1 AmBank SIGNATURE Priority Banking World Mastercard Credit Card/i 15,000 Air Miles Welcome Offer ( Welcome Offer ) 1. AmBank (M) Berhad (Company No D) or AmBank Islamic Berhad (Company No U) will be referred to as the Bank Terms and Conditions 2. This Welcome Offer commences from 1 October 2017 until 31 March 2018 (both dates inclusive) ( Welcome Offer Period ). 3. This Welcome Offer is open to customers who apply for a principal AmBank SIGNATURE Priority Banking World Mastercard Credit Card/i ( Eligible Credit Card/i ) during the Welcome Offer Period and the Eligible Credit Card/i is approved by/ before 30 April This Welcome Offer is only applicable to new and existing AmBank SIGNATURE Priority Banking customers who apply for the Eligible Credit Card/i ( Eligible Cardholders ) 5. The following are customers who are NOT qualified to participate in this Welcome Offer: a. Former AmBank/ AmBank Islamic Cardholders whose credit card/i was cancelled less than twelve (12) months at point of application for the Eligible Credit Card/i. b. Customer who is in default in payment of sums due/ suspected of committing any fraudulent, unlawful and illegal acts in relation to the customer s AmBank/ AmBank Islamic Bank Credit Card/i account, and/ or any other facilities or services with AmBank/ AmBank Islamic. Welcome Offer Mechanics 6. Eligible Cardholder is required to meet the following criteria ( Qualifying Criteria ) within 90 days from their Eligible Credit Card/i approval date in order to be entitled to receive the Welcome Offer: a) Activate the Eligible Credit Card/i that was applied during the Welcome Offer Period; b) Spend a minimum of RM30,000 on Eligible Spend (as defined in Clause 7) on his/her Eligible Credit Card/i and; c) Maintain a minimum average balance of RM200,000 in deposit and/or investment account(s) with AmBank or AmBank Islamic. 7. Eligible Spend are retail transactions that are charged to the Eligible Credit Card/i and; (a) Includes: Local and overseas retail transactions (including online transactions), and (b) Excludes: Balance Transfer, Quick Cash, Cash Advance, card instalment plans, interest charges/management fee and/or any other credit card/i related fees and charges. 2 Any determination by the Bank as to what constitutes Eligible Spend is conclusive and cannot be challenged in any manner whatsoever. All transactions as recorded by the Bank shall also be final and conclusive. The Eligible Spend will include spend made by the primary Eligible Cardholder and his/her supplementary/ies credit cardholder(s), if any, and will not be viewed individually in meeting the minimum spend amount in clause Each Eligible Cardholder is entitled to receive the 15,000 Air Miles only once, based on a first come, first served basis. 9. The Eligible Spend will be calculated 90 days from the credit card/i approval date, with a grace period of five (5) calendar days for transactions to be posted. The Bank is not responsible in any manner whatsoever for any late posting to the Eligible Cardholder s account by merchants and/or third party. 10. There is a maximum capping of 9,000,000 Air Miles to be given out under this Welcome Offer, with maximum capping of 1,500,000 Air Miles to be given out each month throughout the Welcome Offer Period. Any unutilized allocation for the month will be brought forward to the following month. Each month is defined as the 1st of the current month until last day of the current month. 11. An Eligible Cardholder whose credit card/i has been suspended, cancelled or terminated at any time during this Welcome Offer Period or upon the awarding of the Air Miles, will no longer be entitled to receive the 15,000 Air Miles. 