1 AmBank / AmBank Islamic Credit Card Acquisition: Choose Your Gift Campaign Terms and Conditions 1. The AmBank / AmBank Islamic s Credit Card Acquisition Choose Your Gift Campaign ("Campaign") commences from 15 October 2016 to 30 April 2017 (both dates inclusive) ("Campaign Period"). 2. Campaign is open to all new customers who apply for an AmBank / AmBank Islamic Principal Credit Card for the first time during the Campaign Period and the Credit Card is approved by/before 14 May Applicable to AmBank / AmBank Islamic Visa Infinite, World MasterCard, Visa Signature, Platinum, Gold, CARz, AmBank TRUE Visa Card and AmBank Cosway Card only except AmBank-BonusLink Card, Insurance Card, Corporate Card, Commercial Card, AmBank Islamic True, AmBank Visa Imagine and Classic Card. 4. Campaign is only applicable to all New-To-Bank AmBank / AmBank Islamic Cardholders (Qualified Cardholder). Cards cancelled less than twelve (12) months from date of application and reapplied during the Campaign Period will not be considered as New-To-Bank Cardholders. 5. The following are NOT qualified to participate in this Campaign: a. Existing AmBank / AmBank Islamic / MBF Cardholders; b. Existing AmBank Cardholders applying for new AmBank Islamic Credit Card (or vice versa); c. Existing Supplementary Cardholder applying for new Principal Card; d. AmBank Group staff; e. A former AmBank / AmBank Islamic / MBF Cardholders whose credit card was cancelled less than twelve (12) months from the date of the application and reapplied AmBank / AmBank Islamic Credit Card under this Campaign; AND f. Customer who is in default of payment of sums due / suspected of committing any fraudulent, unlawful and illegal acts in relation to the Customer s AmBank / AmBank Islamic Bank Credit Card Account, and/or any other facilities or services with AmBank / AmBank Islamic. Campaign Mechanics 6. All approved New-To-Bank Principal Cardholders that fulfill the following criteria will be rewarded: Offer Spending criteria Gift category 1 Perform minimum cumulative retail transactions amount 1 unit of 20 of RM1,200 Luggage Bag within 2 months from card approval date; (Stellar by OR Valentino Perform a 12-month 0% Balance Transfer (minimum Creations) amount of RM4,000) within 2 months from card approval date Available unit Limited to 12,000 units on first-comefirst-served basis 2 Perform minimum cumulative retail transactions amount of RM2,000 within 2 months from card approval date OR Perform a 12-month 0% Balance Transfer (minimum amount of RM8,000) within 2 months from card approval date 1 unit of Samsung Galaxy J1 Ace Fully Redeemed! 7. Each Cardholder is only entitled to one (1) Gift upon meeting the required criteria, regardless of the number of the credit cards/balance transfer applied during the Campaign Period. 2 2 or more cards having the same anniversary date, card with the highest transaction amount will be selected to participate in this campaign. 8. Gift entitlement is on first come first served basis subject to the stipulated quantity available. 9. For Cardholders who meet the spending criteria and successfully enrolled balance transfer during the campaign period, Gift will be given based on the higher Gift category. 10. The card spending amount will be calculated two (2) months from the card approval date, with a grace period of five (5) calendar days for transactions to be posted. The Bank is not responsible in any manner whatsoever for any late posting to Cardholder s account by merchants and/or third party. 11. All application forms with complete documents must be submitted and reached the Bank within the Campaign Period. Proof of date sent and / or postage does not constitute receipt of application form by the Bank. The Bank s date of receipt of application form shall prevail. 12. A Qualified Cardholder whose credit card has been suspended, cancelled or terminated during this Campaign Period will not be entitled to any Gift. 13. The Bank reserves the right to reject or approve the application at its absolute discretion without any reason nor prior notification to the customer. 14. For the purpose of this Campaign, Eligible Retail Transaction means the purchase of any goods or services (local and international) with the use of the new credit card and may, at the Bank s absolute discretion, include any card transaction determined by the Bank except for the following transactions: a. Easy Payment Plan (EPP), Balance Transfer (BT), QuickCash (QC) and Cash Advance; and/or b. Any form of refund; and/or c. Any dispute, unauthorized or fraudulent retail transaction; and/or d. Interest / Management Fee payments, late payment charges, charges for cash withdrawals, Government Service Tax, Goods and Services Tax and any other form of service/miscellaneous fees. 0% Balance Transfer Mechanics 15. The minimum amount for the Balance Transfer shall be RM4,000 (for offer 1) OR RM8,000 (for offer 2) and maximum amount shall not exceed RM30,000 per Cardholder and applicable to Balance Transfer from credit / charge cards of other banks ( Balance Transfer Amount ). Approval shall subject to the Cardholder s available credit limit. 