1 PROGRAMME FOR MAXIS EMPLOYEES GENERAL TERMS AND CONDITIONS The terms and conditions herein ( Terms and Conditions ) are in addition to and are to be read together with the AmBank (M) Berhad (8515-D) ( AmBank) and AmBank Islamic Berhad ( U) ( AmBank Islamic ) relevant TRUE by AmBank Debit MasterCard Terms and Conditions which govern the use of the TRUE debit card issued by AmBank and AmBank Islamic respectively ( Debit Card ). In the event of any discrepancy or inconsistency between these Terms and Conditions and the TRUE Debit Card Agreement, these Terms and Conditions shall prevail in so far as it relates to AmBank@Work Programme for Maxis employees. Definitions a) AmBank means AmBank (M) Berhad (Company No D), a company incorporated in Malaysia under the Companies Act 1965 (repealed by Companies Act 2016) and having its registered address at Level 22, Bangunan AmBank Group, No. 55 Jalan Raja Chulan, Kuala Lumpur. b) AmBank Islamic means AmBank Islamic Berhad (Company No U), a company incorporated in Malaysia under the Companies Act 1965 (repealed by Companies Act 2016) and having its registered address at Level 22, Bangunan AmBank Group, No. 55 Jalan Raja Chulan, Kuala Lumpur. c) Bank means AmBank and/or AmBank Islamic, as the context requires. d) Maxis means Maxis Communications Berhad (Company No V) a company incorporated under the laws of Malaysia, with its registered office at Level 18, Menara Maxis, Kuala Lumpur City Centre, Off Jalan Ampang, Kuala Lumpur. e) Maxis Employees means employees of Maxis Communications Berhad or Maxis Broad Band Berhad or employees of any other related company that Maxis would include in their payroll. f) AmBank@Work Terms and Conditions means the terms and conditions set out below and any other terms and conditions as AmBank may in its discretion stipulate. g) AmBank@Work Customer means an individual who has fulfilled the AmBank@Work eligibility requirements set by AmBank and who has been accepted by AmBank as an AmBank@Work Customer. h) AmBank@Work Programme for Maxis means features, benefits and rewards on products and services offered by AmBank herein or which may be offered by AmBank from time to time exclusively to AmBank@Work Customers who are Maxis Employees. i) Payroll Account means a savings or current account of AmBank@Work Customers maintained with AmBank/ AmBank Islamic for the purposes of salary crediting. j) Business Day means a day (other than a Saturday, Sunday or a public holiday) on which financial institutions licensed under the Financial Services Act 2013 and Islamic Financial Services Act 2013 are open in the state where the place of business of the Bank is located

2 k) Prior Notice means notice by the Bank of certain facts or of a particular state of affairs of at least twenty one (21) calendar days unless stated otherwise. 1. AmBank@Work Eligibility To be eligible for consideration by AmBank as an AmBank@Work Customer, the customer must comply with the following: a) be an employee of Maxis; and b) he/she must nominate an existing or new AmBank or AmBank Islamic Current or Savings Account as his/her Payroll Account via any process or communication method as stipulated by Maxis for the purposes of salary crediting, and have his/her monthly payroll credited into the Payroll Account by Maxis. 3. AmBank@Work Programme for Maxis 3.1 AmBank may at any time and from time to time offer features, benefits and rewards on products or services offered to AmBank@Work Customer(s) under the AmBank@Work Programme. The full list of the features, benefits and rewards can be viewed at AmBank s website at All such offers may be revised from time to time at AmBank s sole discretion. 3.2 AmBank reserves the right upon giving prior notice of twenty one (21) calendar days to set or impose further terms and conditions in relation to the AmBank@Work Programme. The AmBank@Work Programme for Maxis and AmBank@Work Terms and Conditions shall be subject to the application of the terms and conditions of the relevant or respective products or services (including but not limited to the General Terms and Conditions of Accounts and Services, and Specific Terms and Conditions TRUE Transact, TRUE Savers Accounts and TRUE by AmBank Debit MasterCard) which are separate from the terms and conditions herein. All product benefits allocated as part of the AmBank@Work Programme for Maxis must be read in conjunction with the terms and conditions governing the respective product or services. 3.3 The AmBank@Work Customer must comply with the terms and conditions in relation to the AmBank@Work Programme, or any further terms and conditions which AmBank/AmBank Islamic may from time to time set in accordance with Clause 3.2 before the AmBank@Work Customer(s) are permitted to enjoy the relevant benefits. 3.4 AmBank reserves the right to revise, modify, suspend, cancel, terminate or withdraw the AmBank@Work Programme for Maxis in whole or part, by giving the AmBank@Work Customer prior notice of twenty one (21) calendar days. For the avoidance of doubt, any termination, cancellation, amendment, modification, revision, restriction or suspension of all or any of the AmBank@Work Programme for Maxis shall not entitle the AmBank@Work Customer and/or any person to any claim or compensation against AmBank and/or AmBank Islamic for any losses or damages suffered or incurred by the AmBank@Work Customer and/or any person as a direct or indirect result of the act of termination, cancellation, amendment, modification, revision, restriction or suspension unless the same is due to the gross negligence or willful default of AmBank and/or AmBank Islamic.