12. The Air Miles awarded to the Eligible Cardholder will be of Enrich Miles and the Bank will contact the Eligible Cardholder via SMS based on the contact details maintained in the Bank s system to obtain their Enrich membership number before the awarding of the Air Miles. In the event that the Bank fails to receive a response from the Eligible Cardholder after 3 attempts in contacting the Eligible Cardholder, the Eligible Cardholder will no longer be entitled to receive the 15,000 Air Miles. 13. The awarding of the Air Miles to the Eligible Cardholders that has successfully met the Qualifying Criteria will be done within 12 weeks after the 90 days spending period. 3 1 28 February May 2018 August March June 2018 September The Bank reserves the right, at its absolute discretion, in the awarding of the Air Miles to the Eligible Cardholder. 15. The Eligible Credit Card/i will be entitled to participate under this Welcome Offer only and not any other concurrent AmBank/ AmBank Islamic credit card/i sign-up offer via any other channel. General Terms and Conditions 16. By participating in this Welcome Offer, Eligible Cardholder agrees that they have read, understood the Terms and Conditions herein and agree to be bound by the decision of the Bank and this Welcome Offer s Terms and Conditions and any other relevant Terms and Conditions that the Bank may impose from time to time with at least 5 calendar days notice to Cardholders before the new terms and conditions take effect. 17. The Bank shall not be responsible or liable for any failure by any Cardholder to participate in the Welcome Offer at any time due to any network, communication or system error, interruption and / or failure. 18. The 15,000 Air Miles is not exchangeable for cash, credit or any other kind of products and not transferable to any parties. 19. Notwithstanding any provision to the contrary herein, it is agreed that the Bank shall not be held liable for any costs, expenses or damages that may be incurred or suffered as a result of the Bank being unable to comply strictly with the Terms and Conditions of this Welcome Offer due to the occurrence of an event of force majeure. The term force majeure shall mean any event or cause outside the control of the Bank, including without limiting the generality of the foregoing: a) a revolution, civil commotion, riots, wars, terrorism, hostilities, sabotage, armed conflict, embargoes; b) explosions, accidents, acts of God, natural catastrophes including but not limited to earthquake, floods, storms, landslides, fire; c) strike, lockouts, labour disputes or other industrial disturbances (affecting the performance of this Terms and Conditions) which cause or can reasonably be expected to cause the Bank to fail to comply with its obligations; d) failure, explosions, breakage or accident to machinery, installations, electrical cables, lines, power generation plants, power stations, national electricity grid, high tension electricity cables or the like thereof. 20. The Eligible Cardholders shall be required to adhere to the Welcome Offer s Terms and Conditions. The Bank reserves the right to forfeit the Air Miles in the event any of the Terms and Conditions are not adhered to. 21. The Terms and Conditions herein are to be read together with and are supplementary to the standard Terms and Conditions of AmBank / AmBank Islamic s Cardholder Agreement ( Cardholder Agreement ). In the event of discrepancies or inconsistencies between the Welcome Offer s Terms and Conditions and the Cardholder Agreement, the Welcome Offer s Terms and Conditions shall prevail in so far as it relates to the Welcome Offer. 23. The Terms and Conditions contained herein as well as the Bank s decision on all matters relating to this Welcome Offer including the card approval decision shall be final, conclusive and binding on all Cardholders who participate in this Welcome Offer and no further correspondence or appeal shall be entertained. 