16. The instalment tenure of the Balance Transfer shall be twelve (12) months or such other period as specified by the Bank from time to time with prior notice of at least twenty-one (21) calendar days. Each instalment amount will be proportionately computed and billed accordingly to the Cardholder s Card s Account on the billing date of each month and over the instalment tenure and/or until the full settlement of the instalments. E.g. for approved Balance Transfer amount of RM4,000, the monthly instalment is computed as follows: RM4,000 / 12 months = First month RM337.00, subsequent month RM for 11 months. 17. In accordance with the Cardholder Agreement, if the instalment amount is not paid in full on the payment due date, the prevailing Card interest / management fee rate / finance charge or such rate as prescribed by the Bank with prior notice of at least twenty-one (21) calendar days from time to time at the Bank s absolute discretion will be chargeable on the outstanding principal amount remaining unpaid on the due date from the posting date until the full payment is credited into the Cardholder s account. 18. All outstanding instalments with its respective interest / management fee for the entire instalment tenure shall immediately become due and payable in any early settlement. For the avoidance of doubt, any cancellation of the Card shall be regarded as an early settlement under the Campaign and the Bank shall have the right to claim and be paid with all outstanding instalments with its respective interest/ management fee for the entire instalment tenure and/or until the full settlement of the outstanding instalments, due to the aforesaid reason. 2 P a g e

3 19. Regardless of whether an Event of Default (as defined under the Cardholder Agreement) has occurred, the Bank shall be entitled at its absolute discretion at anytime, without having to assign any reason to the Cardholder to terminate the Campaign facility made available to the Cardholder, whereupon all outstanding monthly instalments with the respective interest rate/ management fee shall immediately become due and payable upon the Bank s demand of the same by notice in writing to the Cardholder. All such outstanding Balance Transfer amount will be shown in the monthly statement and the Cardholder shall pay the same in accordance to the provisions of these Terms and Conditions and the Cardholder Agreement in default of which, the Bank shall be entitled to exercise its rights herein and under the Cardholder Agreement. 20. The Bank may defer, suspend or reject any application for the Campaign in the event but not limited to, if the outstanding balance or amount requested exceeds the Cardholder s credit limit, or the outstanding balance or amount requested does not meet the minimum prescribed transfer or requested amount, or if the Cardholder s account has insufficient available balance, or such other reason as may be deemed fit by the Bank at its absolute discretion. Where the Cardholder s application is successful, payment to credit card accounts with the other credit card issuers/financial institutions will be made in the manner provided herein. 21. Signature of the Cardholder on the application form or consent obtained via phone call will be deemed conclusive proof of the Cardholder s instruction to the Bank to directly settle and pay the outstanding balance of the credit card/charge card provided by other card issuers/financial institutions to the requested credit card issuers/financial institutions, on behalf of the Cardholder. 22. The Balance Transfer Amount shall be reserved from the total credit limit of the Cardholder and shall not be made available for usage. A corresponding amount of the instalment paid by the Cardholder will be progressively restored on monthly basis into the Cardholder s credit limit subject to application of payment under Clause 23 below. 