Fellows, Jr. Manager of Revenue and Tariffs February 5, 2001 ADVICE 1517-E (U 338-E) PUBLIC UTILITIES COMMISSION OF THE STATE OF CALIFORNIA ENERGY DIVISION SUBJECT: Revision to Interruptible Program Tariffs and Establishment of the Interruptible Programs Excess Energy Charges Memorandum Account In compliance with Decision No (D ), Southern California Edison Company (SCE) hereby submits for filing the following changes to its tariff schedules. The revised tariff sheets are listed on Attachment A and are attached hereto. PURPOSE This advice filing revises SCE s tariffs to temporarily suspend, effective January 26, 2001, the penalty provisions for interruptible service customers when the customer fails to curtail electricity use at the request of the ISO and upon notification from SCE, the tolling of hours and number of events against program totals, and other related program requirements. In addition, this advice filing establishes a new memorandum account to track all penalties, including those already paid, outstanding, and yet to be billed, for interruption events from October 1, 2000 through January 25, Furthermore, the tariffs are revised to reflect a deviation from existing tariffs to waive penalties for two public utility pipeline customers, Santa Fe Pipeline, Inc. (SFPP) and GATX Tank Storage Terminal (GATX). BACKGROUND On January 26, 2001, the Commission issued D which ordered immediate revisions to SCE s interruptible tariffs. 2 ADVICE 1517-E (U 338-E) - 2* - February 5, 2001 Suspension of the Excess Energy Charge tariff provision for interruption events beginning January 26, Suspension of counting toward the 25-occurrence limit for the number of Periods of Interruption called and the 150 hour limit per calendar year. Establishment of an Interruptible Programs Excess Energy Charges Memorandum Account to track Excess Energy Charges incurred by customers for interruption events from October 1, 2000 through January 25, Addition of the accounts for the pipeline customers specified in the Decision to SCE s List of Contracts and Deviations to reflect the waiver of Excess Energy Charge Penalties incurred from January 19, 2001 through January 25, The Decision states that the Commission expects all interruptible customers to voluntarily respond to notices of interruption provided by the utilities. For commercial and industrial interruptible customers, SCE will continue to follow the same notice of interruption procedures it has previously followed and each customer will decide whether and to what extent it will reduce load. However, for participants served under agricultural and pumping interruptible rate schedules, SCE will have to modify its current notification procedures in order to make load reduction voluntary for these customers as intended by the Decision. Currently, the load of customers served on agricultural and pumping interruptible schedules (Schedules AP-I and TOU-PA-SOP-I) is automatically reduced when SCE activates remote-controlled shut-off switches. To make this load reduction voluntary, SCE will not activate the remote shut-off switches. Instead, SCE will inform these customers that they are expected to voluntarily initiate load reductions when such reductions would otherwise be required. Pending a decision by the Commission on the disposition of Excess Energy Charges, effective January 26, 2001, SCE will not assess late payment charges on Excess Energy Charges that were billed for interruption events from October 1, 2000 to January 25, 2001, but have not yet been paid by the customer. By filing these tariff revisions, which are required by the Decision, SCE does not waive its right to (1) challenge the legality of the decision by application for rehearing or otherwise, (2) dispute the imposition of a memorandum account with effectiveness retroactive to October 1, 2000, (3) dispute changes to tariffs and deviations that are retroactively made effective by the Decision, or (4) collect the amounts tracked in the memorandum account.

3 ADVICE 1517-E (U 338-E) - 3* - February 5, 2001 Customer Notification Consistent with current tariff provisions, except as described above for interruptible program agricultural and pumping (Schedules AP-I and TOU-PA-SOP-I) customers, SCE will continue to provide a Notice of Interruption to customers in the normal manner. SCE will also notify each affected customer on an interruptible rate schedule of the suspension of the penalty provision and other changes to the interruptible tariff within 20 days of January 26, In addition, separate notice shall be given to SPFF, Inc., and GATX of the deviation authorized beginning January 19, No cost information is required for this advice filing. This advice filing will not increase any rate or charge, cause the withdrawal of service, or conflict with any other schedule or rule. EFFECTIVE DATE Pursuant to D , Conclusion of Law No. 3 and Ordering Paragraph 1, the changes proposed in this advice filing will be effective January 26, 2001, after appropriate review by the Energy Division for compliance with this order. Interruptible Programs Excess Energy Charges Memorandum Account (IPEECMA) The purpose of the Interruptible Programs Excess Energy Charges Memorandum Account (IPEECMA) is to track Excess Energy Charges incurred by customers for interruption events from October 1, 2000 through January 25, 2001, as ordered by Commission Decision , dated January 26, The Excess Energy Charges tracked will be for: Excess Energy Charges billed where payment has been received; Excess Energy Charges billed where payment has not been received; and, Excess Energy Charges not yet billed. Entries to the IPEECMA will be tracked in three Subaccounts: a. Excess Energy Charges Billed; Payment Received b. Excess Energy Charges Billed; Payment Not Received c. Excess Energy Charges Not Billed Interest shall accrue monthly to the subaccounts of the IPEECMA by applying the Interest Rate to the average of the beginning and ending balance. Disposition of the amounts recorded in the above subaccounts shall be determined in the Commission proceeding addressing the reassessment of the interruptible program pursuant to Decision H37