3 4. TRUE Savers 3% Interest p.a. Welcome Offer 4.1 Maxis Employees who become Customers are eligible to opt for higher interest rate of 3% p.a. on their TRUE Savers Account ( Special Rate ), subject to the following: a) A minimum daily balance of RM 2, is required in order to earn the interest rate of 3% p.a. If balances fall below RM 2, at any time during the month, the interest rate will be 0% p.a. b) Eligibility for the 3.0% p.a. will be reviewed at the end of each month to determine if the AmBank@Work Customer is entitled to receive the Special Rate. c) The Special Rate shall be awarded for 6 months from the account opening date, thereafter the interest rate will revert to the TRUE Savers Account board rate. 4.2 The rate will be subject to revision should there be any Overnight Policy Rate (OPR) changes with immediate effect. 5. Changes in Fees & Charges Any changes in fees and charges applicable will be updated in the Bank s website at least 21 calendar days prior to the implementation 6. AmBank Credit Card Choose your Gift Campaign for Maxis Employees ( Choose Your Gift Campaign ) Maxis Employees who become AmBank@Work customers are eligible for the Choose Your Gift Campaign upon successful application of an AmBank Credit Card, subject to the terms and conditions as specified in Appendix Termination 7.1 The AmBank@Work Programme for Maxis of an AmBank@Work Customer shall be deemed terminated upon occurrence of any of the following events: a) Discontinuation of monthly payroll crediting into the AmBank@Work Customer s Payroll Account for three (3) consecutive months; or b) Resignation, termination, or cessation of employment of the AmBank@Work Customer resulting in the discontinuation of monthly payroll crediting as mentioned in Clause 7.1 (a); or c) Withdrawal by Maxis from AmBank payroll crediting services, resulting in the discontinuation of monthly payroll crediting as mentioned in Clause 7.1(a). 7.2 Notwithstanding Clause 7.1, AmBank reserves the right to suspend or terminate the AmBank@Work Customer s entitlement to enjoy or use the AmBank@Work Employee Banking Benefits Programme for Maxis upon giving prior notice of twenty one (21) calendar days to the AmBank@Work Customer.

4 7.3 Upon termination mentioned in Clause 7.1 and 7.2, the Customer shall immediately cease to enjoy or use all features, benefits and rewards offered under the Employee Banking Benefits Programme for Maxis. 7.4 AmBank and/or Ambank Islamic shall not, under any circumstances, be held liable for any loss or damage suffered or incurred by the Customer or any other party, in respect of (i) the Customer s enjoyment and/or non-enjoyment and usage and/or nonusage of the AmBank@Work Programme for Maxis; or (ii) AmBank s action in terminating or suspending the AmBank@Work Customer s entitlement to enjoy or use of the AmBank@Work Programme for Maxis unless the same is caused by AmBank s willful default or gross neglect. 8. Important Notices 8.1 The AmBank@Work Customer(s) enjoyment and usage of the AmBank@Work Programme for Maxis shall be deemed as the AmBank@Work Customer s agreement to the AmBank@Work Programme for Maxis Terms & Conditions and the AmBank@Work Customer(s) agree that the decision of AmBank in relation to every aspect of the AmBank@Work Programme for Maxis shall be final, binding and conclusive. 8.2 The AmBank@Work Customer(s) hereby confirm that they have read, understood and agreed to be bound by the AmBank Group Privacy Notice (which is available at and the clauses herein, as may relate to the processing of the AmBank@Work Customer(s) personal information. For the avoidance of doubt, the AmBank@Work Customer(s) agree that the said Privacy Notice shall be deemed to be incorporated by reference into the Terms and Conditions herein. 8.3 The AmBank@Work Customer(s) agree that they shall not hold AmBank and/or AmBank Islamic liable and/or responsible for any loss or damage which they have incurred or may incur directly or indirectly arising out of or in connection with their enjoyment and usage of the AmBank@Work Programme, including but not limited to breakdown or malfunction of the computer, its terminal connection lines, data processing system or transmission line or any other equipment whether or not belonging to the Bank, attempted or actual acts of terrorism, outbreak of epidemics, war, riot, strike, lockout, industrial action, fire, flood, technical or system failures, any Act of God or any circumstances or event beyond the Bank s reasonable control. 8.4 AmBank reserves the rights upon giving prior notice of twenty one (21) calendar days to vary (whether by addition, deletion, modification, amendment or otherwise howsoever) ( the Amendment ) any of the AmBank@Work for Maxis Terms & Conditions. Notification to AmBank@Work Customer(s) in respect of the Amendment shall be effected at AmBank s absolute discretion through any one of the following means of communication:- a. by ordinary mail to the AmBank@Work Customer(s) last known address; b. by posting a notice regarding the Amendment at each of AmBank s branches;

5 c. by effecting an advertisement regarding the Amendment in one newspaper of AmBank s choice, or via AmBank and/or AmBank Islamic s website; or d. in any other mode as AmBank deems fit. The Amendment shall be deemed as binding on the AmBank@Work Customer as from the date of notification of the Amendment or from such other date as may be specified by AmBank in the notification. 8.5 Time shall be of the essence but AmBank s failure and/or delay in exercising or enforcing its rights, powers, privileges or remedies against the AmBank@Work Customer shall not operate as a waiver thereof nor shall any partial exercise of any rights, powers, privileges or remedies prejudice or affect AmBank's rights to subsequently act strictly in accordance therewith. 8.6 The illegality, invalidity or unenforceability of any AmBank@Work Terms and Conditions shall not affect the legality, validity or enforceability of any other AmBank@Work Terms and Conditions herein. 8.7 AmBank@Work Terms and Conditions herein shall be subject to, governed by and construed in accordance with the laws of Malaysia and the rules, regulations and guidelines of Bank Negara Malaysia, the Association of Banks in Malaysia and other relevant bodies, in force from time to time. The AmBank@Work Customer agrees to submit to the exclusive jurisdiction of the Courts of Malaysia. 8.8 Notwithstanding anything herein, AmBank's rights and entitlement under this AmBank@Work Terms and Conditions shall continue to remain in force and effect and shall survive any termination or suspension of the AmBank@Work Programme for Maxis 8.9 The AmBank@Work Terms and Conditions herein shall continue to be valid and binding notwithstanding any merger, amalgamation, transfer or assignment of business, operations, assets or liabilities of AmBank or any change in AmBank or any company by which the business of AmBank may for the time being be carried on The AmBank@Work Terms and Conditions herein shall be binding upon the heirs, personal representatives and successors-in-title of AmBank and the AmBank@Work Customer respectively and the rights and obligations of the AmBank@Work Customer herein cannot be assigned for any reasons whatsoever The AmBank@Work Terms and Conditions herein are in addition and subject to the agreement and/or rules and regulations governing the operation, services, benefits and privileges in relation to and /or arising under the account(s) of the AmBank@Work Customer maintained with the Bank Any demand, notice and communication in connection with this AmBank@ Work Programme for Maxis sent by the Bank to AmBank@Work Customers shall be in writing and shall be delivered to AmBank@Work Customer s address as per the Bank s records or at such other address as AmBank@Work Customer shall have notified to the Bank in writing. Unless otherwise specified herein, all demand, notice and communication shall be deemed to have been received and effective as follows:-

