2 TYROL BASIN COMPETITION RELEASE OF LIABILITY Team, Event, or Activity: Competitor Age PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS. Of my own free will, I agree to enter and compete in a competition at Tyrol Basin under the terms contained herein. I understand that snowboarding/skiing and this competition involve risks, dangers, and hazards that may cause serious personal injury or death and that injuries are a common and ordinary occurrence in this sport and in competition. Risks include, but are not limited to, falls, changes in terrain, weather and snow surfaces, ice, bare spots, debris, fences, posts, signs, lift towers, padded and non-padded barriers and obstacles, collisions with other persons and other natural and manmade hazards, and improperly-adjusted or malfunctioning equipment. I freely accept and assume the risks associated with snowboarding/skiing and this competition. I represent I possess the necessary skills and physical ability to compete in this competition in such a manner that I will not endanger myself, other competitors, spectators or other persons. I understand that as a snowboarder/skier, I am bound by certain Wisconsin state laws and the Skier Responsibility Code (known as Your Responsibility Code). I understand it is my responsibility to inspect the terrain features and their associated terrain, including the angle and length of their approaches, take-off ramps and landing areas, prior to competing, to avoid falls and collisions, and to avoid injury to myself and others. I understand I am responsible for inspection and maintenance of my equipment. I agree to use restraint devices and/or leashes at all times. I further understand no inverted aerial maneuvers are allowed. In consideration of the permission to compete in this competition at Tyrol Basin and use its facilities, I HEREBY RELEASE AND FULLY DISCHARGE Tyrol Basin Corporation, its owners, officers, shareholders, agents or employees (collectively the TYROL BASIN RELEASEES ) from any liability resulting from any personal injury to myself, including death, or damage to my property which is caused by the BREACH OF ANY EXPRESS OR IMPLIED WARRANTY or the NEGLIGENT ACT OR OMISSION of any TYROL BASIN RELEASEE, including any NEGLIGENT ACT OR OMISSION in: the preparation, organization, coordination, judging, operating, or supervision of the competition; the preparation, design, location, construction, inspection, and maintenance of terrain features, including rails and boxes, together with the angle and length of their approaches, take-off ramps and landing areas; instructions given or not given to me or any other competitors concerning the competition, the terrain features and their associated terrain, or any part thereof; the design, location, construction, inspection, and maintenance of table tops and other jumps, including the angle and length of their approaches, takeoff ramps and landing areas; grooming, snowmaking, the operation of chairlifts and surface lifts, and chairlift and surface lift loading, riding, and unloading operations for the competition; padding or non-padding of natural and man-made obstacles and hazards; or posting or failure to post warnings, signs, fences, or other cautions or barriers, and the construction of or non-construction of fences and other barriers, including the selection of the construction materials. I accept full responsibility for any personal injury or damage which may result from my participation in this competition, and I hereby HOLD HARMLESS the TYROL BASIN RELEASEES for any personal injury or damage sustained by me, including death, while participating in this competition. I agree not to bring any action or lawsuit against any TYROL BASIN RELEASEE for any personal injury or damage. In accordance with Wisconsin law, nothing in this Release of Liability should be construed as releasing, discharging or waiving any claims I may have for reckless or intentional acts on the part of any TYROL BASIN RELEASEE. I understand that, for a fee of $42, in addition to the normal entry fee, Tyrol Basin offers an optional Competition Agreement that does not require me to sign a release of liability. In signing this Release of Liability, I acknowledge I am aware of this option offered by Tyrol Basin and hereby waive my right to purchase the same. 3 Tyrol Basin RACE TEAM POLICY It is the responsibility of every: racer and coach to follow the rules and policies described below. racer s parent or guardian to make sure their racers, under the age of 18, are familiar with and in agreement with the policy below. RACE TEAM POLICY INFORMATION Tyrol Basin has long been a favored training site for Madison area race teams. In the last few years we ve invested time and money improving the racing terrain, buildings, timing, and race course communications, to be a top notch venue for training and competition. We have also shown our commitment to racing with the various teams who train and compete here: Monday Night Adult Race League UW Racers Tyrol Basin Jr. Race Team High School Racing Middle School Racing Mad Alpine Tyrol Basin Snowboard Team Tyrol Basin Freestyle Team NASTAR USASA Snowboard Series While we are most definitely committed to our racing programs, good management practices dictate that we balance the use of our lifts and runs between the race teams and regular non-racing customers. The non-race tickets sold far outweigh the value of those sold to racers, and, in fact, are the bread and butter that enables us to operate profitably. Without those tickets there would be no place to race! In addition to this balance, we want to be sure we are adequately servicing our regular race teams. All winter resorts face this dilemma of balance between racers and regular customers. They must make decisions as to the nights can they practice, the runs on which the teams can set courses, how many teams they can handle without driving away regular customers, as well as how to properly handle the race needs of our regular race teams. We are attempting to clarify some of these details by issuing this policy so that both your racers and our staff, not only understand what the policy is, but also why it exists. As part of our racing policy, the General Manager will be the coordinator of all race teams at Tyrol Basin. The GM will approve a schedule indicating which teams race or train on specific dates based on the tentative schedule submitted by each team. If necessary, due to special circumstances, the GM will dictate the runs upon which training may take place. We are asking for your full cooperation to adhere to these policy guidelines.