23. This Campaign shall be made applicable in the following events: a. It is applicable on outstanding balance of credit /charge card transferred from other card issuers credit or charge cards issued in Malaysia only. b. Payment to the respective card issuer/financial institution(s) shall be effected by the Bank upon approval of the Campaign application. The amount payable is as approved by the Bank and as per transcribed on the application form or obtained via phone call. c. Payment of the Balance Transfer Amount will be made to the respective card issuer / financial institution via direct credit to respective card issuer s / financial institution s account via InterBank GIRO. d. Notwithstanding the Terms and Conditions herein, the Cardholder shall continue and remain liable to the card issuers/financial institutions for the facilities enjoyed by the Cardholder in accordance to the terms governing the same. e. The Bank in implementing the Campaign shall not be liable to Cardholder for any interest / management fee or any other finance charges imposed by the other card issuers / financial institutions caused by a delay or failure on the part of the Bank in paying the outstanding balance, notwithstanding the Bank s approval of Cardholder s balance transfer application, to the other card issuers/financial institutions concerned. f. The Bank has the absolute right to approve and transfer the whole or part of the amount applied for with. The Bank is not obliged to assign any reason to the Cardholder in respect of its decision. 24. Payments made by the Cardholder to the Card Account will be used to pay off outstanding amounts that attract the highest finance charges / management fee rate first. 25. The Bank shall be entitled to debit RM from the Cardholder s account for any early settlement of the amount ahead of the instalment tenure (not applicable to M-Card). All outstanding instalments with its respective interest / management fee for the entire tenure shall immediately become due and payable in any early settlement. For the avoidance of doubt, any cancellation of the Card shall be 3 P a g e

4 regarded as an early settlement under the Campaign and the Bank shall similarly be entitled to debit the amount of RM from the Cardholder s account and shall have the right to claim and be paid with all outstanding instalments for the entire tenure, due to the aforesaid reason. Gift Fulfilment 26. Gift will be delivered to the qualified Cardholders billing address furnished as captured in the Bank s record between eight (8) to ten (10) weeks after the two (2) months spending period. Request to redirect the delivery to another address will not be entertained. 27. Visual of the Gift shown in printed materials and/or website are for illustration purpose only. Such visual may not depict the actual colour of the Gift and does not include any additional accessories. 28. The Bank reserves the right, as it deems fit to substitute the Gift with another product of similar retail value in the event the model is not available or discontinued. 29. The Bank makes no representation or warranty with respect to the quality of the Gift and shall not be responsible to replace any lost, stolen or defective Gift (whether due to defects in materials or workmanship by manufacturer under warranty or otherwise). The Qualified Cardholders are to deal directly with the supplier for such warranty information or claim. 30. The credit card account(s) must be in good standing during the Campaign Period in order to be entitled to the Gift. General Terms and Conditions 31. By participating in this Campaign, each and every Cardholder agrees that they have read, understood the Terms and Conditions herein and agree to be bound by the decision of the Bank and this Campaign s Terms and Conditions and any other relevant Terms and Conditions that the Bank may impose from time to time with at least twenty-one (21) days prior notice. 32. The Bank shall not be responsible or liable for any failure by any Cardholder to participate in the Campaign at any time due to any network, communication or system error, interruption and / or failure. 33. The Gift are not exchangeable for credit or any other kind of products and not transferable to any parties. 34. Notwithstanding any provision to the contrary herein it is agreed that the Bank shall not be held liable for any costs, expenses or damages that may be incurred or suffered as a result of the Bank being unable to comply strictly with the Terms and Conditions of this Campaign due to the occurrence of an event of force majeure. The term force majeure shall mean any event or cause outside the control of the Bank, including without limiting the generality of the foregoing: a. a revolution, civil commotion, riots, wars, terrorism, hostilities, sabotage, armed conflict, embargoes; b. explosions, accidents, acts of God, natural catastrophes including but not limited to earthquake, floods, storms, landslides, fire; c. strike, lockouts, labour disputes or other industrial disturbances (affecting the performance of this Terms and Conditions) which cause or can reasonably be expected to cause the Bank to fail to comply with its obligations; d. failure, explosions, breakage or accident to machinery, installations, electrical cables, lines, power generation plants, power stations, national electricity grid, high tension electricity cables or the like thereof. 35. Cardholders are allowed to choose to enter into contract either in English or Bahasa Malaysia version. The contract entered in that language will be the contract exhibited in the court of law. 4 P a g e