6 a. In the case of ordinary post, two (2) days after posting for peninsular Malaysia and five (5) days after posting for Sabah & Sarawak and places outside of Malaysia; b. If by facsimile, when received in a readable and legible form, on the Business Day immediately after transmission provided always that the Bank has received a confirmation; c. if by or other instantaneous communication, at the time it is actually received in readable form; d. If by display (whether at AmBank and/or AmBank Islamic's premises or on AmBank and/or AmBank Islamic s website) upon such display being made; or e. By any other manner as AmBank and/or AmBank Islamic deems fit The service of legal process in respect of any action or proceedings may be effected on AmBank@Work Customers by delivering a copy of the legal process personally or by way of ordinary post with certificate of posting to the AmBank@Work Customer s address as per the Bank s records or at such other address as the AmBank@Work Customer shall have notified to the Bank in writing. Proof of posting or despatch of any Legal Process shall be deemed to be served:- a. if it is personally delivered, at the time of delivery and duly acknowledged; or b. in the case of an ordinary post with certificate of posting, on the second (2nd) Business Day after posting For the purpose of 8.13, reference to legal process means any pleadings, all forms of originating processes, writs, interlocutory applications, affidavits, orders, such other documents which are required to be served under the rules of court and such notices under the Companies Act 2016 and the Bankruptcy Act 1967 (includes any insolvency legislation enacted from time to time) and the Land Acts. (a) No change in the address of the AmBank@Work Customers shall be effective or binding on the Bank unless actual notice of the change of address has been received by AmBank and/or AmBank Islamic In the event of any inconsistency between the terms and conditions herein and any advertising, promotional, publicity and other materials relating to or in connection with the AmBank@Work Programme, Terms and Conditions, (as may be amended from time to time,) shall prevail Where the context so admits, word importing the singular number shall include the plural number and vice-versa, words importing the masculine gender shall include the feminine and neuter genders and vice-versa. Appendix 1

7 AMBANK / AMBANK ISLAMIC CREDIT CARD ACQUISITION: CHOOSE YOUR GIFT CAMPAIGN TERMS AND CONDITIONS 1. The AmBank / AmBank Islamic s Credit Card Acquisition Choose Your Gift Campaign ("Campaign") commences from 1 April 2017 to 31 August 2017 (both dates inclusive) ("Campaign Period"). 2. Campaign is open to all Maxis employees who are AmBank@Work Customers and apply for an AmBank / AmBank Islamic Principal Credit Card for the first time during the Campaign Period. 3. Applicable to AmBank / AmBank Islamic Visa Infinite, World MasterCard, Visa Signature, Platinum, Gold, CARz, AmBank TRUE Visa Card and AmBank Cosway Card only EXCEPT AmBank-BonusLink Card, Insurance Card, Corporate Card, Commercial Card, AmBank Islamic TRUE, AmBank Visa Imagine and Classic Card. 4. Campaign is only applicable to all New-To-Bank AmBank / AmBank Islamic Cardholders (Qualified Cardholder). Cards cancelled less than twelve (12) months from date of application and reapplied during the Campaign Period will not be considered as New-To-Bank Cardholders. 5. The following are NOT qualified to participate in this Campaign: a. Existing AmBank / AmBank Islamic / MBF Cardholders; b. Existing AmBank Cardholders applying for new AmBank Islamic Credit Card (or vice versa); c. Existing Supplementary Cardholder applying for new Principal Card; d. A former AmBank / AmBank Islamic / MBF Cardholders whose credit card was cancelled less than twelve (12) months from the date of the application and an AmBank / AmBank Islamic Credit Card is reapplied under this Campaign; AND e. Customer who is in default of payment of sums due or suspected of committing any fraudulent, unlawful and illegal acts in relation to the Customer s AmBank and/or AmBank Islamic Credit Card Account, and/or any other facilities or services with AmBank and/or AmBank Islamic. Campaign Mechanics 6. All approved New-To-Bank Principal Cardholders that fulfil the following criteria will be rewarded: Offer Spending criteria Gift category 1 Perform minimum cumulative retail 1 unit of 20 transactions amount of RM1, Luggage within 2 months from card approval date; (Stellar Valentino OR Creations) Perform a 12-month 0% Balance Transfer (minimum amount of RM4, in one transaction) within 2 months from card approval date Bag by Available unit Limited to 200 units on first-come-firstserved basis

