5 Dealer Release and Waiver BRP Dealer # : Dealership Name : In consideration of being considered to participate in this Can-Am X-Team Racer Support Program ( Program ), Dealer, on behalf of itself and its affiliates, owners, directors, officers, employees, agents, representatives, attorneys, independent contractors, predecessors, successors and assigns (collectively with Dealer, "Dealer Parties"), hereby irrevocably and unconditionally releases, discharges, and covenants not to sue Bombardier Recreational Products Inc. ("BRP"), BRP's parent and affiliated companies, and each of their respective owners, shareholders, directors, officers, employees, independent contractors, attorneys, agents, representatives, predecessors, successors and assigns (collectively with BRP, "Released Parties") from and against any and all claims, actions, causes of action, damages, demands, liens, rights, controversies, losses, costs and expenses (including, but not limited to, attorneys' fees and costs), or charges of any nature whatsoever, known or unknown, suspected or unsuspected, fixed or contingent, developed or undeveloped, contingent, past, present or future, including without limitation wrongful death, any and all personal injuries, and injuries to property, real or personal, whether or not liability is alleged to arise from product defect, negligence, failure to warn, failure to instruct, failure to construct properly, failure to keep safe, failure to maintain or other tortious conduct ("Claims"), which Claims arise from or relate to: (a) the participation of the Dealer Parties in the Program or any race or preparation for any race; and (b) any act or omission of the Released Parties relating to the Program. Dealer understands that ATV and side-by-side riding is inherently dangerous and hereby represents to BRP that the Dealer Parties and the Racers they sponsor, based on the information provided for in the Racer Resume document, have had sufficient experience riding ATVs or sideby-side vehicles to understand all the risks involved in ATV or side-by-side vehicle racing. Dealer expressly and voluntarily assumes all risk of personal injury or death sustained by the Dealer Parties while participating in racing events and the Program, whether or not caused by the negligence or other fault of Released Parties, or any of them, including but not limited to EQUIPMENT MALFUNCTION FROM WHATEVER CAUSE, INADEQUATE TRAINING OR SUPERVISION, DEFECTIVE DESIGN OR MANUFACTURE OF EQUIPMENT OR ATV OR SIDE-BY- SIDE VEHICLE RACE COURSE, FAILURE TO KEEP SAFE, FAILURE TO INVESTIGATE OR SUPERVISE OTHERS, OR FAILURE TO WARN OF POTENTIAL RISKS. Dealer further agrees, on behalf of itself and all Dealer Parties, to indemnify, defend and hold harmless all of the Released Parties from all claims and suits for personal injuries, including death, and damage to property caused directly or indirectly by any act or omission arising out of the participation in any racing events or the Program by any Dealer Parties, and from all judgments recovered and from all expenses incurred in defending said claims or suits. Dealer further agrees, on behalf of itself and all Dealer Parties, that all photographs, pictures, slides, likenesses, and/or movies taken or made of any Dealer Parties by or for BRP in connection with the Program, or any reproduction or replica of same, as well as the name of any Dealer Parties, may be used in any manner by BRP or by any person or entity authorized by BRP. Dealer understands that it is giving up substantial rights by signing this document. The person signing on behalf of Dealer hereby certifies that he or she is authorized to do so, and has done so after reading and fully understanding all terms and conditions of the Program, and Dealer hereby agrees to abide by such terms and conditions, as they may be changed from time to time by BRP in its sole discretion. 6 Racer Release and Waiver Racer Full Name : In consideration of being considered to participate in this Can-Am X-Team Racer Support Program ( Program ), I, the undersigned, for myself and for my successors, heirs and assigns, hereby release, waive liability, promise never to sue, and forever discharge, Bombardier Recreational Products Inc. ("BRP") and BRP's parent and affiliated companies, and each of their respective owners, shareholders, directors, officers, employees, independent contractors, BRP dealers, attorneys, agents, representatives, predecessors, successors and assigns (collectively, including BRP, Released Parties ) from all claims, including but not limited to claims for negligent acts or omissions, actions or judgments that I may have or claim to have against Released Parties, or any of them, for ALL PERSONAL INJURIES, INCLUDING DEATH, AND ALL INJURIES TO PROPERTY, real or personal, directly or indirectly caused by or arising out of my participation in any racing events or the Program. I understand that ATV or side-by-side vehicle riding is inherently dangerous. I understand that there are risks (including SERIOUS BODILY INJURY or DEATH) associated with participating in the Program, and I hereby assume, on behalf of the Child, myself and my spouse, all such risks, including those detailed above. I am releasing any and all claims that the Child, my spouse or I may have for emotional distress or loss of consortium in the event the Child suffers bodily injury or death.