24. The Bank reserves the right to change, amend, delete or add on to these Terms and Conditions and to cancel, terminate, suspend or extend this Welcome Offer with at least 5 calendar days notice to Cardholders before the new terms and conditions take effect. The Cardholders shall not be entitled to claim for any compensation against the Bank for any and all loss and damage suffered by the Cardholders whether as a direct or indirect result of the act of amendments, cancellation, termination or suspension of this Welcome Offer. 25. The Bank reserves the right to: a. decline the eligibility of any Cardholder to participate in the Welcome Offer for any reason whatsoever as the Bank may in its absolute discretion deem fit. In particular, the Bank shall have the absolute right to decline the eligibility of a Cardholder who has made an Eligible Spend within the meaning of these Terms and Conditions, in a manner or pattern which the Bank deems to be abnormal, irregular and/or is indicative of an attempt to obtain an unfair advantage over other Eligible Cardholders with normal/regular spending patterns, and the Bank s decision in this matter shall be final and conclusive on all Cardholders; b. forfeit the Air Miles in the circumstance where there is reversal of Eligible Transactions or termination of AmBank / AmBank Islamic Credit Card/i during the Welcome Offer Period and/or at the point of awarding of the Air Miles; or non-adherence to the terms and conditions herein; c. amend the Air Miles capping and/or replace the Air Miles herein with a similar value at its absolute discretion, by way of posting on the website, or in any other methods which the Bank deem practical, in order to give prior notice to qualified Eligible Cardholders; and d. add, delete or amend the terms and conditions herein, wholly or in part, or to terminate this Welcome Offer at its absolute discretion, by way of posting on the AmBank / AmBank Islamic website, or in any other methods which the Bank deems practical, in order to give a prior notice to Cardholders on such addition, deletion or amendment of the terms and conditions or termination of this Welcome Offer. 26. Cardholder is advised to refer to ambank.com.my from time to time for the latest Terms and Conditions. 27. Cardholder is advised to read and understand and accept the AmBank Group Privacy Notice, which is available at website (ambank.com.my) and branches. 28. The Bank may disclose the Cardholder s information only to third parties appointed by the Bank for the purpose of banking operations that provide for this Welcome Offer. Upon participation in this Welcome Offer, the Cardholder gives consent to such disclosure. 29. By participating in this Welcome Offer, the Cardholder hereby consent to and agree that the Bank shall be at liberty to publish or display materials and/or information, including but not limited to their names and photographs without compensation for advertising and publicity Page 4 of 10
5 purposes in any manner the Bank deems appropriate. Non-consent may result in an alternative Cardholder being chosen. 30. All Terms and Conditions stipulated herein are governed by and construed in accordance with the laws of Malaysia and any legal disputes shall be commenced and heard in courts in Kuala Lumpur. 31. 6 Tawaran Alu-aluan 15,000 Mil Udara Kad Kredit/i World Mastercard Perbankan Prioriti AmBank SIGNATURE ("Tawaran Alu-aluan") 1. AmBank (M) Berhad (No. Syarikat 8515-D) atau AmBank Islamic Berhad (No. Syarikat U) akan dirujuk sebagai "Bank" Terma dan syarat 2. Tawaran Alu-aluan ini bermula dari 1 Oktober 2017 hingga 31 Mac 2018 (merangkumi kedua- dua tarikh) ("Tempoh Tawaran Alu-aluan"). 