8 2 Perform minimum cumulative retail transactions amount of RM2, within 2 months from card approval date OR Perform a 12-month 0% Balance Transfer (minimum amount of RM8, in one transaction) within 2 months from card approval date 1 unit of Samsung Galaxy J1 Ace Limited to first 100 for Maxis staff only on first-come-firstserved basis 7. Each Cardholder is only entitled to one (1) Gift upon meeting the required criteria, regardless of the number of the credit cards or balance transfer applied during the Campaign Period. 8. Gift entitlement is on first come first served basis subject to the stipulated quantity available. 9. For Cardholders who meet the spending criteria and successfully enrols for a balance transfer during the campaign period, Gift will be given based on the higher Gift category. 10. The card spending amount will be calculated two (2) months from the card approval date, with a grace period of five (5) calendar days for transactions to be posted. The Bank is not responsible in any manner whatsoever for any late posting to Cardholder s account by merchants and/or third parties. 11. All application forms with complete documents must be submitted to the Bank within the Campaign Period. Proof of date sent and / or postage does not constitute receipt of application form by the Bank. The Bank s actual date of receipt of application form shall prevail. 12. A Qualified Cardholder whose credit card has been suspended, cancelled or terminated during this Campaign Period will not be entitled to any Gift. 13. The Bank reserves the right to reject or approve the application at its absolute discretion without any reason nor prior notification to the customer. 14. For the purpose of this Campaign, the following transactions are not considered Eligible Retail Transactions and will not be taken into consideration towards the fulfilment of the Spending Criteria:- a. Easy Payment Plan (EPP), Balance Transfer (BT), QuickCash (QC) and Cash Advance; and/or b. Any form of refund; and/or c. Any disputed, unauthorized or fraudulent retail transaction; and/or d. Interest / Management Fee payments, late payment charges, charges for cash withdrawals, Government Service Tax, Goods and Services Tax and any other form of service/miscellaneous fees Eligible Retail Transaction shall mean the purchase of any goods or services (local and international) with the use of the new credit card and may at the Bank s absolute discretion, include any other card transaction determined by the Bank, and any decision of the Bank is final and binding on the Cardholder. 0% Balance Transfer Mechanics 14. The minimum amount for the Balance Transfer shall be RM4, (for Offer 1) OR RM8, (for Offer 2) and maximum amount shall not exceed RM30, per Cardholder and

9 applicable to Balance Transfer from credit / charge cards of other banks ( Balance Transfer Amount ). Approval shall be subject to the Cardholder s available credit limit. 15. The instalment tenure of the Balance Transfer shall be twelve (12) months or such other period as specified by the Bank from time to time with prior notice of at least twenty-one (21) calendar days. Each instalment amount will be proportionately computed and billed accordingly to the Cardholder s Card s Account on the billing date of each month and over the instalment tenure and/or until the full settlement of the instalments. E.g. for approved Balance Transfer amount of RM4,000, the monthly instalment is computed as follows: RM4,000 / 12 months = First month RM337.00, subsequent month RM for 11 months. 16. In accordance with the Cardholder Agreement, if the instalment amount is not paid in full on the payment due date, the prevailing Card interest / management fee rate / finance charge at such rate as prescribed by the Bank with prior notice of at least twenty-one (21) calendar days from time to time at the Bank s absolute discretion will be chargeable on the outstanding principal amount remaining unpaid on the due date from the posting date until the full payment is credited into the Cardholder s account. 17. All outstanding instalments with its respective interest / management fee for the entire instalment tenure shall immediately become due and payable in any early settlement. For the avoidance of doubt, any cancellation of the Card shall be regarded as an early settlement under the Campaign and the Bank shall have the right to claim and be paid all outstanding instalments with its respective interest/ management fee for the entire instalment tenure and/or until the full settlement of the outstanding instalments, due to the aforesaid reason. 18. Regardless of whether an Event of Default (as defined under the Cardholder Agreement) has occurred, the Bank shall be entitled at its absolute discretion at anytime, without having to assign any reason to the Cardholder to terminate the Campaign facility made available to the Cardholder, whereupon all outstanding monthly instalments with the respective interest rate/ management fee shall immediately become due and payable upon the Bank s demand of the same by notice in writing to the Cardholder. All such outstanding Balance Transfer amount will be shown in the monthly statement and the Cardholder shall pay the same in accordance to the provisions of these Terms and Conditions and the Cardholder Agreement in default of which, the Bank shall be entitled to exercise its rights herein and under the Cardholder Agreement. 19. The Bank may defer, suspend or reject any application for the Campaign in the event but not limited to, if the outstanding balance or amount requested exceeds the Cardholder s credit limit, or the outstanding balance or amount requested does not meet the minimum prescribed transfer or requested amount, or if the Cardholder s account has insufficient available balance, or such other reason as may be deemed fit by the Bank at its absolute discretion. Where the Cardholder s application is successful, payment to credit card accounts with the other credit card issuers/financial institutions will be made in the manner provided herein. 20. Signature of the Cardholder on the application form or consent obtained via phone call will be deemed conclusive proof of the Cardholder s instruction to the Bank to directly settle and pay the outstanding balance of the credit card/charge card provided by other card issuers/financial institutions to the requested credit card issuers/financial institutions, on behalf of the Cardholder. 21. The Balance Transfer Amount shall be reserved from the total credit limit of the Cardholder and shall not be made available for usage. A corresponding amount of the instalment paid by the

10 Cardholder will be progressively restored on monthly basis into the Cardholder s credit limit subject to application of payment under Clause 23 below. 22. This Campaign shall be made applicable in the following events: a. It is applicable on outstanding balance of credit /charge card transferred from other card issuers credit or charge cards issued in Malaysia only. b. Payment to the respective card issuer/financial institution(s) shall be effected by the Bank upon approval of the Campaign application. The amount payable is as approved by the Bank and as per transcribed on the application form or obtained via phone call. c. Payment of the Balance Transfer Amount will be made to the respective card issuer / financial institution via direct credit to respective card issuer s / financial institution s account via InterBank GIRO. d. Notwithstanding the Terms and Conditions herein, the Cardholder shall continue and remain liable to the card issuers/financial institutions for the facilities enjoyed by the Cardholder in accordance to the terms governing the same. e. The Bank in implementing the Campaign shall not be liable to Cardholder for any interest / management fee or any other finance charges imposed by the other card issuers / financial institutions caused by a delay or failure on the part of the Bank in paying the outstanding balance, notwithstanding the Bank s approval of Cardholder s balance transfer application, to the other card issuers/financial institutions concerned. f. The Bank has the absolute right to approve and transfer the whole or part of the amount applied for with. The Bank is not obliged to assign any reason to the Cardholder in respect of its decision. 23. Payments made by the Cardholder to the Card Account will be used to pay off outstanding amounts that attract the highest finance charges / management fee rate first. 24. The Bank shall be entitled to debit RM from the Cardholder s account for any early settlement of the amount ahead of the instalment tenure (not applicable to M-Card). All outstanding instalments with its respective interest / management fee for the entire tenure shall immediately become due and payable in any early settlement. For the avoidance of doubt, any cancellation of the Card shall be regarded as an early settlement under the Campaign and the Bank shall similarly be entitled to debit the amount of RM from the Cardholder s account and shall have the right to claim and be paid with all outstanding instalments for the entire tenure, due to the aforesaid reason. Gift Fulfilment 25. Gift will be delivered to the qualified Cardholders billing address furnished as captured in the Bank s record between eight (8) to ten (10) weeks AFTER the two (2) months spending period. Request to redirect the delivery to another address will not be entertained. 26. Visual of the Gift shown in printed materials and/or website are for illustration purpose only. Such visual may not depict the actual colour of the Gift and does not include any additional accessories. 27. The Bank reserves the right, as it deems fit to substitute the Gift with another product of similar retail value in the event the model is not available or discontinued. 28. The Bank makes no representation or warranty with respect to the value or quality of the Gift and shall not be responsible to replace any lost, stolen or defective Gift whether due to defects