5 36. All Cardholders shall be required to adhere to the Campaign s Terms and Conditions. The Bank reserves the right to forfeit the Gift(s) in the event any of the Terms and Conditions are not adhered to. 37. The Terms and Conditions herein are to be read together with and are supplementary to the standard Terms and Conditions of AmBank / AmBank Islamic s Cardholder Agreement ( Cardholder Agreement ). 38. In the event of discrepancies or inconsistencies between the Campaign s Terms and Conditions and the Cardholder Agreement, the Campaign s Terms and Conditions shall prevail in so far as it concerns the Campaign. 39. The Terms and Conditions contained herein as well as the Bank s decision on all matters relating to this Campaign including the card approval decision shall be final, conclusive and binding. 40. The Bank reserves the right to change, amend, delete or add on to these Terms and Conditions and to cancel, terminate, suspend or extend this Campaign with at least twenty-one (21) days prior notice. The Cardholders shall not be entitled to claim for any compensation against the Bank for any and all loss and damage suffered by the Cardholders whether as a direct or indirect result of the act of amendments, cancellation, termination or suspension of this Campaign. 41. The Bank reserves the right to: a. decline the eligibility of any Cardholder to participate in the Campaign for any reason whatsoever as the Bank may in its absolute discretion deem fit. In particular, the Bank shall have the absolute right to decline the eligibility of a Cardholder who has performed an Eligible Retail Transaction within the meaning of these Terms and Conditions, in a manner or pattern which the Bank deems to be abnormal, irregular and/or is indicative of an attempt to obtain an unfair advantage over other Cardholders with normal/regular spending patterns, and the Bank s decision in this matter shall be final and conclusive on all Cardholders; b. forfeit the Gift(s) in the circumstance where there is reversal of Eligible Transactions or termination of AmBank / AmBank Islamic Credit Card during the Campaign Period and/or at the point of Gift of the Gift(s); or non-adherence to the terms and conditions herein; c. amend the Total Units allocated for Gift(s) and/or replace the Gift(s) herein with a similar value at its absolute discretion, by way of posting on the website, or in any other methods which the Bank deem practical, in order to give prior notice to qualified Principal Cardholders; and d. add, delete or amend the terms and conditions herein, wholly or in part, or to terminate this Campaign at its absolute discretion, by way of posting on the AmBank website, or in any other methods which the Bank deems practical, in order to give a prior notice to Cardholders on such addition, deletion or amendment of the terms and conditions or termination of this Campaign. 42. Cardholder is advised to refer to ambank.com.my from time to time for the latest Terms and Conditions. 43. Cardholder is advised to read and understand and accept the AmBank Group Privacy Notice, which is available at website (ambank.com.my) and branches. 44. The Bank may disclose the Cardholder s information only to third parties appointed by the Bank for the purpose of banking operations that provide for this Campaign. Upon participation in and acceptance of the Programme, the Cardholder is giving consent to such disclosure. 45. By participating in this Campaign, the Cardholder hereby consent to and agree that the Bank shall be at liberty to publish or display materials and/or information, including but not limited to their names and photographs without compensation for advertising and publicity purposes in any manner the Bank deems appropriate. Non compliance may result in an alternative Cardholder being chosen. 46. All Terms and Conditions stipulated herein are governed by and construed in accordance with the laws of Malaysia and any legal disputes shall be commenced and heard in courts in Kuala Lumpur. Pemerolehan Kad Kredit AmBank / AmBank Islamic Kempen Pilih Hadiah Anda ("Kempen") bermula dari 15 October 2016 sehingga 30 April 2017 (termasuk kedua-dua tarikh) ( Tempoh Kempen ). 