3. Tawaran Alu-aluan ini terbuka kepada pelanggan yang memohon untuk Kad Kredit/i World Mastercard Perbankan Prioriti AmBank SIGNATURE ("Kad Kredit/i Layak") semasa Tempoh Tawaran Alu-aluan dan Kad Kredit/i Layak diluluskan selewat-lewatnya/sebelum 30 April Tawaran Alu-aluan ini hanya untuk pelanggan Perbankan Prioriti AmBank SIGNATURE baharu dan sedia ada yang memohon untuk Kad Kredit/i Layak ("Pemegang Kad Layak") 5. Berikut ialah pelanggan yang TIDAK layak untuk menyertai Tawaran Alu-aluan ini: a. Bekas Pemegang Kad AmBank/AmBank Islamic yang kad kredit/i-nya telah dibatalkan kurang daripada dua belas (12) bulan semasa membuat permohonan untuk Kad Kredit/i Layak. b. Pelanggan yang ingkar dalam jumlah yang perlu dibayar/disyaki melakukan sebarang perbuatan berbentuk penipuan, menyalahi undang-undang dan tidak sah berhubung dengan akaun Kad Kredit/i AmBank/AmBank Islamic, dan/atau sebarang kemudahan atau perkhidmatan lain dengan AmBank/AmBank Islamic. Mekanik Tawaran Alu-aluan 6. Pemegang Kad Layak dikehendaki memenuhi kriteria berikut ("Kriteria Kelayakan") dalam tempoh 90 hari dari tarikh kelulusan Kad Kredit/i Layak untuk berhak menerima Tawaran Alu-aluan: a. Aktifkan Kad Kredit/i Layak yang dimohon semasa Tempoh Tawaran Alu-aluan; b. Melakukan perbelanjaan minimum RM30,000 bagi Perbelanjaan Layak (seperti ditakrifkan dalam Klausa 7) menggunakan Kad Kredit/i Layak dan; c. Kekalkan baki purata minimum RM200,000 dalam akaun deposit dan/atau pelaburan dengan AmBank atau AmBank Islamic. 7. "Perbelanjaan Layak" ialah transaksi runcit yang dikenakan kepada Kad Kredit/i Layak dan; a. Termasuk: Transaksi runcit tempatan dan luar negara (termasuk transaksi dalam talian), dan b. Tidak termasuk: Pindahan baki, Pelan Bayaran Mudah, Pendahuluan Tunai, pelan ansuran kad, bayaran faedah/yuran pengurusan dan/atau sebarang yuran dan caj kad kredit/i lain yang berkaitan. 7 Sebarang penentuan oleh pihak Bank berkaitan apa yang layak ditakrifkan sebagai Perbelanjaan Layak adalah muktamad dan tidak boleh dipertikaikan dalam apa jua cara. Semua transaksi seperti yang direkodkan oleh pihak Bank juga adalah muktamad dan tidak boleh dipertikaikan. Perbelanjaan Layak akan merangkumi perbelanjaan yang dibuat oleh Pemegang Kad Layak utama dan pemegang kad kredit tambahannya, jikalau ada, dan tidak akan dilihat secara individu dalam memenuhi jumlah perbelanjaan minimum seperti dalam Klausa Setiap Pemegang Kad Layak berhak menerima 15,000 Mil Udara sekali sahaja, atas dasar yang terdahulu diutamakan. 9. Perbelanjaan Layak akan dikira 90 hari dari tarikh kelulusan kad kredit/i, dengan tempoh selama lima (5) hari kalendar untuk penghantaran transaksi yang berjaya. Pihak Bank tidak bertanggungjawab dalam apa jua cara bagi sebarang kelewatan transaksi yang dicaj kepada akaun Pemegang Kad Layak oleh peniaga dan/atau pihak ketiga. 10. Had Maksimum 9,000,000 Mil Udara akan diberikan di bawah Tawaran Alu-aluan ini, dengan had maksimum 1,500,000 Mil Udara yang akan diberikan setiap bulan sepanjang Tempoh Tawaran Alu-aluan. Sebarang peruntukan yang tidak digunakan pada bulan tersebut akan dibawa hadapan ke bulan berikutnya. Setiap bulan ditakrifkan sebagai hari pertama pada bulan semasa hingga hari terakhir pada bulan semasa. 11. Pemegang Kad Layak yang kad kredit/i-nya telah digantung, dibatalkan atau ditamatkan pada bila-bila masa semasa Tempoh Tawaran Alu-aluan ini atau semasa pemberian Mil Udara, tidak lagi berhak menerima 15,000 Mil Udara. 12. Mil Udara yang diganjarkan kepada Pemegang Kad Layak adalah dalam bentuk Mil Enrich dan pihak Bank akan menghubungi Pemegang Kad Layak menerusi SMS berdasarkan butiran hubungan yang dikekalkan dalam sistem pihak Bank untuk mendapatkan nombor keahlian Enrich mereka sebelum diganjari Mil Udara. Sekiranya pihak Bank gagal menerima maklum balas daripada Pemegang Kad Layak selepas 3 percubaan untuk menghubungi Pemegang Kad Layak, Pemegang Kad Layak tersebut tidak lagi berhak menerima 15,000 Mil Udara. 