11 in materials or workmanship by manufacturer under warranty or otherwise. The Qualified Cardholders are to deal directly with the supplier for such warranty information or claim. 29. The Bank is not responsible to replace any Gift lost, damaged or stolen in the course of its delivery to and / or after its receipt by the Cardholder. 30. The Bank is not affiliated with the organization whose product is given out as Gift in this Campaign. 31. The Cardholder is not allowed to choose the colour or type of the Gifts. The Bank s decision shall be final and no correspondence or appeal will be entertained to change the Gifts. 32. The Gift are non-exchangeable for cash, credit or any such other kind of products and nontransferable to any third (3rd) parties. 33. The credit card account(s) must be in good standing during the Campaign Period in order to be entitled to the Gift. General Terms and Conditions 34. By participating in this Campaign, each and every Cardholder agrees that they have read, understood the Terms and Conditions herein and agree to be bound by the decision of the Bank and this Campaign s Terms and Conditions and any other relevant Terms and Conditions that the Bank may impose from time to time with at least twenty-one (21) days prior notice For avoidance of doubt, the General Terms and Conditions of AmBank@Work Programme for Maxis Employees are incorporated herein. 35. The Bank shall not be responsible or liable for any failure by any Cardholder to participate in the Campaign at any time due to any network, communication or system error, interruption and / or failure. 36. Notwithstanding any provision to the contrary herein it is agreed that the Bank shall not be held liable for any costs, expenses or damages that may be incurred or suffered as a result of the Bank being unable to comply strictly with the Terms and Conditions of this Campaign due to the occurrence of an event of force majeure. The term force majeure shall mean any event or cause outside the control of the Bank, including without limiting the generality of the foregoing: Language Change a. a revolution, civil commotion, riots, wars, terrorism, hostilities, sabotage, armed conflict, embargoes; b. explosions, accidents, acts of God, natural catastrophes including but not limited to earthquake, floods, storms, landslides, fire; c. strike, lockouts, labour disputes or other industrial disturbances (affecting the performance of this Terms and Conditions) which cause or can reasonably be expected to cause the Bank to fail to comply with its obligations; d. failure, explosions, breakage or accident to machinery, installations, electrical cables, lines, power generation plants, power stations, national electricity grid, high tension electricity cables or the like thereof. 37. Cardholders are allowed to choose to enter into contract either in English or Bahasa Malaysia version. The contract entered in that language will be the contract exhibited in the court of law. a. In the event of any discrepancy or conflict in the interpretation of these Terms and Conditions, the English and Bahasa Malaysia versions of each of these Terms and

12 Conditions shall be construed as equivalent and each of the Terms and Conditions stipulated shall carry the same meaning. 38. All Cardholders shall be required to adhere to the Campaign s Terms and Conditions. The Bank reserves the right to forfeit the Gift(s) in the event any of the Terms and Conditions are not adhered to. 39. The Terms and Conditions herein are to be read together with and are supplementary to the standard Terms and Conditions of AmBank and/or AmBank Islamic s Cardholder Agreement ( Cardholder Agreement ). 40. In the event of discrepancies or inconsistencies between the Campaign s Terms and Conditions and the Cardholder Agreement, the Campaign s Terms and Conditions shall prevail in so far as it concerns the Campaign. 41. The Terms and Conditions contained herein as well as the Bank s decision on all matters relating to this Campaign including the card approval decision shall be final, conclusive and binding. 42. The Bank reserves the right to change, amend, delete or add on to these Terms and Conditions and to cancel, terminate, suspend or extend this Campaign with at least twenty-one (21) days prior notice. The Cardholders shall not be entitled to claim for any compensation against the Bank for any and all loss and damage suffered by the Cardholders whether as a direct or indirect result of the act of amendments, cancellation, termination or suspension of this Campaign. 43. The Bank reserves the right to: a. decline the eligibility of any Cardholder to participate in the Campaign for any reason whatsoever as the Bank may in its absolute discretion deem fit. In particular, the Bank shall have the absolute right to decline the eligibility of a Cardholder who has performed an Eligible Retail Transaction within the meaning of these Terms and Conditions, in a manner or pattern which the Bank deems to be abnormal, irregular and/or is indicative of an attempt to obtain an unfair advantage over other Cardholders with normal/regular spending patterns, and the Bank s decision in this matter shall be final and conclusive on all Cardholders; b. forfeit the Gift(s) in the circumstance where there is reversal of Eligible Transactions or termination of AmBank / AmBank Islamic Credit Card during the Campaign Period and/or at the point of Gift of the Gift(s); or non-adherence to the terms and conditions herein; c. amend the Total Units allocated for Gift(s) and/or replace the Gift(s) herein with a similar value at its absolute discretion, by way of posting on the website, or in any other methods which the Bank deem practical, in order to give prior notice to qualified Principal Cardholders; and d. add, delete or amend the terms and conditions herein, wholly or in part, or to terminate this Campaign at its absolute discretion, by way of posting on the AmBank website, or in any other methods which the Bank deems practical, in order to give a prior notice to Cardholders on such addition, deletion or amendment of the terms and conditions or termination of this Campaign. 44. Cardholder is advised to refer to ambank.com.my from time to time for the latest Terms and Conditions. 45. Cardholder is advised to read and understand and accept the AmBank Group Privacy Notice, which is available at website ( and branches.