2. Kempen ini terbuka kepada semua pelanggan baharu yang memohon Kad Kredit Utama AmBank / AmBank Islamic bagi pertama kali semasa Tempoh Kempen dan kad kredit yang berjaya diluluskan pada/sebelum 14 Mei Terpakai kepada AmBank / AmBank Islamic Visa Infinite, World MasterCard, Visa Signature, Platinum, Gold, CARz, Kad TRUE AmBank dan Kad Cosway AmBank sahaja, kecuali Kad AmBank-BonusLink, Kad Insurans, Kad Korporat, Kad Komersial, Kad TRUE AmBank Islamic, Kad Visa Imagine AmBank dan Kad Klasik. 4. Kempen ini hanya sah untuk semua Pemegang Kad Kredit AmBank / AmBank Islamic baharu kepada pihak Bank (Pemegang Kad yang layak). Kad Kredit yang dibatalkan kurang daripada dua belas (12) bulan dari tarikh kelulusan dan memohon semula dalam Tempoh Kempen tidak dianggap sebagai Pemegang Kad Baharu-Kepada-Bank. 5. Berikut adalah mereka yang TIDAK layak untuk menyertai Kempen ini: a. Pemegang Kad AmBank / AmBank Islamic / MBF sedia ada; b. Pemegang Kad AmBank sedia ada memohon untuk Kad Kredit AmBank Islamic yang baharu (atau sebaliknya); c. Pemegang Kad Tambahan sedia ada memohon untuk Kad Utama baharu; d. Kakitangan Kumpulan AmBank; e. Bekas Pemegang Kad kredit AmBank / AmBank Islamic / MBF yang kad kredit dibatalkan kurang daripada dua belas (12) bulan dari tarikh kelulusan dan memohon semula untuk kad kredit AmBank / AmBank Islamic di bawah Kempen ini; DAN f. Pelanggan yang ingkar membuat pembayaran wang yang perlu dibayar / disyaki melakukan sebarang tindakan penipuan, menyalahi undang-undang dan tidak sah berhubung dengan Akaun Kad Kredit AmBank / AmBank Islamic, dan /atau mana-mana kemudahan atau perkhidmatan yang lain dengan AmBank / AmBank Islamic. Mekanisma Kempen 6. Sepanjang Tempoh Kempen ini, Pemegang Kad Utama Baharu-Kepada-Bank yang memenuhi kriteria akan diberi Hadiah seperti berikut: Tawaran Kriteria perbelanjaan Kategori Hadiah Unit disediakan 1 Melakukan minimum transaksi runcit terkumpul sebanyak RM1,200 dalam tempoh 2 bulan dari tarikh kelulusan kad; ATAU Dapatkan 0% Pindahan Baki selama 12 bulan (jumlah pindahan minima RM4,000) dalam tempoh 2 bulan dari tarikh kelulusan kad; ATAU 1 unit Bag Bagasi bersaiz 20 Had untuk 12,000 unit Berdasarkan yang terdahulu diutamakan 2 Melakukan minimum transaksi runcit terkumpul sebanyak RM2,000 dalam tempoh 2 bulan dari tarikh kelulusan kad ATAU Dapatkan 0% Pindahan Baki selama 12 bulan (jumlah pindahan minima RM8,000) dalam tempoh 2 bulan dari tarikh kelulusan kad. 1 unit Samsung Galaxy J1 Ace Ditebus Sepenuhnya! 7. Setiap Pemegang Kad layak menerima hanya satu Hadiah setelah memenuhi jumlah perbelanjaan yang diperlukan, tanpa mengira bilangan kad kredit yang dipohon semasa Tempoh Kempen. 6 P a g e

7 Sekiranya ada 2 atau lebih kad mempunyai tarikh ulang tahun yang sama, kad dengan jumlah transaksi yang tertinggi akan dipilih untuk mengambil bahagian dalam kempen ini. 8. Kelayakan Hadiah adalah berdasarkan yang terdahulu diutamakan dan tertakluk kepada kuantiti yang ditetapkan. 9. Bagi Pemegang Kad yang memenuhi kriteria perbelanjaan dan juga melakukan pindahan baki dalam tempoh kempen, Hadiah akan diberikan berdasarkan kategori Hadiah yang lebih tinggi. 10. Jumlah perbelanjaan kad akan dikira dua (2) bulan dari tarikh kelulusan kad, dengan tempoh selama lima (5) hari untuk penghantaran transaksi yang berjaya. Pihak Bank tidak bertanggungjawab dalam apa saja cara ke atas kelewatan transaksi yang dicaj ke akaun Pemegang Kad oleh peniaga dan/atau pihak ketiga. 11. Semua borang permohonan bersama dengan dokumen yang lengkap mesti dihantar dan diterima oleh pihak Bank dalam tempoh Kempen. Bukti tarikh penghantaran dan/atau pos tidak bermaksud pihak Bank telah menerima borang permohonan. Tarikh penerimaan borang permohonan oleh pihak Bank akan digunapakai. 12. Pemegang Kad yang layak tetapi Kad Kredit telah digantung, dibatalkan atau ditamatkan semasa Tempoh Kempen ini tidak akan layak untuk sebarang Hadiah. 13. Pihak Bank mempunyai hak untuk menolak atau meluluskan permohonan itu sebagai budi bicara mutlaknya tanpa apa-apa sebab dan pemberitahuan terlebih dahulu kepada Pemegang Kad. 14. Untuk tujuan Kempen ini, "Transaksi Runcit Layak" bermaksud pembelian apa-apa barang atau perkhidmatan (tempatan dan antarabangsa) dengan penggunaan kad kredit dan boleh, pada budi bicara mutlak pihak Bank, termasuk apa-apa urus niaga kad sebagaimana yang ditentukan oleh pihak Bank kecuali urus niaga berikut: a. Pelan Bayaran Mudah, Pindahan Baki dan Pendahuluan Tunai; dan / atau b. Sebarang bentuk pembayaran balik; dan / atau c. Transaksi runcit yang dipertikaikan dan tidak dibenarkan atau penipuan; dan / atau d. Bayaran faedah / yuran pengurusan, caj lewat bayar, caj untuk pengeluaran tunai, Cukai Perkhidmatan Kerajaan, Cukai Barang dan Perkhidmatan dan apa-apa bentuk perkhidmatan / yuran tambahan. Mekanisma Pindahan Baki 0% 15. Jumlah minimum untuk Pindahan Baki adalah RM4,000 (untuk tawaran 1) ATAU RM8,000 (untuk tawaran 2) dan jumlah