Excess Energy: The number of kwh consumed in each Time Period involved in a Period of Interruption which exceeds the product of the Firm Service Level kw multiplied by the total number of hours of Interruption within the Time Period, shall be considered Excess Energy. 8. Charges for Excess Energy: For each period of interruption during which the customer fails to interrupt and hence incurs Excess Energy, the applicable $/kwh penalty as shown below shall be added to the customer s billing as otherwise provided in this schedule:* Applicable Penalties Service Voltage Service Voltage Service Voltage in Excess of 50 kv 2 kv - 50 kv Below 2 kv $/kwh $/kwh $/kwh For Each Failure to Interrupt Ownership and Control of Facilities: Communication, metering, and interrupting facilities, as specified by the Company, will be installed, owned, and maintained in accordance with Company specifications at customer s expense, including such facilities not located on the customer s property. These facilities will be solely under operational control of the Company unless otherwise specified by the Company. Such communications and interrupting facilities may include, but will not be limited to, the following: a. Necessary facilities between the customer and the Company to provide Notice of Interruption. b. Equipment to permit remote monitoring of the customer s load. * Pursuant to California Public Utilities Commission (Commission) Decision , effective January 26, 2001 and until further notice from the Commission, applicable Charges for Excess Energy for interruption events beginning January 26, 2001 and going forward will not be assessed. 5H18

PUC Sheet No E Schedule I-6 Sheet 6 TIME-OF-USE GENERAL SERVICE - LARGE - INTERRUPTIBLE SPECIAL CONDITIONS 10. Contracts: A contract is required for service under this schedule. To be served under this schedule, eligible customers shall comply with all provisions of the contract within 90 days of contract execution. During the initial year of service the customer may terminate service under this schedule upon not less than 30 days written notice to the Company. Effective the date the Commission or its delegate declares to be the start date for Direct Access, after the initial year of service, customers shall have a one month window each year between November 1 and December 1, to provide written notice to the Company to terminate service or increase the Firm Service Level under this schedule.* However, for a 30-day period commencing the date the Commission or its delegate declares to be the start date for Direct Access, on a one time basis, interruptible customers shall be given the opportunity to cancel their interruptible service contracts or increase their Firm Service Level. A customer may not obtain interruptible service following termination of interruptible service under this schedule. Customers shall not be permitted to prematurely terminate service hereunder for reasons that changes in electrical demand requirements may otherwise preclude them from taking service under this schedule. Customers permitted by the Company to change to this schedule from another interruptible rate schedule shall, without further action by the Company, retain the termination requirements, if any, of the prior schedule and any contract associated therewith. 11. Number and Duration of Interruption: The number of Periods of Interruption will not exceed 25 times per calendar year. The duration of the Periods of Interruption will not exceed 6 hours each or 150 hours per calendar year.** 12. Spot Pricing Option: This option is available to customers who are presently served under this schedule whose Firm Service Level is 0 kw, and who have had an inverted load profile during 12 representative months, as determined by the Company, out of the last 24 months. This Special Condition will be closed to new customers at the end of the rate freeze or March 31, 2002, whichever occurs first. An inverted load profile is indicated by energy usage and recorded demand in the On-Peak period which is less than usage and demand in the Mid-Peak period or the Off-Peak period. To utilize this option, a customer must execute a Spot Pricing Amendment Agreement with the Company. * Until March 31, 2001, only those customers who began service on this Schedule on or after April 1, 1998 may elect to terminate their Contract or increase their Firm Service Level between November 1 and December 1. All other customers who began service on this Schedule prior to April 1, 1998 cannot elect to terminate their Contract or increase their Firm Service Level between November 1 and December 1. ** Pursuant to California Public Utilities Commission (Commission) Decision , effective January 26, 2001, and until further notice from the Commission, the tolling of hours and number of Periods of Interruption per calendar year is suspended. 6H15