13. Ganjaran Mil Udara kepada Pemegang Kad Layak yang telah berjaya memenuhi Kriteria Kelayakan akan dilakukan dalam tempoh 12 minggu selepas tempoh perbelanjaan 90 hari. Tarikh kelulusan atau tarikh ulang tahun Kad Kredit/i Layak Perbelanjaan selama 90 hari dari tarikh kelulusan kad Mil Udara akan diganjarkan selewat-lewatnya pada 1 31 Oktober Januari 2018 April November Februari 2018 Mei Disember Mac 2018 Jun Januari April 2018 Julai Februari Mei 2018 Ogos Mac Jun 2018 September 2018 Page 7 of 10
8 14. Atas budi bicara mutlaknya, Pihak Bank mempunyai hak dalam pengurusan ganjaran Mil Udara kepada Pemegang Kad Layak. 15. Kad Kredit/i Layak berhak untuk menyertai Tawaran Alu-aluan ini sahaja dan tidak boleh menyertai sebarang tawaran permohonan kad kredit /i AmBank /AmBank Islamic serentak lain melalui mana-mana saluran lain. Terma dan Syarat Am 16. Dengan menyertai Tawaran Alu-aluan ini, Pemegang Kad Layak bersetuju telah membaca, memahami Terma dan Syarat ini dan bersetuju untuk terikat dengan keputusan pihak Bank dan Terma dan Syarat Tawaran Alu-aluan ini dan sebarang Terma dan Syarat lain yang pihak Bank mungkin menguatkuasakan dari semasa ke semasa dengan notis sekurang-kurangnya 5 hari kalendar kepada Pemegang Kad sebelum terma dan syarat baharu tersebut berkuatkuasa. 17. Pihak Bank tidak akan dipertanggungjawabkan terhadap sebarang kegagalan oleh manamana Pemegang Kad untuk menyertai Tawaran Alu-aluan pada bila-bila masa disebabkan oleh sebarang kegagalan rangkaian, komunikasi atau masalah sistem, gangguan dan/atau kegagalan ,000 Mil Udara tidak boleh ditukar dengan wang tunai, kredit atau sebarang jenis produk lain dan tidak boleh dipindah milik kepada mana-mana pihak. 19. Meskipun terdapat peruntukan yang bertentangan di sini, ia adalah dipersetujui bahawa pihak Bank tidak akan dipertanggungjawabkan terhadap sebarang kos, perbelanjaan atau kerosakan yang mungkin ditanggung atau dialami akibat pihak Bank tidak dapat mematuhi Terma dan Syarat Tawaran Alu-aluan ini dengan sepenuhnya disebabkan oleh kejadian peristiwa force majeure. Istilah "force majeure" bermaksud sebarang kejadian atau sebab di luar kawalan pihak Bank, termasuk tanpa mengehadkan kenyataan umum yang disebut: a. revolusi, kekecohan awam, rusuhan, peperangan, keganasan, permusuhan, sabotaj, konflik bersenjata, embargo; b. letupan, kemalangan, bencana alam, malapetaka semulajadi termasuk tetapi tidak terhad kepada gempa bumi, banjir, ribut, tanah runtuh, kebakaran; c. mogok, sekat masuk, pertikaian buruh atau gangguan perindustrian lain (yang mempengaruhi prestasi Terma dan Syarat ini) yang menyebabkan atau semunasabahnya dijangka menyebabkan pihak Bank gagal mematuhi kewajipannya; d. kegagalan, letupan, kerosakan atau kemalangan kepada jentera, pemasangan, kabel elektrik, talian, loji penjanaan kuasa, stesen kuasa, grid elektrik negara, kabel elektrik tegangan tinggi atau yang seumpamanya. 20. Pemegang Kad Layak dikehendaki mematuhi Terma dan Syarat Tawaran Alu-aluan. Pihak Bank berhak untuk melupuskan Mil Udara sekiranya sebarang Terma dan Syarat tidak dipatuhi. Page 8 of 10