maksimum tidak boleh melebihi RM30,000 bagi setiap Pemegang Kad sepanjang Tempoh Kempen dan sah ke atas pindahan baki dari kad kredit / kad caj (Jumlah Pindahan Baki). Kelulusan adalah tertakluk kepada had kad sedia ada Pemegang Kad. 16. Tempoh ansuran Kempen ini adalah dua belas (12) bulan atau lain-lain tempoh yang dinyatakan oleh pihak Bank dari semasa ke semasa dengan notis terdahulu sekurang-kurangnya dua-puluh satu (21) hari kalendar. Setiap jumlah ansuran akan dibahagi kepada 12 bulan dan dibil sewajarnya ke akaun Kad Pemegang Kad pada tarikh penyata setiap bulan dan sepanjang Tempoh Ansuran dan / atau sehingga penyelesaian penuh ansuran. Contoh: untuk jumlah pindahan baki yang diluluskan sebanyak RM1,000, ansuran bulanan dikira seperti berikut: RM4,000 / 12 bulan = bulan pertama RM337.00, bulan berikutnya RM untuk 11 bulan. 17. Mengikut Perjanjian Pemegang Kad, sekiranya jumlah ansuran tidak dibayar sepenuhnya pada tarikh akhir bayaran, kadar faedah/ yuran pengurusan/yuran/caj kewangan Kad kredit atau sekadar seumpamanya yang ditetapkan oleh pihak Bank dengan notis terdahulu sekurang-kurangnya duapuluh satu (21) hari kalendar dari masa ke semasa atas budi bicara mutlaknya akan dikenakan ke atas jumlah prinsipal tertunggak yang masih belum dibayar pada tarikh matang dari tarikh dicatatkan sehingga bayaran penuh di kreditkan ke dalam akaun milik Pemegang Kad. 18. Semua ansuran belum jelas bersama kadar faedah / yuran pengurusan yang berkenaan akan dianggap matang dan perlu dibayar sekiranya terdapat Penjelasan Awal dibuat. Untuk mengelakkan sebarang keraguan, sebarang pembatalan kad akan dianggap sebagai Penjelasan Awal di bawah Promosi ini dan berhak untuk menuntut dan untuk dibayar dengan semua ansuran belum jelas bersamaan dengan faedah / yuran pengurusan / yuran untuk keseluruhan Tempoh berkaitan dengan perkara tersebut. 7 P a g e

Tidak kira sama ada Kegagalan Membayar (seperti yang dinyatakan di bawah Perjanjian Pemegang Kad) telah berlaku, pihak Bank berhak atas budi bicara mutlaknya pada bila-bila masa, tanpa perlu memberikan sebarang sebab kepada Pemegang Kad untuk menamatkan Kempen yang ditawarkan kepada Pemegang Kad, dan dalam keadaan tersebut, semua ansuran bulanan belum jelas dengan kadar faedah/ yuran pengurusan yang berkenaan akan menjadi matang dan perlu dibayar apabila diminta oleh pihak Bank dengan memberi notis bertulis kepada Pemegang Kad. Segala jumlah Pindahan Baki tertunggak akan dinyatakan di dalam penyata bulanan dan Pemegang Kad haruslah membayar jumlah tersebut seperti yang telah diperuntukkan di dalam Terma dan Syarat ini dan Perjanjian Pemegang Kad, sekiranya gagal berbuat demikian, pihak Bank berhak untuk melaksanakan haknya di sini di bawah Perjanjian Pemegang Kad. 20. Pihak Bank boleh menangguhkan, menggantung atau menolak sebarang permohonan untuk Kempen ini dalam sebarang keadaan termasuk tetapi tidak terhad kepada, sekiranya baki tertunggak atau jumlah yang dipohon melebihi had kredit Pemegang Kad atau baki tertunggak atau jumlah yang dipohon tidak menepati had minimum permindahan yang ditetapkan atau akaun Pemegang Kad tidak mempunyai baki sedia ada yang mencukupi atau sebarang sebab lain yang dianggap sesuai oleh pihak Bank atas budi bicara mutlaknya. Di mana permohonan Pemegang Kad berjaya, pembayaran ke akaun pinjaman/pembiayaan dengan pengeluar kad / institusi kewangan yang lain yang berkaitan dengan pindahan baki akan dibuat mengikut kaedah yang dinyatakan di sini. 21. Tandatangan Pemegang Kad di atas borang permohonan atau persetujuan melalui panggilan telefon akan dianggap sebagai bukti muktamad arahan Pemegang Kad kepada pihak Bank untuk menyelesaikan dan membayar baki tertunggak kad kredit / kad caj kepada pengeluar kad atau institusi kewangan yang lain. 22. Jumlah Pemindahan Baki akan diperuntukan dari jumlah had Kad kredit Pemegang Kad dan tidak disediakan untuk penggunaan. Jumlah yang sama dengan jumlah ansuran yang dibayar oleh Pemegang Kad akan dilepaskan secara berperingkat pada setiap bulan ke dalam had kredit Pemegang Kad tertakluk kepada aplikasi pembayaran di bawah Fasal 23 di bawah. 