DPW Monthly Report July Statistics. Randazzo noted that the WWTP was out of compliance for 1 day at the end of July due to the sludge haul that was recently completed. Hohl stated that he wants a written commitment from Biotech Agronomics regarding the 2016 spring and fall hauling schedule. Randazzo also noted that the DPW staff has replaced all of the diffusers in the SBR tanks. Grinder calls are down considerably from the same time last year. In addition, the DPW has started the manhole inspections. Podvoyski noted that staff finally found the manhole on Industrial Drive in the woods in a low spot near the creek and noted that the manhole had shifted out of position leaving a large gap that allowed ground water to enter the system. During heavy rains the creek floods the low area and drains into the manhole causing. Podvoyski stated staff have repaired the manhole and sealed it so that no further infiltration can enter the manhole. MOTION BY HOHL, SUPPORTED BY MENZIES TO NOTE THE UTILITIES COORDINATOR S COST REVIEW AND TO CLOSE OUT THE SEWER CONNECTION FILE. Ayes: Hohl, Hahn, Menzies Absent: None Nays: None Motion carried. C Bluewater Drive Sewer Damage Invoice Discussion Paul Zahner. Mr. Zahner stated that he feels his plumber did not damage the grinder pump. He noted that it was the original pump installed in Mr. Zahner has paid over $8, in O & M fees in the 20 years since the sewers were installed and feels he shouldn t have to pay for this repair. Zahner stated that when he asked the DPW staff for the damaged parts that he was being billed for that he was informed that they had been disposed of. Randazzo stated that the cost of the alarm switch and the labor should be removed from the invoice. Hohl expressed his strong concern about not retaining the damaged parts. Podvoyski suggested that the homeowners only be billed for the damaged power cord. Mr. Zahner implied action could be taken against the Township under the Consumer Protection Act if he is billed for parts he could not get from the DPW. Hohl suggested that the DPW have a basket or locker set-up to retain damaged parts that will be billed back to the homeowner. Podvoyski and Campbell will put together a policy to be reviewed by DPW staff and then forwarded to the Utilities Committee to be adopted and included in the Policies and Procedures Manual. MOTION BY HOHL, SUPPORTED BY MENZIES TO APPROVE THE PETERS BUILDING SEWER AGREEMENT FOR A DIRECT CONNECTION AS PRESENTED, AS ALL OF THE ESTIMATED SEWER FEES WERE PAID UP-FRONT IN CASH. Campbell provided the Committee with 2 bids received for lowering a manhole structure on Century Drive that has been causing issues for the residents for several months. The DPW staff will be on-site while the work is completed by the approved Contractor. MOTION BY HOHL, SUPPORTED BY HAHN TO AWARD THE BID TO MYERS EXCAVATING. THE UTILITIES COORDINATOR SHALL PREPARE THE NOTICE TO PROCEED FOR THE SUPERVISOR AND CONTRACTOR SIGNATURES AND TO SCHEDULE THE WORK TO BE COMPLETED AS SOON AS POSSIBLE. Ayes: Hohl, Hahn, Menzies Absent: None Nays: None Motion carried. G. 2014/2015 Fiscal Year Sewer REU/Tap Tracker. Campbell provided the Committee with the sewer REU and tap fee showing that the Township added a total of new REUs to the sewer system and collection $120, in tap fees for the 2014/2015 fiscal year. MOTION BY HOHL, SUPPORTED BY MENZIES TO NOTE THE UTILITIES COORDINATOR S REPORT AS RECEIVED AND TO BE FILED AND TO FORWARD A COPY TO THE ACCOUNTING DIRECTOR. Hohl again stated his desire to have a written commitment from Biotech regarding the spring and fall sludge hauls for There should not be any delay pushing the haul to the summer as done this year. Hohl also noted that there was a cancellation clause in the contract if Biotech cannot agree to the proposed dates for the next sludge hauls. Randazzo noted that we could also look into having Synagro complete sludge hauls. The Wastewater Treatment Plant was out of compliance for two days in August because of high phosphorus. 2. DPW staff is looking into new locating equipment that uses ground penetrating radar to find utility lines. This has the potential to make miss digs much more accurate and less time consuming in areas without tracer wire. 3. DPW staff has sealed off some manholes in the gravity portion of the system that were allowing water infiltration to occur.