PUC Sheet No E Schedule RTP-2-I Sheet 4 GENERAL SERVICE - LARGE REAL TIME PRICING - INTERRUPTIBLE SPECIAL CONDITIONS 12. Contracts: Two contracts are required for service under this schedule: the RTP-2-I Participation Agreement and the Contract for Interruptible Service. To be served under this schedule, eligible customers shall comply with all provisions of the Contract for Interruptible Service within 90 days of contract execution. The RTP-2-I Participation Agreement will automatically be renewed at the end of each 12-month period. The customer may terminate service under the Real Time Pricing portion of this schedule at the end of each 12-month period upon not less than 30 days prior written notice. A customer who terminates service under the Real Time Pricing portion of this schedule shall be transferred to applicable General Service and interruptible schedules and shall retain the interruptible termination requirements set forth in this schedule. The customer may terminate interruptible service at the end of the initial 12-month period upon not less than 30 days prior written notice. Effective the date the Commission or its delegate declares to be the start date for Direct Access, after the initial year of service, customers shall have a one month window each year between November 1 and December 1, to provide written notice to the Company to terminate service or increase the Firm Service Level under this schedule.* However, for a 30-day period commencing the date the Commission or its delegate declares to be the start date for Direct Access, on a one time basis, interruptible customers shall be given the opportunity to cancel their interruptible service contracts or increase their Firm Service Level. Where customer-owned electrical generating facilities are used to meet a part or all of the customer's electrical requirements, service shall be provided concurrently under the terms and conditions of Schedule S and this Schedule. Parallel operation of such generating facilities with the Company's electrical system is permitted. A Generation Agreement is required for such operation. * Until March 31, 2001, only those customers who began service on this Schedule on or after April 1, 1998 may elect to terminate their Contract or increase their Firm Service Level between November 1 and December 1. All other customers who began service on this Schedule prior to April 1, 1998 cannot elect to terminate their Contract or increase their Firm Service Level between November 1 and December 1. ** Pursuant to California Public Utilities Commission (Commission) Decision , effective January 26, 2001, and until further notice from the Commission, the tolling of hours and number of Periods of Interruption per calendar year is suspended. 4H16

PUC Sheet No E Schedule AP - I Sheet 2 AGRICULTURAL AND PUMPING - INTERRUPTIBLE SPECIAL CONDITIONS 3. Period of Interruption: A Period of Interruption is a time interval which commences upon interruption by SCE. Under this schedule all interruptions are controlled by SCE. 4. Number and Duration of Interruption: The number of Periods of Interruption will not exceed 25 times per calendar year. The duration of the Periods of Interruption will not exceed 6 hours each or 150 hours per calendar year.* 5. Ownership and Control of Facilities: Communication, metering, and interrupting facilities, as specified by SCE, will be installed, owned, and maintained in accordance with Company specifications at customer's expense, including such facilities not located on the customer's property. These facilities will be solely under operational control of SCE unless otherwise specified by SCE. Such communications and interrupting facilities may include, but will not be limited to, the following: a. Necessary facilities between the customer and SCE to provide Notice of Interruption. b. Equipment to permit remote monitoring of the customer's load. 6. Excess Energy: The number of kwh consumed after the first thirty minutes during a Period of Interruption shall be considered Excess Energy. 7. Customers permitted by the Company to change to this schedule from another interruptible rate schedule shall, without further action by the Company, retain the termination requirements, if any, of the prior schedule and any contract associated therewith. 11. Number and Duration of Interruption: The number of Periods of Interruption will not exceed 25 times per calendar year. The duration of the Periods of Interruption will not exceed 6 hours each or 150 hours per calendar year.** 12. Separate Service Connections or Meters: Under this schedule, the Company may, at its option, provide an additional service connection and/or meter, separate from any other service connection and/or meter provided under this or any other applicable rate schedule. Customers so served shall not be permitted to have an electrical interconnection beyond the Company's point of delivery between the separately metered loads except upon written approval of the Company. When, at the request of an applicant or customer, a separate service connection is installed under this schedule, the second service connection shall be installed at the applicant or customer's expense in accordance with Rule 2, Section H. A change from this rate schedule to any non-super-off-peak rate schedule will be permitted only if the separate meter and/or service connection are removed. Any such removal shall be at the customer's expense. In addition, any rearrangement of facilities required to provide the additional meter and/or service connection shall be at the expense of the requesting applicant or customer. Where an additional meter is provided under this Special Condition and there is no increase in the size of the Company's serving facilities, there will be no Customer Charge for the General Service account served under the schedule having the lowest customer charge amount. * Until March 31, 2001, only those customers who began service on this Schedule on or after April 1, 1998 may elect to terminate their Contract or increase their Firm Service Level between November 1 and December 1. The ISO is expected to direct the Company to curtail specific amounts of load (up to the full capability of the interruptible program) sufficient to maintain operating reserves above the five percent level through the next forecast hour. Advance Notice of Interruption will not be provided. 3. Period of Interruption: A Period of Interruption is a time interval which commences upon interruption by the Company. Under this schedule all interruptions are controlled by the Company. 4. Number and Duration of Interruption: The number of Periods of Interruption will not exceed 25 times per calendar year. Effective the date the Commission or its delegate declares to be the start date for Direct Access, after the initial year of service, customers shall have a one month window each year between November 1 and December 1, to provide written notice to the Company to terminate service under this schedule.** However, for a 30-day period commencing the date the Commission or its delegate declares to be the start date for Direct Access, on a one time basis, interruptible customers shall be given the opportunity to cancel their interruptible service contracts. A customer may not obtain interruptible service following termination of interruptible service under this schedule. Customers shall not be permitted to prematurely terminate service hereunder for reasons that changes in electrical demand requirements may otherwise preclude them from taking service under this schedule.
