat yang terkandung di sini. Makluman kepada Pelanggan Layak mengenai Pindaan hendaklah dilaksanakan menurut budi bicara mutlak CIMB melalui mana-mana satu daripada cara komunikasi berikut, iaitu, melalui pos biasa ke alamat terakhir Pelanggan Layak yang diketahui atau dengan menampal notis berhubung dengan Pindaan di setiap cawangan CIMB I atau dengan menyiarkan iklan berhubung dengan Pindaan dalam satu akhbar pilihan CIMB, atau di laman web CIMB atau melalui SMS atau edm atau dengan apa-apa cara makluman lain yang dipilih oleh CIMB dan Pindaan akan dianggap mengikat Pelanggan Layak dari tarikh makluman Pindaan atau dari tarikh sebarang lain yang boleh dinyatakan oleh CIMB dalam makluman. x. CIMB hanyalah pengedar produk Bancassurance yang ditaja jamin oleh Sun Life Malaysia dan tidak akan bertanggungjawab atau dipertanggungjawabkan dalam apa cara jua terhadap apa-apa perkara atau tuntutan yang timbul di bawah produk Bancassurance yang disediakan oleh Sun Life Malaysia. Terma-terma ini akan mengatasi apa-apa peruntukan atau representasi yang terkandung dalam sebarang bahan promosi lain yang berkaitan dengan Kempen. Sun Life Malaysia sebagai penanggung insurans berlesen dan penaja jamin produk Bancassurance akan melaksanakan obligasi insurans penuh. Produk Bancassurance bukan produk Bank dan oleh itu bukan kewajipan / tidak dijamin oleh Bank.