4 GUIDELINES 1. That each team limit training to the assigned runs, which are, but not limited to, Twister and the west side of Bump Buster. No training gates or races are to be set on the West Ridge slopes. 2. That prior to each training or race session, the coach check in at Customer Service, in the Tickets Sales Office to ascertain whether or not there are any special instructions or restrictions which may be in effect. 3. Practice, at times other than regularly scheduled training dates/times, is not allowed without specific permission of management and then only under the supervision of a qualified coach. 4. Each team to limit their training to a single course on their designated run(s) and/or share courses with other teams training at the same time. The maximum number of courses allowed on Twister is two and on Bump Buster, two, unless there are moguls or other terrain features in place along the east side of the run and then only one course will be permitted. 5. Whenever only one course is set on Bump Buster, the course is to be marked from top to bottom along the Eastside of the course next to the moguls or between public skiing/boarding areas and the race course with bamboo and orange KEEP OFF marking discs approximately every 50 feet apart. If two courses are set then the entire run is to be closed and appropriately signed to close the run to the public. 6. If only one course is being set on Twister, the trail should be separated between public and racecourse area with bamboo and orange KEEP OFF marking discs. This should be from the top of Chair B, tower 2 in order to keep one half of Twister open to the public. If two courses are set on Twister, the entire slope should be closed off to the public at the top of the run with bamboo and ribbon or net fencing and appropriate slope closed signage. 7. At all times, when a course is set, the race in progress sign should be prominently displayed at the top of the appropriate slope. 8. Waiting racers or personal equipment should not block the skier traffic flow from Chair A to the westerly slopes. 9. The entire finish area at the bottom of Bump Buster or Twister should be completely fenced with temporary net fencing whenever timing equipment is in use or a finish line is established. Leave enough space around and downhill of the net fencing and finish area to allow regular non-racing access from Bump Buster and/or the west side trails to the bottom of Chair B. 10. The slalom pole storage lockers, located at the top of the racecourse, have been assigned to each team. Security of your team equipment is your responsibility, not Tyrol Basin s. 11. Ski racing poles and bamboo must be removed from runs and stored in the lockers or taken home after each race or training session. Do not leave them in the race buildings. A bamboo storage barrel is located at the top of the hill across from the upper race building for Tyrol Basin slope marking bamboo and poles. If there is not time enough to return the bamboo to the top of the hill it may be left inside the chairlift base terminal fence. 12. Slope closing or marking signage, ropes, marking tape, and net fencing should be stored in the race buildings. 13. Race buildings are to be kept clean, heat turned off at end of day, and doors closed and locked. 14. Broken gates and trash must be disposed of in the Dumpster on the North side of the Chalet. 15. Use the intercom phones for official race business only. Outside calls cannot be made from these phones. Key phone numbers are: a. First Aid Room 38 b. Ski Patrol Room 45 c. Josh Faber 10 d. Kim Washburn Radios, if used, must be on a separate frequency from Ski Patrol and area management and not interfere with area operations.