9 21. Terma dan Syarat di sini hendaklah dibaca bersama dan adalah tambahan kepada Terma dan Syarat am Perjanjian Pemegang Kad AmBank/AmBank Islamic ("Perjanjian Pemegang Kad"). 22. Sekiranya terdapat percanggahan atau tidak konsisten di antara Terma dan Syarat Tawaran Alu-aluan dan Perjanjian Pemegang Kad, Terma dan Syarat Tawaran Alu-aluan akan diguna pakai setakat yang berkaitan dengan Tawaran Alu-aluan. 23. Terma dan Syarat yang terkandung di sini serta keputusan pihak Bank berkenaan dengan semua perkara yang berkaitan dengan Tawaran Alu-aluan ini termasuk keputusan kelulusan kad adalah muktamad, tidak boleh dipertikaikan dan mengikat terhadap semua Pemegang Kad yang menyertai Tawaran Alu-aluan ini dan tiada surat-menyurat atau rayuan lanjut akan dipertimbangkan. 24. Pihak Bank berhak menukar, meminda, memotong atau menambah kepada Terma dan Syarat ini dan membatalkan, menamatkan, menggantung atau melanjutkan Tawaran Alualuan ini dengan memberi notis sekurang-kurangnya 5 hari kalendar kepada Pemegang Kad sebelum terma dan syarat baharu berkuatkuasa. Pemegang Kad tidak berhak untuk menuntut apa-apa pampasan terhadap pihak Bank untuk sebarang dan kesemua kerugian dan kerosakan yang dialami oleh Pemegang Kad sama ada akibat secara langsung atau tidak langsung bagi tindakan pindaan, pembatalan, penamatan atau penggantungan Tawaran Alu-aluan ini. 25. Pihak Bank berhak untuk: a. menolak kelayakan mana-mana Pemegang Kad untuk menyertai Tawaran Alualuan untuk apa jua sebab yang dianggap sesuai oleh pihak Bank dalam budi bicara mutlaknya. Khususnya, pihak Bank mempunyai hak mutlak untuk menolak kelayakan Pemegang Kad yang telah membuat "Perbelanjaan Layak" dalam pengertian Terma dan Syarat ini, dengan cara atau pola yang dianggap oleh pihak Bank sebagai tidak normal, tidak teratur dan/atau menunjukkan percubaan untuk mendapatkan kelebihan yang tidak adil terhadap Pemegang Kad Layak lain dengan pola perbelanjaan biasa/tetap, dan keputusan pihak Bank dalam hal ini adalah muktamad bagi semua Pemegang Kad; b. melucutkan Mil Udara dalam keadaan di mana terdapat pembalikan Transaksi Layak atau penamatan Kad Kredit/i AmBank/AmBank Islamic semasa Tempoh Tawaran Alu-aluan dan/atau pada masa pemberian Mil Udara; atau ketidakpatuhan Terma dan Syarat yang terkandung di sini; c. meminda had Mil Udara dan/atau menggantikan Mil Udara di sini dengan nilai yang sama mengikut budi bicara mutlaknya, dengan cara paparan di laman web, atau dengan kaedah lain yang dianggap sesuai oleh pihak Bank, untuk memberi notis terlebih dahulu kepada Pemegang Kad Layak yang memenuhi syarat; dan d. menambah, memotong atau meminda terma dan syarat yang terkandung di sini, secara keseluruhan atau sebahagiannya, atau menamatkan Tawaran Alu-aluan ini mengikut budi bicara mutlaknya, dengan paparan di laman web AmBank/AmBank Islamic, atau dengan sebarang kaedah lain yang dianggap sesuai oleh pihak Bank, untuk memberi notis terlebih dahulu kepada Pemegang Page 9 of 10
10 Kad tentang penambahan, pemotongan atau pindaan terma dan syarat atau penamatan Tawaran Alu-aluan ini. 26. Pemegang Kad dinasihati supaya merujuk kepada ambank.com.my dari semasa ke semasa untuk Terma dan Syarat terkini. 27. Pemegang Kad dinasihati supaya membaca dan memahami dan menerima Notis Privasi Kumpulan AmBank, yang boleh didapati di laman web (ambank.com.my) dan cawangancawangan. 28. Pihak Bank boleh mendedahkan maklumat Pemegang Kad hanya kepada pihak ketiga yang dilantik oleh pihak Bank untuk tujuan operasi perbankan bagi persediaan Tawaran Alu-aluan ini. Sebaik sehaja menyertai Tawaran Alu-aluan ini, Pemegang Kad memberi persetujuan kepada pendedahan tersebut. 29. Dengan menyertai Tawaran Alu-aluan ini, Pemegang Kad dengan ini membenarkan dan bersetuju bahawa pihak Bank berhak menerbitkan atau memaparkan bahan dan/atau maklumat, termasuk tetapi tidak terhad kepada nama dan gambar mereka tanpa pampasan untuk tujuan pengiklanan dan publisiti dengan apa-apa cara yang dianggap sesuai oleh pihak Bank. Ketidaksetujuan boleh menyebabkan Pemegang Kad alternatif dipilih. 30. Semua Terma dan Syarat yang tertakluk di sini ditadbir dan ditafsirkan mengikut undangundang Malaysia dan sebarang pertikaian undang-undang hendaklah mengikut pendengaran mahkamah di Kuala Lumpur. 31.