23. Kempen ini sah dalam keadaan berikut: a. Pindahan baki sah untuk baki tertunggak kad kredit atau kad caj yang dipindahkan dari pengeluar kad kredit atau kad caj lain yang dikeluarkan di Malaysia sahaja. b. Pembayaran kepada pengeluar kad atau institusi kewangan yang dinyatakan berkuatkuasa bagi pihak Bank setelah permohonan Kempen diluluskan. Jumlah yang perlu dibayar adalah seperti yang diluluskan oleh pihak Bank dan seperti yang dinyatakan di dalam borang permohonan atau arahan yang diterima daripada panggilan telefon. c. Pembayaran Jumlah Pindahan Baki akan dibuat kepada pengeluar kad atau institusi kewangan melalui kredit terus ke dalam akaun pengeluar kad atau institusi kewangan tersebut melalui GIRO Antara Bank. d. Tanpa mengambil kira syarat-syarat dan peraturan yang dinyatakan di sini, Pemegang Kad akan terus dan masih bertanggungjawab ke atas pengeluar kad atau institusi kewangan untuk kemudahan yang dinikmati oleh Pemegang Kad berdasarkan syarat-syarat yang ditetapkan. e. Pihak Bank yang melaksanakan Kempen ini tidak akan bertanggung jawab ke atas Pemegang Kad untuk sebarang kadar faedah/ yuran pengurusan atau apa-apa caj kewangan lain yang dikenakan kepada Pemegang Kad oleh pengeluar kad atau institusi kewangan lain disebabkan oleh kelewatan atau kegagalan pihak Bank dalam menjelaskan baki tertunggak, tanpa mengambil kira kelulusan permohonan Pemegang Kad oleh pihak Bank, kepada pengeluar kad atau institusi kewangan lain yang berkaitan. f. Pihak Bank mempunyai hak mutlak untuk melulus dan memindahkan seluruh atau sebahagian daripada jumlah baki tertunggak yang ditetapkan dengan notis terdahulu kepada Pemegang Kad. Pihak Bank berhak untuk tidak menyatakan sebab keputusannya kepada Pemegang Kad mengikut budi bicaranya. 24. Pembayaran yang dibuat oleh Pemegang Kad kepada Akaun Kad kredit akan digunakan untuk menyelesaikan apa-apa jumlah tertunggak yang dikenakan caj kewangan tertinggi terlebih dahulu. 25. Bank berhak untuk mendebit RM100 daripada akaun Pemegang Kad bagi sebarang penjelasan amaun ansuran yang lebih awal daripada tempoh ansuran (tidak sah untuk M-Card). Semua ansuran bulanan tertunggak, akan serta-merta matang tempohnya, dan perlu dijelaskan sepenuhnya. Untuk mengelakkan keraguan, sebarang pembatalan kad akan dianggap sebagai penjelasan awal di bawah Kempen dan Bank juga berhak untuk mendebit RM100 daripada akaun Pemegang Kad dan berhak 8 P a g e

9 untuk menuntut dan dibayar dengan segala ansuran tunggakan bersama faedah / yuran pengurusan / kos masing-masing untuk keseluruhan tempoh, akibat daripada sebab tersebut di atas. Pemenuhan Hadiah 26. Hadiah akan dihantar ke alamat bil Pemegang Kad Utama yang layak yang diberikan dan mengikut rekod pihak Bank antara lapan (8) hingga sepuluh (10) minggu selepas tempoh perbelanjaan dua (2) bulan. Permintaan untuk penghantaran ke alamat lain tidak akan dilayan. 27. Visual Hadiah yang dipaparkan dalam bahan bercetak dan/atau laman web hanyalah untuk tujuan ilustrasi sahaja. Visual tersebut tidak menggambarkan warna sebenar Hadiah tersebut dan tidak termasuk sebarang aksesori tambahan. 28. Pihak Bank berhak, sebagaimana yang difikirkannya patut untuk menggantikan Hadiah dengan produk lain yang sama nilai runcitnya sekiranya model tersebut tidak boleh didapati atau dihentikan. 29. Pihak Bank tidak memberi representasi atau jaminan berkenaan dengan kualiti Hadiah tersebut dan tidak akan bertanggungjawab untuk menggantikan mana-mana Hadiah yang hilang, dicuri atau rosak (sama ada disebabkan oleh kecacatan dalam bahan atau mutu kerja oleh pengilang di bawah jaminan atau sebaliknya). Pemegang Kad berkelayakan hendaklah berurusan secara langsung dengan pembekal untuk maklumat atau tuntutan jaminan tersebut. 30. Akaun kad kredit mestilah dalam keadaan yang baik semasa Tempoh Kempen untuk layak mendapatkan Hadiah ini. Terma dan Syarat Umum 31. Dengan menyertai Kempen ini, Pemegang Kad bersetuju kepada Terma dan Syarat Kempen ini. Setiap Pemegang Kad bersetuju bahawa mereka telah membaca, memahami Terma dan Syarat di sini dan bersetuju untuk terikat dengan keputusan pihak Bank dan sebarang Terma dan Syarat yang mungkin dikenakan oleh pihak Bank dari semasa ke semasa yang berkaitan dengan notis sekurang-kurangnya dua-puluh (21) hari terdahulu. 32. Pihak Bank tidak bertanggungjawab atas sebab kegagalan oleh mana-mana Pemegang Kad untuk menyertai Kempen ini pada bila-bila masa melalui mana-mana rangkaian, komunikasi atau sistem, gangguan dan / atau kegagalan. 33. Hadiah ini tidak boleh ditukar dengan kredit atau mana-mana jenis produk lain dan tidak boleh dipindah milik kepada mana-mana pihak. 34. Di atas mana-mana peruntukan di sini yang bertentangan, ia adalah dipersetujui bahawa pihak Bank tidak akan bertanggungjawab atas sebarang kos, perbelanjaan atau kerosakan yang mungkin dialami atau ditanggung akibat daripada berlakunya peristiwa force majeure. Istilah "force majeure" bermakna mana-mana peristiwa atau sebab di luar kawalan pihak Bank, termasuk tanpa menghadkan perkara umum tersebut: a. revolusi, kekecohan awam, rusuhan, peperangan, keganasan, permusuhan, sabotaj, konflik bersenjata, sekatan ; b. letupan, kemalangan, bencana alam, termasuk tetapi tidak terhad kepada gempa bumi, banjir, ribut, tanah runtuh, kebakaran; c. mogok, sekat masuk kerja, pertikaian buruh atau gangguan perindustrian lain (mempengaruhi prestasi Terma dan Syarat ini ) yang menyebabkan atau musibahnya dapat dijangka menyebabkan Pihak Bank gagal untuk mematuhi obligasinya; d. kegagalan, letupan, kerosakan atau kemalangan kepada jentera, pemasangan, kabel elektrik, talian, loji penjanaan kuasa, stesen kuasa, grid elektrik negara, kabel elektrik tegangan tinggi atau yang seumpamanya. 35. Pemegang Kad dibenarkan untuk memilih dan mematuhi Terma dan Syarat ini sama ada dalam Bahasa Inggeris atau versi Bahasa Malaysia. Terma dan Syarat yang ditandatangani dalam pilihan bahasa akan digunakan sekiranya diperlukan di mahkamah. 9 P a g e

