1 TERMS AND CONDITIONS FOR THE NIKE BATTLE FORCE EVENT NIKE Philipinnes Inc. ( Nike ) in media partnership with Creative Programs, Inc. ( CPI ) is sponsoring a competition-based event designed to support and promote the burgeoning dance and rap scene in Metro Manila during the period October 28, 2017 to December 2, 2017 (hereafter Event ). PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PARTICIPATING IN THE EVENT/ USING ANY EVENT PLATFORM. By accessing or using the website, mobile application or other service relating to the Event (collectively the "Platform") and / or participant in the Event, you ( Participant ) signify that you have read, understand and agree to be bound by the terms and conditions set out below. 1. Participants in the Event shall bear each of their own costs and expenses incurred and/or arising from their participation in the Event, including (without limitation) telecommunications, network, SMS and all such other charges and out-of- pocket expenses as may be incurred by each Participant during or in connection with the Event. NIKE and CPI shall not be liable in any manner to refund, buy or otherwise incur any expense to or on behalf of Participant. 2. Participant understands that participating in the Event is potentially hazardous, and that Participant should not enter and participate unless the Participant is medically able and properly trained. Participation in or attendance at the Event involves inherent risks and dangers of accidents, personal and bodily injury (including death) and property loss or damage. These may result from actions or inactions of the Participant, as well as the actions or inactions of others. Further, there may be other risks not known to Participant and not reasonably foreseeable at this time. By participating in the Event, Participant confirms having considered the nature and extent of the risks involved and voluntarily chooses to assume all such risks, both known and unknown, even those risks that result from the negligence of the Released Parties (defined below) or others and assume full responsibility for Participant s participation in the Event. Participant for themselves and their heirs and executors, hereby waive, release and forever discharge NIke, CPI, the event organizers, promoters and each of their agents, representatives, successors and assigns, and all other persons associated with the event, for all my liabilities, claims, actions, or damages that Participant may have against them arising out of or in any way connected with their participation in this event. Participant fully understands that this waiver includes any claims, whether caused by negligence, the action or inaction of any of the above parties, or otherwise. 3. Participant consents to the use by CPI and NIKE of the Participant s photograph, Instagram and other social media postings relating to the Event, Participant s name and likeness (in any form and without regard to distortions of character, form or color, or any other alteration) in photographs, videotapes, audiotapes, and other media, on promotional materials, internal and external communication materials without any further consent from Participant and without any additional consideration to Participant or to any third party. Participant hereby grants to NIKE, CPI their affliates, subsidiaries, successors, assigns, and licensees permission to film, photograph, video record, conduct live online broadcast or use my image, image, voice, avatar, name, biographical data, silhouette, body dimension, shape, posture, or any other aspect of the recording at the Event (collectively the Recording ) and the right, throughout the world, in perpetuity, to register for copyright, to use, and to assign and/or license others to use all or any portion of the results thereof (or a reproduction thereof), in all media and in any manner now known or hereafter developed, in connection with the Event or otherwise without any additional consideration. Participant agrees that he / she shall have no right of approval and no legal claim arising out of any use or editing of the Page 1 of 5

2 Recording or name. NIKE and CPI shall have no obligation to use any of the Participant rights granted here. Participant represents that it is not necessary for CPI or NIKE to obtain permission from or to pay any third party in connection with the rights granted in this paragraph. 4. The Participant shall indemnify and keep NIKE, CPI and their affiliates and subsidiaries and their respective officers, directors, shareholders, employees, agents, distributors, representatives, contractors, successors, assigns, and insurers, all of Nike s, advertisers, volunteers, and staff (collectively "the Indemnified Parties") fully indemnified against any and all losses, damages, claims and costs (including legal costs on a full indemnity basis) suffered and/or incurred by any of the Indemnified Parties as a result of the Participant's participation in the Event or their breach of any of these Terms and Conditions. 5. By participating in the Event, Participant agrees to the disclosure of their personal particulars to NIKE, CPI or to any third party, if requested, for the purpose of organizing, promoting and/or conducting the Event, and consent to receiving promotional, marketing and other publicity information from NIKE and CPI from time to time. 6. By participating in the Event, Participant allows NIKE and CPI and their employees and authorized representatives to contact them via phone, , and SMS to share information and details relating to the Event. 7. Participants are required to read, understand and abide by the Terms of Use of Event Platform s as set on at Nike s website and that of CPI s 8. NIKE and CPI reserve the right to cancel the Event and/or Terms and Conditions of the Event at its sole discretion and without any prior notice or liability. 9. All decisions made by CPI with respect to the Event shall be final and binding on Participant. 10. Participants are prohibited from using foul language. 11. Participants are restricted from mentioning other brands in a negative light. Nike s Terms Of Use And Privacy Policy By participating in this Event, you consent to the Terms of Use and Nike s Privacy Policy as set on the website Participants are requested to read and understand Terms of Use and Nike Digital Privacy Policy and as set out at Nike s website before taking any steps to participant in the Event. 1. How we collect information about you When you visit the Event registration system, we collect your IP address and standard web log information, such as your browser type and the pages you accessed on our website. 3 2. Contact information - your name, address, phone number, and other similar information. Before permitting you to use EVENT registration system, we may require you to provide additional information we can use to verify your identity or address; such as your date of birth, national ID number, Nationality, and other identifying information. When you are in EVENT registration system, we collect information about your transactions and your other activities using EVENT registration system and we may collect information about your computer or other access device for fraud prevention purposes. Finally, we may collect additional information from or about you in other ways such as from contacts with our customer support team, results when you respond to a survey, from interactions with members of EVENT and from other companies. 3. How we use cookies We do not use cookies throughout EVENT registration system. You may encounter cookies from third parties when using EVENT registration system on certain websites that we do not control (for example, if you view a webpage created by a third party or use an application developed by a third party, there may be a cookie placed by that web page or application). 4. How we protect and store personal information Throughout this policy, we use the term "personal information" to describe information that can be associated with a specific person and can be used to identify that person. We do not consider personal information to include information that has been anonymized so that it does not identify a specific user. We store and process your personal information on our computers in Philippines and at various customer and operations support centers around the world such as in Malaysia, the Philippines, and China, and we protect it by maintaining physical, electronic and procedural safeguards. We use computer safeguards such as firewalls and data encryption, we enforce physical access controls to our buildings and files, and we authorize access to personal information only for those employees who require it to fulfill their job responsibilities. 5. Companies that we plan to merge with or be acquired by. If your personal information could be used contrary to this policy, you will receive prior notice. I also, for myself and on behalf of my heirs, estate, insurers, successors and assigns, hereby fully and forever release and discharge the Indemnified Parties (defined above) from any and all claims or causes of action I may have for damages for personal or bodily injury, disability, death, loss or damage to person or property, whether arising from the negligence of any or all of the Indemnified Parties or otherwise, to the fullest extent permitted by law.