13 47. The Bank may disclose the Cardholder s information only to third parties appointed by the Bank for the purpose of banking operations that provide for this Campaign. Upon participation in and acceptance of the Programme, the Cardholder is giving consent to such disclosure. 48. By participating in this Campaign, the Cardholder hereby consent to and agree that the Bank shall be at liberty to publish or display materials and/or information, including but not limited to their names and photographs without compensation for advertising and publicity purposes in any manner the Bank deems appropriate. Non-compliance may result in an alternative Cardholder being chosen. 49. All Terms and Conditions stipulated herein are governed by and construed in accordance with the laws of Malaysia and any legal disputes shall be commenced and heard in courts in Kuala Lumpur.

Definisi a) AmBank bermaksud AmBank (M) Berhad (No. Syarikat: 8515-D) sebuah syarikat yang diperbadankan di Malaysia di bawah Akta Syarikat 1965 (dimansuhkan oleh Akta Syarikat 2016) dan mempunyai alamat berdaftar di Tingkat 22, Bangunan AmBank Group, No. 55 Jalan Raja Chulan, Kuala Lumpur. b) AmBank Islamic bermaksud AmBank Islamic Berhad (No. Syarikat: U), sebuah syarikat yang diperbadankan di Malaysia di bawah Akta Syarikat 1965 (dimansuhkan oleh Akta Syarikat 2016), dan mempunyai alamat berdaftar di Tingkat 22, Bangunan AmBank Group, No. 55 Jalan Raja Chulan, Kuala Lumpur. c) Bank bermaksud AmBank dan/atau AmBank Islamic, seperti yang dikehendaki oleh konteks. d) Maxis bermaksud Maxis Communications Berhad (No. Syarikat: V), sebuah syarikat yang diperbadankan di bawah undang-undang Malaysia, dengan pejabat berdaftar di Tingkat 18, Menara Maxis, Kuala Lumpur City Centre, Off Jalan Ampang, Kuala Lumpur. e) Kakitangan Maxis bermaksud kakitangan Maxis Communications Berhad atau Maxis Broad Band Berhad atau kakitangan mana-mana syarikat berkaitan lain yang Maxis akan masukkan dalam senarai gaji mereka. f) Terma dan Syarat AmBank@Work bermaksud terma dan syarat yang ditetapkan di bawah dan mana-mana terma dan syarat lain yang AmBank mungkin tetapkan menurut budi bicaranya. g) Pelanggan AmBank@Work bermaksud seseorang individu yang telah memenuhi keperluan kelayakan AmBank@Work yang ditetapkan oleh AmBank dan yang telah diterima oleh AmBank sebagai seorang Pelanggan AmBank@Work. h) Program AmBank@Work untuk Maxis bermaksud ciri-ciri, manfaat dan ganjaran ke atas produk dan perkhidmatan yang ditawarkan oleh AmBank di sini atau yang mungkin akan ditawarkan oleh AmBank dari semasa ke semasa secara eksklusif kepada Pelanggan AmBank@Work yang merupakan Kakitangan Maxis. i) Akaun Senarai Gaji bermaksud akaun simpanan atau semasa Pelanggan AmBank@Work yang disenggara dengan AmBank/ AmBank Islamic bagi tujuan pengkreditan gaji. j) Hari Perniagaan bermaksud satu hari (selain daripada Sabtu, Ahad atau cuti umum) yang mana institusi kewangan yang dilesenkan di bawah Akta Perkhidmatan Kewangan 2013 dan Akta Perkhidmatan Kewangan Islam 2013 dibuka di negeri di mana terletaknya tempat perniagaan Bank. k) Notis Terdahulu bermaksud notis oleh Bank berkenaan fakta-fakta tertentu atau berkenaan sesuatu keadaan yang tertentu dalam tempoh sekurang-kurangnya dua puluh satu (21) hari kalendar kecuali dinyatakan sebaliknya.

Kelayakan Untuk layak dipertimbangkan oleh AmBank sebagai seorang Pelanggan pelanggan hendaklah mematuhi perkara-perkara yang berikut: a) menjadi seorang kakitangan Maxis; dan b) beliau hendaklah mencalonkan satu Akaun Semasa atau Simpanan AmBank atau AmBank Islamic sedia ada atau baharu sebagai Akaun Senarai Gaji beliau melalui sebarang proses atau kaedah komunikasi yang ditetapkan oleh Maxis bagi tujuan pengkreditan gaji dan memastikan bayaran gaji bulanan beliau dikreditkan ke dalam Akaun Senarai Gaji tersebut oleh Maxis. 3. Program untuk Maxis 3.1 AmBank boleh pada bila-bila masa dan dari semasa ke semasa menawarkan ciri-ciri, manfaat dan ganjaran ke atas produk atau perkhidmatan yang ditawarkan kepada Pelanggan di bawah Program Senarai penuh ciri-ciri, manfaat dan ganjaran boleh dilihat di laman web AmBank di Semua tawaran yang sedemikian mungkin akan disemak dari semasa ke semasa menurut budi bicara AmBank. 3.2 AmBank berhak selepas memberi notis terdahulu selama dua puluh satu (21) hari kalendar untuk menetapkan atau mengenakan terma dan syarat lanjut berkaitan dengan Program Program untuk Maxis dan Terma dan Syarat akan tertakluk kepada pengenaan terma dan syarat produk atau perkhidmatan masing-masing atau yang berkaitan (termasuk tetapi tidak terhad kepada Terma dan Syarat Umum Akaun dan Perkhidmatan, dan Terma dan Syarat Khusus - TRUE Transact, Akaun TRUE Savers dan TRUE by AmBank Debit MasterCard) yang berasingan daripada terma dan syarat yang dinyatakan di sini. Semua manfaat produk yang diperuntukkan sebagai sebahagian daripada Program AmBank@Work untuk Maxis hendaklah dibaca bersama dengan terma dan syarat yang mentadbir produk dan perkhidmatan yang berkenaan. 3.3 Pelanggan AmBank@Work hendaklah mematuhi terma dan syarat yang berhubung dengan Program AmBank@Work atau mana-mana terma dan syarat lanjut yang AmBank /AmBank Islamic boleh, dari semasa ke semasa tetapkan selaras dengan Klausa 3.2 sebelum Pelanggan AmBank@Work dibenarkan menikmati manfaat yang berkaitan. 3.4 AmBank berhak untuk menyemak, mengubah suai, menggantung, membatalkan, menamatkan atau mengeluarkan Program AmBank@Work untuk Maxis secara keseluruhan atau sebahagian, dengan memberi Pelanggan AmBank@Work notis terdahulu selama dua puluh satu (21) hari kalendar. Untuk mengelakkan keraguan, sebarang penamatan, pembatalan, pindaan, pengubahsuaian, semakan, pengehadan atau penggantungan semua atau mana-mana Program AmBank@Work untuk Maxis tidak akan memberi Pelanggan AmBank@Work dan/atau mana-mana orang hak ke atas sebarang tuntutan atau pampasan terhadap AmBank dan/atau AmBank Islamic bagi sebarang kerugian atau kerosakan yang dialami atau ditanggung oleh Pelanggan AmBank@Work dan/atau mana-mana orang secara langsung atau tidak langsung akibat tindakan penamatan, pembatalan, pindaan,