Box 157 Hamburg, MI Phone: Fax: Policies and Procedures Regarding Recovering Costs for Damages to the Hamburg Township Sanitary Sewer System (HTSSS) In cases where the owner of properties, its agents or assigns, has damaged the HTSSS through the owner s inattention, misuse, negligence or intentional acts, the Township pursuant to Ordinance 69F, Section 7, Paragraph F has the authority to recover the costs incident to the said damages. Therefore, in order to implement the said Ordinance, the following procedures shall apply to all properties connected to the (HTSSS): 1. When the Township becomes aware of damages to its HTSSS, the Department of Public Works (DPW) shall conduct an on-site inspection to determine the extent of the damages. and obtain estimates for all necessary repairs. The DPW Field Superintendent shall then notify the Utilities Coordinator of the damages and the repair costs. 2. The damage shall be documented by the DPW staff, including photographs, observation notes, etc., before the equipment or parts are removed from the property and taken to the Township s repair facility. 3. The DPW staff shall maintain a secure storage bin or locker in order to retain the damaged equipment or parts that shall be tagged with the date and property address from where they were recovered. Pursuant to the Consumer Protection Act the property owner shall have the right to inspect any and all damaged equipment or parts at their request. 4. DPW staff shall then develop and/or obtain estimates for all necessary repairs. 5. The DPW Foreman shall then notify the Utilities Coordinator of the damages and repair estimate, providing the necessary documentation to draft a report to be presented to the Municipal Utilities Committee at the next available meeting date. 6. The Committee shall make the final determination if the property owner is to be billed for the damaged sewer equipment or parts. If it is concluded that the property owner is responsible, a request to invoice the owner will be forwarded to the Accounting Department along with a copy of the DPW report.

21 7. If the Committee determines that the property owner is not responsible for the sewer damage, the DPW staff will be notified that the equipment and/or parts may be properly disposed of or returned to E-One if found to be under warranty. 8. Once the cost for making all of the said repairs has been established pursuant to the Ordinance, including all authorized administrative fees, the Township, at its discretion, may pursue collection for the recovery of these costs in any appropriate Court of law or equity. 9. A notice shall be prominently posted on the property The Accounting Department shall send an invoice to the property owner setting forth all of the costs and administrative fees relating to the repair of the damages as may have been or to be incurred by the Township for the repairs. 10. A copy of the invoice shall be forwarded to the Utilities Department by the Accounting staff. The Utilities Coordinator shall monitor and oversee the recovery of the costs for the damages and to otherwise coordinate all communication with owners, their agents, or assigns, relating to the recovery of the costs incurred by the Township. 11. In addition to the foregoing, the Township may file a lien against the affected property for the costs and administrative fees as have been determined by the Township. Any unpaid charges or costs for such repairs may, at the option of the Township, be added to the ad valorem tax bills of the property benefitted by the said township repairs or services. 12. If it is determined by the DPW staff that the grinder pump is bad and needs to be repaired or replaced the Township shall do so at no cost to the property owner. Actual Construction Charges: The estimated construction charges under the bid proposal were $5, The actual construction charges were $5, leaving an excess balance of $ The homeowner completed his own electrical work and property restoration that was originally included in the Contractor s bid for the sewer connection project leaving a $ credit. However, in addition to the originally estimated sewer lateral footage of 55 feet, an extra 7 feet of pipe was installed at $35.00 per foot for $ (7 ft. x $35.00/ft.). The Contractor also had to core drill a 4 hole in the footing for the building sewer not completed by the Builder for a charge of $ As result of the additional charges a total refund of $ is due to the property owner. Proposed Action by MUC: Upon review and approval by the Committee, a motion recommending the approval of the refund in the amount of $ should be made to direct the Director of Utility Services to issue the Purchase Order pursuant to the policies and procedures for sewer refunds contingent upon the funds availability within the Enterprise Fund budget. NOTE: On August 21, 2012 the Township Board voted to amend the sewer refund policy to require that the estimated sewer project costs be deposited into a non-interest bearing Escrow account.