5 17. HIGH SPEED skiing on Nisse Sti will not be tolerated and may result in loss of ticket for the day. 18. Help us discourage ski and snowboard thieves. Racers with high tech gear are prime targets. Coaches please stress lock-up equipment. Tyrol Basin provides coin operated ski racks and lockers where you can insure your items are secure. There are places available where equipment may be secured with personal locking devices. Only you can make the decision to use them. Please do so. 19. Each team Head Coach is responsible for the setting of training and/or racing gates. Except for designating which slope(s) upon which courses may be set, Tyrol Basin does not and will not inspect courses for technical merit or hazard and/or safety conditions, this is the sole responsibility of the coaches and team members. 20. It is the sole responsibility of each team coach to designate any course setters and determine the criteria upon which this decision is based. Each team shall submit a list of authorized course setters and their qualifications prior to the first race training session and provide updates as appropriate for management approval. 21. Each and every person, including racers, coaches, parents, and others participating in racing for race training at Tyrol Basin must read, agree to, and sign a Release of Liability for Tyrol Basin prior to participating. Minors (under 18) must have a parental or guardian signature. It is the responsibility of each team to obtain completed forms from each racer and submit them to Tyrol Basin Management. It is imperative that all coaches, team members and racers be fully aware of, and promotes responsible and safe skiing/snowboarding practices while present at Tyrol Basin. This means that each individual must know, and practice, the dictates of Your Responsibility Code at all time. Tyrol Basin has a film of Your Responsibility Code that you may use to show the racers. Tyrol Basin wishes all coaches and racers to know that we consider these efforts to be mandatory. Team members not abiding by Your Responsibility Code while at Tyrol Basin will face expulsion from the premises as well as revocation of season tickets. Absolutely no refunds will be made. We do not wish to make such decisions, however, if forced to by a specific person s behavior, we will do so without hesitation. All racers must wear a valid lift ticket or season pass at all times. Tickets are to be worn on the jacket or pants and in plain view of the lift operator and/or ticket checker. On race days, a racer may choose to wear the daily ticket on boots, helmets, or they may be worn on the bib only if bib is to be worn for the entire day. Do not wear more than one ticket at a time or place one ticket on top of another. If ticket is not worn in the proper manner, facility use privileges may be lost. Season passes must be displayed according to season pass holder instructions. It should be understood that whenever the terms ski or skiing are used, they are being used generically to refer to all participants including but not limited to alpine skiers, snowboarders, and telemark skiers. As in the past, we ask the aid and cooperation of every racer in promoting racing through their behavior while at Tyrol Basin. Courtesy to other guests, responsible skiing and snowboarding and adherence to the Your Responsibility Code will help you and those of us at Tyrol Basin continue to make ski racing compatible with our regular ticket buying clientele. 7 Southern Conference WHSARA, Inc. AGREEMENT OF RELEASE, WAIVER AND DISCHARGE EACH OF THE UNDERSIGNED UNDERSTANDS AND EXPRESSLY ACKNOWLEGES that the Southern Conference WHSARA, Inc. (hereinafter the Southern Conference ) is a group of volunteer parents, coaches and skiers organized to give high school age skiers and snowboarders the opportunity to participate in regularly scheduled races. Further, the undersigned understand and acknowledge that downhill skiing/snowboarding and downhill ski/snowboard racing are inherently dangerous sports that present the very real risk of serious injury, death or property damage. It is with full knowledge and understanding of these risks and in consideration of the undersigned team member s participation in events organized by the Southern Conference that the undersigned enter into this agreement releasing, waiving and discharging the Southern Conference from liability associated with such events. THEREFORE, each of the undersigned for himself or herself, his or her personal representatives, spouse, heirs, assigns, offspring, relatives and next of kin does hereby release, waive, discharge and covenant not to sue or otherwise pursue claims against the Southern Conference, its officials, organizers, employees and representatives (hereinafter releases ) from any and all liability to the undersigned, his or her personal representatives, spouse, assigns, heirs, offspring and next of kin for any and all damages, and any claim or demands therefor on account of death or injury to the person or injury to the property of the undersigned, whether caused by the negligence of the releases or otherwise while the undersigned is preparing to participate in, participating in, in attendance at, or travelling to or from an event, including practice, as a member of or otherwise in association with the Southern Conference or a Southern Conference team. EACH OF THE UNDERSIGNED HAS READ AND VOLUNTARILY SIGNS THIS AGREEMENT and agrees that no representations or statements apart from this written Agreement have been relied upon as an inducement to enter into this Agreement. This Agreement is intended to cover multiple events attended by members of the Southern Conference and Southern Conference teams and shall continue in full force and effect throughout the 2017 season and for each event during said season attended by the undersigned team member as a member of the Southern Conference or a Southern Conference ski team. The undersigned each agree that the foregoing release, waiver, and discharge is intended to be as broad and inclusive as permitted by law and that if any portion thereof is held invalid the balance shall continue in full force and effect. 8 PARENT & ATHLETE AGREEMENT As a Parent and as an Athlete it is important to recognize the signs, symptoms, and behaviors of concussions. By signing this form you are stating that you understand the importance of recognizing and responding to the signs, symptoms, and behaviors of a concussion or head injury. Parent Agreement: I have read the Parent Concussion and Head Injury Information and understand what a concussion is and how it may be caused. I also understand the common signs, symptoms, and behaviors. I agree that my child must be removed from practice/play if a concussion is suspected. I understand that it is my responsibility to seek medical treatment if a suspected concussion is reported to me. I understand that my child cannot return to practice/play until providing written clearance from an appropriate health care provider to his/her coach.