16 pengubahsuaian, semakan, pengehadan atau penggantungan kecuali yang sama disebabkan oleh kecuaian melampau atau keingkaran sengaja oleh AmBank dan/atau AmBank Islamic. 4. Tawaran Aluan TRUE Savers dengan Faedah 3% setahun 4.1 Kakitangan Maxis yang menjadi Pelanggan layak untuk memilih kadar faedah lebih tinggi 3% setahun bagi Akaun TRUE Savers mereka ( Kadar Istimewa ), tertakluk kepada yang berikut: a) Baki harian minimum sebanyak RM 2, diperlukan untuk memperolehi kadar faedah 3% setahun. Jika baki berada di bawah RM 2, pada bila-bila masa dalam bulan tersebut, kadar faedah akan menjadi 0% setahun. b) Kelayakan untuk mendapat 3.0% setahun akan disemak pada hujung setiap bulan untuk menentukan jika Pelanggan AmBank@Work berhak untuk menerima Kadar Istimewa. c) Kadar Istimewa akan diberikan selama 6 bulan dari tarikh pembukaan akaun, selepas itu kadar faedah akan kembali kepada kadar papan Akaun TRUE Savers. 4.2 Kadar tersebut akan tertakluk kepada semakan dengan serta-merta sekiranya terdapat sebarang perubahan kepada Kadar Dasar Semalaman (OPR). 5. Perubahan dalam Yuran & Caj Sebarang perubahan dalam yuran dan caj yang terpakai akan dikemas kini di laman web Bank sekurang-kurangnya 21 hari kalendar sebelum pelaksanaannya. 6. Kempen Kad Kredit AmBank "Pilih Hadiah Anda" untuk Kakitangan Maxis ( Kempen Pilih Hadiah Anda ) Kakitangan Maxis yang menjadi Pelanggan AmBank@Work adalah layak untuk Kempen Pilih Hadiah Anda selepas permohonan untuk Kad Kredit AmBank berjaya, tertakluk kepada terma dan syarat seperti yang ditetapkan dalam Lampiran 1 7. Penamatan 7.1 Program AmBank@Work untuk Maxis bagi Pelanggan AmBank@Work akan dianggap telah ditamatkan apabila berlaku mana-mana satu daripada perkara berikut: a) Penghentian pengkreditan gaji bulanan ke dalam Akaun Senarai Gaji Pelanggan AmBank@Work selama tiga (3) bulan berturut-turut; atau b) Perletakan jawatan, penamatan atau pemberhentian pekerjaan Pelanggan AmBank@Work yang mengakibatkan penghentian pengkreditan gaji bulanan seperti yang dinyatakan dalam Klausa 7.1 (a); atau c) Tindakan Maxis keluar daripada perkhidmatan pengkreditan bayaran gaji AmBank, mengakibatkan penghentian pengkreditan gaji bulanan seperti yang dinyatakan dalam Klausa 7.1 (a). 7.2 Walau apa pun yang dinyatakan dalam Klausa 7.1, AmBank berhak untuk menggantung atau menamatkan kelayakan Pelanggan AmBank@Work untuk menikmati atau menggunakan Program Manfaat Perbankan Kakitangan AmBank@Work untuk Maxis selepas memberi notis terdahulu selama dua puluh satu (21) hari kalendar kepada Pelanggan AmBank@Work 7.3 Selepas penamatan seperti yang dinyatakan dalam Klausa 7.1 dan 7.2, Pelanggan AmBank@Work hendaklah dengan serta-merta berhenti menikmati atau menggunakan