10 36. Semua Pemegang Kad dikehendaki mematuhi Terma dan Syarat Kempen ini. Pihak Bank mempunyai hak untuk membatalkan kelayakan Pemegang Kad sekiranya mana-mana Terma dan Syarat ini tidak dipatuhi. 37. Terma dan Syarat ini hendaklah dibaca bersama-sama dengan dan adalah tambahan kepada Terma dan Syarat standard Perjanjian Pemegang Kad AmBank / AmBank Islamic ("Perjanjian Pemegang Kad"). 38. Sekiranya berlaku percanggahan atau tidak konsisten di antara Terma dan Syarat Kempen ini dan Perjanjian Pemegang Kad, Terma dan Syarat Kempen ini akan diguna pakai setakat yang ia melibatkan Kempen ini. 39. Terma dan Syarat yang terkandung di sini dan juga keputusan Pihak Bank ke atas semua perkara yang berhubungan dengan Kempen ini termasuk keputusan kelulusan Kad adalah muktamad dan mengikat. 40. Pihak Bank berhak untuk menukar, meminda, memotong atau menambah kepada Terma dan Syarat ini; untuk membatalkan, menamatkan, menggantung atau melanjutkan Kempen ini dengan memberi sekurang-kurangnya dua-puluh (21) hari notis terlebih dahulu. Pemegang Kad tidak berhak untuk menuntut apa-apa pampasan terhadap Bank bagi sebarang dan semua kerugian dan kerosakan yang ditanggung oleh Peserta yang sama ada secara langsung atau tidak langsung daripada tindakan pindaan, pembatalan, penamatan atau penggantungan Kempen ini. 41. Pihak Bank berhak mengikut budi bicara mutlaknya untuk: a. menolak kelayakan mana-mana Pemegang Kad untuk menyertai Kempen ini atas apa jua sebab. Khususnya, pihak mempunyai hak mutlak untuk menolak kelayakan Pemegang Kad yang telah melakukan satu "Transaksi yang Layak" dalam pengertian terma dan syarat ini, dalam satu cara atau corak yang pihak Bank dianggap tidak normal, tidak teratur dan / atau menunjukkan usaha untuk mendapatkan kelebihan yang tidak adil ke atas Pemegang Kad yang lain dengan corak perbelanjaan normal / biasa, dan keputusan pihak Bank dalam perkara ini adalah muktamad dan tidak boleh dipertikaikan ke atas semua Pemegang Kad; b. membatalkan Hadiah (-Hadiah) di dalam keadaan di mana terdapat pembalikan Transaksi Layak atau penamatan Kad Kredit AmBank / AmBank Islamic dalam Tempoh Kempen dan/atau pada ketika pemberian Hadiah; atau ketidakpatuhan kepada terma dan syarat yang terkandung di sini; c. meminda jumlah unit yang diperuntukkan untuk Hadiah dan / atau menggantikan Hadiah- Hadiah di sini dengan nilai yang sama mengikut budi bicaranya melalui pemberitahuan di laman web Bank, atau mana-mana kaedah lain yang pihak Bank difikirkan praktikal untuk memberi notis terlebih dahulu kepada Pemegang Kad yang layak; d. menambah, mengeluar atau meminda terma dan syarat ini, secara keseluruhan atau sebahagiannya, atau untuk menamatkan Kempen ini mengikut budi bicara mutlaknya, melalui pemberitahuan di laman web AmBank, atau dalam mana-mana cara lain yang difikirkan praktikal oleh pihak Bank, untuk memberikan notis terlebih dahulu kepada Pemegang Kad, mengeluarkan atau meminda terma-terma dan syarat-syarat atau penamatan Kempen ini. 42. Pemegang Kad adalah dinasihatkan untuk merujuk kepada laman web ambank.com.my dari masa ke semasa untuk Terma dan Syarat terkini. 43. Pemegang Kad adalah dinasihatkan untuk membaca dan memahami dan menerima Notis Privasi Kumpulan AmBank, yang boleh didapati di laman web (ambank.com.my) dan cawangan-cawangan. 44. Pihak Bank mungkin mendedahkan maklumat Pemegang Kad hanya kepada pihak ketiga yang dilantik oleh pihak Bank bertujuan untuk operasi perbankan bagi Kempen ini. Sebagai pengambilan bahagian dan penerimaan Kempen, Pemegang Kad memberikan kelulusan kepada pendedahan tersebut. 45. Dengan mengambil bahagian dalam Kempen ini, Pemegang Kad dengan ini memberi kebenaran dan bersetuju bahawa Pihak Bank diberi kebebasan untuk menerbitkan atau memaparkan bahan material dan/atau informasi, termasuk tetapi tidak terhad kepada nama dan gambar tanpa pampasan untuk tujuan pengiklanan dan publisiti dalam apa cara sekalipun yang dianggap sesuai oleh Pihak Bank. Ketidakpatuhan boleh mengakibatkan Pemegang Kad alternatif dipilih. 46. Semua Terma dan Syarat yang ditetapkan di sini adalah ditadbir dan ditafsirkan mengikut undangundang Malaysia dan sebarang pertikaian undang-undang boleh dibicarakan dan didengar di mahkamah di Kuala Lumpur.