17 semua ciri-ciri, manfaat dan ganjaran yang ditawarkan di bawah Program Manfaat Perbankan Kakitangan untuk Maxis. 7.4 AmBank dan/atau AmBank Islamic tidak akan, dalam apa-apa jua keadaan sekalipun, dipertanggungjawabkan ke atas sebarang kerugian atau kerosakan yang dialami atau ditanggung oleh Pelanggan atau mana-mana pihak lain, berkaitan dengan (i) penikmatan dan/atau bukan penikmatan dan penggunaan dan/atau bukan penggunaan Pelanggan terhadap Program untuk Maxis; atau (ii) tindakan AmBank dalam menamatkan atau menggantung hak Pelanggan untuk menikmati atau menggunakan Program untuk Maxis kecuali yang sama disebabkan oleh keingkaran sengaja atau kecuaian melampau AmBank. 8. Notis-Notis Penting 8.1 Penikmatan dan penggunaan Program untuk Maxis oleh Pelanggan akan dianggap sebagai perjanjian Pelanggan kepada Terma dan Syarat Program untuk Maxis dan Pelanggan bersetuju bahawa keputusan Ambank berhubung dengan setiap aspek Program untuk Maxis adalah muktamad, mengikat dan konklusif. 8.2 Pelanggan dengan ini mengesahkan bahawa mereka telah membaca, memahami dan bersetuju untuk terikat dengan Notis Privasi Kumpulan AmBank (yang boleh didapati di dan klausa-klausa di sini, seperti yang boleh berkait dengan pemprosesan maklumat peribadi Pelanggan Untuk mengelakkan keraguan, Pelanggan bersetuju bahawa Notis Privasi tersebut akan dianggap sebagai telah digabungkan secara rujukan ke dalam Terma dan Syarat di sini 8.3 Pelanggan bersetuju bahawa mereka tidak akan mempertanggungjawabkan kepada AmBank dan/atau AmBank Islamic atas sebarang kerugian atau kerosakan yang mereka telah tanggung atau mungkin tanggung, sama ada secara langsung atau tidak langsung, yang timbul daripada atau berhubung dengan tindakan mereka menikmati dan menggunakan Program termasuk tetapi tidak terhad kepada kerosakan atau kepincangan tugas komputer, talian sambungan terminal, sistem pemprosesan data atau talian transmisi atau sebarang peralatan lain, sama ada dimiliki oleh Bank atau tidak, percubaan atau tindakan keganasan sebenar, merebaknya wabak, peperangan, rusuhan, mogok, penyekatan, tindakan industri, kebakaran, banjir, kegagalan teknikal atau sistem, bencana alam atau apa-apa keadaan atau peristiwa yang berlaku di luar kawalan munasabah Bank. 8.4 AmBank berhak selepas memberi notis terdahulu selama dua puluh satu (21) hari kalendar untuk mengubah (sama ada dengan menambah, memadam, mengubah suai, meminda atau dengan cara apa sekalipun selainnya) ( Pindaan ) mana-mana Terma dan Syarat AmBank@Work untuk Maxis. Pemberitahuan kepada Pelanggan AmBank@Work berkaitan dengan Pindaan tersebut akan dilakukan mengikut budi bicara mutlak AmBank melalui mana-mana satu keadah komunikasi yang berikut:- a. melalui pos biasa ke alamat terakhir Pelanggan AmBank@Work yang diketahui; b. dengan mengepos notis berkenaan Pindaan di setiap cawangan Ambank;

18 c. dengan membuat iklan mengenai Pindaan tersebut dalam akhbar pilihan AmBank atau melalui laman web AmBank dan/atau AmBank Islamic; atau d. dalam apa-apa cara yang AmBank fikirkan wajar. Pindaan tersebut akan dianggap sebagai mengikat ke atas Pelanggan bermula dari tarikh pemberitahuan Pindaan tersebut atau dari lain-lain tarikh yang sedemikian yang mungkin akan ditetapkan oleh AmBank dalam pemberitahuan. 8.5 Masa hendaklah menjadi intipati tetapi kegagalan dan/atau kelewatan AmBank dalam melaksanakan atau menguatkuasakan hak, kuasa, keistimewaan atau remedinya terhadap Pelanggan tidak akan berfungsi sebagai satu penepian darinya dan sebarang pelaksanaan sebahagian mana-mana hak, kuasa, keistimewaan atau remedi juga tidak akan prejudis atau menjejaskan hak AmBank untuk kemudiannya bertindak dengan tegas selaras dengannya. 8.6 Keharaman, ketidaksahihan atau tidak kebolehkuatkuasaan mana-mana Terma dan Syarat tidak akan menjejaskan kesahan, kesahihan atau kebolehkuatkuasaan manamana Terma dan Syarat yang lain di sini. 8.7 Terma dan Syarat yang dinyatakan di sini akan tertakluk kepada, ditadbir oleh dan ditafsirkan menurut undang-undang Malaysia dan aturan, peraturan dan garis panduan Bank Negara Malaysia, Persatuan Bank-Bank Dalam Malaysia dan lain-lain badan berkaitan, yang berkuatkuasa dari semasa ke semasa. Pelanggan bersetuju untuk tertakluk kepada bidang kuasa eksklusif Mahkamah Malaysia. 8.8 Walau apa pun yang dinyatakan di sini, hak dan kelayakan AmBank di bawah Terma dan Syarat akan kekal berkuatkuasa dan berkesan dan akan kekal wujud selepas sebarang penamatan atau penggantungan Program untuk Maxis. 8.9 Terma dan Syarat yang dinyatakan di sini akan kekal sah dan mengikat meskipun berlaku sebarang penggabungan, penyatuan, pemindahan atau penyerahan perniagaan, operasi, aset atau liabiliti AmBank atau sebarang perubahan dalam AmBank atau mana-mana syarikat yang mana perniagaan AmBank boleh, untuk sementara waktu, diteruskan Terma dan Syarat yang dinyatakan di sini akan mengikat ke atas pewaris, wakilwakil peribadi dan pengganti hakmilik AmBank dan Pelanggan dan hak serta obligasi Pelanggan di sini tidak boleh diserah hak atas apa-apa sebab jua sekalipun Terma dan Syarat yang dinyatakan di sini adalah tambahan dan tertakluk kepada perjanjian dan/atau aturan dan peraturan yang mentadbir operasi, perkhidmatan, manfaat dan keistimewaan berkaitan dengan dan/atau yang timbul di bawah akaun Pelanggan yang disenggara dengan Bank Sebarang tuntutan, notis dan komunikasi berhubung dengan Program untuk Maxis ini, yang dihantar oleh Bank kepada Pelanggan akan dibuat secara bertulis dan akan dihantar ke alamat Pelanggan seperti yang ada dalam rekod Bank atau ke lain-lain alamat yang sedemikian seperti yang Pelanggan telah maklumkan kepada Bank secara bertulis.
